cry.

I have always felt slightly bad about not really having cried for decades. People insist that crying is good for you and that not crying is bad for you. The danger is, you might be going to explode some day from repressed grief (watch this space).

And of course in the counselling side of my life I am supposed to consider it a Very Bad Thing if people don’t cry. So I was pleased to see some of the orthodox views on crying disputed by Dutch psychologist Ad Vingerhoets in an interview with The Psychologist. He specialises in the psychology of crying.

Do people feel better after a good cry? Not necessarily, says Vingerhoets. Some feel bad. It helps if other people respond to tears with support but if crying is ignored or disapproved of the crier can end up feeling worse.

Women cry more often than men. Essentially, he says, women cry in situations that make men swear. These include computer crashes, car breakdowns and feeling frustrated or angry. So if you’re female and Vingerhoets’ statement makes you angry, prove him wrong by swearing.

Some Indian tribes, he says, use crying instead of shaking hands as a means of greeting – since I’ve never heard of them before I assume these tribes are obscure and it’s not hard to see why.

You are most likely to cry in the presence of your mother or your romantic partner or another “attachment figure” to use the psychological jargon. Thus, children who are hurt physically or emotionally will sometimes hold off the tears until they get to a parent and then they let them out.

The idea of tears as a sign of weakness seems to have been introduced by the Victorians.

What about tears of happiness? Vingerhoets doesn’t believe people cry because they’re happy. Usually we cry because the happy event also calls up negative emotions, he suggests. An example is crying when you meet a loved one after a long separation. That’s a happy event but the tears come with the accompanying realisation of the pain of the separation.

What mostly makes people cry is “conflict, rejection, criticism and minor failure”. Frustration and helplessness also bring on crying.

If I can’t produce real tears I would certainly have no hope of turning on crocodile tears. People who are really good at this, according to Vingerhoets, include narcissists, psychopaths and actors.

Tears usually lead other people to feel empathy and to want to lend support, which is why narcissists and psychopaths use them to manipulate. It only works, naturally, if people think they’re genuine – and since psychopaths are really good at turning on the charm they can make very good use of tears.

Very empathic people are more likely to cry themselves in response to the tears of others.

you are not too fucking sensitive. period.

You, the people who dare to say to your families that you want something different; that you want love; that you want connection?

You are not too (fucking) sensitive.

You, the people who cry when someone is unkind to you? When someone judges you? When someone finds ways to put you down? When that someone is a family member or friend or partner?

You are not too (fucking) sensitive.

You, the people who are committed enough to changing old patterns that once people switch from outright condemnation to passive-aggressive snarck, you actually call them out?

You are not too (fucking) sensitive.

You, the people who say something when they hear someone say “That’s so gay” or “How retarded” or calling women “bitches” as is if it’s a term of affection or making generalizations about a person of color?

You are not too (fucking) sensitive.

You, the people who hug trees, recycle toilet paper rolls, and cry at the sight of birds bathed in oil after BP blows a rig?

You are not too (fucking) sensitive.

Let me tell you who you actually are:
When you ask your families to engage with you in a way that is loving and connected, you are asking everyone to rise and live bigger. You are engaged with connection.

(Note: the trick is to take responsibility for yourself, and not get attached to controlling/changing their behavior).

When you cry because someone who says they love you is treating you unkindly, you’re feeling the pain of disconnection from other human beings, and this means that you are not a desensitized sociopath. It means you’re a functioning human being who has not cut themselves off from what they feel.

(Note: the trick is to take responsibility for yourself, and not get attached to controlling/changing their behavior).

When you are committed enough to respectful relationships that you draw a clear boundary and you enforce it, including communicating those times where it seems like something passive-aggressive is happening, you are practicing this thing called “self-respect.”

(Note: the trick is to take responsibility for yourself, and not get attached to controlling/changing their behavior).

When you decide to speak up against discrimination, bigotry, and slurs, you’re taking a stand for your values as well as asking others to think about how their words, their “harmless jokes,” might contribute to a collective experience of oppression.

(Note: the trick is to take responsibility for yourself, and not get attached to controlling/changing their behavior).

When your heart aches at the destruction of the planet, you’re exercising compassion, connection, and a deep desire for life to thrive.

(Note: the trick is to take responsibility for yourself, and not get attached to controlling/changing the outcome).

So do you get it?
You’re not too (fucking) sensitive. You’re engaged. Connected. Human. Awake. Alive.

The people accusing you of being too (fucking) sensitive? They’re disconnected.

A moment of compassion for all of us, please.

We’ve all been there. We all have our moments of thinking that someone else’s needs or preferences are just too precious, and judging the hell out of them.

Let’s not polarize into an us/them.

But truly–celebrate your sensitivity. Those who are sensitive are those who are also paying attention. It speaks to the potential for a radiant love within. A deep love within, combined with a willingness to take positive action, is the only thing that has ever revolutionized the world.

Thank you for being so (fucking) sensitive.

A letter to my younger self.

Remember when you thought 40 was so old? Good news, you’re not ready for the Smithsonian yet. Helpful hint: you are going to need a magnifying mirror to do your makeup at 40 otherwise you will end up leaving the house looking like a clown.

Remember when we thought when we were 40 we would have life all figured out? Well we were wrong. Life is a series of lessons that will mold you into a better person. Growing up there will be fear and anxiety, a lot of it. There will also be massive amounts of joy and triumph. Stop wasting time worrying about fitting in. Stop spending so much money on hair spray. For the love of creatures please stop with the Aqua Net. Once you toss that gigantic can of Aqua Net you will realize it’s true you CAN dance in the rain and not have sticky gross hair. Please don’t waste anymore time worrying if you’re too fat or too skinny. You are perfect just the way you are. An intelligent, confident female is beautiful regardless of her appearance and size.

Eventually you will be able to have a phone with you all the time and you will have this device called a smart phone. That’s right, the phone will no longer be attached to the wall and you won’t need to have a really long cord on your telephone. Even better, you will no longer have to hide in the pantry when talking to your friends on the phone. I know it’s weird. On your smart phone you will have all sorts of technology. Please use it wisely. This thing called social media will happen and it will blow your mind. You have an even weirder thing called a “status” and people will know where you are and what you are thinking depending on what you type in the status bar. You can even post photos of yourself or your food. Brace yourself, people will begin posting photos of everything they are about to eat. But it won’t be McDonald’s because society becomes very health conscious. Eat all the bread you can now because when you get older the entire world will tell you that carbs are bad. Relax, we aren’t going to stop eating pasta.

There’s also this thing called a “selfie.” You can take a selfie with your phone. That’s right. The smartphone you will take every place will even have a camera. So throw away your pink Le Clic camera and get with the times! Young people post selfies all the time. Sometimes they even do it while getting dressed in the bathroom and forget to close the top of the toilet or the shower curtain. Gross, I know. Sometimes they get a little too revealing. Please do this responsibly. The internet never forgets. Someday you will go job hunting and you don’t want a potential employer to not hire you because of endless bathroom selfies. I could go on and on about the internet, but I will tell you to use your words wisely when posting. Always be mindful when speaking to others.

Your life is an incredible blessing and a journey. One which you will fall in love with when you realize God is in control and you finally stop to smell the roses and enjoy the ride.

Below are some of the lessons learned along the way:

You are not everyone’s cup of tea and that’s okay.
Your sense of humor is what keeps you strong during the tough times.
You don’t always have to have the last word; sometimes silence is the best response to quiet a fool.
Every relationship has a purpose that helps us grow and become stronger. The most challenging relationships teach us about forgiveness and patience.
As long as you have Mom and Dad you will always have a place to call home.
No relationship is worth your self respect.
Mom and Dad will not be here forever. Cherish them.
You can actually hold Mom’s hand in public without people thinking you’re her girlfriend.
Mom will be your best friend when you grow up and you will want to be just like her.
Dad remains your real life super hero, even when he is no longer alive.
You do not know everything. Listen. Be alert. People want to teach you things, they want you to evolve into a successful adult. No one likes a know it all.
Accept yourself as God made you. Stop trying to be what you’re not, be true to yourself because God does not make mistakes.
Try not to take things personally; what people say about you is a reflection of their own insecurities.
If you don’t completely love the person you see in the mirror, you will never truly be happy or successful.
Love yourself, be proud of who you are.
Growing up you will experience a mix of emotions. They will be confusing. You will experience pain and sorrow. You will also experience unconditional love and support. You will be betrayed and your heart will be broken. You will also experience times when you are so sad you can’t lift your head off the pillow. Times when you are certain that the sounds of your breaking heart are deafening to others. I’m not going to lie, those times are really going to hurt, but there will be countless moments of joy and gratification that make your entire world light up. It is important to trust your journey. You have a magnificent life ahead of you. The road will not always be easy but I can promise you it will be an incredible journey with so many exquisite blessings along the way. When life gets tough, always remember you are a beautiful diamond that shines bright in a world where people have as many preferences as they have types of precious gemstones. Never forget that.

Love,

Your older, wiser self

Ten traits of a classic bibliophile/bookworm.

when I moved from Igatpuri a countryside to nashik in the city two years ago – a journey of about 19 miles i knew i had to pack light , so i sold out everything in my room my furniture some antique wall hangings my hammock chair and everything was left out which wasnt a complete daily essential to me . but people i packed 15 huge boxes of books and transported them ( payed an hefty amount).I could live without a workstation/ study table for a while – but my books were a different story.

Hello, My name is Jigeesha Banerjee, and I am a bibliophile , perhaps you are familiar with that life.

The word “bibliophile” literally means a lover (phile) of books (biblio). The term is often thrown around to refer to people who simply like to read, but in its most precise interpretation, “bibliophile” means something more specific: someone who loves books particularly—how they look, how they smell, what they feel like. Of course, most bibliophiles are great readers, collecting (OK, hoarding) books in part because they love the narratives in them. But they also value books as fascinating objects in themselves, objects with their own stories to tell. These are readers who will never really be satisfied with electronic books—how can a cold iPad screen possibly compare to a tattered, musty, well-loved print book? To find out if you are one of those blessed with (or suffering from, depending on you point of view) bibliophilia, read on.

  1. You have both a permanent copy and a loaner copy of your favorite books

Certain books—ones I’ve read over and over since I was a teenager—have enormous personal value to me. Of course, I want to share these wonderful, formative reading experiences with other people. But other people are jerks sometimes! What if I lend a friend a book and she dog-ears the pages? What if she breaks the spine? WHAT IF SHE LOSES IT? So I have my copy, and a loaner copy, and everyone is happy. All perfectly normal, right?

  1. You judge other people according to the books they have
Oh, come on. We all do it. Actually, I don’t judge people so much by what books they have as by whether they own books or not. I don’t care what people read, but someone who doesn’t have any books is probably an orc and cannot be trusted.
  2. You spend way to much time thinking about book organization

My books are organized according to an intricate system that is so logical that only I can understand it. Some are alphabetized, some are categorized according to genre, some are ordered by color.

  1. Used books stores fill you with glee
Used books are the best: they’re cheap, they hold the same texts as newer editions, and sometimes you find amazing evidence of past readers—marginal notes, bookmarks, inscriptions. All tiny glimpses into other people’s lives. Bibliophiles can’t get enough of all of that. More, please.
  2. You view books as actual home decor
    1. Because they are pretty. Spaces always look more interesting, more inviting, and more homey when they are filled with books.
  1. You plan to use them as centerpieces at your wedding (or you already did)

For bibliophiles, books form a major part of one’s personal identity. It’s only natural that you’d want to be surrounded by them on your big day.

  1. Your ultimate fantasy is to have a library in your house, à la Belle in Beauty and the Beast.

Preferably one with a ladder. And yes, you’re going to swing around the room, gesturing grandly, whatever.

  1. You would love to travel far and wide to look at books and the homes of the people who write them

I’ve gone far, far out of my way to visit places like Haworth (home of the Brontë family in West Yorkshire) and Prince Edward Island (home Lucy Maud Montgomery and the Anne books). There is something powerful in seeing where my favorite books were written, and in seeing great authors’ own books. Because, naturally, great writers tend to be bibliophiles themselves.

  1. You own multiple copies of the same books

I have at least four copies of Pride and Prejudice, including a battered paperback edition, a fancy leather-bound edition, a critical edition, and an illustrated edition. And they are all completely necessary to my life.

  1. You spend crazy amounts of money on rare books
One would have to have crazy amounts of money in order to fulfill this criterion, but I think we can assume that whoever spent $11.5 million on a copy of John James Audubon’s Birds of America in 2010 is a pretty hard-core book lover.

My First Solo Trip to Nainital

Nainital, also known as the “City of Lakes,” is magnificent in every sense. The night, my train reached Bareilly, and I stepped out of the station to rent a cab to Nainital. Never had I any idea that a short trip of 3 days could change my whole perspective about traveling. I have always been fond of traveling, but Nainital was my first female solo trip, and the excitement, fear, and thrill juxtaposed all together inside my heart. But, let me tell you, even though the beautiful city is known for the lakes, it is much more than that. Nainital welcomes you with open hands, and trust me when I say this; it is one of the safest cities in India.

Now, I decided I would give you a list of activities you could do in Nainital, and none of them would burn a hole in your pocket. When I left for my solo travel, I only had 7,000 INR with myself, and I saved 3,000 INR, and I am not at all bluffing. The entire trip, excluding the train tickets, cost me 4,000 INR only. So, let’s get started on the list of activities you could do when you visit Nainital:

  • Walk around the City

One thing, I had never experienced before Nainital, was walking around a city leisurely. This was my first time alone, and I had no restrictions on me, which is pretty standard in an Indian household, especially if you are a girl. So, three years back, when I set my feet on the roads of Nainital, it was way into the night. I had my luggage with me, and no outside cars are allowed inside the city premises at night. The cab dropped me on the outskirts, and I started walking without any idea of where to go. I had not booked a hotel yet, and to be honest, I was scared to death to walk alone on the streets. But the moment I came closer to the lake of Nainital, the beauty of the night sky filled with stars, and the reflection on the still water of the lake, I forgot what fear feels like. I was mesmerized by the beautiful sight of the city, and I walked on the streets the whole night. In my opinion, this is the most affordable way to look around the city. Go out and walk around leisurely, the beauty of the town would keep you captivated for a long time.

  • Visit the Mall Road

Walking around the Mall Road was one of the most exciting activities for me. The entire road is always filled up with tourists and local people. There are tiny little shops on one side of the mall. You can buy a souvenir from one of the shops, for cheap. The Mall Road is the busiest place in the city. Every day, I used to walk down the Mall Road at least once, and talk to the people around. The people who live there are incredibly polite and friendly, and you can learn a lot about the city from them.

  • Row Boating at the Naini Lake

If you are in Nainital, you have to visit Naini Lake. The city, Nainital, is named after this particular lake. The lake’s atmosphere is vibrant in the day time, and you can also experience the beautiful silence at night time. Also, it would be best if you experienced row boating at the lake. The ticket is for 200 INR only. I would personally recommend you to visit the lake at night, too. The silence and the night sky make the lake more peaceful at that hour.

  • Visit the Mukteshwar Temple and the Rocks

After my first day at Nainital, I rented a cab with eight other tourists to visit Mukteshwar. I had heard a lot about the temple located at Mukteshwar and planned on visiting it. But, the most spectacular incident took place after I reached my destination. The Mukteshwar Temple was undoubtedly magnificent. But, I started to walk around the temple, and that’s how I found a trail to the most beautiful view I had ever seen. Rocks surrounded the entire place, and you could try rock-climbing, too. I spent the whole afternoon sitting on one of the stones, completely mesmerized by the view in front of me. I witnessed the snow-covered peaks of the mountains in front of me while sipping on a hot cup of tea. At that time, I realized how wonderful it was to be on your own, in an unknown city, with strangers.

  • Go on the Ropeway

On the last day on my solo trip to Nainital, I planned on going up on the ropeway to observe the entire city. Undoubtedly, one of the most extraordinary experiences I had in Nainital is this. You don’t want to miss out on this one. There is always a massive line of travelers waiting to board on the ropeway. It took me a good one hour to finally get my turn, but I completely forgot about pretty much everything when I did.

Nainital is immensely close to my heart. The city has given me a lot more than mere beautiful scenic sites. The town has given me beautiful memories to look back at, and it has taken away my fear of the outside world. The city made me fall in love with being alone and taking risks, even when you might face trouble. Before Nainital, I have been to multiple other cities and towns with my family, but what Nainital gifted me was more than just traveling. If you are a woman who is afraid to go solo or you are anticipating whether to take the trip alone, please do it. There is nothing freer and more peaceful about traveling at your own pace and on your own. To conclude, I would like to quote Jane Austen, “What are men to rocks and mountains?”

MINISO: The Japanese Lifestyle Brand That’s Taking Over India’s Retail Scene

Miniso is a Chinese retailer and designer brand specializes in house goods and cosmetics founded in 2011 by a young Chinese entrepreneur Ye Guofu and co-founded by Japanese Designer Mr. Miyake Junya. It holds a wide range of product categories including cosmetics, home goods, digital accessories, stationery kitchenware and much more under a single hood and it follows the philosophy of “simplicity, nature and good quality”.

WHY IS MINISO ( A 100% CHINESE COMPANY ) PRETENDING AS JAPANESE COMPANY ?

Initially claiming to be a famous Japanese brand, despite operating in Mainland China have no outlets in Japan. Yes this company is pretending. Apple launch watchos7 for apple watch with new handwashing feature which was in development years before COVID-19

Last week at its annual Worldwide Developer conference apple UNVEILED the watchos7 for apple watches. The updated version of the software that will power the apple watch which is good news for all the devoted user of Apple smartwatch series. Apple has added a number of feature. One of the Apple latest update has added a hand wash detector feature to motivate the user to wash their hands properly for 20 seconds amid COVID-19. Washing hands will help to avoid coronavirus transmission that has allegedly stop the world.

In Watcheos 7 apple has added the number of features like sleep tracker, handwashing, new workouts- Apple has added dance, strength functional health workouts in the list, face watches, noise app and many more. Sadly all the features will be compatible with only Apple smartwatch series 3 or later and some features are only compatible with Apple watch series 5. In the time of global crisis, the WHO guidelines focus on the handwashing for about 20 seconds to avoid COVID transmission so many of you might think that due to coronavirus the feature has developed overnight but Apple was working on the handwash feature for years before COVID-19. Apple Kevin Lynch, vice president of technology told that it hand wash detector feature is “years of work”. The apple watch feature is really important these days amid coronavirus. Apple interpreted the handwashing feature as a ‘first-of-its-kind invention for a wearable’ technology that will also merge with the Health app on the iPhone.Even the watch reminds you to hand wash when the user comes back home told by Apple officials at the Worldwide Developer conference 2020 held last week.

The hand wash detector is designed to starts the timer of 20 seconds automatically detecting the user is handwashing. The watch uses the accelerometer which detects the specific handwashing pattern to record whether the user is scrubbing properly or not for 20 seconds, adopting different method using machine learning. If the user doesn’t wash your hands for 20-second, the Apple Watch will poke the wrist, motivating the user to wash hands properly. Along with this, it listens to the sound of the running water. But that’s not enough since eco-sinks have gain wide popularity and ultimately the sound of the tapping water is less and in last it takes care of the sound of squishing soap. The device got an audio signature to confirm that the user has hand-washed. Apple take logs of how many times user wash the hands in the health app. This is not the first kind of smartwatch having this feature. Earlier, Samsung has launched the Galaxy watched app having this feature but user have to manually start the timer. That’s why the apple watch will jump with a big bang in the market.

The feature has contributed to the COVID-19 related initiatives from Apple. The Apple funded $10 million to quickly scale COVID-19 sample collection kit production and the company has donated masks and been a great player in contact trace initiative.

Monument of India : The tajmahal

Tajmahal is one of the seven wonders of the world built with white marbles by mughal emperor shah jahan in the memory of his beloved wife mumtaz mahal. Mumtaz was the second wife of shah jahan, she died while giving birth to their fourteenth child. After her death, shah jahan decided to make a monument in her memory whose construction started in 1632. It is situated near the bank of river Yamuna in Agra city of Uttar Pradesh. The tomb of mumtaz was placed in the tajmahal and after the death of Shah Jahan, his tomb was also placed adjacent to his wife’s tomb.

Tajmahal construction costs around 32 million rupees at that time. It was build by approx 20000 workers. Artists were called from different places. Unique craftsmanship can be seen on this structure. Flowers are carved on marbles, plant motifs, calligraphy of Persian poems, calligraphy of Arabic ayat are detailed on walls and gates, reflective tiles, finial floor tiles are used, detailed jali are constructed. Tajmahal is covered by red sandstone walls in 3 sides and one of the side facing river Yamuna is open.

However there are many confusions regarding the construction of tajmahal that when it is built and by whom, many people and books claims that it is not built by shah Jahan and is not built in 17th century. However they are considered false by the indian government.

About 7-8 million tourists came to see the beauty of tajmahal every year. Tajmahal is considered as a symbol of love.

Calcutta HC Pulls Up State Police For Rampant Child Marriages

In a recent, remarkable and righteous decision, the Calcutta High Court just recently in ‘Court In Its Own Motion In Re: Contagion of Covid-19 Virus In Children Protection Homes (Through video conference) in W.P. 5327 (W) of 2020 while taking strict stock of flagrant child rights violations amidst the lockdown pulled up the State police on several accounts. Taking note of the affidavit of the Home Secretary, the Calcutta High Court observed that while there have been no instances of child trafficking, however, child marriages during this period in most of the districts have been rampant. This cannot be taken for granted and so the Calcutta High Court rightly took serious note of it!

To start with, we see that this latest, landmark and extremely laudable judgment delivered by a two Judge Bench of Calcutta High Court comprising of Justice Harish Tandon and Justice Soumen Sen on June 25, 2020 sets the ball rolling by first and foremost observing that, “The affidavit filed by the Additional Chief Secretary, Home Affairs Department and Home Secretary, report filed by the Secretary, Women and Child Development and Social Welfare Department and the affidavit filed by the Secretary, Health Department in Court today are taken on record.”

To put things in perspective, it is then pointed out that, “In the affidavit filed by the Home Secretary, district-wise details of the cases in relation to violation of child rights of all forms till 15th June, 2020 has been disclosed. Contrary to the earlier report, this affidavit spells out in detail and to the satisfaction of this Court the nature of the violation of child rights and the steps taken by the police authorities in connection with such reported cases. Most of the reports, state that there have been no instance of child trafficking, however, child marriage during this period in most of the districts have been rampant and with the assistance of the DALSA and the police authorities many of such child marriages could be prevented.”

Truth be told, the Bench then minces no words to hold that, “This alarming rise of child marriages during this lockdown period has given us a strong impression that these child marriages may be in the garb of child trafficking and we, accordingly, direct the Superintendent of Police of every districts to investigate into the cases regarding child marriage and to find out if such child marriages are for economic consideration or under the garb of child trafficking. It is needless to mention that the perpetrators of these child marriages should be dealt with in accordance with law and cases should be registered against them without any delay.”

While elaborating further, it is then pointed out in this judgment that, “The report in relation to North 24-Parganas, inter alia, has stated that cases of “other violation of child rights” are 124. We need to know the nature of such “other violation” and we direct the Home Secretary to file a report disclosing such “other violation of child rights” and the steps taken by the police against the violators.”

To be sure, it is then noted with concern by the Bench that, “We have received reports from the District Judges and the POSCO Courts that the investigating officers in most of the districts are delaying in production of the victim and/or filing application for recording of statement under Section 164 of the Criminal Procedure Code which only can enure to the benefit of the perpetrators of the crime.”

As it turned out, the Bench then directed that, “We direct the Superintendent of Police of all the districts to ensure that the victims are produced immediately and not later than 48 hours before the Magistrates for recording of statement under Section 164 of the Criminal Procedure Code. All delays attributable to the prosecution should be immediately addressed and all attempts should be made so that the progress of the trial takes place without any delay.”

While conceding the difficulties faced by the police, the Bench then states that, “We understand that during the lockdown period police officers and the public prosecutors are facing difficulty. But we find no reason for not ensuring the recording of statement of the victims under Section 164 of the Criminal Procedure Code.”
It is then also pointed out that, “We have received report from the District Judges which show that after our earlier order, in most of the cases statements under Section 164 of the Criminal Procedure Code has been recorded.” Also, it is then directed that, “The Superintendent of Police of all the districts must also ensure that there is no delay in investigation of the cases relating to child rights violation and charge-sheet are filed in time.”

Going forward, it is then pointed out that, “We have drawn attention to the learned Advocate General the report filed by the Superintendent of Police, Cooch Behar dated 22nd June, 2020 wherefrom it appears that 40 children have been recovered in the said district but apparently no FIR had been lodged against the perpetrators of the crime. Learned Advocate General has assured us that he would personally look into the matter and ensure that in all the districts immediate steps are taken for registration of FIR, once a complaint is received.”

As we see, the Bench then directs that, “We call for a report as to the steps taken by the police authorities in the district of Cooch Behar regarding the recovery of children from 1st January, 2020 till 22nd June, 2020.”

More significantly, while dwelling on the deficiencies, the Bench then observes that, “In one of our earlier order dated 21st April, 2020, we have recorded that the report shared by the Visitors and Principal Magistrates of the J.J.B.s and Chairperson of the C.W.C. would show the J.J.B.s are functioning under tremendous stress and the infrastructure is extremely inadequate. We have recently received reports from the Principal Magistrates of all the J.J.B.s functioning in the State, wherefrom we find the following deficiencies:

i.                  No chamber for the Principal Magistrate and other members of the Committee,

ii.               Lack of office space,

iii.            No separate room for vulnerable child witnesses,

iv.            No separate entrance for the C.C.L. and vulnerable witnesses,

v.               No official vehicle is assigned to the Principal Magistrate,

vi.            Lack of broad-band connection and inconsistent bandwidth,

vii.         Lack of hardware and software infrastructure required for audio video linkage,

viii.      Inadequate and/or no support staff like bench clerk, lower division clerk-cum-typist, counsellor etc.,

ix.            No separate provision of wash-room for female staff/members/lady officers,

x.               No separate room for counselling for the C.C.L.s and for sitting of social worker members,

xi.            Lack of maintenance of public toilets and wash-room of Principal Magistrates.”

It is then clarified that the aforesaid list is only illustrative but not exhaustive.

Having said this, the Bench then laments that, “We have time and again apprised the Secretary, Women and Child Development and Social Welfare Department, but it appears from the report that the situation has not improved and the J.J.B.s in almost all the districts are facing infrastructural deficiencies which certainly impedes the functioning of the J.J.B.s, as a result whereof the children are suffering.”

Of course, the Bench then notes with some satisfaction that, “The learned Advocate General has assured us that he would immediately take up the issue with the Home Secretary and on the adjourned date would apprise as to the steps taken to remove such deficiencies.”

As things stand, the Bench then says that, “The report filed by the Secretary, Women and Child Welfare Department discloses few cases of follow up action by way of phone call interventions which have brought succor to the family of the child and we hope that same kind of interventions would be made as and when occasion arises for the other children to safe-guard their interest. The said report also discloses the guidelines and the nature of information sought for as a follow-up action of children restored to families since March, 2020.”

What follows next is that the Bench then says that, “We would request the Secretary to submit a report afresh with regard to few cases of post-restoration follow-up of children to family on the adjourned date.”

Furthermore, the Bench then hastens to add that, “The report filed by the Secretary, Department of Health and Family Welfare shows that 75 children of the migratory workers have been found to be Covid-19 positive and subsequently they were referred to designated covid hospitals, samples were collected from asymptomatic children of migratory workers and 43 of such samples were reported as positive. Those 43 children were admitted at designated covid hospitals and as of now, those children have been discharged from such hospitals after recovery. These 43 positive children were mentioned as higher referral in the earlier report. However, considering the safety of the children we would like to know if any random test was carried out of the children of the migratory workers and if so, disclose the result of such random test with specific comment as to whether anyone of them tested positive, save and except the particulars already disclosed.”

What’s more, the Bench then notes seriously that, “We have recently come across a newspaper report from the Ananda Bazar Patrika wherefrom it appears that one female minor girl belonging to North 24 Parganas has been recently recovered by the Maharashtra police with the help of the N.G.O.s. The trafficking took place in the year 2018 and although complaints were made against three traffickers, but it is reported that no attempt was made by the Bagda Police Station in recovering the female child.”

To say the least, the Bench then observes that, “We have shared the news item with the learned Advocate General. We call for a report to be filed with regard to the investigation of the said child trafficking case from the date of lodging of the complaint till date, together with an explanation for not being able to recover the child until intervention of the Maharashtra police.”

Not stopping here, the Bench then further observes that, “We also brought it to the attention of the learned Advocate General that 13 C.C.L. boys from Dhruba Ashram Observation Special Home had escaped and was culminated in registration of FIR vide Belghoria Police Station case no. 138 of 2020 dated 8th March, 2020 under Section 363 of the Indian Penal Code. Two of such C.C.L. boys have surrendered but the fate of the 11 C.C.L. boys are still unknown.”

While expressing unhappiness with the police functioning, the Bench then says in simple and straight language that, “We are not happy with the investigation. The Police has not yet been able to recover the said 11 C.C.L. boys. We call for a detailed report with regard to the said police station case and progress of the investigation, on the adjourned date.”

Finally, it is then held that,“
The matter stands adjourned till 2nd July, 2020 (at 2.00 P.M.). At the request of the learned Advocate General we shall take up compliance of our directions in relation to districts of Cooch behar, Darjeeling, Jalpaiguri, Kalimpong and Malda on the next date. A video conference shall be held with the Secretary (Social Welfare) under the Andaman and Nicobar Administration, Port Blair and all stake holders are directed to be present through video linkage.”

To conclude, the sum and substance of this notable order till now by a two Judge Bench of Calcutta High Court even though it has yet to be finally pronounced is that child marriage has to be taken most seriously. It cannot be taken for granted. There has to be zero tolerance for child marriages which is an old social evil. Those who dare to indulge in it in any manner must be made to face the music of law under all circumstances!  This explains why the Calcutta High Court has gone so minutely into this! Very rightly so!

RECRUITMENT

The term Recruitment denoted that process by which the management locates the source of supply of manpower and then traps that source and it encourages outside manpower to apply for the jobs in the organization and search for the proper person for the right type of job at the right time is the basic function of the personnel department. The selection of wrong persons for the right job can ruin the process of work. A well-planned recruitment policy ensures increased productivity, decreased costs, increased employee morale and goodwill of the organization and thus recruitment is the process of searching for prospective employees and encouraging them to apply for the jobs in an organization and it aims at securing as many qualified applicants for the jobs as possible so as to decrease the hiring ratio and before searching for applicants, an organization should consider the most likely sources of the type of employees it needs. According to Edwin Flippo “Recruitment is the process of searching for prospective employees and stimulating and encouraging them to apply for jobs in an organization”. Recruitment also includes seeking and attracting a pool of people from which qualified candidates for job vacancies can be chosen. There are various sources of recruitment of workers and the personnel manager will select a source of recruitment, keeping in view the requirements of the departments concerned, the type of persons needed and the advantages of a source of recruitment and different sources of recruitment can be tapped on different occasions for different types of persons.

INTERNAL RECRUITMENT

One important source of recruitment is a promotion from within and it is the best method for recruitment of high and the medium cadre of managers and many companies feel that the best practice is to fill jobs from within the organization and they feel that inside employees already know the company and its policies and presumably have proved their ability and loyalty. This keeps the employees happy contented and in good morale and they know that they will earn promotion to a higher position. A performance test is the best test to determine a person’s suitability for a job. Filling of a vacancy from an internal source is very economical and no time and money are required to spend on a new candidate and a person who is selected for a job from within an organization knowns the organizational relationships.

EXTERNAL RECRUITMENT

By the external sources of recruitment, a vast mass of skilled, semi-skilled, and unskilled people is recruited from outside the organization. By using external sources of recruitment the organization can expect to get talented candidates from outside and the selection process is characterized by competition and the prospects that the organization can pick up the best candidates and fresh talents for the job are high. External candidates are expected to be trained and be efficient in work as they join the organization they work with great vigor and put in their best efforts to achieve the objectives and this creates healthy competition and congenial work environment in the organization.
