The only reason I believe in happy endings

Like SRK said if the ending is not happy ending then, “Picture abhi baki hai mere dost”. When the sky is in it’s beautiful colours and the sun is going down, may be they are trying to say us that look, “the endings can be beautiful too”, may be they are giving us hope, hope for better and beautiful future, may be, they are trying to say us that, let go what happened today, just forgot what happened in the past by looking at this beautiful sunset skies and look forward to every sunrise, it’s your golden opportunity to “RESET”.

It’s the nature of life that things don’t stay the same but sunsets are the proof that, they can end beautifully, so don’t give up, just keep going no matter what happens the end gonna be beautiful. After entire day work just you, a cup of coffee and beautiful sunset with your favourite music will help you to forgot about all your worries and you’ll just want to live in that moment forever when the sky is in it’s beautiful colours. The world is fighting against the virus and we are too young to dealing with all this, so much has happened, so much is happening, at some point in our life we all feel depressed, sad and lonely, sometimes we just want to give up and it’s a life but, DON’T, comfort yourself by looking at these beautiful sunset skies.

Some people may sound like that, you need to do something special in life, and that’s not true. They will judge you at every point in your life but, don’t think, don’t put so much thoughts into what you’re doing and what others are saying or what others will say, you just have to keep going. Start doing things for yourself let them call you selfish sometimes it’s really okay to be selfish.

Also always remember, you are just a little bit doubtful of your potential and unsure of your worth but you are as amazing as these sunset skies.

How to build a good Team ?

A team is a group of people working together towards a common goal. Creating an opportunity for people to come together to share concerns, ideas, experiences, and to begin to work together to solve mutual problems and achieve common goals.

Team Development Life Cycle

  1. Forming : In this stage high dependence on leader for guidance and direction. Little agreement on team. Individual roles and responsibilities are unclear. Leader must be prepared to answer lots of questions about the team’s purpose, objective and external relationships.
  2. Storming : In this stage decisions don’t come easily within group. Team members compete for position Clarity of purpose increases but plenty of uncertainties exist. Compromises may be required to enable progress.
  3. Norming : In this stage agreement and consensus forms among team. Roles and responsibilities are clear and accepted. Big decisions are made by group agreement. Commitment and unity is strong. The team discusses and develops its processes and working style. There is general respect for the leader and some of leadership is shared.
  4. Performing : The team clearly knows “why it is doing ?” and “what it is doing ?” . The team has a shared vision. There is a focus on over-achieving goals. Disagreements occur but now they are resolved within the team positively. The team is able to work towards achieving the goal. Team members look after each other. The team does not need to be instructed or assisted.
  5. Adjourning : Adjourning, is the break-up of the group, hopefully when their task is completed successfully, their purpose fulfilled; everyone can move on to new things, feeling good about what’s been achieved. From an organizational perspective, recognition of and sensitivity to people’s vulnerabilities during this fifth stage is helpful. Feelings of insecurity would be natural

Characteristics of a Good Team

  • Everyone participates actively and positively.
  • Team goals are understood by everyone.
  • Everyone takes initiative to get things done.
  • Each teammate trusts the judgment of the others.
  • The team is willing to take risks.
  • Everyone is supportive of the project and of others.
  • Team goals are given realistic time frames.

Poverty in India

Poverty one of the major problem in India. India is the second most populous country after China with 1.2 billion people and it is the seventh largest country in the world in terms of area.

Around ⅔rd of people in India live in poverty in which 68.9 % of Indian population lives on less than 2 dollar a day and over 30% even have less than 1.25 dollar per day. And thus they are considered extremely poor.

India subcontinent is one of the poorest country in the world.

The most poor section of our country is children and Womens. They are considered as the weakest member of Indian society and that’s why they suffer the most.

In India womens are not considered as the strongest member of the society because of a patriarchy.

Education and job for womens are not considered important in our society.

By preventing education for Childrens and womens leads to the poverty and poverty is also preventing children from getting an education

  • India is one of the country with highest child mortality rate.

Child labour

  • Child labour for children under the age of 14 in India is prohibited by law.
  • According to official figures 12.5 nilganj children between the age of 5 to 14 are working.
  • It is believed that Indian children’s contribute to the living wood of their poor family.
  • Children’s work in the field in factories, in quarries, private households .

Malnutrition

  • India is one of the world’s top countries when it comes to Malnutrition.
  • 7.8 infants were found to have birth weight less than 2.5Kg
  • More than 200 million people don’t have sufficient access food.

Lack of Education

  • Most of childrens have no access to education in India.
  • Girls are excluded from the school in higher numbers with respect to boys.
  • We should have to treat them equally but it is believed to be inferior on lower caste.
  • Without education, chances of finding living from employment in India is impossible.
  • If educated peoples start teaching childrens at free of cost then it also be very useful in making a better world.
  • Like If 30 college students are studying in 1 course and they start teaching poor childrens only 1 day per month then the childrens study 1 month at free of costs.
  • We also have to put some efforts in making better world not for others, but for ourselves as well.

Child marriage

  • As we know Child marriage is crime according to Child marriage Restraint Act, 1929.
  • But it is still widespread in many regions of India.
  • Poverty is also the main reason behind this.

Overpopulation

  • Overpopulation leads to high competition in every aspects of life.
  • We see lack of job opportunities, education.
  • Food production is not as much to fulfill the need of this higher population.
  • Due to overpopulation, and not doing work after having such high population in India is main reason behind poverty.
  • If we utilise this overpopulation as the opportunity to increase country’s financial condition then it actually going to worth it.

How Body Shaming affects one’s well being

We all know and accept the fact that different humans will have different characterstics, likes and dislikes but what about the physical appearance. Why is it that a standard is set for people which everyone accept them to follow . The ones who fail to meet the standard criteria are then “shamed” on the pretext of motivation.

Crticising someone for their body fat, “thin” built, hair texture and colour, hair density or bald looks, too much height or “such a shorty”, different body shapes, size of various body parts like small or heavy breasts or hips, skin tone etc comes under the broad term of BODY SHAMING. Not only just the looks but people are shamed with the accessories they decide to decorate their body with like tattoos, piercings etc and also with the marks that the diseases or some accidents leave. The memories of diseases and the accidents are traumatic enough, in addition to this one has to bear the addition burden of someone not liking some marks on their bodies which they have learnt to make peace with hereby scratching the old wounds making the person relive the trauma.

A person is defined by its physical and mental health. While the latter includes moral virtues , the former stands for a healthy body where all oragans function properly. Different skin colors , height, length of hair until and unless you have got an illness is all okay and acceptable. Anything which doesn’t threaten the working of your organs is completely normal. Sadly, this is not the case today.

  • It is like a chain reaction which goes on in the society. There are some standards set by the people themselves which they expect everyone to follow to be “an epitome of PERFECTION”. For example – If you are a male , you ought to have good height, good muscles, lusty dense hairs and if you are a female, then the list extends to a great measure. A “good Indian girl” ought to have “fair ” skin , should not be covered in the layers of “fat”, should have markless, flawless skin, medium height , good natural color hair, tattoos makes one characterless and piercings except the traditional ear and nose also contribute to the former category. Now I ask, which text or rule book has defined these charactersticcs of a man or woman. The most funniest thing is the third gender is not even mentioned and talked baout anywhere instead they are shamed. Because some “boys” prefer wearing make up with female clothing and some girls keep short hairs and speak for themselves. The onlything which are ancient texts teaches us is to be honest , hardworking and possess good moral virtues there was never a mention about the physical appearnce. History is evident of the fact that people who were beyond this tandard criteria , proved better than the ones who followed it . The best example being Physics genius STEPHENS HAWKING. It is a sort of revenge game which continues.Because the people were teased and criticsed about their looks by the others they continue to do it with the rest to take out their frustration. The origin of this “toxic game” being unknown.
  • A default reaction to something which someone says or does and we dont like is to comment on their physical attributes making that person feel guilty about themselves . Like if someone acts in the manner which we dont like, people are often heard saying, “Obviously, she/he will do that. Didn’t you see how ugly they are”. This process of making a person guilty by remarking about their physical attributes is very common in today’s world specially in this age of social media.

Affects of BODY SHAMING

  • Reduction of self esteem, self confidence because you think you are not worthy or capable because someone told you that you are “unfit”. Everyone is unique with a different story behind each of their “not normal looks”, until and unless the third person knows about it they should not comment about it. This is very common to feel because confidence is the belief we have on ourselves which motivate and enable us to do the things properly and our confidence specially in the teen years is based on what the people around us friends, peers or family feels about us. In these growing years, one needs motivation and support in the form of words not the harsh words making people to change their appearance and hate themselves. This often leads to anxiety, stress, eating disorders bringing the ACTUAL DISEASES, depression sometimes leading people to self harm themselves. And then people says today’s youth is so reckless and “Teenagers attempt suicide because they were CORRECTED ABOUT SOMETHING or Scolded for their won well being”. Correcting someone’s natural built is equal to meddling with the nature and we have enough evidences of the consequences of meddling with the nature. This all is the result of the trauma which sometimes lead people into the actual bad habbits like alchol, drugs fastening the process towards their mortality.
  • In order to fit into the “standard criteria” , people undergo diets, proteins for increasing weights and heights, laser treatments for those who have thin hair or bald look, dozens of products containing many harmful chemicals to whiten their skin tone. This not only takes a toll on financial health , but also on the mental physical health. The treatments are not always effective , it causes more harm than good at times. The stress and anxiety in the anticipation of the result is a very acute thing which is actually to be worried about.

We need to stop criticising people on the pretext of looking after them If you really want to look after your “loved ones” , then it should be to take care of their health in all aspects not to bring them on the verge of madness.

Gandhigiri With Munna Bhai: Valuable Lessons From The Film

Released in 2006, Lage Raho Munna Bhai is a movie directed by Rajkumar Hirani, screenplay by Vidhu Vinod Chopra, and starring talented actors like Sanjay Dutt, Arshad Warsi, Vidya Balan, Boman Irani, etc that proved to be a massive hit on the box office. The story begins with Munna Bhai being in love with the radio jockey Jhanvi. To win a chance to meet her, he cheats his way through the Mahatma Gandhi quiz and passes. When he finally meets Jhanvi, Jhanvi requests him to give a lecture on Mahatma Gandhi to the old people in her house. Munna who pretended to be a History professor and a Mahatma Gandhi fan has no choice left but to study all about Mahatma Gandhi for the remaining 3-4 days that he has left until the fixed date. This causes an extensive load on his brain due to which Munna Bhai starts hallucinating about Mahatma Gandhi’s persona.

The whole story moves forward with a battle against the corrupt Lucky Singh who deceives Munna and takes over the 2nd Innings House (of the old men) versus Munna Bhai who fights back using Gandhigiri. All along the movie Munna’s hallucinations of Gandhi continue to help him win and showcases Gandhi’s ethics that were long forgotten. Lage Raho Munna Bhai leaves its viewers with a deep sense of morality and Gandhigiri along with bouts of humor and comedy that keeps the audience engaged throughout the end, making it such a massive hit.!

The movie succeeds in reminding the long-forgotten ethics laid by Mahatma Gandhi for the country that he visioned. Below are the major matters that the movie tackles by implementing the concept of Gandhigiri. A neologism that refers to implementing and following the methods and guidelines laid and preached by Mahatma Gandhi. Throughout the movie, Munna acts as a spokesperson for Gandhiji’s values.

Here are some of the valuable lessons from the movie:

1. Truth – Truth is one of the fundamental teachings of Mahatma Gandhi. In this movie too, the value to always speak the truth no matter what is depicted firmly. There are 3 major instances when the characters are encouraged to speak the truth. The first instance is when Munna hides his real identity from Jhanvi and is later persuaded by Gandhi to tell Jhanvi the truth.

The second instance is when Munna and Jhanvi start their ‘Gandhigiri’ program to help people and a caller explains his desire to die as he doesn’t have the courage or way to return the hard-earned money of his father. To this Munna convinces the caller to tell his father the truth honestly and work hard to return the money. No matter how small the amount he earns or how long it takes to return the money Munna requests the caller to speak the truth.

The last instance is when Lucky’s daughter runs away from her wedding because she is upset about the lie that her father told her in-laws about her not being ‘Manglik’. Munna advocates her to face whatever it is and to tell the truth to her in-laws. Further, he comforts her by saying that if the boy loves her then he will not care about such stuff and will still marry her regardless of all this.

2. Non-Violence – This is the 2nd fundamental teaching of Mahatma Gandhi. Non-violence is also preached through the movie in a very subtle and effective way. The first example of non-violence in the movie is when Gandhi advocates Munna to turn to non-violence rather than hurting his enemy.

The second example is when another caller asks Munna for help to stop his fellow neighbour from spitting on his entrance wall. Munna suggests him to adopt the Non-Violent way and instead of beating or spewing bad words, he should clean up the spit every day with a smile on his face. This will reduce the hatred in the enemy’s heart and make him realize his mistake. And so, it happens!

3. Importance of values and respect for elders – At the start of the film, we see how children abandon their parents in their old age. This is a very heart-wrenching scene. Later Munna is seen remarking and rebuking the son of one of the old men. He scolds him saying that the parent who raised him with everything he got, is being abandoned today by his son when he needs him the most. This is a strong criticism towards people who, in their selfishness forgets the values and morals that one needs to follow in life.

4. Satyagraha and peaceful methods of protests – The very core theme of Lage Raho Munna Bhai movie explores the aspects of corruption and bribery. Gandhi Ji advocated the concept of Sarvodaya for everyone’s progress however, we know that the present world does not focus on equity but greed.

Corruption in the system is growing at a stark rate. By adopting the Gandhigiri way to fight against this, the peaceful methods of protests preached by Mahatma Gandhi are ignited again in this movie. First, Munna adopts the peaceful method of Satyagraha to fight against Lucky Singh’s corruption. In another instance, again through one of the callers, we are reminded about how to fight bribery and corruption in the system i.e. by making the other person feel ashamed in the most non-violent way.

5. Superstitious beliefs in India Lage Raho Munna Bhai smoothly tackles the superstitious problems that are still common in India. We see the plot of the movie revolve around Lucky Singh’s daughter being ‘Manglik’ and how Lucky Singh lies about it, which in the end is revealed to the in-laws by Lucky Singh’s daughter. It shows how most of the superstitions that Indians have is nothing but a way for the so-called ‘pandits’ and ‘Jyotish’ to extract money from people. Mahatma Gandhi never showed support for superstitious beliefs and always asked people to walk with reason, empathy, truth, and non-violence. Thus, this also remains an important point in Gandhian Philosophy.

The film succeeds in lining up with the expectations of people. Lage Raho Munna Bhai proves to be a great movie to convey the message of Gandhigiri to the audience in a serious yet humoristic way without being didactic. It not only shows Gandhi’s principles of thought but also shows a way to employ them in the present situations in India. The film is a great medium for anyone who wants to explore Gandhi Ji’s ideals without needing to have any prior knowledge about it.

Uniform Civil Code in India

Introduction

India is a very diverse nation having several different cultures, traditions and religions. This diverse nature of India makes it a vibrant and varied country, where it reconciles different religious and cultural views to form one unified nation. However, this also necessitates the need for personal laws that govern each religion and allow their followers to live according to certain religion-specific laws and regulations. For example, Hindus have the Hindu Marriage Act (1955), Muslims have the Muslim Personal Law (Shariat) Application Act (1937), Christians have the Indian Christian Marriage Act (1871), etc. The personal laws are aimed at giving each religion a fair opportunity at following their own customs and traditions. However, many instances in Indian history are evidence to the fact that distributing justice on the basis of religion leads to a multitude of communal issues. Moreover, numerous personal laws have been found to be discriminatory in nature and thereby in derogation of the Fundamental Rights as given in the Indian Constitution. Many a times, these personal laws are regressive in nature and represent ancient societal views that show no congruence to the current, progressive Indian society. It is in view of this that the framers of the Indian constitution, and many other prominent figures during the period of drafting, made efforts to implement a ‘Uniform Civil Code’ in the interest of national consolidation and communal harmony.

The Uniform Civil Code

The Uniform Civil Code refers to a single set of rules or a singular code of law that is applicable to all the citizens of India, regardless of their religious affiliations or which community they belong to. Such a code is the hallmark of a contemporary, progressive nation that has ascended the need for segregation based on religion, caste, race, etc. Article 44 of the Indian Constitution states that a ‘Uniform Civil Code’ is to be implemented for the citizens of India. The Article reads: “The State shall endeavour to provide for its citizens a uniform civil code throughout the territory of India.” Therefore, the idea of a uniform civil code is enshrined in the Indian constitution and stands as a something that the country should strive for. However, it is included as one of the Directive Principles of State Policy, and not as a Fundamental Right or constitutional guarantee. Hence, despite being mentioned in the constitution, there have been no significant steps taken by India to realise such a code.

Goa is the only state in India to have a fully functioning uniform civil code called the Portuguese Civil Code (1867). This code replaces the personal laws based on religion in Goa, and introduces a common law for all its residents regardless of their religion, caste, gender, etc. For example, according to the code, a Muslim man whose marriage is registered in the State of Goa cannot practice polygamy. Although polygamy is a part and parcel of the Muslim personal law, it is nullified in the State of Goa due to the presence of a UCC. Furthermore, a married couple share equal property and divide their assets equally, and succession rights for men and women are similar in Goa. Thus, Goa acts as a contemporary example as to how a uniform civil code works, and what it involves.

Evaluation of the Uniform Civil Code

It can be said that the uniform civil code is a very polarising concept, and that it can bring about both benefits and adversities. It is important to understand these before a solid decision about it can be made. In case it seems like the benefits outweigh the adversities, then it should be implemented, and vice-versa. These can be discussed as:

Pros

  • The application of a uniform code will allow for a much more coherent and efficient system of administration, mitigating a lot of the confusion and conflict created due to the existence of numerous personal laws.
  • A uniform civil code is the hallmark of a secular democracy like India. As mentioned in the Preamble, India is a secular country and does not identify any particular state religion. It is acceptive of all faiths, and gives the freedom to practice and preach any religion its citizens deem suitable for themselves.
  • A common feature seen among most personal laws is discrimination towards women. This is again a reflection of ancient and obsolete beliefs that have no place in modern society. The uniform civil code, however, is devoid of any such discrimination and promotes equal treatment of both genders.
  • Possibly the most important pro is that the implementation of a uniform civil code will infuse the Indian legal system to make it one well-oiled machine. As of right now, the segregation of different personal laws implies different practices in different religions.

Cons

  • Although aiming for communal harmony, the uniform civil code may cause some divisiveness in the Indian society. Communities such Hindus and Muslims have deep-rooted hate against each other, and neither one will be pleased to follow the same code as the other. Hence, the UCC may cause some communal disharmony.
  • It will be a very lengthy and cumbersome process to come up with a uniform civil code that is equitable and non-discriminatory in nature. Realistically, it will take numerous years and make use of many resources, which might not be the best idea considering the many issues India has to focus on in the current times.
  • Most importantly, as mentioned before, people in India have deep emotional ties to their religions. The introduction of such a code that trumps their personal laws is not advisable and can lead to antipathy from the citizens of India.

Conclusion

Ultimately, the debate around the uniform civil code does have valid arguments both for and against it. It boils down to whether it is worth sacrificing some diversity for a stable law and order situation in India. I believe that the UCC could be the need of the hour, and could help in building the egalitarian society India is striving for. India’s long history of communal disputes and discrimination can come to an end, or at least be reduced exponentially, and there can be national integration and unity. However, such a uniform code cannot be suddenly implemented with the hope that it will rectify issues. People should be educated and made aware about it, and a gradual approach should be administered in introducing the UCC.  This will allow it to be effective and accepted in society. Furthermore, each community’s interests should be taken into consideration. In this way, the secular nature of India will be preserved and it will allow for India to progress and grow.

He made many breakthrough in the production, application and transmission of the electric power. The first alternating current motor was invented by him. NIKOLA TESLA (1856 – 1943)

Nikola Tesla was born on 10th July 1856 in Croatia, America. His father, Milutin Tesla was preist in Eastern Orthodox Church. His mother,Đuka Mandić was very talented and she has the power to memorise Serbian epic poems. The crave for knowledge in Tesla came from his mother. Tesla was the fourth child of the family. He had three sisters and an older brother. His brother died when Tesla was five years old.

Tesla said that his interest in demonstration of electricity came from his physics teacher. He has a talent to calculate integral calculus in his head which prompted his teachers to believe that he was cheating. In 1875, Tesla enrolled at the Imperial Royal Technical College, Gauz, on a Military Frontier scholarship. During his first year, Tesla never missed a lecture, earned the highest grades possible, passed nine exams. He even got the letter of recommendations from his dean. After his father’s death in 1879, Tesla lost his scholarship and addicted to gambling. He never get through the final semester exams and didn’t finish of his degree. To hide fact, he severed the ties with his family and his friends thought that he was dead.

TESLA IN THE FIELD OF ELECTRICITY

  • In 1884, he reached America with the letter of inrtoduction to work with Thomas Edison, whose DC-based electrical works were fast becoming the standard in the country. Edison hired Tesla and the two worked hard tirelessly on Edion’s inventions. After some months, they two parted their ways due to some issues related to their business.
  • Tesla discovered, designed and developed ideas for a number of important inventions which were officially patented by other inventors including dynamos and the induction motor. Tesla designed the alternating-current (AC) electrical system, which had become the prominent power system of the 20th century and has remained the worldwide standard ever since.
  • In 1887, Tesla found funding for his new Tesla Electric Company, and by the end of the year, he had successfully filed several patents for AC-based inventions.
  • In 1895, Tesla designed what was among the first AC hydroelectric power plants in the United States.
  • In the 19th century, Tesla patented Tesla coil, which laid the foundation for wireless technologies and is still used in radio technology today. The heart of an electrical circuit, the Tesla coil is an inductor used in many early radio transmission antennas. The coil works with a capacitor to resonate current and voltage from a power source across the circuit.

Tesla died due to Chronic Thrombosis on 7th January 1943. He died in New York where he lived for sixty years. He worked hard to prove himself in the field of electricity. THE PICARESQUE NOVEL

The Picaresque novel is a famous technique in earlier periods. These techniques were used to record the Kings’ and other person’s victories in and out of the battlefields even during his adventures. This form of literature helped in recording the real historical heroes and events from various perspectives. Many authors adapted these techniques and succeeded in making new epic fictions, mythologies, and other real events and incidents.

The Picaresque Novel originated in Spain. The term ‘Picaresque’ is derived from the Spanish ‘picaro’ meaning an anti-hero or rogue. A Picaresque novel is generally an autobiography account of the hero’s fortunes, sufferings and wanderings. It is a combination of episodic tales arranged as journeys. They episodes generally depict low life in a rambling manner and come to an abrupt ending.

The first prose fiction in the nature of the picaresque was John Lyly’s ‘Euphues’ published in 1578 detailing the loves and adventures of a young Athenian called Euphues. Six years later, Thomas Nash published his ‘Unfortunate Traveller’, a more perfect picaresque romance dealing with the travels and adventure of a page called Jacky Wilton. Defoe’s ‘Moll Flanders’ published in 1722 had an affinity with the picaresque mode of writing. But Smollett’s  ‘The Adventure of Ferdinand Count Fathom’ is a more perfect form of the picaresque. However, it was Fielding’s ‘Tom Jones’ which established the respectability of the picaresque novel. Fielding’s novel describes through 18 book’s the adventures and several love affairs of The Young anti-hero Tom Jones. Elements of the picaresque can be found in Dickens’s Nicholas Nickleby and in Joyce Cary’s “The horse’s mouth.”

The object of the picaresque novel is to take a central figure through a succession of scenes and adventures, introduce a great number of characters around him and thus build-up picture of society. In the eighteenth century and before travel was the only way to get acquainted with social life. That is why heroes in the Picaresque novels are travelling heroes. The hero in a picaresque novel is always in the Whirlpool of adventures and he has to be present in several human situations. The picaresque hero often transcends the level of the rogue into a tragic figure with human attributes as in the case of Fielding’s Tom Jones.

Another feature of the picaresque novel is the dynamic movement of the hero. He should run through a succession of scenes as Tom does during his journey to London. The novelist constructs the picture of society through the narration of the hero’s wanderings. Smollett sends his hero Roderick Random not only to London but also to France and for a ship journey. The picaresque novel may go deeper into a contemplation of the more intricate relationship between good and evil. They also reveal the strange truth that generous impulses exist even in those whom society considers as rougues. Tom Jones is a generous and manly youth in spite of the rouguish elements in his character.

QUASAI- CONTRACT

Introduction:- There are many situations in which law, as well as justice, require that a person be required to conform to an obligation, although he has neither broken any contract nor committed any tort. Chapter V of the Indian Contract Act deals with the situations under the heading “Of certain relations resembling those created by Contract”. The chapter avoids the word “Quasi-contract” and given the clear statutory authorization, the courts in India are not hindered in allowing relief under the different sections of the Act by the theoretical considerations concerning quasi-contracts.

Conditions of quasi- contract:-

(1) A legal agreement created by the courts between two parties who did not a previous obligation to each other.

(2) A normal contract requires two parties to consent to mutually agreeable terms under a quasi-contract neither party is originally intended to create an agreement. Instead, an agreement is imposed by a judge to rectify an occurrence of unjust enrichment.

(3) Courts create quasi-contracts to protect the unjust enrichment of the parties in dispute over payments of goods and services.

Salient Features of quasi-contractual rights:-

(a) Firstly, it does not arise from any agreement of the parties concerned but is imposed by the law, and

(b) Secondly, it is a right that is available not against the entire world but a particular person or persons only.

Kinds of quasi-contractual Obligations:- Section 68 to 72 provide for 5 kinds of quasi-contractual obligations are as follows:

(1) Supply of necessaries

S.68. Claim for necessaries supplied to a person incapable of contracting, or on his account.

Persons incapable of contracting includes:

• a minor

• person of unsound mind

• person disqualified by law to which they are subjected

Illustration:- A supplies B, a lunatic, with necessaries suitable to his condition in life. A is entitled to be reimbursed from B‘s property.

(2) Payment by interested person

S.69. Reimbursement of person paying money due to another, in payment of which he is interested.

Essential requirements of section 69:

• payer must be interested in making payment

• but should not be bound to pay

• defendant should be under legal compulsion to pay

• payment should be by one to another

(3) Liability to pay for non-gratuitous acts

S.70. Obligation of person enjoying the benefit of non-gratuitous act.

Essentials:

• a person should lawfully do something for another person or deliver something to him;

• in doing the said thing or delivered the said thing he must not intend to act gratuitously;

• the other person for whom something is done or to whom something is delivered must enjoy the benefit thereof.

(4) Finder of goods

S.71. Responsibility of finder of goods.

• Entitled to retain the goods until he receives the lawful charges or consequences for retaining the goods and taking care of them.

• However, he cannot sue for such compensation unless a specified reward has been advertised by the owner.

• Entitled to possess the goods until the true owner was found.

(5) Mistake or coercion

S.72. Liability of person to whom money is paid, or thing delivered by mistake or under coercion- A person to whom money has been paid, or anything delivered, by mistake or under coercion, must repay or return it.

Illustration: A and B jointly owe 100 rupees to C. A alone pays the amount to C, and B, not knowing this fact, pats 100 rupees over again to C. C is bound to repay the amount to B.
