Human Rights of Women Must Also be Respected

It is most unfortunate and most disgraceful that in India where women is worshipped as Durga, Kali, Gauri etc and where we all show utmost respect to our sister and mother, we don’t care to ensure that those men who without being brainwashed in Pakistan by Pakistani Army or ISI or terror leaders like Hafiz Saeed or Syed Salaluddin or Masood Azhar or anyone else and without being trained in any hostile foreign country perpetrate the worst kind of crimes against women which under no circumstances can ever be justified by anyone. Why when rapists gang rape a women turn by turn and then stab her and then set her ablaze still why in our country are our lawmakers always bothered only and only about the human rights of men alone? Why are such rapists and gang rapists not killed like mosquitoes?

Why should any leniency be shown towards such demons?  Why is it that in last 15 years just one poor Dhananjoy Chatterjee is hanged on circumstantial evidence alone in 2004 and whose petition was drafted by prisoners of Tihar jail as was pointed by earlier by senior Supreme Court advocate Colin Gonsalves as he could not hire a lawyer even though every year we keep hearing that more than 32,000 to 33,000 rape incidents keep happening? Why is it that from 1982 to 2004 only Ranga and Birla are hanged for rape cum murder and who certainly deserved no mercy?

But what about other rapists cum murderers? Why were they also not hanged for similar crimes? Why the rich and the affluent are able to escape punishment just because they are able to hire a battery of “eminent and experienced” lawyers to offer thousands of reasons for sparing their client from being sent to the gallows?

Why are our lawmakers not closing all the escape routes in the form of “discretion bomb” in our IPC which many times mostly saves a rapist from being sent to the gallows? Why there is no mandatory death penalty for rape and gang rape? Why even for repeated offenders we see that there is no mandatory death penalty?

Why are rape trials and trials of other crimes perpetrated against women not conducted most expeditiously? Why do we see inordinate delay in the completion of rape trials and trials of other crimes pertaining to women? Should we be proud of it? Certainly not!

It is heartening to note that while urging for quick disposal of rape cases, Union Law Minister Ravi Shankar Prasad on December 8 said that he would write to all Chief Ministers and Chief Justices of the High Courts to complete investigation in cases of rape and those registered under the Protection of Children from Sexual Offences (Pocso) Act in two months. He also said that the trial of such cases should also be completed within six months. Inordinate delay in completing rape cases has certainly brought disrepute to our legal system and to our judiciary and so what our Union Law Minister has just recently stated is good to read and it must now be earnestly implemented in totality! It brooks no more delay.

While noting that incidents of rape and crimes against women are “unfortunate and highly condemnable”, Ravi Shankar Prasad asserted quite unequivocally that perpetrators of such “heinous” crimes will be punished expeditiously through the judicial process. He said that, “I am going to write letters to all the chief ministers urging them to complete the investigation within two months in rape and Pocso cases.” This is certainly a commendable and courageous step which must be appreciated unequivocally!

Not stopping here, Ravi Shankar Prasad further added that, “I will also write to the Chief Justices of all the High Courts to dispose of expeditiously all cases relating to rape and Pocso pending in the Fast Track Courts.” He also disclosed that he has also requested the Chief Justice of India to ensure that there is a mechanism for speedy disposal of such cases. His comments assume huge significance as they came in the backdrop of nation-wide outrage and uproar over the alleged gang rape cum murder cases at Hyderabad and Unnao.

While mentioning that 704 Fast Track Courts (FTCs) are currently working across the country, Ravi Shankar Prasad further revealed that 1,023 new FTCs are going to be constituted to try cases of Pocso and rape offences, besides other crimes against women. All such FTCs must be constituted at the earliest. It brooks no more delay now!

It is most concerning that there is an alarming increase in the incidents of rape, gang rape, throwing of acid on women, and many other crimes perpetrated on women. The main reason behind such a meteoric upsurge is that criminals feel that they can get away by doing anything in India as the criminal justice system functions at an excruciatingly glacial pace which only further punished women and accused easily gets bail! Can this be ever justified by any sane person?

We all know that the Unnao rape victim who was gang raped earlier in March and after complaining to police the gang rapists were arrested. But they were released after Allahabad High Court granted them bail. What did it culminate into?

As we all know the gang rapists ensured that they waylaid the rape victim while she was on her way to attend court hearing at Raebareli to testify against the criminals. Why were the gang rapists given bail at the first instance? Why were the rights of accused given precedence over the rights of the women?

Not stopping here, why did the police not provide adequate security to the rape victim? Why were the criminals allowed to easily set her ablaze and stab her? Should no policemen be held accountable in this regard?

Why are such policemen just suspended? Why are they not dismissed from service and why are they not held accountable for the death of the Unnao gangrape victim? Why is there so much of leniency towards those police cops who should have jolly well ensured that the gangrape victim was not left alone and especially when she was going to attend court hearing and testify herself in gang rape case why was she not provided full security?

It is good to learn that just a day after the Chief Justice of India Sharad Bobde said that justice can never be instant and loses its character when it becomes revenge we also got to read what our Vice President M Venkaiah Naidu said that, “There cannot be instant justice, but there cannot be constant delays in justice delivery either, else people become restive.” Moreover, how can we afford to ignore the time tested dictum that “Justice delayed is justice denied”? There can be no denying that even the Chief Justice of India – Sharad Bobde is most concerned to see how rapidly crimes against women are increasing in our country and he fully realizes the invaluable importance of combating such crimes on a war footing!

We get to read everyday so many news of even minors being most brutally raped, murdered with her head smashed and what not. But how many times do we read that such rapists, gang rapists and murderers are hanged? Why always we see that the rights of the accused takes precedence over the rights of the women victim? This has to certainly change now if we really want that the people’s faith in our judiciary stands intact!

Why should throwing of acid on women not be punished with mandatory death penalty? How can throwing of acid on women be justified on any ground? How can any punishment less than death penalty or at the least life term without any remission which means imprisonment for the whole life not be awarded on all those who throw acid on women or hurt her in grievous manner?

Why are woman’s right to safety and her right to life not accorded the highest priority in India? Should we not feel ashamed to see that even those who throw acid on women escape very easily after spending at the most just few years in prison? Why should dowry death not be punished with mandatory death penalty? Why are so many escape routes left open for criminals to escape easily and with just a light punishment even after committing the most horrifying crimes against women?

Why is it that under our penal laws there is no mandatory life imprisonment also for gang rape as stipulated in Section 376D of the IPC? Why the punishment for gang rape as stipulated in Section 376D of the IPC is “shall not be less than twenty years but which may extend to life”? Why this “discretion bomb” in form of “may” is inserted in Section 376D dealing with gang rape?

Should this “discretion bomb” not be defused promptly by removing it and providing for “mandatory death penalty” considering the irrefutable fact that gang rape incidents are increasing alarmingly in our country followed by even gang burning of gang rape victims as we saw most recently in Unnao and earlier in Hyderabad with a 26-year-old veterinary doctor? Can gang rape be justified under any circumstances? Why then do we see that there is no mandatory death penalty for such offences?

Why different punishment prescribed for gang rape on woman under 16 years of age as prescribed in Section 376DA and that on woman under 12 years of age as prescribed under Section 376DB of IPC? Why only life imprisonment under Section 376DA and not death? Why option of life and death in Section 376DB of IPC? Why not mandatory death penalty?

Why should minors who rape and gang rape not be punished with death? Why should they at least not be punished with mandatory life term? Why should they be allowed to escape easily after spending some time in reformatory home as we saw in Nirbhaya gang rape cum murder case where the maximum brutality was committed by the minor?

What message are we sending to the world? That in India you can get away by doing anything just because you are a minor! Why should our law makers not listen to the invaluable advice of Vice President M Venkaiah Naidu in this regard who said that there should be no benefit given to minors when they commit such heinous crimes and underscored that political will is needed to implement it?

Why does India figure even far below Pakistan and Bangladesh in happiness index ranking at an abysmally low 140? It is because in India just two rapists are hanged from 1982 to 2003 and from 2004 to 2019 just one rapist is hanged on circumstantial evidence alone! Is this what is fair and can this be justified in the guise of “due process of law”?

Why should our outdated colonial laws like IPC, Evidence Act and CrPC not be changed drastically to meet the present circumstances? Why should human rights of women not be accorded the topmost priority? Why when incidents of rape, gang rape by 4 men or 14 men or even more followed by stabbing and followed by setting her ablaze not be followed by gang hanging?

How many incidents of gang rape are followed by gang hanging? Why our rape laws ensure that gang rapists are never hanged? Should we not be ashamed of this?

Why judiciary never ensures that gang rapists are gang hanged? Why we are happy just after seeing that one poor Dhananjoy Chatterjee is hanged on circumstantial evidence alone? If gang rapists who first gang rape and then set the women ablaze after stabbing her also not deserve death penalty then this death penalty must be kicked out of India right now!

Today that is December 10 is “Human Rights Day”! We must always accept that even “woman” is “human” and not just “men” alone! Therefore, our law makers must ensure that human rights of “women” are accorded the top priority and those who dare to violate them are dealt with swiftly and sternly in accordance with law which must be now amended urgently to ensure that no criminal is able to mock at women and yet escape lightly just by using his “money and muscle power”!

Minority communities equally contributing in the fight against COVID-19

Union Minister for Minority Affairs Shri Mukhtar Abbas Naqvi today said here that more than 1500 Health Care Assistants, who have been trained under skill development programme of Minority Affairs Ministry, are assisting in treatment and well-being of Corona patients.

Shri Naqvi said here that these Health Care Assistants include 50 per cent girls who are helping in treatment of Corona patients in various hospitals and health care centres across the country. This year, more than 2000 other Health Care Assistants will be trained by the Minority Affairs Ministry. The Ministry is providing one-year training to Health Care Assistants through various health organisations and reputed hospitals of the country.

Shri Naqvi said that different waqf boards across the country have contributed Rs 51 crore in PM and CM relief funds for Corona pandemic with the support of various religious, social and educational organisations. Besides, these waqf boards are also distributing food and other essential commodities among the needy.

Shri Naqvi said that 16 Haj Houses across the country have been given to state governments for quarantine and isolation facilities for Corona affected people. Various state governments are utilising the facilities at these Haj Houses according to their needs.

Shri Naqvi informed that Aligarh Muslim University has contributed Rs 1.40 crore in “PM-CARES” fund. AMU Medical College has also arranged 100 beds for treatment of Corona patients. AMU has also arranged Corona tests, more than 9000 tests have been done till now.

Shri Naqvi further said that quarantine and isolation facilities were arranged at Khwaja Model School and KayadVishramsthali at Ajmer Sharif Dargah for Corona affected people. More than 4500 Jayarin belonging to all religions from across the country were provided food, accommodation and health facilities during lockdown. These facilities were arranged by Dargah Committee, Dargah Khadims and Sajjada-nashin. The Dargah Committee and its other associated organisations provided facilities worth about Rs 1 crore which also included arrangements to send the people back to their states.

Shri Naqvi said that face masks have been prepared on large scale under SeekhoAurKamao skill development programme of the Minority Affairs Ministry, these masks are being distributed among the needy. The Minority Affairs Ministry will launch “JaanBhi, Jahan Bhi” awareness campaign to make the people aware of social distancing and other guidelines for safety from Corona.

Shri Naqvi said that all people of the country are working united and strongly to defeat challenge of Corona pandemic on the appeal of Prime Minister Shri Narendra Modi. The people belonging to Minority communities are equally contributing in this fight along with all the people of the society.

Preparedness and containment measures taken for COVID-19

Dr. Harsh Vardhan, Union Minister of Health and Family Welfare held a high level meeting today with Arunachal Pradesh, Assam, Manipur, Meghalaya, Mizoram, Nagaland, Tripura and Sikkim to review the status of COVID-19 in the north-eastern States along with the measures being taken for its containment and management, in the presence of Sh. Ashwini Kumar Choubey, MoS (HFW), here today. The review meeting (over video conferencing) was attended by Dr. R Lalthangliana, Health Minister of Mizoram, Sh. Alo Libang, Health Minister of Arunachal Pradesh, and Shri Piyush Hazarika, MoS, Health and Family Welfare, Assam along with senior officers from the eight States.

At the outset, Dr. Harsh Vardhan appreciated the dedication of all the States in combating COVID-19 in the country. “It is a huge relief and very encouraging to see green zones in most North Eastern States. As of date, only Assam and Tripura have active COVID-19 cases; the other States are all in the green zone. Let us focus and work together by converting the orange zones to green zones and maintain the protective status across the States”, he stated. Dr Harsh Vardhan stated that as on 9th May 2020, a total of 59,662 cases have been reported from the country in which 17,847 persons have been cured and 1,981 deaths had occurred. In the last 24 hours, 3,320 new confirmed cases have been added and 1307 patients were found cured. He added that the fatality rate is 3.3% and recovery rate is 29.9%. He also added that (as of yesterday) there are 2.41% present active COVID-19 patients in ICU, 0.38% on ventilators and 1.88% on oxygen support. Dr. Harsh Vardhan also said, “The testing capacity has increased in the country and it is 95,000 tests per day with 332 Government laboratories and 121 private laboratories. Cumulatively, 15,25,631 tests have been done so far for COVID-19.”

During the detailed interaction with the NE States, they highlighted various issues related to testing facilities, health infrastructure, surveillance, contact tracing etc., and also shared their best practices. Dr Harsh Vardhan mentioned about the various measures taken by the Centre to combat COVID-19 so far. “Political commitment at the highest levels of the Government, led by the Hon’ble Prime Minister Shri Narendra Modi is leading the government’s response against Novel Coronavirus Disease (COVID-19). India is prepared and fighting with the pandemic through its various timely measures and sturdy systems of surveillance for Novel Coronavirus”. Dr. Harsh Vardhan said.

The Union Health Minister informed that appropriate measures are being taken to combat COVID-19 and with the cohesive efforts of both Centre and States, adequately growing numbers of dedicated COVID hospitals, Isolation & ICU beds and Quarantine centres being identified and developed. These provide us the assurance that the country is well-prepared to face any eventuality due to COVID-19. Centre is also supporting by providing sufficient number of masks & Personal Protective Equipments, Ventilators etc. to the States/ UTs / Central Institutions, he further added.

To maintain the positive status of COVID-19 management in the North East, Dr. Harsh Vardhan advised the States to ensure that the returning migrant labourers, students and those returning from abroad should be screened and quarantined as per the guidelines and protocol laid down by the by Ministry of Health and Family Welfare and Ministry of External Affairs. He also stated that the guidelines for discharging patients is also revised and needs to be followed by all the States.

Dr. Harsh Vardhan stated, “While some states have worked in this direction, others need to focus on more effective surveillance, contact tracing, house to house survey and early diagnosis”. He said, “Surveillance for Severe Acute Respiratory Infections (SARI)/ Influenza Like Illness (ILI) should be intensified in unaffected districts and districts which have not reported cases from last 14 days and more through the IDSP network in collaboration with Medical College Hospitals”, he added. He urged States to aggressively pursue the download of Aarogya Setu app to aid contact tracing and surveillance, and for self assessment by people. He advised the States to put the information of the earmarked facilities for COVID-19 like the dedicated COVID hospitals, COVID Health Centres and Care Centers in public domain to help people access the services. The States were informed that funds have been allocated by Minister of DONER (Ministry of DoNER) for strengthening of the health infrastructure, and states need to submit their proposals for availing of funds under this fund.

For the States that have international borders, Dr Harsh Vardhan stated that these States need to take adequate measures at the border areas to prevent exposure by conducting screening of all individual entering the State at entry points and following quarantine protocol as per the guidelines.

The States were reminded that in addition to the COVID-19 care, non-COVID-19 health services were equally important and should not be neglected. Due attention was required to be paid to health care services such as ANCs for pregnant women, immunization drives, OPD/IPD services, screening of NCDs and TB diagnosis and treatment. Adequate measures for prevention of vector borne diseases also need to be taken, they were advised. Also, facilities of telemedicine and tele-counselling could be used for reaching to a larger population for their healthcare needs.  States were also advised to ensure that payments, salaries and incentives were paid to the healthcare staff, paramedics and other healthcare workers, for which States were also advised to ensure that the NHM funds were transferred to the Health Department. States were also informed that helpline number 104 in addition to 1075 can be used for grievance redressal for non-COVID essential services, and for providing the needed information to the people on their location etc. States were also advised to keep adequate stock of essential medicines and explore home delivery by engaging volunteers for the purpose.

In view of the larger prevalence of non-smoking tobacco usage in some of the states, Dr Harsh Vardhan advised the States to ensure that concrete actions were taken for prohibiting their wide usage and for prohibiting spitting in public places which shall help in preventing spread of COVID-19. Strong reforms are needed in this direction, he stated. He appreciated the effort of States that have banned the use of chewing tobacco and imposition of fine for  spitting in public places.

Ms. Preeti Sudan, Secretary (HFW), Shri Rajesh Bhushan, OSD (HFW), Ms. Vandana Gurnani, AS & MD (NHM), Dr. Manohar Agnani, Joint Secretary (MoHFW), Dr. S.K. Singh, Director, NCDC along with Principal Secretary (Health) and other senior state health officials participated in the meeting.

Retailers and Practicing Engineers, Architects and Town planners

Union Minister for MSME and Road Transport and Highways, Shri Nitin Gadkari today assured the Retailers Association of India and Practicing Engineers, Architects and Town Planners Association (India) that their request for registering as MSMEs will be examined expeditiously. He felt that this need to be explored from the point of these bodies being employment creators and whether various benefits such as insurance, medical, pension, etc can be provided to workers.

He also called upon the retailers to start exploring option of home delivery and maintaining social distancing, availability of sanitizers for customers/employees and use of masks at all retail outlets.

The Minister was addressing meetings today via video conferencing with the representatives of Retailers Association of India and representatives of Practicing Engineers, Architects and Town Planners Association (India) on impact of COVID-19 on their respective sectors. During this interaction, the representatives expressed concerns regarding various challenges being faced by them amid COVID-19 pandemic along with few suggestions and requested support from the government to keep the sector afloat.

He also called upon the Engineers, Architects and Town planners to explore decongesting over crowded cities and   participate in the development of rural, tribal and backward regions especially along the Green Expressways like the new Delhi -Mumbai Exoressway which is passing through such areas. He said various clusters and logistics parks will come up up on this ambitious project offering huge opportunities.

Some of the major issues highlighted and the suggestions given included: registering retailers/restaurants/architectural firms as MSMEs, starting Malls with conditions of safety measures related to COVID-19, starting operations of e- Commerce companies for non-essential items, relief in rentals for retailers, extension of moratorium to 9 months, reduction in bank interest rate from 10% to 4-5%, adherence to RBI guidelines by private banks, applying GST on receivables only, registration of builders as MSME who are already registered under RERA Act, etc.

Shri Gadkari called upon the industry that it is needed to be ensured by industries that necessary preventive measures are taken to prevent the spread of COVID-19. He emphasized on usage of PPE (masks, sanitizer etc.) and advised to maintain social distancing norms during business operations.

He mentioned that all the stakeholders must adopt an integrated approach to come over the crisis while ensuring the lives and livelihood of the people. Shri Gadkari also urged the industry to have a positive attitude during this time to tide over this crisis.

The Union Minister emphasized that special focus towards export enhancement is the need of the hour and necessary practices shall be adopted to reduce power cost, logistics cost and production cost to become competitive in the global market. Further, he mentioned that there is also need to focus on import substitution to replace foreign imports with domestic production.

He further mentioned that work on Green Express Highway has already started, and this is an opportunity for industry to make future investments in industrial clusters, logistics parks equipped with state-of-art technology. He opined that there is a need to expand the horizon of industrial cluster in areas other than metro cities and urged industries for participation.

The Minister recalled that Government of Japan has offered special package to its industries for taking out Japanese investments from China and move elsewhere. He opined that it is an opportunity for India which should be grabbed.

Shri Gadkari responded to the questions from representatives and assured all possible help from the government. He informed that he would take up the issues with related departments. He emphasized that industry should take a positive approach and tap the opportunities that will be created when the COVID-19 crisis gets over.

Creating Infographics With Young Learners

In our previous post, we wrote about the infographics that second grade students created for their social studies unit. We’ve created infographics this year with a number of our elementary grades, and through trial and error, we’ve perfected the process to help them gather their data facts for the topics they researched.

For younger learners, a clearly defined way of collecting the information is key. To do this, we designed the simple graphic organizer in this post to help them. The purpose of separating the number from the description is twofold. It not only clearly delineates the data from the facts, but it also aids in designing the actual infographic.

In order for the number to stand apart, it needs to be in its own textbox. This allows the data to be sized differently from the text in the infographic. The data piece is important. It should be more pronounced, in order to highlight each key fact in the overall design. We found that using this method with younger students also helped guide them through the editing process in writing the descriptions without repeating the number within the text.

Empowering kids to be their own content creators helps them visually look at ways to encode the design of information. We firmly believe that building the skills of design literacy develops a keen sense of how to manipulate content for maximum impact. It develops visual literacy and visual thinking, the key components of graphicacy. The process of shifting from linear to visual information aids the learning process by providing context for content individually and by educating others about their topics.
