ADVANTAGES:

India is one of the ancient civilizations in the world and boasts numerous ethnic groups professing different cultures and religions. Being a diverse civilization, India is a land of countless languages with over 1650 regional accents and dialects. Despite different cultures, religions, and languages, the people of India live together with love and brotherhood. Great unity in diversity makes India an example of a cultural society. Each region of the country, from Jammu and Kashmir to Kanyakumari, presents different customs and traditions. Since ancient times, the people of India live together and respect all religions and cultures. Unity in diversity is a characteristic feature of this beautiful nation and connects people in the bond of humanity and peace.


India’s moral and spiritual values have always been the same, despite many political and social changes. They strengthened India’s even more fundamental unity. There is a long story all the time; Hindus were profoundly religious and spiritual. They have always attributed the highest place and value to the spiritual development and evolution of the soul. For them, the ultimate and only goal of life is liberation, nirvana, or moksha. Great saints, rishis, preachers, and philosophers have always been integral to the complex and common Indian heritage and culture as Vedas, Gita, Ramayana, Kuran, Guru Grantha Sahib, Bible, etc.

As India is a united and secular country and for the freedom of our country from the Britishers in the past, many freedom fighters struggle for our freedom, and also the freedom fighters do not see that he is from other religion they all together come with brotherhood and fought with the Britishers as one Indian nation. And it is a great example for our united India from the past as it has spread a strong message to the people. There are many different cultures in India and also the culture has several different types of radiation in everything such as in Hindus and Muslims the people pray and worship are different kinds and also the of clothing and celebrating their festivals are also different and also the festivals of these people are also different, but all people come together and celebrate all the festival with each other as a united country and the united people of India.

When a country is united like India, it helps the people live in the country and work and organized and do all the things equally and with altogether as it improves the performance of the people and lifestyle of the people also gets improved. It makes communication with the people and all the people able to help the other people in any bad situation as it keeps away from the social problems and helps manage any conflicts easily. When a country is united there are also many disadvantages that a country faces such as it can give rise to corruption and illiteracy in many of the areas as the country is very populated. But by all these problems people solving it and many organizations are held for the people to make their problems get solved and when all the people come together and fight against this problem of the country and then it is united and India is one of the countries which is united and unity in diversity is the real prosperity of India and the way to progress it in the future and the present.

We have created unity out of diversity for our merit. Outside, it seems that our country is a heterogeneous mix of diverse elements. However, it is a homogeneous whole as a chemical compound. The most striking example of unity in diversity is the composition of the parliament council. Different political parties from different parts of the country merged (forgetting their political ideologies) to form a government.

FINANCE COMMISSION

 

Finance Commission is constituted to define financial relations between the center and the states. Under the provision of Article 280 of the Constitution, the President appoints a Finance Commission for the specific purpose of devolution of non-plan revenue resources. It was formed in 1951. Shri Ajay Narayan Jha recently joined the Fifteenth Finance Commission as its member. The 15th Finance Commission has released a report titled ‘Finance Commission in COVID Times’ on 1st February 2021.

Article 280 of the Indian Constitution

  • After two years of the commencement of the Indian Constitution and thereafter every 5 years, President has to constitute a Finance Commission of India.
  • It shall be the duty of the Commission to make recommendations to the President concerning the:
    • The distribution between the Union and the States of the net proceeds of taxes which are to be, or maybe, divided between them and the allocation between the States of the respective shares of such proceeds;
    • The principles which should govern the grants in aid of the revenues of the States out of the Consolidated Fund of India;
    • Any other matter referred to the Commission by the President in the interests of sound finance
    • The Commission shall determine their procedure and shall have such powers in the performance of their functions as Parliament may by law confer on them

Article 281 of the Indian Constitution

  • It is related to the recommendations of the Finance Commission:
    • The President has to lay the recommendation made by the Finance Commission and its explanatory memorandum before each house of Parliament



Functions of Finance Commission

The Finance Commission makes recommendations to the president of India on the following issues:

  • The net tax proceeds distribution will be divided between the Centre and the states, and the allocation between states.
  • The principles governing the grants-in-aid to the states by the Centre out of the consolidated fund of India.
  • The steps required to extend the consolidated fund of a state to boost the resources of the panchayats and the municipalities of the state are based on the recommendations made by the state Finance Commission.
  • Any other matter referred to it by the president in the interests of sound finance.
  • The Commission decides the basis for sharing the divisible taxes by the center and the states and the principles that govern the grants-in-aid to the states every five years.
  • Any matter in the interest of sound finance may be referred to the Commission by the President.
  • The Commission’s recommendations along with an explanatory memorandum concerning the actions done by the government on them are laid before the Houses of the Parliament.
  • The FC evaluates the rise in the Consolidated Fund of a state to affix the state Panchayats and Municipalities resources.
  • The FC has sufficient powers to exercise its functions within its activity domain.
  • As per the Code of Civil Procedure 1908, the FC has all the powers of a Civil Court. It can call witnesses, ask for the production of a public document or record from any office or court.


Finance Commission Chairman and Members

  • Chairman: Heads the Commission and presides over the activities. He should have had public affairs experience.
  • Four Members.
  • The Parliament determines legally the qualifications of the members of the Commission and their selection methods.

Qualifications of Finance Commission Chairman and Members

  • The 4 members should be or have been qualified as High Court judges, or be knowledgeable in finance or experienced in financial matters and are in administration, or possess knowledge in economics.
  • All the appointments are made by the President of the country.
  • Grounds of disqualification of members:
  • found to be of unsound mind, involved in a vile act, if there is a conflict of interest
  • The tenure of the office of the Member of the Finance Commission is specified by the President of India and in some cases, the members are also re-appointed.
  • The members shall give part-time or service to the Commission as scheduled by the President.
  • The salary of the members is as per the provisions laid down by the Constitution.

My absolute personal favorite player whom I completely idolize is Mahendra Singh Dhoni, who has also earned names like Mahi, Captain Cool, and MSD. Dhoni is an international Indian cricketer who plays as a middle-order batsman and a wicket-keeper. He is also known to be a finisher in many matches. He is the only cricketer under whose captainship, India has won a trophy in every ICC format. In 2011, Dhoni was also featured in the TIME’s List of 100 Most Influential People in The World.

At the young age of 26, MS Dhoni led India to a win in the inaugural ICC T20 World Cup 2007.

M.S.Dhoni became the captain of the Indian Team for the inaugural ICC World Twenty20 held in South Africa in September 2007 and served as captain till 2016. In test matches, Dhoni captained Indian Team from 2008 to 2014.

"People who live in glass houses should not throw stones.”

The proverb literally means that those people who are living in houses made of glasses should not throw stones at others. This is because when you throw from glasshouses, you are nowhere on the safer side. When the other person starts throwing the stone at you, your house and everything you own get destroyed instantly. Your action will end up destroying you ultimately. This has a symbolic meaning towards our dealing with other persons. When you are at fault, you should not spot the faults of others. If you do so, you will end up in trouble. Those who “throw stones” at others to hurt them, can be thrown back to hurt themselves. When you say bad about others you are going to experience the same. That too, when you live in a “glass house” it will be easier for them to hurt you with your faults by throwing the same stones at you.

All men are liable to commit mistakes and fall a victim to follies, this makes man’s position weak and vulnerable. Therefore, one must be very cautious and careful in casting aspersions on others or finding fault with others. The other man so criticized can also find faults with you. So if you are living in a glasshouse, which means if you have faults with you, your position is as weak as one living in a glass house and if stones are thrown at you your glasshouse would also get broken and you would stand exposed.

Therefore, one needs to be very careful before casting blames on others, or finding faults with them if you yourself suffer from faults and frailties. It is not fair for the pot to call the kettle black as both have been on the fire and both have black spots over them. Those who are themselves corrupt should take care not to call others corrupt otherwise the other would bounce back. It is only when one is fully convinced of his own honesty and truthfulness that one should dare to accuse others otherwise it is best to keep quiet.

CAPITAL PUNISHMENT FOR CRIME AGAINST WOMEN


If the supreme court turns down the appeal, then the condemned person can submit a ' mercy petition' to the president of India and the Governor of the state. The basic intention behind any punishment, in general, is that a criminal deserves a punishment to set an example for other would-be criminals and to maintain the decorum of civilized human society. Henry Ford puts that ' capital punishment is as fundamentally wrong as a cure for crime as charity is wrong as a cure for poverty When the death sentence is awarded for rape, even detailed stories leave out any mention of the debate, for example,  When a political leader makes headlining emotive statements such as “rapists don’t deserve to live”, there are few attempts to balance coverage with statistics or even a summary of evidence-based counter-arguments.

When the matter enters into the realm of emotions of those directly affected, analysis is again put on hold. For example, when the family members of victims — such as the mother of Nirbhaya and the father of the Kathua victim — express views in favor of the death penalty as an appropriate form of retributive justice, media reports rarely provide the context in the form of the larger discourse on capital punishment.

The rape and murder of the young woman in Delhi in 2012 horrific crime and our deepest sympathy go out to the victim's family. Those responsible must be punished, but the death penalty is never the answer." Mukesh (26), Akshay Thakur (28), Pawan Gupta (19), and Vinay Sharma (20) were convicted by the court on September 10 for the brutal gangrape of a 23-year-old paramedic student on the night of December 16, 2012 h eventually led to her death. The justice was given in 2020. The justice is delayed but not denied ……..

The alleged torture, if any, in the prison cannot be a ground for judicial review of the executive order passed under Article 72 of the Constitution of India rejecting the mercy petition.” In November 2019, the gang rape and murder of a 26-year-old veterinary doctor in  Shamshabad, near Hyderabad, sparked outrage across India.[1] Her body was found in  Shadnagar on 28 November 2019, the day after she was murdered. Four suspects were arrested and, according to the Cyberabad Metropolitan Police, confessed to having raped and killed the doctor. All four accused were killed in an "encounter", a term used in India for killings by police, at around 3:30, am IST on 6 December 2019, under a bridge on Bangalore Hyderabad national highway, prompting accusations of extrajudicial execution. Here also the punishment is the death penalty.

I have concluded that the death penalty is morally right to a considerable extent. When a criminal commits a capital crime, they should suffer a punishment which equals the crime and it is thought that the worst punishment possible is the death penalty since it does not only remove a criminal's physical freedom by imprisoning them, it removes their psychological freedom by withdrawing their choice to live. Currently, the death penalty is administered as a painless injection which is the most humane way possible in comparison to earlier methods such as beheading or the electric chair.
