WhatsApp Versus Indian Government

The whole nation is in turmoil due to the provisions of the new Information Technology Rules, 2021. To understand the situation better, we will see what the rules are and why they are causing conflicts with the Government. 

New IT rules that undermine the power of social media

The proposed new rules will cover social media companies like Facebook and Twitter, OTT platforms such as Netflix, Amazon Prime, Hotstar, and digital news publishers like The News Minute, Scroll, Quint, The Wire, Newslaundry, The Cue. 

Indian Government revealed the new social media rules on February 25, 2021. As per the new rules, social media intermediaries will now come under a three-tier regulatory regime. In this context, “social media intermediary” refers to an intermediary which primarily enables interaction between two or more users and allows them to create, upload, share, disseminate, modify or access information using its services. 

  • The First Tier

The first tier follows a self-regulating mechanism. The social media intermediary is required to appoint a resident Chief Compliant Officer, nodal contact person, and a resident Grievance Officer. The Chief Compliant Officer shall ensure compliance with the Act and the rules thereunder. The nodal officers shall coordinate with the law enforcement agencies to ensure compliance with their orders. The Grievance Officer shall acknowledge the complaint of a user within 24 hours and dispose of such complaint within a period of fifteen days from the date of its receipt. 

  • The Second Tier

The second tier is self-regulated by a self-regulating body. This body consists of a retired judge or an eminent person from the department of media, entertainment, or any relevant field. It has the power to censure, modify or delete any content it deems a cognizable offense.

  • The Third Tier

The third tier follows an oversight mechanism. It establishes an Inter-Departmental Committee that mainly performs the functions of the self-regulatory bodies. 

Some of the chief issues that worry the social media companies

  • Privacy concerns

One of the provisions of the new rules requires that the social media intermediaries disclose the identity of the “first originator” of the information that threatens the sovereignty and integrity of India, the security of the state, or public order.

  • Usage of AI

The Indian Government also requires the social media intermediaries to deploy technology-based measures to identify information that depicts any act or simulation in any form depicting rape, child sexual abuse, or conduct, whether explicit or implicit. 

Reactions to the imposed IT rules:

Obtaining the identification of the first originator would break the end-to-end encryption. By breaking the encryption, users cannot safely exchange chats, photos, or information on social media platforms without them being open to access not just by bureaucrats and government bodies but also by hackers.

While it is necessary to deploy Artificial Intelligence (AI) to monitor objectionable content, there are certain limitations to implementing it. With the number of users increasing, it is laborious to moderate the amount of content generated every day. 

WhatsApp’s stand against the Government

While Facebook has complied with the new rules and Twitter has remained a silent bystander, WhatsApp has filed a lawsuit in India which seeks to block the new digital ethics code from coming into force. For WhatsApp to identify the first originator of even one message, it has to restructure the entire platform. This feature compromises the privacy of billions of people who communicate digitally. The other concern is that freedom of speech and any form of expression of dissent would be hampered. 

IT Minister Ravi Shankar Prasad has stated, “It is WhatsApp’s responsibility to find a technical solution, whether through encryption or otherwise.” It will be interesting to witness how far India would go to press WhatsApp to comply with the new rule.

WhatsApp Bullying

A few days back, I was casually chatting with my cousin sister discussing about how the pandemic is altering our life. While discussing she cited a very interesting incident which happened to her daughter, Tanaya a couple of weeks back. Tanaya is currently promoted to fifth standard and she has been attending her classes in online mode since June end. My cousin said that they have created WhatsApp group among themselves where they discuss about their ‘school-affairs’. A few days passed by, she noticed that Tanaya was feeling very low and she almost stopped communication with her fellow mates. Distressed, she questioned her if something is bothering her, since it is a very new thing for Tanaya. After a lot of pestering, she opened her unofficial WhatsApp group of their class and she says that she was shocked reading the conversation. She noticed that there were a lot of slangs for fifth standard students. The most oppressive thing that she understood was that Tanaya was completely ignored when she asks or say something, or laughed at or completely victimised her. She was so outrageous that she took the matter up to the Principal and finally after a heated discussion that volunteer parents will be a part of those group and banned the creation of any other unofficial WhatsApp groups. Upon listening, I just saluted her for what she did and how she stood up to it.

WhatsApp is the only source of communication among us right now. That is the platform where everyone, from students to professionals, converse among themselves, trying to keep up with the changing world. That said, now when we all are chatting in a public forum, we usually tend to oversee the boundaries and limitations. Students who have been programmed to attend classes in offline mode were under a lot of restrictions and discipline and so such random conversations were easily avoided. But they have started attending their classes online, where there is no restriction, no rules and especially there is no such ingrained discipline. Well, I have particularly experienced that seeing my cousin’s daughter. Considering her age, it is very well perceived that freedom of such kind in unexpected and very often, such freedom bears its own consequences. They tend to say everything, thinking that it is cool and very often they tend to exhibit groupism. At times, they say something to a particular person, out of ‘longing for acceptance’, without giving it a second thought. This is what constitutes bullying. Repeated avoidance, being laughed at or made mockery of, posting ridiculous and insulting messages as WhatsApp status, sending offensive memes or caricatures in the public groups are some forms of mental harassment in online mode, otherwise known as WhatsApp Bullying.

What I believe is that people, especially such young ones, are going through a massive change. Schools and other such institutions need to understand that just initiating classes in the online mode can make someone ‘educated’ but it will completely erode the ‘mental’ and ‘civilized’ part of our character. Parents and teacher should make them understand that everyone is feeling excluded at this hour and we should take the responsibility of making someone feel inclusive.

While leaving my cousin’s house, Tanaya came to bid me good-bye. I looked at her eyes and remembered about my past too. I smiled, and then left.

My phone chimes with a notification sound, while the birds from the trees and skies chirp outside, my phone twitters me awake at 5:30 in the morning. My alarm is yet to wake me up but I turn it off nevertheless and reach for my device or ‘WhatsApp’ to be specific. It is now 5:45am, the Sun is not out yet but my mobile screen is brighter than ever. The world has entered my room bombarding me with wisdom and a flower wishing me good morning. It is demanding my attention, comments, jokes, wits, opinions and some fun emojis.
