Know about how to voice for your rights, legal bounds, and solve wrong conducts or mistakes by legal officials.

Writs! What do you mean by writs?

In common law, a writ is a formal written order issued by a body with administrative or judicial jurisdiction; in modern usage, this body is generally a court. Warrants, prerogative writs, and subpoenas are common types of writ, but many forms exist and have existed.

Why are Writs needed?

It is a constitutional remedy available to a person to bring his complaint or grievance against any administrative action to the notice of the court.

Types of Writs:

  • Writ of Habeas Corpus
  • Writ of Mandamus
  • Writ of Certiora
  • Writ of Prohibition
  • Writ of Quo-Warranto,

WRIT OF HABEAS CORPUS

It is also known as the “great writ”

Habeas Corpus means “Let us have the body.”. In other words, it means “you may have the body” which means that a person under arrest is to be brought before a judge or into court. It is an important writ for personal liberty. A person, who is arrested, can move the Court for the issue of Habeas Corpus.

It is an order by a Court to the detaining authority to produce the arrested person before it so that it may examine whether the person has been detained lawfully or not. It ensures that a prisoner can be released from detention if the Court is convinced that the person is illegally detained—that is, detention lacking sufficient cause or evidence.

The person under arrest or any another person on his behalf can file a writ in this. Formal and informal applications in respect of the writ is accepted by the Courts. It is only a procedural remedy and does not necessarily protect other rights, such as the entitlement to a fair trial. A person cannot make the application for the Writ successively to different judges of the same court.

In India, writs are issued by the Supreme Court under Article 32 of the Constitution of India and by the High Court under Article 226 of the Constitution of India.

Writ of Mandamus:

Mandamus means “We Command”. Mandamus is an order from a superior court to a lower court or tribunal or public authority to perform an act, within its duty. In short, it is an order to perform a duty which should have done but failed to do so.  It is the discretionary power of a court. It is simply to ensure rights are ensured and the Government Authorities perform their duties.

The writ of mandamus can be granted when there is right to compel the performance of some duty cast upon the authority. It can also be issued to public authority to restrain it from acting under a law which has been declared unconstitutional. The petitioner has a right recognized by law.

The writ cannot be granted when

  • Duty is not compulsory.
  • Against a private individual, private organization since they are not entrusted with public duty.
  • To enforce an obligation arising out of contract.
  • Where the right of the petitioner has lapsed

Writ of Certiora

Certiorari means to be certified. The Writ of Certiorari can be issued by the Supreme Court or any High Court for retracting the order which is already passed by an inferior court and to properly investigate the matter and opinions objectively. A writ of certiorari is only granted when a Court has acted without or in excess of its jurisdiction and For correcting error of law. It cannot lie to remove merely ministerial act or to remove/cancel executive administrative acts. It is corrective in nature which means the purpose of this Writ is to correct an error.

When there is an error apparent on the record, it becomes a valid ground for issuing the Writ of Certiorari.

Certiorari can be resorted to only after the order or decision has been announced.

Writ of Prohibition

Writ of prohibition means to cease or to stop. it is also known as a ‘Stay Order’. When a lower court or a body tries to perform an action outside its jurisdiction, This Writ issued by a superior court to lower court or a tribunal to prohibit or forbidden it to do so. The Supreme Court can issue this Writ only where a fundamental right is affected.

In cases where the court is partly acting within its jurisdiction and partly outside it, the Writ will be issued against the act which is partly outside its jurisdiction. This Writ can be issued only when the proceedings are pending in the inferior court and not when an order has already been passed by that court. The Writ of Certiorari can be issued only when the order has passed.

Writ of Quo-Warranto

The word Quo-Warranto literally means “by what warrants?” and ‘by what authority’. It is issued restraining a person from acting in a public office to which is out of bounds. The business or the office in question is public office. The issue of summon is followed by legal proceedings, during which an individual’s right to hold an office or governmental privilege is challenged.

Grounds on what it is issued.

Emily Dickinson – An intellectually Rebellious and the most memorable poet of all time.

About Emily Dickinson, her writing style, favorite works and Amazing facts about her. Dickinson Series- Apple TV

Emily DIckinson

Birth, inspirations, and how her works were saved.

Emily Dickinson was born on December 10, 1830, in Amherst, Massachusetts. She attended Mount Holyoke Female Seminary in South Hadley for one year. Dickinson’s poetry was influenced by the Metaphysical poets of seventeenth-century England. She also read Book of Revelation, admired the poetry of Robert and Elizabeth Barrett Browning, and John Keats. She was dissuaded from reading the verses of Walt Whitman (Due to his daring writeups). Yet Walt Whitman and Emily Dickinson ending up being two of the most famous poets from the time period who revolutionized both the subject and style of American poetry. The first volume of her work was published posthumously in 1890 and the last in 1955. She died in Amherst in 1886. Dickinson’s family found forty volumes of nearly 1,800 poems (or “fascicles”).

Dickinson assembled these booklets by folding and sewing five or six sheets of stationery paper, what seem to be final versions of poems. The original order of the poems was not restored until 1981, when Ralph W. Franklin used the physical evidence of the paper itself to restore her intended order. He relied on smudge marks, needle punctures, and other clues to reassemble the packets.

The Manuscript Books of Emily Dickinson (Belknap Press, 1981) is the only volume that keeps the order intact.

Her Writing Style:

Her features were of verse forms suggesting hymns and ballads, with lines of three or four stresses. Her unusual off-rhymes have been seen as influenced by the 18th-century hymnist Isaac Watts. The intellectual content of her work amazed many and her writings were exceptionally and beautifully bold and original. Her verses has distinct quality by their epigrammatic compression, haunting personal voice, enigmatic brilliance, and lack of high polish.

Her major themes include nature, law, music, commerce, medicine, fashion, finding oneself, death and immortality, and love. She had a unique usage of Capitalization. She is best known for her use of slant rhyme.

Facts:

  • Unconventional approach to poetry, she interspersed her writing with many dashes of varying lengths and orientations (horizontal and vertical)
  • She could play piano.
  • She called herself a pagan.
  • She had an older brother named William Austin and a younger sister called Lavinia.
  • She wrote about the benefits of science over religion.
  • She lived with her family throughout her life. She shared her poems via letters to Susan, her alleged love interest. Who became her sister-in-law later.
  • She sent 250 poems.
  • Dickinson was a fan of the book ‘Jane Eyre’.
  • Her sister and Mabel Loomis Todd (An alleged mistress) published her works after Dickinson’s death.
  • Her second Tombstone reads “Called Back”, reference to an 1880 novel by Hugh Conway called “Called Back” that Dickinson enjoyed loved. This was the idea of Martha Dickinson Bianchi, her niece. The reason could be that she wrote a letter to her cousins before her death to her cousins which had only “Called Back” written.

Emily Dickinson’s well-known must-reads!!

  1. I’m Nobody! Who are you?
  2. Because I could not stop for Death
  3. Success is Counted sweetest
  4. Wild nights – Wild nights!

  6. I Felt a Funeral, in my Brain

Emily Dickinson and Susan Gilbert

Ps… Dickinson is believed to have a lifelong love affair with her childhood friend Susan Gilbert, who agonizingly became her sister-in-law. Emily had written many letters to Susan till the end. The letters are believed to be indirect confession and expression of love. Austin’s mistress Mabel Loomis Todd -Editor and publisher- erased references to Susan from Emily’s letter, but the fact that the Mysterious “Master” poem – letters (Alleged love interest of Emily) were sent to Susan, doesn’t hide much. But, well historians will still call them “Best Friends”, right?

There’s a book called “Emily Dickinson’s Intimate Letters to Susan Huntington Dickinson”

Summary: For the first time, selections from Emily Dickinson’s thirty-six year correspondence to her neighbor and sister-in-law, Susan Huntington Dickinson, are compiled in a single volume. Open Me Carefully invites a dramatic new understanding of Emily Dickinson’s life and work, overcoming a century of censorship and misinterpretation.

WARLI PAINTINGS – Indigenous Age-old Tribal Art

Origin of Warli, it’s history and significance, how to read the paintings, and few fun facts about Warli Paintings will be discussed here!

Warli painting is a tribal form of art and one of the famous Indian Fork Art, traced back to 10th Century AD. These paintings use a set of basic geometrical figures and common shapes like lines, circles, triangles etc, which represents the Mother Nature. Warli is the name of the largest tribe found on the northern outskirts of Mumbai, in Western India

Yashodhara Dalmia, in her book ‘The Painted World of the Warlis’, claims that Warli tradition goes way back to 2500 or 3000 BCE.

Warli painting, being a Tribal and sacred art, originates from North Sahyadri ranges encompassing Dahanu, Talasari, Palghar, Mokhada and Jowhar which is situated in the state of Maharashtra. Warli paintings were drawn by woman on the occasion of the marriage ceremony.

White colour is mostly used for painting with occasional use of yellow and red dots and they are painted on an austere mud base. The white colour is made by putting together rice paste and water with gum acting as a binding agent. Bamboo stick with one end chewed was used as a paint brush. They are usually painted on an austere mud base or on mud walls of the houses.

These paintings serve as a medium of expressing and depicting the social and religious aspirations for the local people. Unlike most traditional art forms, warli was/is not used to depict mythological characters or images of deities but to show the respect towards Mother Nature.

Maharashtra is known for its Warli folk paintings.

EVOLUTION OF THE WARLI PAINTING

At present, the background of the painting has been replaced from mud walls to paper or fabric for show casing in exhibitions. The simple yet beautifully delicate patterns and the intricate geometric patterns of the walri style is quite popular among home decors and fashion designers due to the certain appeal to the contrasts of the colour. Warli Art was first discovered in the early seventies dating as early as the 10th century A.D.

Jivya Soma Mashe, the artist in Thane district has played a great role in making the Warli paintings more popular. He has been honoured with a number of national and central level awards for his paintings. In the year 2011, he was awarded Padmashree

Believed that Warli paintings invoke powers of the Gods and represent a sense of togetherness.

HOW TO READ WARLI PAINTINGS

Circles represent the Sun and the Moon while Triangles represent mountains, trees, while human along with animal bodies are drawn with inverse triangles joining at the tip. The upward facing triangles represents the male while downward represents the females. The squares represent a sacred enclosure for the mother goddess symbolizing fertility. A straight line is never seen in Warli art. One of the central aspects depicted in many Warli Paintings is the Tarpa dance. Tarpa means a trumpet like instrument is played in turns by the villagers. The participants entwine their hands and move in a circle around the Tarpa player.

Warli art to some extent makes one think of being environmentally conscious and finding joy in simple things of life. Warli people worshipped Nature and were dependent on nature for food and water supplies. They did not believe in disrupting nature or taking more than needed. The Warli people believe in harmony between nature and man and these beliefs are often reflected in their paintings.

Coca-Cola India launched a campaign featuring Warli painting in order to highlight the ancient culture and represent a sense of togetherness. The campaign was called “Come Home on Deepawali” and specifically targeted the modern youth. The campaign included advertising on traditional mass media, combined with radio, the Internet, and out-of-home media.

International Cat Day!! 8th August 2021!

Theme this day and importance. Ways we can adopt, protect, and cherish our feline friends, and Important facts to know about them.

Theme : ‘ BE CAT CURIOUS’

Cats: Fluffy, mature, savage, intellectually and emotionally sharp, and blessed divine gifts. Besides my intense love for them let’s dive into some scientific knowledge about cats. The cat is a domestic, small carnivorous mammal. It’s Binomial Name is Felis Catus. Often, they are called Domestic Cats to distinguish them from the Wild Cats. Usual types of cats: Farm cat, a house cat or a feral cat. Around 7500BC, Cats are known to be first domesticated in the Near East especially in the Ancient Egypt.

Cats have inborn hunting and territorial characteristics. it’s very, very important for them to survive. Being wary of humans and other animals helps them not to fall in the traps of horrific poachers and deadly animals. There are terrible people who lure cats in just to torture, sell your pets by kidnapping them, and all of this just for alleged “Fun” or “Money”. Abuse surrounding feline creatures have been growing. You can not only protect your cat partners but also donate, foster, food drive, neuter drive, and protect animals around you as well. Remember that your one act of kindness gives a safe home for cats. It isn’t necessary to care for them by bringing them home.

First time celebrated in 2002 by the International Fund for Animal Welfare (IFAW), Canada

IMPORTANT NOTE: For their safety and wellness, make sure your cat wears a safety collar and an ID tag.

Cats are naturally curious and love to explore. Due to vehicles (Crossing road or sleeping under cars for shade), poachers, coyotes, owls, and what not. Obviously, we don’t want to rob outside life from cats just to keep them completely safe since indoor things or genetic diseases can hurt them as well.

It is always better to train them about goods and bad, cat-friendly leashes for walking if they like it, and taking precautions. You can take following steps to care for them:

  • Build an outdoor Catio.
  • Do not put bells on their collars
  • Have a back-up caretaker, like a neighbor(Not completely), siblings, or a trusted friend.
  • VACCINATIONS! VACCINATIONS like rabies, feline leukemia and feline distemper vaccine.
  • Always leave a bowl of extra food and water before you go out.
  • Tend to injuries immediately.
  • GET AN ID TAG! An ID tag has the cat’s name and your phone number.
  • Do not declaw very often They need it to protect themselves.
  • Neutering cats might feel a little extreme, but it is for their own safety.
  • Get acknowledged with flea-, tick-, and intestinal parasite–preventive medications with veterinary directions. About 250 heritable genetic disorders have been identified in cats,

Aim is to enable and inspire people to understand cats’ individual needs and perspective, and to act in the interests of each cat’s welfare. We do this by creating and sharing knowledge, insights, skills and current best practice so people can feel confident in their ability to help cats and to challenge ignorance and misconceptions,

You need to learn how to select your thoughts just the same way you select your clothes every day.

Summary:

Elizabeth Gilbert’s perfect world comes shattering down when she gets divorced. She then embarks on a journey across the world in an attempt to rediscover her true self.

Book adapted from: Eat, Pray, Love: One Woman’s Search for Everything Across Italy, India and Indonesia

“Happiness is the consequence of personal effort. is the consequence of personal effort. You fight for it, strive for it, insist upon it, and sometimes even travel around the world looking for it.

Review:

Liz Gilbert- a women in a subtly failing marriage, successful life, and a safe home. She has everything one dreams about. She hits the stage of crisis in faith and realizes hard truths of her marriage. She leaves him and travels around Italy, India and Indonesia to find herself. Doing so isn’t easy. She hits roadblocks and understands that she, herself is her biggest hater.

Liz went to Bali for a Yoga magazine work, and she met Ketut Liyer. He reads her palm and lays out her near future. He inspires her to travel to know answers to her questions. She regains her love for cuisine, her body, her likes, and her dislikes. After meeting and conversing with people she meets in Italy, her love for food and meaning of life starts building. The notion of perfect body, extreme diet, and insecurities one might have about their body is pondered upon here.

She visits her guru’s ashram, introduced by David, a short love-interest she had after her divorce. Her initial days at ashram is challenging. She meets Richard from Texas, who gives her a push in understanding the true meaning of meditation and life here.

Instead of trying to forcefully take your thoughts out of your mind,  give your mind something better to play with. Like pure divine love.

She then tries to focus her prayers on someone and find more meaning to “Praying“. She then decides to stay there for few more months. Richard helps her to find freedom- letting go, forgiving- and resolves things between her and her ex-husband. She is greatly affected by meditating in Ashram. The Author has left 2 poems to express gratitude.

“I’m here. I love you. I don’t care if you need to stay up crying all night long, I will stay with you. If you need the medication again, go ahead and take it—I will love you through that, as well. If you don’t need the medication, I will love you, too. There’s nothing you can ever do to lose my love. I will protect you until you die, and after your death I will still protect you. I am stronger than Depression and I am braver than Loneliness and nothing will ever exhaust me.”

She visits Bali, Indonesia to meet Ketut Liyer again, She meets Felipe and her journey to refine the meaning of “Love” and trust again begins.

“Happiness is the consequence of personal effort. You fight for it, strive for it, insist upon it, and sometimes even travel around the world looking for it.

This movie, book and several more books by Elizabeth Gilbert is going to be a part of my life forever. The moment we let ourselves be receptive to healthy thoughts, they are bound to be grown when you nurture them occasionally with love and faith. Even the slightest beam of sunlight (Metaphors for faith and hope) is enough to keep you going, trying again and again without pondering over growth rate compared to others. Go with your own pace.

it is a book and a movie which you must see and read at least once.

Top 6 (+1) “Intellectual” Horror Movies / Series

Let’s explore the world of horror which is mixed with smart storyline, twists, simple yet effective jumpscares. Mike Flanagan’s horror mocies are a must see!

The types of horror movies in this list will not just be mere ghost sightings, lights flickering, and terrible ghostly faces. You will encountering some Nolan-like concepts, twists; action, psychological twisters, concepts will scare you in an unusual way. There’s no knowing what you will find spooky or give a rush of adrenaline alongside the characters. Let’s dig in.

Also, skip the trailers. Probably read the summary and go for it. Nowadays, most of the spoilers are given in the trailers itself.

The Haunting series

The Haunting is an American television anthology series created by Mike Flanagan and produced by Amblin Television and Paramount Television, for Netflix. The first season is titled The Haunting of Hill House and the second, titled The Haunting of Bly Manor.

The haunting of the Hill House

The haunting of the Bly manor

Well, let me talk about Mike Flanagan. Over the period of time, I have fallen in love with his unique set of horror films. He gives a new definition to the meaning of horror. I found both these series, especially The Haunting of Hill House, lethally amazing. The twists, jump scares (One of the best jump scare I have ever come across), character growth, expertly connected forth and back storylines, flashbacks, and again twists. I got hooked it to it the moment I started seeing it. Each one of the actors are amaze!

The Haunting of Hill House, is loosely based on the 1959 novel of the same name by Shirley Jackson. The future, present and past are all connected which led the family to the mansion, to stay in mansion, paranormal activities ….Everything is connected. There are less words to describe how much I loved this series.

The Haunting of Bly Manor, to be based on The Turn of the Screw by Henry James. There is no connection between the Hill House and this. The story tells of a young au pair hired by a man to look after his niece and nephew at the family country house after they fall into his care. Arriving at the Bly estate, she begins to see apparitions that proceed to haunt the premises. It is again an intellectual piece, there are flashbacks, twists, unexpected occurrences with a sad ending. Although it is a completely horror film, it has it’s own share of gothic vibes.

Ready or not

After the wedding ceremony of a young woman, her new in-laws force her to participate in a seemingly innocent game. Things soon turn bloody and sinister, revealing the sick rituals of the family. It is a mandatory Hide & Seek game whereby each new spouse must pass a kind of postnuptial initiation. People are literally equipped with crossbow, pocket pistol or battle ax. It is obvious that no one is going to think that a certain family is going to take “Till Death do us apart” so seriously. The family is held together by this silly and horrific ritual. The one who gets to hide and is to be sought, the family is obligated to kill them before. If not, deadly consequences wait for them. Yes, not killing them is going to get them killed, ridiculous right? But well, when you see this crazy family being scared out of their life for having missed to shoot her or something, sums up pretty well that you are are about to go on a ride of Dark Humor, crazy humans with their crazy weapons.

Amidst this craziness, the amazing actress Samara Weaving, portrayed her character through and through. This movie is has also highlighted crazy richness, statuses, etc. in a exaggerated way of course. The reason I put this this in this list is because of her acting and all the ways she defended herself, especially in a bridal attire. For me, the hunt, plot, acting were top-notch regardless of few clichés. But, it is a totally different, new, and unique horror movie out there.

Host

Six friends accidentally invite the attention of a demonic presence during an online séance and begin noticing strange occurrences in their homes. Yes, I know séances over zoom and demonic activities sound impossible and a recipe for disaster. Personally, I am rarely spooked out, but this movie did give me few chills. In this world, where we do use zoom to attend colleges, meetings, seeing a movie made completely over Zoom gives you a totally different experience. Host, do not get confused with other Host movies, it is like a short film which was released by SHUDDER.

This movie was made on Zoom and the actors use their own lights as well. You will be hit with weird occurrences through the screens, filters on invisible ghosts, footprints on floor(Flour :p). If you want a short spooky movie, do see it in a dark from. Yes, I did it and it’s probably the reason for my chills. Nevertheless, it gives you the feeling of being in the same page with movie.

Oculus

A recently released inmate from a mental asylum learns from his sister that the murders he was convicted of committing were actually orchestrated by a supernatural entity, the Lasser Glass mirror. It is a American supernatural psychological horror film co-written, edited, and directed by Mike Flanagan.

It is not just your typical horror movie, it is an elegant piece of art; psychological thriller, and again a unique masterpiece by Mike Flanagan. As you go through the movie, you experience what they experience, you see what they see, and realize what’s happening alongside them. There are many baffling scenes, some will make your skin crawl (Not extremely in a bad way). In the end, you are just amazed and shocked by what you have seen. You also might want to punch the brother now and then.

Insidious

Insidious is a series of American horror films created by James Wan and Leigh Whannell. There are four films in the franchise—Insidious, Insidious: Chapter 2, Insidious: Chapter 3, and Insidious: The Last Key. The franchise is very well known. Each of it’s films have a plot, punches of adrenaline rush and some jumps scares.

The one that really really got my attention was “The last key” film. It is where Elise, the somewhat paranormal expert has to visit her childhood hellhouse. The demon has the power to posses one and make him act and do bad things. They have the power of completely muting someone. The connection between this and other movie in this franchise is astonishing. The jump scares are not that cliché. Overall, if u do want to watch something with quick pace, this film could be goof for you.

Lights out

Rebecca and her boyfriend try to investigate the connection between her mother and her imaginary friend, Diana, after her stepfather is murdered by a supernatural entity. This movie connects psychological wellbeing and paranormal entity to a different level. Also, it took our childhood memories of balancing on and off button in a completely bizarre way. It is basically spooky of when you can see Diana, demon with lights off. It is actually an evil concept.

It does have some really spooky, emotional, and crazy scenes. If you want a light yet scary movie to watch (At night, yes). It is a spooky movie with a simple yet functional execution. But, I do not agree with psychological use in here. Other than that, why not see all the movies for yourself and have a fine collection of spooks.

Bonus Suggestion: HUSH by Mike Flanagan. Yes, him again.

International Tiger Day

Today is International Tiger Day – 28th July 2021. It’s significance and theme this year.

Theme this year: “Their survival is in our hands”.

The day is observed to spread awareness about dangers faced by tigers, the threat to their natural habitats due to natural or man-made reasons, to protect them from poachers. Wild tiger numbers dropped by more than 95% since the beginning of the 20th century.

Over 18 States in India provide habitat for tigers. 70% of the total number of tigers in the world are in India. National Tiger Conservation Authority (NTCA) and the Wildlife Institute of India (WII) have mapped 32 major tiger corridors and several smaller ones. (By: ANI)

It has been reported that the number of India has increased over time due to active actions by local community. Reportedly approximately 3,900 tigers now. It is reportedly also known that many tigers live in cage rather than out in wild.

The tiger is officially declared as endangered by the IUCN.

Tiger daywas celebrated first in 2010 at the Saint Petersburg Tiger Summit in Russia.13 tiger range countries came together to create Tx2, the global goal to double the number of wild tigers by the year 2022. Government officials, citizens, celebrities and many organizations from all over the world came together and showed the tiger range countries that there is worldwide support for tiger conservation efforts and to encourage the Tx2 goal.

“Doubling tigers is about tigers, about the whole of nature – and it’s also about us”

Marco Lambertini, Director General WWF

WWF has contributed greatly to this cause. Animal adoptions, funding local communities to help them in tiger conservation, reducing poaching, and creating awareness by letting people be in proximity of this beautiful and ferocious animal to encourage them to take actoins.
