The Legacy of Saurav Ganguly.

Sourav Ganguly, the captain credited for putting fire within the belly of Indian cricket, celebrates his 48th birthday today.
‘Dada who is known for his legacy, ‘God of the Off-Side’, ‘King of Comebacks’ — Ganguly has been christened with multiple nicknames by cricket fans, experts and team-mates alike through his playing career.

Ganguly took over India’s captaincy after the match-fixing fiasco in 2000 and proved to be a pacesetter who believed in youth and putting them within the line of fireside to get the best out of them. Yuvraj Singh, Zaheer Khan, Harbhajan Singh, Virender Sehwag, Ashish Nehra, Mohammad Kaif et al. are all such examples from that era.
His call to ask Sehwag to open the batting in Tests changed Sehwag’s career and had a fantastic impact on Indian cricket. Ganguly was also the one who asked Rahul Dravid to wear the wicket-keepers’ gloves, at a time when India were struggling to seek out a permanent keeper.

‘Dada’ remains India’s second highest run-scorer in ODIs, with a tally of 11,363 runs at a mean of 41.02, which incorporates 22 hundreds and 72 half-centuries.
Ganguly

After retiring from the game in 2008, Ganguly chose to give back to the game that made him one of the icons of world cricket.
Having served because the president of Cricket Association of Bengal, Ganguly was elected because the current president of the Board of Control for Cricket in India.
On the other hand apart from featuring in 311 ODIs, Ganguly played 113 Tests, scoring 7212 runs with 16 centuries and 35 fifties. He never played T20 international cricket.

THE INAPT VERDICT IN ENRICA LEXIE’S CASE

In Enrica Lexie’s case, India’s long-await hasn’t caused any satisfactory result. Italy has command over it since the very beginning and eventually succeeded in its objective. on February 15, 2012, two fishermen sailing on fishing boat St. Antony shot off by two Italian marines, Massimiliano Latorre and Salvotore Girone in India’s contiguous zone. Which is positioned 20.5 nautical miles off the Kerala coast. This incident caused outrage and conflict of opinions over legal jurisdiction and immunity between the governments of India and Italy.

Recently, Permanent Court of Arbitration acknowledged the functional immunity of the two marines accepting the plea of Italy that they were working on a mission on behalf of the Italian government and gave Italy the jurisdiction over the matter, regardless of the fact that, the incident happened in India’s contiguous zone and the victims were the Indians. Due to the non-existence of any unilateral and bilateral and treaty between India and Italy, the Italian marines shouldn’t have gotten away in the name of immunity. This decision has set the menacing precedent for all the countries will now be enacting specific laws to give immunity to the military and paramilitary personnel. This will be troublesome for contiguous States. Albeit, the International  tribunal for the law of the Sea,  ruled that the marines are entitled to compensate India for the loss of life, physical harm, material damage to property, and moral harm, India still seeks for more than just monetary restitution for the unjustified killing of its citizens on mere doubt that the boat was a pirate skiff. Now it is to be seen how Italian court will act against the marines under the criminal law. India as a responsible state accepted the decision made by PCA by the virtue of Article 51 of Indian constitution which mandates it to uphold and respect the International law. Now that India has no jurisdiction over the matter anymore it must not show any leniency in securing the justice for Pink and Valentine if Italian court go to the extreme to support the killers.

Rising cases of rape in India

Rape is the fourth most common crime against women in India.According to the National Crime Records Bureau (NCRB) 2018 annual report, 33,356 rape cases were reported across India in 2018. Out of these, 31,320 were committed by someone known to the victim (93.9% of the cases).

India has been characterised as one of the “countries with the lowest per capita rates of rape”. Many rapes go unreported in various countries including India. In India, consensual sex given on the false promise of marriage constitutes rape. The willingness to report the rape has increased in recent years, after several incidents of rape received widespread media attention and triggered public protest. This led the Government of India to reform its penal code for crimes of rape and sexual assault.

Definition in Indian Penal Code

After 3 February 2013, the definition was revised through the Criminal Law (Amendment) Act 2013, which also raised the legal age of minor to eighteen.

Section-375. A man is said to commit “rape” if he:–– (a) penetrates his penis, to any extent, into the vagina, mouth, urethra or anus of a woman or makes her to do so with him or any other person; or (b) inserts, to any extent, any object or a part of the body, not being the penis, into the vagina, the urethra or anus of a woman or makes her to do so with him or any other person; or (c) manipulates any part of the body of a woman so as to cause penetration into the vagina, urethra, anus or any part of body of such woman or makes her to do so with him or any other person; or (d) applies his mouth to the vagina, anus, urethra of a woman or makes her to do so with him or any other person, under the circumstances falling under any of the following seven descriptions:

Firstly. –– Against her will.

Secondly. –– Without her consent.

Thirdly. –– With her consent, when her consent has been obtained by putting her or any person in whom she is interested, in fear of death or of hurt.

Fourthly. –– With her consent, when the man knows that he is not her husband and that her consent is given because she believes that he is another man to whom she is or believes herself to be lawfully married.

Fifthly. –– With her consent when, at the time of giving such consent, by reason of unsoundness of mind or intoxication or the administration by him personally or through another of any stupefying or unwholesome Substance, she is unable to understand the nature and consequences of that to which she gives consent.

Sixthly. –– With or without her consent, when she is under eighteen years of age.

Seventhly. –– When she is unable to communicate consent.

Even after the 2013 reform, marital rape when the wife and husband live together continued not to be a crime in India. Article 376B of the 2013 law made forced sexual intercourse by a man with his wife – if she is living separately – a crime, whether under a decree of separation or otherwise, punishable with at least a 2-year prison term.Forced sex by a man on his wife may also be considered a prosecutable domestic violence under other sections of Indian Penal code, such as Section 498(A) as well as the Protection of Women from Domestic Violence Act 2005.The crime of sexual assault on a child, that is anyone below the age of eighteen, is further outlined and mandatory punishments described in The Protection of Children from Sexual Offences Act 2012.(POCSO)

All sexual acts between the members of the same sex, consensual or forced, was previously a crime under Section 377 of Indian penal code, after the 2013 Criminal Law reform, with punishment the same as that of rape but it was later overturned in a landmark judgement of the Supreme Court on 6 September 2018 which stated all consensual sexual acts between adults who have met the age of consent are not violative of Section 377, hence decriminalizing gay sex in India. On 6 September 2018, the Court ruled unanimously in Navtej Singh Johar v. Union of India that Section 377 was unconstitutional “in so far as it criminalises consensual sexual conduct between adults of the same sex”.

A rape in India in every 15 minutes

In India, a rape is reported every 15 minutes, according to recently released official government crime data. The National Crime Records Bureau (NCRB) data from 2018 has stark revelations about crime in the country.

The NCRB data is usually released after two years, annually. Under the Narendra Modi government the data was inordinately delayed and some aspects are still missing. However, the data on violence against women throws up shocking figures for 2018.

Despite various federal government campaigns such as Beti Bachao Beti Padhao – Educate the daughter, Save the daughter – the crime rate per 100,000 women increased to 58.8% in 2018 in comparison with 57.9% in 2017.

A recent verdict in a Delhi gang-rape case handed down after seven years leaves much to be desired.

In 2012, the case of young Delhi-based woman Jyoti Singh, christened Nirbhaya (Fearless) by the media, shook the nation. She was abducted by a group of men and repeatedly raped on a moving bus. They also mutilated her body before throwing her from the bus.

As the details of the ferocity of the attack emerged, the country erupted into protests. This led to a number of changes in India’s rape laws in the hope that speedier trials and harsher punishments would lead to fewer assaults on women.

But her case took seven years to go through India’s judicial system.

In 2013, the criminal law amendment act was passed which criminalized sexual offenses like acid attacks, voyeurism and stalking, and also provided 20-year sentences for rape and the death penalty in extreme rape cases.

A committee was set up under former Chief Justice of India J S Verma. His committee’s report pointed out systemic failures on the part of the government and the Delhi police.

Conclusion

As of 2018, there were 133,000 pending rape cases in the courts. In May, a panel of judges dismissed allegations of sexual harassment against the erstwhile chief justice of India made by a former court employee in a ruling that infuriated women and activists. The chief justice denied the claims. The fact that even a high-profile case like Nirbhaya’s took seven long years to reach a conclusion underscores how slowly the wheels of justice move in the country.

Sexual assault occurs with frightening regularity in this country, adds the activist. We need to evolve punishments that act as true deterrents to the very large number of men who commit these crimes.

According to Flavia Agnes, a women’s rights lawyer and co-founder of Majlis, a feminist organization, India needs a higher budgetary allocation to build the infrastructure and facilities for rape cases. “Why do these cases have to wait long for justice? We need budgetary allocation [and] political will as well as sensitivity down the chain.”

Indian law provides for rape cases to be completed within a year through fast-track courts, there has been a sharp increase in pendency of such cases. According to the data taken from different high courts, and subsequently released by the Union law ministry, the pendency of such cases has increased by more than 46% across the country since March 2018.

Delhi has topped the list and has registered a whopping 353% increase in pending rape cases. However, in absolute terms, the number of pending cases in Uttar Pradesh is the highest – from 36,000 to 67,000 between March 2018 and December 2019. Maharashtra, Bihar, West Bengal, Madhya Pradesh and Rajasthan have also registered very high number of pending rape cases.

Kashmiri youth joining Rebel Ranks

It is heartbreaking how some of the Kashmiri youth are getting distracted into false and heinous crimes, where they are forced to be a part of terrorist groups and made to pick up guns and kill people. How sad it would be for a mother who loses her child, who joins a terrorist group and works against the country. Since Kashmir is facing many hardships beginning from Article 370 which includes communication blackout, internet services, people have to jail themselves at home and wait for the orders of reopening. This was one part of the story where Kashmir has become the highly militarised zone because of constant protest and fights, where Article 370 has separated the roots of Kashmir, where some of the young boys are forcefully made to join terrorist groups and fight for the evil things.

One such story is of Khurshad Ahmad a 23 year old young boy who went to a nearby valley with his herd and never came back. His family was worried for him and searched everywhere but couldn’t find a single clue of him. After few months the family was informed that Khurshad was shot dead in a gun fight in Sugg village. This news left his family, specially his mother helpless and heartbroken, where they couldn’t even fight for their child, where they couldn’t even ask the terrorists that why they did this to their son and why a 23 yr old lad was made to hold a gun instead of holding a book and working hard to take the responsibilities of his family.

There are many more stories which you and me don’t know because fortunately we are sitting safely at homes and taking care of ourselves, if we think about the people in Kashmir, we can’t even fathom the problems which they are suffering from, poverty, climatic changes, war, protest and now their children are joining rebel groups. This is not a choice for them, they are forced to do so, they are brain washed in a way that they just can’t ignore the facts to join the terrorist group and become one of them but what is left behind is their family, the mothers, who patiently wait for the child to return but little did she know that her child would never return, his mind and soul has been captured by the evils and they will never leave him until they eat him up.

My dear friends, we don’t know where our destiny will take us, but we should always think about others, pray for the people of Kashmir, pray that they get peace and they can also live normal lives like us.

Moods

Moods say experts are emotions that tend to become fixed, influencing one’s outlook for hours days or even weeks. That’s great if your mood is a pleasant one, but a problem if you are sad, anxious, angry or simply legthargic.

There is a reported basic link between food and mood. Eating protein tends to sustain alertness and mental energy. The best proteins are shellfish, chicken, etc.

A strong connection has been found between high caffeine intake, and increased depression, irritability and anxiety. People are often depressed when their thoughts are negative and distorted. Think positive thoughts, you are actually more likely to feel happy. It is important to lift oneself out of one’s own self defeating moods and to take an interest in someone else.

YOUTH

Youth is the “age of ease” being mentally and physically in the pink of health. Their minds are fresh and hence more receptive to new idea and thoughts. Physically too they are mature with all facilities functioning optimally. Being so endowed this is the appropriate time for them to choose a specific stream for study that would lead them to their future career.

The youth of today are however not a very happy lot, for despite good health and the comforts of modern Life they have to study hard at school and at home. Their peers and parents expect too much from them causing stress and anxiety which leads to psychological imbalance, depression and frustration that sometimes proves fatal. The increasing trend of youth taking the extreme step of suicide, is an indication of the stress they are under. However, that in this play of life the part of youth has no retake. One must therefore live their part truly and sincerely

Welcome easing of tension with China

The procedure of withdrawal that has begun at the Line of Actual Control (LoAC) is welcome. What India needs isn’t an arrival to business as usual before June 15, yet a progressively dynamic, determined crusade to compel China to forsake its expansionist cases on neighbors’ region and to settle its outskirt with India. Following quite a while of wary commitment with China, driven mostly by India’s 1962 thrashing and somewhat by the conviction that India and China could be accomplices in attempting the Asian Century, India has started to content an alternate methodology. This incorporates venturing up the structure and updating of foundation in outskirt zones, turning down support in the Beijing’s lead Belt and Road Initiative (BRI) and latent participation of the exchange understanding, RCEP.

New Delhi has all the earmarks of being at last advancing a China strategy that recognizes Beijing’s expansionist and mercantilist inclinations and that India imparts to China a long fringe that is yet to be settled. This expects India to keep on keeping up its endeavors versus China on each of the three fronts — military, strategic and monetary. China may have made a stride back for the time being, yet it doesn’t mean it has abandoned its endeavors. Unceasing cautiousness on the fringes, not exactly at the LoAC, is the path forward for India. Simultaneously, New Delhi should proactively work with accomplices, those in the area, Bhutan, Nepal, Myanmar and Bangladesh, and the worldwide ones, the US, Japan, Australia, South Korea and Vietnam among others, to oppose China’s expansionist points, especially in the South China Sea and the Indo-Pacific. India should likewise fortify its organization with France, Germany, UK and the EU, incorporating to advance improvement in Africa.

At last, India must concentrate on building its financial profile for building its own versatility as well as for giving choices as the world tries to differentiate flexibly chains. India should likewise center and put resources into development, business and giving top of the line arrangements over the range. China must figure out how to contend while regarding serene conjunction.

COVID 19:- The World health report

The World Health Organization says that in any event one of the almost 150 Covid-19 antibodies being tried the world over ought to be prepared by 2021. Creating a sheltered and useful immunization, instead of attempting to beat nearsighted cutoff times, ought to be the objective for India and nations over the world that are as of now occupied with examination and testing of an antibody for the infection. Science must guide the speed of antibody exploration and preliminaries must be led with thoroughness and tenable straightforwardness. Quicker clearances for starting preliminaries (read: cutting formality) is welcome, yet giving quick work to testing conventions or fudging results will have hazardous outcomes.

In the event that any organization in India prevails with regards to making a decent and powerful antibody, its picture and India’s will get a lift all around. The opposite would occur on the off chance that it creates a terrible antibody that bargains security. Apparently, around 21 antibody competitors are in human preliminaries, including one created by the University of Oxford and AstraZeneca that is at the most exceptional stage — with Phase II/III preliminaries in England and Phase III preliminaries in Brazil and South Africa. As of late, Indian immunization producer Zydus Cadila got endorsement to begin human preliminaries of a DNA-based antibody, turning into the second organization in India to join the race after Hyderabad-based Bharat Biotech that is working together with the ICMR to build up an immunization.

The ICMR ought to keep away from any future contentions over setting self-assertive cutoff times for dispatch of the immunization. India has enough residential patients for undeniable tests. This is indispensable in the propelled viability preliminaries (Phase III preliminaries) when the immunization is given to a huge number of individuals to perceive what number of get contaminated contrasted and the volunteers who got a fake treatment . Hitting the nail on the head is a higher priority than getting it quick.
