Abstain From Broadcasting Zee Owned Films Jung And Kartavya

It has to be stated right at the outset that in a major and significant development, the Bombay High Court in a recent, remarkable and righteous decision titled “Zee Entertainment Enterprises Limited Vs Teleone Consumer Product Pvt. Ltd. & Ors.” in exercise of its ordinary original civil jurisdiction in its commercial division delivered on 16th July, 2020 has ordered the television channels Maha movie and Manoranjan TV to abstain from broadcasting Zee owned films – Jung and Kartavya. Very rightly so! This commendable judgment was delivered after the entertainment media giant – Zee Entertainment Enterprises Limited (ZEEL) moved the Bombay High Court to restrain the television channels viz ‘Maha Movie’ and ‘Manoranjan TV’ from broadcasting its films namely “Jung” (1996) starring eminent film stars – Mithun Chakraborthy, Ajay Devgan, Aditya Pancholi and others and “Kartavya” (1979) starring eminent film stars – Dharmendra, Rekha, Aruna Irani and others, without obtaining license from ZEEL for the same.

To start with, this notable judgment delivered by Justice KR Shriram of Bombay High Court sets the ball rolling by first and foremost pointing out in para 1 that, “The present action is filed by plaintiff claiming infringement of plaintiff’s copyright in two cinematograph films “Jung” and “Kartavya” by defendants who are broadcasting the movies on their respective television channels without any permission from plaintiff.”

To be sure, it is then stated in para 2 that, “The papers and proceedings in the present matter have been served by plaintiff upon defendant nos. 1 and 2. Plaintiff has e-filed affidavit of service dated 13th July 2020 in respect thereof. Further, the intimation of listing of matter on 16th July 2020, the link of today’s hearing and the causelist has been served by plaintiff upon defendant nos. 1 and 2. Plaintiff has e-filed affidavit of service dated 16th July 2020 in respect thereof.

To say the least, para 3 then goes on to say: “It is stated that plaintiff company is engaged in the media and entertainment business inter alia of procurement, development, distribution and dissemination, broadcast/re-broadcasting of music, entertainment television programs, including cinematograph feature films, serials, talents hunts, reality shows through satellite, terrestrial and cable channels, through Direct to Home (DTH) using existing and emerging technologies and distribution platforms and is the owner/operator of several leading Indian television channels such as “Zee TV”, “Zee Cinema”, “Zee Marathi” and “Zee Talkies”.”

While elaborating in detail, para 4 then states: “It is stated that the Suit Films, i.e. “Kartavya” and “Jung”, were released in the Indian cinemas in the years 1979 and 1996, respectively. Copies of Censor Certificates issued by the Central Board of Film Certification in respect of the Suit Films are at Exhibits A1 to A2 to the Plaint. By and under a Film Assignment Agreement executed between Soham Rockstar Entertainment and plaintiff, plaintiff acquired exclusive liner rights on demand rights, local cable distribution rights, catch up TV rights, syndication rights, editing rights, promotion rights, dubbing rights, subtitling rights, doordarshan rights, home video rights, subtitling rights in all languages of the world including Indian languages, and non-exclusive performance rights, merchandising rights, dubbing rights and clip rights in a total of sixty four films, including the Suit Films “Jung” and “Kartavya”, for a term of 10 years commencing from 19th July 2017 in respect of linear rights, home video rights, local cable distribution rights, subtitling and dubbing rights for “Jung”; 1st October 2016 in respect of on demand rights for “Jung” and “Kartavya”; 15th September 2016 in respect of home video rights and local cable distribution rights for “Kartavya”, for the entire world, including India and overseas territories. Plaintiff has annexed all the agreements to the Plaint showing how the rights in the said two films have been acquired by plaintiff. Copy of the Film Assignment Agreement executed between Soham Rockstar Entertainment and plaintiff is at Exhibit J to the Plaint.  It is stated that plaintiff has the unequivocal, exclusive and absolute rights under the Assignment Agreement to broadcast/publish the Suit Films on television and/or DTH connections. Plaintiff has annexed redacted versions of the agreements to the Plaint, however, during the hearing today, plaintiff has produced the non-redacted versions of the agreements before the Court in a sealed envelope.”

Be it noted, it is then disclosed in para 5 that, “According to plaintiff, in end of June 2020, plaintiff learnt that defendant nos. 1 and 2 were broadcasting the Suit Films on their television channels “Maha Movie” and “Manoranjan TV”, respectively, without any authorization from plaintiff. Upon collecting data from the Broadcast Audience Research Council, plaintiff learnt that Defendant No. 1 has broadcast the movie “Jung” thirty seven times and “Kartavya” thirty two times, and that defendant no. 2 has broadcast the movie “Jung” forty two times and “Kartavya” nine times, on their respective channels. Detailed lists of dates and time slots on which the Suit Films have been telecast on defendant nos. 1 and 2’s television channels are at Exhibits K1 and K2 to the Plaint.”

Most significantly, it is then very rightly held in para 6 that, “Prima facie, the unauthorized broadcast/exploitation of the Suit Films on defendants TV channels is a violation of the copyright vested in plaintiff in respect of the said two Films under the said Assignment Agreement. Plaintiff has made out a prima facie case for the grant of interim injunction. If reliefs as prayed for are not granted, plaintiff will suffer irreparable damage and injury. There are no equities in favour of defendants and the balance of convenience is in favour of plaintiff and against defendants. In the circumstances and in view of the above, plaintiff is pressing for reliefs in terms of prayer clauses – (a), (b) and (e) of the Interim Application, which are hereby granted.”

To put things in perspective, it would be worthwhile now to go through para 7 which stipulates that, “The prayer clauses – (a), (b) and (e) of the Interim Application read as under:

(a)          pending the hearing and final disposal of the present Suit, this Hon’ble Court be pleased to pass a temporary order and injunction restraining defendant nos. 1 and 2, acting by themselves and/or through their servants, agents and/or representatives, from, in any manner exploiting/publishing/broadcasting/communicating to public the Film No. 1 and/or Film No. 2 or any audio or video clip thereof, on any platform and/or any other mode or medium;

(b)         pending the hearing and final disposal of the present Suit that this Hon’ble Court be pleased to pass a temporary order and injunction restraining defendant nos. 1 and 2, acting by themselves and/or through their servants, agents and/or representatives, from, in any manner, creating, alienating and/or transferring any rights in Film No.1 and/or to any third party;

(c)           pending the hearing and final disposal of the present Suit that this Hon’ble Court be pleased to direct defendant nos. 1 and 2, acting by themselves and/or through their servants, agents and/or representatives, by a temporary order and injunction to suspend future broadcasting of the Film No. 1 and Film No. 2 on their respective channels.”

As it turned out, it is then made clear in para 8 that, “Liberty to defendants/recalling this order by giving written notice in advance of at least 5 working days.”

Finally, it is then held in the last para 9 that, “This order will be digitally signed by the Private Secretary of this Court. Associate/Sheristedar of this Court is permitted to forward plaintiff copy of this order by e-mail. All concerned to act on digitally signed copy of this Order.”

In conclusion, all the television channels must pay heed to what the Bombay High Court has held so elegantly, effectively and eloquently! It is in their own best interest to do so! The earlier they understand this, the better it shall be for them! It is only after obtaining licence from those who owe it as we see in this case that films should be broadcasted! No denying it!

The Psychological Connection to Hobbies

Most of us have had a childhood interest or a hobby which was our favourite pastime. With not much to do all day, we would spend our time engaging in different unique and creative activities. Not only saving us from boredom, these hobbies have provided us with lot of benefits and shaped us into becoming what we are today.

Almost everyone had a favourite pastime activity which would keep us busy in our childhood. Starting from painting, doodling to collecting stamps, pebbles, train tickets and what not. When asked about their hobbies many people were found to narrate happy tales of their childhood. In today’s busy world where it is difficult to even take a day off from work, we tend to lose touch with our creative sides. Thinking about our childhood days makes us realise how long it had been since these hobbies were a part of our lives. Sports, music, crafts have all been pushed aside in adulthood by our busy schedules and responsibilities. In the midst of all these we have not realised how important these had been in shaping us and how amazing it would be to revisit these days by going back to those hobbies.

As children we had many different ways to spend our times. Some of us were into painting and crafts, some were into musical instruments, while some had the interesting habit of collecting stuffs. All these hobbies seem simple but studies show that there is a lot more to it.

There’s a lot of factual information about the importance of art in a child’s development. Researches show that individuals who have been into art and crafts in their childhood are found to be more expressive and have better communication skills. Experimenting with art makes children open to broader ideas and help them handle unexpected situations with ease.

Collecting is believed to be a psychological impulse. Collection is a historical practice and it ranges from stamps, books, tickets, coins to leaves and pebbles. People maintain the habit of collecting due to various reasons. Some collect due to an interest in the things that the collections represent, while others view collection as a pleasurable form of owning something. The different aspects attached with it makes the psychology behind it so interesting. It has been known that individuals who had the habit of collecting grow up to be careerist individuals in future. As the saying goes “An individual’s childhood is reflection of their life”. Collectors are also known to make better social connections and more friendships.

Individuals engaging with music from a very young age tend to enjoy musical instruments. Engaging with music makes us happy and lifts our spirits. Studies show that music improve our brain functions and it keeps the brain active. It has also been known that music helps in retaining information and develops memory. Children who have had such hobbies grow up to be smart individuals.

Few years back, Google had encouraged its employees to devote 20 percent of their time to side projects of their interest. It was a very innovative decision on the part of the company and it yielded amazing results. It has been known that following this, employees have performed more productively in their work and have achieved more. There are innumerable ways in which hobbies help in one’s overall growth and development. Most of us have lost touch with these but we can surely try and revive those habits. In fact, discovering childhood hobbies can make our lives better and make us happier. It feels amazing to revive those countless memories we have with an instrument or a habit. This will also help us become more productive in our work. Investing one’s time in areas of interest alongside their career can yield incredible results and, in the process, will make us better individuals with a more holistic outlook towards life.

Music Therapy:A Novel Therapy

Did you ever feel that therapy involves talk by a psychologist and nothing else could come under the domain of therapy? If your answer is yes,Then you are wrong!!Well times have changed my reader~

Therapies have come a long way to incorporate other clinically approved methods such as animal assisted therapy, food therapy, aroma therapy etc.Music Therapy is one clinically developed program by psychologists to assist speedy healing of their clients. In this blog, the readers would be introduced to the world of Music therapy. So lets get started!

WHAT IS MUSIC THERAPY?

Music Therapy is the clinical and evidence-based use of music interventions to accomplish individualized goals within a therapeutic relationship by a credentialed professional who has completed an approved music therapy program. It is is an established health profession in which music is used within a therapeutic relationship to address physical, emotional, cognitive, and social needs of individuals. After assessing the strengths and needs of each client, the qualified music therapist provides the indicated treatment including creating, singing, moving to, and/or listening to music.

Through musical involvement in the therapeutic context, clients’ abilities are strengthened and transferred to other areas of their lives. This therapy also provides avenues for communication that can be helpful to those who find it difficult to express themselves in words. Research in music therapy supports its effectiveness in many areas especially emotional rehabilitation.

History

You all will be shocked to know that both world wars were the trigger that initiated the development of this therapy.During and after both World Wars, doctors and clinicians began to realize the powerful effects that music has on the healing process and requested that professional musicians be hired by the hospitals. This therapy first got officially recognized in the Michigan state university of the United States of America.Ultimately,The American Music Therapy Association (AMTA) was formed which focuses on creating more awareness about this wonderful therapy.

BENEFITS

Music therapy can benefit many individuals. The diverse nature of music means it can be applied in the treatment of concerns both physical and psychological.Since music can evoke positive emotions and improve brain health,Music therapy is said to manage and alleviate symptoms of mental health concern such as Depression, Mood issues,Anxiety,Schizophrenia,Substance abuse,Autism,Personality issues,Insomnia,Dementia etc.

In addition,Music therapy can improve the social, cognitive, emotional and motor functioning. This therapy was also effective in controlling patient’s situation in Alzheimer’s,Cancer and Hypertension.

Music therapy is frequently administered to reduce stress levels and pain perception of females in labor. This novel therapy has also been linked with improvements in self-esteem, self-concept, verbal communication, prosocial behavior, socialization skills, group cohesion, and coping skills.

Limitations

Even the most beautiful things have flaws, and so has music therapy. One of the major drawback is that this therapy cannot be used as a stand-alone therapy. The music therapy is also known as music assisted therapy implying it’s sole purpose is to assist the main therapy applied by the clinician on the client to produce fast results and relief.

Also, the music therapy like all other therapies is individualized. This is not a major drawback but should be kept in mind before going in for this option. All individuals are unique and so is their taste in music. Thus the therapist has to do additional tests to see which type of music and musical instrument works better for the client.

ALWAYS REMEMBER,WHERE WORDS FAIL,MUSIC SPEAKS…..

Thus in short we need to know that music therapy is a wonderful form of therapy which strengthens an individual and increases his/her quality of life.Choose Music for a better Life!

The Casteless Collective

The Casteless Collective is a Chennai based Tamil indie band.

The band currently consists of 19 members including Tenma (leader and music producer), singers Muthu, Bala Chandar, Isaivani, Arivu and Chellamuthu, Dharani (Dholak), Sarath (Satti), Gautham (Katta molam), Nandan (Parai and Tavil), Manu Krishnan (drums) and Sahib Singh (guitar).

Formed in the year 2017, the band was started by Pa. Ranjith and Tamil Indie Musician and Composer, Tenma, founder of Madras Records. The band’s name originated from the phrase ‘Jaathi Illadha Tamizhargal’ which was coined by the 19th century anti caste activist C. Iyothee Thass. He was a social activist who urged Dalits across Tamil Nadu to register themselves as Tamils without caste in the first census in 1871. The band makes music to protest and rebel against the age-old caste-based discrimination and violence. Their songs are political which speaks against the inequalities of the caste system and oppression of women and minorities in Tamil Nadu.

The leader and music producer of the band, Tenma was preparing to put together a group of indie musical artists for the Madras Indie Collective in 2017 when he got the idea from Pa. Ranjith, of training Gaana musicians for it. They prepared auditions for over 150 applicants and looked for artists who had a socio-political motivation in their lives as well as musical strengths. A mixture of Gaana, hip hop, rap and folk musicians were brought together. About 19 singers were selected for the initial ensemble.

Jai Bhim Anthem (2018), Quota (2018), Magizhchi (2018), Vada Chennai (2018), Thalaiva (2019), Dabba Dabba (2019) are popular singles of the band.

It has broken caste boundaries by engaging with the current social and political issue in the state. Instead of making music for entertainment alone the band has tried to eradicate discrimination through its music. Their main intention is “to create political awareness through music and art” because “art which makes us question discomfort is beautiful”. The band is a collective without caste which aims to eradicate caste based and religious discrimination through music.

The Casteless Collective had their very first concert on January 2018 in Chennai. It was their first performance in front of more than 4000 people. The 19 members including one female artist, all dressed in identical grey suits gave a wonderful performance. Their cries of “Jai Bhim!” would be greeted with thunderous applause. They did not expect such a big entusiastic crowd and it was a very emotional experience for all of them. This was also because most of the artists came from small backgrounds and they had mostly performed in one or two funeral processions. The instumentalists who played katte and chatti were really overwhelmed as these instuments were restricted to only funeral events.

It was not a concert that had people head-banging or jumping to the beat of drums. Instead, the audience listened to the songs with rapt attention. They broke into applause and shouts of agreement whenever the lyrics hit home. The Bhim Rap, a song on BR Ambedkar’s life and work, was met with a very enthusiastic reception. So was the rap song that condemned honour killings in the name of caste pride which was a major social evil in Tamil Nadu. Another popular track, Madrasin Magizhchi, spoke about the small joys of living in Madras, despite being poor.

They say that people often ask them about the song lyrics and the stories about their experiences, so a discussion has begun. The band believes that social problems cannot be solved unless it is spoken about. Without discussions around caste-based discrimination one cannot attempt to eradicate the social evil. Their songs have already fulfilled their aim and created a stir among people. We hope that the band achieves greater heights and reaches out to everyone out there who has been a victim of caste discrimination and that it becomes successful in eradicating the malpractices of the system.

NETFLIX, something we are all guilty of

When’s the last time you saw a movie in theatres? How about the last time you watched a movie or show on Netflix? If you’re like most consumers, you’ve done the second thing more often. Even as movies bring in record amounts of money at the box office, Netflix grows its number of subscribers by around 10% a year and now has an estimated more than 59 million subscribers in the U.S. alone. There’s no doubt Netflix is the definitive modern media company, and its impact is felt in several industries. It’s what experts call the Netflix Effect. The habit of watching television series has greatly evolved in recent years among young adults. In the 1990s, young people dedicated much of their time to watching terrestrial television, directly broadcast by traditional television networks. Nowadays, young adults often watch series on digital platforms such as Netflix or Amazon Prime Video. Back in the day, you’d wait a whole week for the next episode of your favourite TV show. Now we can watch the whole series in one sitting — and many of us do. With the advent of streaming platforms like Netflix, Amazon and Hulu, binge-watching has become the new normal. But this new habit of watching hours of back-to-back television could take a toll on us — particularly when it comes to sleep.

The Netflix Effect

People justify spending time in the evening in front of a television or computer for many reasons. A lot of people want to relieve stress from a hard day at work or just take some time to slow down for the night. Everyday households with a Netflix account can sit down in front of a television, start watching a series and escape from reality. But suddenly, hours and hours have gone by and the one episode the household sat down to watch has now become many episodes. This problem of people losing track of time while watching series television shows is being called the “Netflix Effect.” People find that they cannot just watch one episode of a show because they have to find out what happens next. Then people find that they cannot just watch one season of a show because they were left hanging and need to find out what happens next. After hours and hours have passed sitting in front of a television or computer, some households are now asking whether or not watching Netflix is a positive way to relieve stress or if it is taking up most of their free time.

According to reports, teens, adults, and even children are being impacted by the “Netflix Effect.” The disadvantages for teens who binge-watch television include slipping grades, being late to work or class, not going outside to be active thereby gaining weight, and closing themselves off from having a social life.

Netflix and Chill

Online video streaming and Netflix have become popular among college crowds. Now that I am a college student and living in a college community, I can see firsthand the effect these online streaming networks have on friends and fellow students. There is not a real definition for the term “Netflix and Chill.”  The understood meaning goes something like this: invite someone of the opposite sex over, pick a random show from Netflix, start watching the show, and then…

Conclusion

In conclusion, Netflix has become something that affects many lives in many areas. This new idea of binge-watching television or online series is robbing people of valuable time that they can never get back. Average households are dealing with the “Netflix Effect” while colleges deal with the “Netflix and Chill” concept of dating, and workplaces struggle to get their employees to work. But, watching Netflix does not have to turn into something negative. Netflix can be a good stress reliever and create family fun time. It is a great source for watching movies or even catching up on some of the favorite shows. The challenge is about finding enough self-control to create a healthy balance between relaxation and wasting time. Watching Netflix, like anything, just needs to be done in moderation.
