The modern state of India still has one of the largest employed workforce in the textile sector, and a large part of it is the handloom industry – which is mostly worked in by the artisans who are either poor or are working hard to preserve their traditional way of manufacturing clothes and designs. For India presents a rainbow in manufacturing methods – right from the famous Benarasi Saree to the now almost extinct methods of making silk and woolen garments in the remote hills of Ladakh and Kashmir.

Cotton has been cultivated in the Indian subcontinent for over 3000 years. And that is probably also the age of a rich tradition of fabric making. With the advent of the bronze age through the influx of Greco-Roman, Mongol, Iranian, Vedic and Afghan cultures into the modern age of Mughals, Marathas, British and later the republic of India and her neighbours – the Indian textile industry has seen a plethora of changes and demand.

Handloom has a great symbolic importance to India. For it was the first Industry that stood as a symbol of self-reliance during the British Raj resistance period, a rhetoric the current Indian Prime Minister used in his Atmanirbhar Bharat campaign. Handloom products are often costly than the cheap produce of the machines that invaded the textile industry 200 years ago, effectively ushering in the Industrial Revolution in the 17th century England.

Back to India, here is a list of some famous Indian handloom industries and the cities in which they are concentrated.

  1. Varanasi – The famed Banaras Silk sari is the prized possession of many north Indian women as that is the standard sari of the bride in marriages in households that can afford them. And yet, the Benarasi artists are increasingly been replaced by machines that are producing cheaper saris though with reduced finesse.   2. Jaipur – Jaipur and its handloom industry have the royal family of Jaipur as its patrons. There are establishments and shops that were opened by the last Rajmata of the city, Gayatri Deviji to promote local industries. To add to that is the already existing tradition of Bandhni, Zari and Patti works.
  3. Surat – One of the oldest textile industries that were spotted and used by the local rulers and the British alike. The silk industry in Surat is one of the largest of its kind in the country.
  4. Kota – The tuition capital of the country is also home to the Kota Doria, Gotta Patti and the Kota weave artisans.
  5. Lucknow – The city has an industry that keeps alive the times when nawabs ruled over the city of Lucknow, the then capital of the Awadh state. Most famous of its local weaves is the Chikankari work.
  6. Bhadohi – The small town is only 40km from Varanasi and has been the centre of Indo-Persian carpet work since the era of the Mughal Emperor Akbar and has the largest carpet making industry in the country.

Well, there are many more of such cities and villages when one researches about them. Many of the ingenious art forms that are involved in making clothes are dying with less than 50 families left that carry forward the tradition. The sad part – machines cannot replicate that finesse. Such is the case of the wool and silk industry in the Gharwal and Kashmir valleys.

After the pandemic or even during it, let us and our government support this remnant of our history, our art, our tradition and a symbol of first instance of our modern industrial self reliance.

Clothes shopping used to be an occasional event—something that happened a few times a year when the seasons changed or when we outgrew what we had. But about 20 years ago, something changed. Clothes became cheaper, trend cycles sped up, and shopping became a hobby. Enter fast fashion and the global chains that now dominate our high streets and online shopping. But what is fast fashion? And how does it impact people, the planet, and animals?

It was all too good to be true. All these stores selling cool, trendy clothing you could buy with your loose change, wear a handful of times, and then throw away. Suddenly everyone could afford to dress like their favourite celebrity or wear the latest trends fresh from the catwalk.

Then in 2013, the world had a reality check when the Rana Plaza clothing manufacturing complex in Bangladesh collapsed, killing over 1,000 workers. That’s when consumers really started questioning fast fashion and wondering at the true cost of those affordable t-shirts. If you’re reading this article, you might already be aware of fast fashion’s dark side, but it’s worth exploring how the industry got to this point—and how we can help to change it.

What is fast fashion?

Fast fashion can be defined as cheap, trendy clothing that samples ideas from the catwalk or celebrity culture and turns them into garments in high street stores at breakneck speed to meet consumer demand. The idea is to get the newest styles on the market as fast as possible, so shoppers can snap them up while they are still at the height of their popularity and then, sadly, discard them after a few wears. It plays into the idea that outfit repeating is a fashion faux pas and that if you want to stay relevant, you have to sport the latest looks as they happen. It forms a key part of the toxic system of overproduction and consumption that has made fashion one of the world’s largest polluters. Before we can go about changing it, let’s take a look at the history.

How did fast fashion happen?

To understand how fast fashion came to be, we need to rewind a bit. Before the 1800s, fashion was slow. You had to source your own materials like wool or leather, prepare them, weave them, and then make the clothes.The Industrial Revolution introduced new technology—like the sewing machine. Clothes became easier, quicker, and cheaper to make. Dressmaking shops emerged to cater to the middle classes.

Many of these dressmaking shops used teams of garment workers or home workers. Around this time, sweatshops emerged, along with some familiar safety issues. The first significant garment factory disaster was when a fire broke out in New York’s Triangle Shirtwaist Factory in 1911. It claimed the lives of 146 garment workers, many of whom were young female immigrants. By the 1960s and 70s, young people were creating new trends, and clothing became a form of personal expression, but there was still a distinction between high fashion and high street.

In the late 1990s and 2000s, low-cost fashion reached its zenith. Online shopping took off, and fast-fashion retailers like H&M, Zara, and Topshop took over the high street. These brands took the looks and design elements from the top fashion houses and reproduced them quickly and cheaply. With everyone now able to shop for on-trend clothes whenever they wanted, it’s easy to understand how the phenomenon caught on.

How to spot a fast fashion brand

Some key factors are common to fast fashion brands:

  • Thousands of styles, which touch on all the latest trends.
  • Extremely short turnaround time between when a trend or garment is seen on the catwalk or in celebrity media and when it hits the shelves.
  • Offshore manufacturing where labour is the cheapest, with the use of workers on low wages without adequate rights or safety and complex supply chains with poor visibility beyond the first tier.
  • A limited quantity of a particular garment—this is an idea pioneered by Zara. With new stock arriving in store every few days, shoppers know if they don’t buy something they like, they’ll probably miss their chance.
  • Cheap, low quality materials like polyester, causing clothes to degrade after just a few wears and get thrown away.

What’s the impact of fast fashion?

On the planet: Fast fashion’s impact on the planet is immense. The pressure to reduce costs and speed up production time means that environmental corners are more likely to be cut. Fast fashion’s negative impact includes its use of cheap, toxic textile dyes—making the fashion industry the second largest polluter of clean water globally after agriculture. That’s why Greenpeace has been pressuring brands to remove dangerous chemicals from their supply chains through its detoxing fashion campaigns through the years.

Cheap textiles also increase fast fashion’s impact. Polyester is one of the most popular fabrics. It is derived from fossil fuels, contributes to global warming, and can shed microfibers that add to the increasing levels of plastic in our oceans when washed. But even ‘natural fabrics’ can be a problem at the scale fast fashion demands. Conventional cotton requires enormous quantities of water and pesticides in developing countries. This results in drought risks and creates extreme stress on water basins and competition for resources between companies and local communities.

The constant speed and demand mean increased stress on other environmental areas such as land clearing, biodiversity, and soil quality. The processing of leather also impacts the environment, with 300kg of cehmicals added to every 900kg of animal hides tanned. The speed at which garments are produced also means that more and more clothes are disposed of by consumers, creating massive textile waste. In Australia alone, more than 500 million kilos of unwanted clothing ends up in landfill every year.

On workers: As well as the environmental cost of fast fashion, there’s a human cost. Fast fashion impacts garments workers who work in dangerous environments, for low wages, and without fundamental human rights. Further down the supply chain, the farmers may work with toxic chemicals and brutal practices that can have devastating impacts on their physical and mental health, a plight highlighted by the documentary The True Cost.

On animals: Animals are also impacted by fast fashion. In the wild, the toxic dyes and microfibres released in waterways are ingested by land and marine life alike through the food chain to devastating effect. And when animal products such as leather, fur, and even wool are used in fashion directly, animal welfare is put at risk. As an example, numerous scandals reveal that real fur, including cat and dog fur, is often being passed off as a faux fur to unknowing shoppers. The truth is that there is so much real fur being produced under terrible conditions in fur farms that it’s become cheaper to produce and buy than faux fur!

On consumers: Finally, fast fashion can impact consumers themselves, encouraging a ‘throw-away’ culture because of both the built-in obsolescence of the products and the speed at which trends emerge. Fast fashion makes us believe we need to shop more and more to stay on top of trends, creating a constant sense of need and ultimate dissatisfaction. The trend has also been criticized on intellectual property grounds, with some designers alleging that retailers have illegally mass-produced their designs.

First and most importantly we should improve the grading system. Rote learning should be discouraged completely. Teachers and faculties should focus more on the analytical skills of the students and grade them accordingly. There should be more focus on comprehensive evaluation instead of scoring only good marks. Workshops must be organized for teachers on a regular basis to keep them updated about the latest developments in the sector of education. At the same time, the curriculum should be reframed according to the present needs of education in India. 

The payroll structure of the teachers and the faculties especially in the government institutions should be improved. This step will help in motivating the teachers to develop their skills and they will take a keen interest in grooming or shaping up a student’s life and career. The government and other entities who are associated with the education sector, need to understand the importance of quality of education. Education should be a holistic process that must focus on the overall development of the physical, emotional, social and cognitive skills of a child. Anatula Sudhakar v. P. Buchi Reddy

Statement of Facts

This appeal for special leave is by the defendant in a suit for permanent injuction. Puli Chandra Reddy and Puli Buchi Reddy were the plaintiffs in the said suit. Both the plaintiffs claimed to be the respective owners in possession of the said two sites having purchased them under two registered sale deeds dated 9.12.1968 from Rukminibai. When they were digging trenches in order to commence construction, the defendant interfered with said work. The plaintiffs filed a suit for permanent injuction to restrain the defendant from interfering with their possession. Defendant resisted the suit claiming that suit property measuring 300sq. yards in premises No. 13/776 was purchased by him from K.V. Damodar Rao, brother of Rukminibai. He had also obtained a loan for such construction from the Central Government by mortgaging the said property. According to him, when he commenced construction in the said property, the plaintiffs tried to interfere with his possession and filed a false suit claiming to be in possession.

Issues Raised

  1. Whether the plaintiffs are in exclusive possession of the suit sites?
  2. Whether the defendant has interfered with the possession of the plaintiffs over the split plots?
  3. Whether the plaintiffs are entitled to permanent injunction? And to what relief?

Critical Analysis

A step in the right direction was taken by the High Court in its judgement of Anatula Sudhakar V. P. Buchi Reddy. The High Court by its judgement dated 18.1.1991 allowed the second appeal and restored the judgement and decree of the Irial Court and consequently held that plaintiffs had established their title in regard to the two vacant sites purchased by them and drew an inference that possession was presumed to be with them by applying the principle of possession follows title. The HC also held that it was not necessary to plaintiffs to sue for declaration of title, as the question of title could be examined incidental to the question of possession.

There was some confusion as to what circumstances the question of title will be directly and subsequently in issue in the suit for injunction simpliciter. In Vanagri Sri Selliamam Ayyanar Uthirasomasundareswarar Temple V. Rajanga Asari AIR 1965, Madras High Court considered an appeal arising from a suit for possession and injunction. The defendant contended that the plaintiff had filed an earlier suit for injunction which was dismissed, and therefore the plaintiff was precluded from agitating the issue of the title in the subsequent title suit, being barred by the principal of res judicata. It was held that the earlier suit was only for injunction and the averments in the plaint did not give rise to any question necessitating denial of plaintiffs title by the defendant, and as the earliest suit was only concerned only with possessory right and not title, the subsequent suit was not barred. There are several decisions taking similar view that in a suit for injunction, the question of title does not arise or would arise only incidentaly or collateraly, and therefore a subsequent suit for declaration oof title would not be barred. The judgement by the High Court has stated an effective decision and restoring the decree of the trial court in favour of the plaintiffs that the plaintiffs and their witnesses gave evidence to the effect that Damodar Rao represented that his sister Rukminibai was the owner of the plot and negotiated for the sale of the several portions thereof in favour of the plaintiffs. Further, where title of plaintiffs is disputed and claims for possession is purely based on tiltle, and the plaintiffs have to rely on various principles of law relating to ostensible ownership and section 41 of TPA, validity of an oral gift by way of ‘Pasupu Kumkumam’ under Hindu Law, estoppel and acquiescene, to put forth a case of title, such complicated questions could properly be examined only in a title suit, that is a suit for declaration and consequential reliefs and in a suit for an injunction simppliciter.

State of Haryana v. Bhajan Lal and Others

Statement of Facts

The first Respondent was a minister and subsequently Chief Minister of Haryana State. Later he became Union Minister. Bhajan Lal at the same time of the case was the Union Minister of Environment and Forests and Devi Lal was elected as the Chief Minister of the State of Haryana. In the same election Respondent 2, Dharam Pal lost the election against Smt. Jasma Devi, wife of Bhajan Lal . Owing to various political rivalries and institutions of various criminal cases there was a lot of bad blood between Bhajan Lal and Devi Lal. Consequently, Respondent 2 placed a complaint before the CM, Devi Lal against Bhajan Lal where he alleged that Bhajan Lal possesses disproportionate property or pecuniary resources compared to his indefinite sources of income. It was also alleged that the accumulation of that much property was far beyond his legal means. Special officer on duty in CM’s secretriat passed the message to the office Director General of Police stating that the CM has sought appropriate action in the said case. The complaint was further passed on to the Superintendent of Police (SP) asking for the necessary measure to be taken and report back. The SP asked the SHO (Station House Officer) to register the case and investigate. Subsequently, a case was filed under Sec. 161 and Sec. 165 of the IPC and Section 5(2) of the Prevention of Corruption Act in November 1987. The copy of the FIR was then sent to the magistrate and the investigation was started.

Issues Raised

  1. Whether just the allegations are enough to constitute a cognizable offences and give the power of investigation to the police?
  2. Whether the action of investigating on the part of SHO on just the order of one word “investigate” from SPis enough as per Sec. 5 of Prevention of Corruption Act, 1947?
