Race: today’s generation!

As I’m going to start this blog I would love to say everyone is perfect in their own personality, in their own perspective, in their own decisions. So it’s been a long time I had passed my school and now persuing my passion (not a course) ‘my passion’ so let me tell what is the main topic I’m talking about but firstly I’ll tell you a story which is real, so I was studying in 10th and one of my closest friend I can’t revel his name but his intrest was in painting and then he was confused that ‘bro what should I take as a stream in 11th’ so I told him what you love or in which you have your interest, but he said my father is telling me to take PCM (science, math) and he wants to take humanity but he was confused because his dad said if you’ll took humanity then there’s no future! And his dad told him take science-maths and then you cout prepare for IIT and he took science-math and just because he want to become a engineer and want to earn money! And he wasn’t happy as he wasn’t able to paint because of his studies and he wasn’t that good in studies so he was trying very hard but I said why I mean if you love to paint and you wanted to take humanity as your stream then did you took science and math just for the sake of money and even you don’t have intrest in science maths then why and he said because of my father. And this is my experience ladies and gentlemen he took science and maths he studied very hard and gave the exam for jee and he failed because he wasn’t having that intrest in PCM. And on the other hand he haven’t painted for more than a year and when he gave his exam and came back home he took his brush and painted and I’ll that art was one of the best of my friend as he hasn’t painted for a while which is more than a year but,

As i said ‘IF YOU HAVE INTREST IN A PARTICULAR FIELD, YOU’LL DEFINITELY WIN’ but if you don’t have intrest in that particular field you’ll definitely lose doesn’t matter who much you work upon it ‘HAVING INTREST IS THE TOP FACTOR’

For example, if you don’t love to cook and your mom said son just cook tonight’s dinner and you know how to cook but you hate it than Tonight’s dinner would be for the dustbin. I’m damn sure! I don’t love to paint and if you’ll say please make my sketch. Then I don’t know what I’ll make but after making that Sketch you’ll disown me I know.

But why you guys just want yurselves to put yur souls, your hard-work, your precious time and obviously money, in those things where you don’t have any Intrest in. My today’s generation just want to become a engineer, doctor, or a IAS.

Okay so, let’s take an assumption, if my friend was passed in that jee exam and he was selected in a college and becomes an engineer and was doing his job properly but what do you think he used to be happy and prosperous okay if you was at his place were you used to feel good and happy. Guys invest yourselves in those materials where you’re good at and where you’ll love your thing. Its not about that we should not listen to our parents but sometimes we should listen to ourselves too.

Learn something every day, important or not

Human is one of the most powerful creatures on this planet. Have you think what makes us different from others, we are also an animal, then what is difference between us and other animals. According to evolution, there are lots of species that came on this planet and after some time they destroyed and their places were occupied by another one.

This is the basic nature of the universe. But what is the unique thing about the human species, God also gives brains to the other animals and there are so many examples that prove that every animal has its unique nature.

Have you think that how we human-dominated on this planet what is the uniqueness about us, you become amazed that all animals have a mind, size different, difference in the complexity of the brain, but God give brain to all the species, of this world.

There is some uniqueness, and that is learning power, the capacity of thinking, I think these two things create differences between us and other animals. I am not talking about overthinking, this is our gift to us.

Why learning is important in our life, and what is the limit of it.

Learn something every day, this is the best and one of the most important things that we do in our life So, in this post, we discussed the importance of learning, and how we can learn something every day.

1) when you try to learn one thing every day unconsciously you change yourself every day,

2) when you have a learning mindset, you can not only learn from the positive things but also from the negative things

3) you have to develop the habit of learning something every day, due to this, you not only change yourself but also your surrounding atmosphere.

4) if you want to learn something, you are not required something so extraordinarily, you can learn with small things also.

5) have you try to find out that why we bored with this life after some time, because with time we remove the habit of learning something from our life, and due to this, the whole aura is the same in our life.

6) try to learn one thing every day for 1 week and after that take some time and you become amazed that how you are changed in your life, not only you will change, your life will also change.

7) this is the rule of life, you have to accept changes in your life,

8) in reality, if you see your life problem, they are not problems they are the opportunity to learn something.

9) how many of you notice that what is the difference between a normal person or someone who achieved something in life, between a happy person and the sad one

There are so many problems in our life, but the difference between a happy person and a sad one is that the happy one understands that problems are the nature of life, so why waste your precious time blaming God or some other, but on another side sad one will

always blame others for their conditions.

10) you can easily learn the basic rules of life from your own life, you can learn from your failures, your habits. You always have one problem that whenever you try to forget something, that things recall more and more time, you get one thing never try to forget it try to learn something from that particular and after that, you will that, your past will never affect you in your life. because at this time you are not running from your fears, you are facing them and they are from you.

I think this is the rule of life

‘When you are running from someone, they will run after you but when you start to run for them, they will run from you’

WANT TO TRANSFER PROPERTY TO AN UNBORN?

TRANSFER OF PROPERTY TO AN UNBORN PERSON

Unborn person means a person who has not come into existence.

As a general rule, a property can be transferred between the two living persons that means persons should be in existence at the time of the transfer of the property.

Section 5 of the Transfer of Property Act,1882 defines the Transfer of property as :

“Transfer of Property” means an act by which a living person conveys property, in present or in future, to one or more other living persons, or to himself, 1[or to himself] and one or more other living persons; and “to transfer property” is to perform such act.

But, Section 13 of the TRANSFER OF PROPERTY ACT provides for remedy by which a property can be transferred or an interest can be created in the property in favor of an unborn person. This is not an exception for the general rule, in fact it is an extension of the general rule which widens the scope to make the transfer of the property.

Where on a transfer of property, an interest therein is created for the benefit of a person not in existence at the date of the transfer, subject to a prior interest created by the same transfer, the interest created for the benefit of such person shall not take effect unless it extends to the remaining interest of the transferor in the property.

FOLLOWING ARE THE ELEMENTS KEPT TO BE IN  MIND WHILE CREATING AN INTEREST IN FAVOR OF AN UNBORN PERSON :

  1. Transfer for the unborn must be preceded by a life interest created in favor of a person in existence at the date of the transfer.
  2. Absolute interest must be transferred that is the whole remainder.
  3. The unborn person must come into existence.
  4. enjoyment of interest may be postponed.
  5. Transfer must not be in perpetuity.
  6. No direct transfer.

EXAMPLE : A transfers property of which is the owner to B, in trust for A and his intended wife successively for their lives and after the death tog the survivor, for the eldest son of the intended marriage for life, and after his death for A’s second son. The interest so created for the benefit of the eldest son does not take effect, because it does not extend to the whole of A’s remaining interest in the property.

LEGAL CONSEQUENCES 

The transfer in favor of unborn person must be preceded by a life interest and that only absolute may be given to the unborn has following legal consequences :

  1. The intermediary person living at the date of the transfer is to be given only life interest. It means giving him only the right to enjoyment and possession. He has to preserve the property like a trustee during his life-time on behalf of the unborn.
  2. The unborn must come into existence before the death of the person holding property for life. If the unborn comes into existence say, after month after the death of the last living person, the property shall revert back to the transferor or his heirs.

POSTPONEMENT OF ENJOYMENT

The enjoyment of the property transferred for an unborn person can be postponed for some future date. Section 14 of the Transfer Of Property act,1882 makes rule against perpetuity which means the postponement cannot be for unlimited period.

INTEREST AT THE TIME OF BIRTH

Section 20 of the Transfer of Property Act, where on a transfer of property, an interest therein is created for the benefit of unborn person not then living, he acquires upon his birth, unless a contrary intention appears from the terms of the transfer, a vested interest, although he may not be entitled to the enjoyment thereof immediately on his birth.

 

CONCLUSION

A property can not be directly transferred to an unborn person but if prior life interest has been created and the absolute interest has been made that is the whole of the remainder to unborn, then a property can be transferred in favor of an unborn person.
