Filling Spaces

‘Empty spaces in life are luxuries which you can fill with wisdom- the unending tunnel.’

Everyone in this world is gifted with exuberance to generate its own universe. Just like the space between stars, there are empty spaces in your life as well. Just like they shine, you are also made to sparkle. It’s upon you, how you fill those spaces. Everything has two aspects- the positive aspect and a negative one. Who created these aspects? Who told you that one thing is positive and the other one is negative? Take it just the way it is. Change your thoughts and change your thinking. Now the point comes, how will you fill these vacant parts of your life? Let me take you through it.

LOVE the secret to everything. The greatest contribution you can make in anybody’s life is love. Remove hatred from your heart and add love. The essence of love has so much potency that it will soak away every pain, every tear from your life. It has the highest frequency to fill gaps just as the gaps between your hands are filled by your spouse. Just as you are made for someone and someone is made for you, you are made human and humanity is made for you. Fill your gaps in humanity with love. Maybe you’re broken, maybe the world has given to you so much, maybe now you’re smiling but under that, you hide the pain, but there is always a place for love that will take away all your griefs. Now, this place is your empty space which you have filled with immense love.

Fortune favours the BRAVE. Remove the fear from your heart and add bravery. Learn to fight with your own struggles. You have to fight for yourself, nobody is going to fight for you. Take the first step of courage and the rest will be made for you. Many of us are afraid to take the first initial step. Remember you are the light and spread that glow for the path on which you have to go. Don’t be afraid, never doubt your capabilities. What if Mahatma Gandhi doesn’t take his first step for freedom? If Kalam didn’t make his first missile? If Graham Bell doesn’t make phones? Today, without their guts can India be able to achieve success? So go ahead, be brave enough to fight your battles, for your dreams. After all, there’s always light at the end of the tunnel. Congratulations! you’re on a way to achieve success, to fill those gaps.

Spread KINDNESS. You know you’re here in this world for a purpose. We are born in this world to spread smiles, to be kind. Every hand that offers love has a spirit to spread goodness. Ask yourself, are we kind enough to help? Do we have enough to give something to that poor child asking for food? Yes, of course! Live your life in abundance, after all, life is meant to be abundant. Until and unless you do not learn to help others you cannot go ahead in your life. Help others to get help. Understand the pain in others eyes, give a hand for help, you’ll feel heaven. Be generous to donate for those who are born in this world for this purpose. Have a noble attitude of giving.

A GRATEFUL heart is a magnet for miracles. Have you ever wondered why 96% of all the wealth is only in the lives of 1% people? It’s because they have an attitude of gratitude. They run business, not for the sake of money, but to create opportunities for others. This is the most powerful way to fill those empty spaces of your life with goodness. Have an attitude of developing gratitude. Take a piece of paper and write all the things you’re grateful for. The pen, laptop, your eyes, your beautiful face, your house and all those things which you see around you. Unless and until you are not grateful for the things you already have, how will you be grateful for the things you’ll get in future? The whole struggle of your life will end if you begin to be grateful for the things you have now. The greatest battles of your life are fought in these secrets above you. The empty spaces of your life can be filled with the peace of mind having open and clear space. As a wise human make your empty space your most beautiful opulence.

PUBG banned in India.

You may think its an action shooter game………no its much more.

PUBG

PUBG Mobile has been the center of the gaming news in India ever since the ban on September 2, 2020. As previously noted, ever since the ban, Google and Apple have removed the game from their app stores. In fact, Android and iOS smartphone gamers can only install the game if they had previously installed the game. Previous game installs mean that the game is still associated with their Google or Apple ID. This ban came just weeks after PUBG Corp teased the launch of its major 1.0 version. It is also worth noting that PUBG Mobile players can still play the game in India.

For tens of millions of gamers in India, Tencent’s PlayerUnknown’s Battlegrounds (PUBG) video game was a welcome distraction from the coronavirus pandemic. Then the government said it was pulling the plug.

Its not only shocking to all gamers in India but all over the world. Ban against Chinese apps are trending world wide.According to the information available online, Indian players can still play the popular Battle Royale game. However, this is only temporary before the game developer shuts down its Indian game servers. We are unsure about the timeline of the server shut down. However, the company behind the game has already revealed that it will work with authorities to resolve things. In the meantime, some players are either shifting to other Battle Royale games in the market or the PC version.

Some PUBG players in India have spent thousands of rupees to buy so-called Royal Passes, a way to earn quick rewards and have access to special missions in the game. Some took to Twitter to appeal the ban making #PUBG a top trend across India this week.

The ban is a blow for Tencent in India whose PUBG is a smash-hit in the country. India is PUBG’s biggest market by users, and according to analytics firm Sensor Tower, accounts for 29 percent of the apps total downloads. Still, Sensor Tower says PUBG’s revenue hit will be marginal as India only contributed about 2.5 percent of its lifetime revenue.

India first banned 59 Chinese apps, including ByteDance’s popular video-sharing app TikTok, Tencent’s WeChat and Alibaba’s UC Browser, in June.

PUBG is still available on PC, PS4 as well as Xbox. This is because the game was initially introduced for Windows PCs by PUBG Corporation, which is owned by BlueHole, located in Korea. The same firm is responsible for the PS4 and Xbox One versions of the game.

When it comes to the mobile version of the game, the Korea-based company was approached by China’s Tencent Games to license out the game. Then, the Chinese company launched the game for both Android and iOS platforms.

Given the connections of PUBG Mobile with China, the Indian government had to ban it over security and privacy concerns. However, if you are a fan of the game, you can still play it on a PC or a console. Do note that the change of device and the difference of mechanics will make you feel like a noob at start. But once you get the hang of it, you should be able to play with extreme confidence.

The Father of Indian Cinema

Satyajit Ray, Lata Mangeshkar, Dilip Kumar, Sivaji Ganesan, Asha Bhosle, Yash Chopra, Dev Anand, K. Balachander, Amitabh Bachchan are the list of Indian cinema legends who were honored by the Dadasaheb Phalke award, which is India’s highest award in cinema for “outstanding contribution to the growth and development of Indian cinema”. The man behind the name of this prestigious award is Dhundiraj Govind Phalke, popularly known as Dadasaheb Phalke, an Indian producer-director-screenwriter, known as the Father of Indian cinema.

An overall of 95 feature films and 27 short films, in his career, spanning 19 years, he is known as the Father of Indian cinema for writing, directing, producing, and distributing his debut movie, which is also India’s first movie Raja Harishchandra in 1913.

As a child, Phalke displayed great interest in the creative arts. Determined to pursue his dreams, he joined the Sir J.J. School of Art, Bombay (now Mumbai), in 1885. While there he pursued a variety of interests, including photography, lithography, architecture, and amateur dramatics, and he became adept even at magic. He briefly worked as a painter, a theatrical set designer, and a photographer. In 1908 Phalke and a partner established Phalke’s Art Printing and Engraving Works, but the business failed because of differences between them. It was Phalke’s chance viewing of the silent film The Life of Christ (1910) that marked a turning point in his career. Deeply moved by the film, Phalke saw it as his mission to bring all that was Indian to the moving picture screen. He went to London in 1912 to learn the craft from British pioneer filmmaker Cecil Hepworth. In 1913 he released India’s first silent film, Raja Harishchandra, a work based on Hindu mythology.

While there are news about him like, He had given several advertisements for seeking handsome actors for the lead role. But, these advertisements brought inadequate and non- professional talent and so, he was forced to add a line “ugly faces need not apply” and the miserable failure of his firm, the Phalke Diamond Company, a model studio to train technicians, actors. He made many more movies including renowned works like Mohini Bhasmasur in 1913, Satyavan Savitri (1914), Lanka Dahan (1917), Shri Krishna Janma (1918), and Kaliya Mardan (1919). which paved the way to the cinema industry we have now.

In recognition of Phalke’s contribution to the Indian cinema, the India government instituted the Dadasaheb Phalke Award in 1969, an award presented annually by the president of India for lifetime contribution to Indian cinema.

One Rule…can end up corruption by 70%

There are many people who talks about it , and few screams and fight to end it…………but since ages, it’s not being possible to make a difference, and still have not got independence from it’s foul smell, where someone dwelling in it , without sense. But, should we live in this rut forever ?…And to accept ourselves as incapable of destroying it, and to live like a looser.

I have a one brilliant rule, if it comes into play that undoubtedly changes the fate of the country. Before i reveal it, let us know why this rule works besides many measures being taken were failing since decades.
The main feasible condition for corruption, is lack of surveillance and awareness among people, and how it greatly damages our standard of living. So,creating awareness among all the people might sometimes work, but most of the time it rewards us with great disappointment. because, India has biggest population, it’s hard to make all of us to bring on to one platform with one voice.

But, there was no dearth of solution, if we think and the first said idea is………….
This idea works with collection of students, professors, university bodies, govt anti corruption and adminstrative bodies , police.
You may wonder that how, could you connect students, professors with police?
The bitter fact is, about 90% of indian passouts graduates are unskilled according to the several esteemed surveys. The main reason for it is, not having a platform to access practical knowledge, we have severe shortage of internship opportunities and real time project works. This problem can also be indirectly solved by our main idea.

The govt should make project works mandatory and give them more importance in their course, some may refrain with this idea…but if we couldn’t able to perform on projects itself, how can we able to sustain after getting to global market; initially it might be hard, but with support of our peer and lecturers we can excel gradually.
Now, we all should be assigned project works by our colleges in collaboration with national education body (now MHRD), only on all governmental assets and organisations….here comes a game changing shot. But, how is it possible?

The government must allow all the students to study governmental organisations, properties, and projects build by them.(let’s say a dam, hospital etc…). This helps to make an assessment for the quality of work being done in various govt fields and organisations. The reports submitted by students can be used by anti corruption agencies and help them to understand the situation at very ground level. As it’s not possible for anti corruption agencies to keep an eye over every inch of the whole country, they can use this student community as a strongest trustworthy network as they don’t provide false reports, if in case; the professor and the whole college who guided him will be felt guilt, and leads to their lack of reputation in society. so, this locking system can help students ro not provide false reports.

All the students must be allotted some projects on live aspects(like dams, hospitals ,industries built and being run by govt) in their respective fields, and we have to start analyzing their maintenance and prepare and submit the report of it’s quality and working efficiency. Here itself, we get an opportunity to dig up the flaws went up and to make a change by preparing efficient reports of the atrocities made and corruption that underwent.

For say, i’m a student of civil engineering, got a project to understand about kaleshwaram dam and have to submit report on it. I started by when it has built, and how much cost it took, what are the materials used in it, what are the technologies use in it, why does the walls of the dam is being getting cracks just after 5 years of its inauguration, what is the reason for recent fire accident……..when i submit the detail report to the college, I am gonna get my marks
The above said will be the work of every student in every field, not only engineering also health, law, agriculture, finance and every field.
Instead the anti corruption bureau working on intensive ground level, they can collect all the project reports form all colleges and will be easier for them to take action, by using the information.
As, it is a real time project, the professor of individual group must take care of no flaws and genuinity of information, as it will be a major source for higher govt authorities to take action.
In simple, students has to set on to study the past govt projects and organisations; and the detailed project reports and student community acts as a strong surveillance framework and it bring out the corruptions of the past as well as prevents the corruptions of the future. This idea, if it honed by the bright minds of our country, it can surely be an influential act.

MIDNIGHT SUN – The Movie Review

https://www.pinterest.co.uk/pin/112027109501875790/

Cast :

Be it ‘ Me Before You’ ‘The Fault In Our Stars’ or ‘Five Feet Apart’ all these good old sad romantics follow the same basic storyline. But I guess maybe because I’ve watched this genre after quite long so I just went away with the flow & am finally reviewing this movie now.

Portraying Katie Price this story is set all around her life. She has this rare genomic condition called Xeroderma pigmentosum (XP.) So this meant even the slightest bit of sunrays hitting her skin could make it fatal for her to live. Thus making her homebound since childhood & take homeschooling & other online courses rather than actually attending schools like other normal children of her age. In fact, she was also called a ‘vampire’ back in her childhood by her school friends. This is when she finds her BFF Morgan, who’s always by her side. Sharing their every soul-to-soul talks with each other.

Over time she got used to all this, as she’s the kind who accepts fate with open arms & a smile on her face however dire the situation be. This optimistic & carefree attitude is what I absolutely loved about her. With time passing by she had learned how to play the guitar & sing songs. So one such night, at her graduation her father Jack gifted Katie her mother’s guitar. At this, this couldn’t contain her excitement & headed out to the station to play it.

This is where she meets Charlie, her only crush she has admired all her life. This couldn’t be a dream right? She was actually face to face with the guy today. Charlie used to be a part of her schedule as she used to spend hours gazing at him through her window & stalking on social media. Confused & utterly shy, she leaves the place in haste. This is when mesmerized Charlie finds a diary she left behind, that she forgot in a hurry.

Finally, this results in their second meet, as Morgan & Charlie together setup this little prank on her. This time she finally holds herself together & has some normal conversation with him. This further leads them to more & more hangouts.

Of course, with time both of them grow to like each other more & more. The interesting part is their dates used to be at night, due to obvious reasons. But all this long, Katie didn’t confront Charlie. She used to bring out some lame excuse to not deal with the details about it. As she believed, confronting that will make her life more like a ‘disease’ than a ‘normal human.’

One fine night, when they were casually hanging a serious incident happened. This led Charlie to actually learn the truth thus beans were spilled. Being this concerned & serious boyfriend that he was, he made a research on the disease to collect every speck of information he could. Katie now had started shoving him off because she couldn’t see him in pain.

This is when Dr Fleming paid her dad a visit. Understanding the severity of the situation, & helplessly fish out ways & means for the unavailable cure Jack breaks up into sobs. The doctor informs him of how her brain had now begun disintegrating & the research studies had stopped due to no funding. As Jack breaks apart saying “Was it for all these days for him to learn, a dad raising his daughter all these years, will one fine day die. Albeit knowing very well there’s no cure to this. It’s heartbreaking to lose your child & finally coming in the face with reality.”

One fine day, a certain situation or a string of those, caused her dad to realize the growing affection between the two. So, he finally made the two meet. At this point I thought, Charlie could have easily lost his mind. But the way he still holds his sanity in place after meeting her knowing she concealed the truth is a matter of applause.

In the end, she finally lives her heart out with Charlie. Spending the most beautiful last summer of her life. This made me realize somehow, that there’s a sacrifice in life every time you want something bad. Just when she was compromising with her living all this long, she had her life in return. And vice versa.

Sadly, this followed to her tragic demise, leaving her dad all alone. Her boyfriend was now set out to begin his new school in Brooklyn, for he had got his scholarship there. But what touched my heart the most was how both of them fulfilled each other’s incomplete dreams & wishes all this while. Unlike most of these rugged dramas these days, their dates simply meant fulfilling each other’s dreams & wishes and living life up to the most.

Even after she left, she had made sure to fulfill his dreams. The best part was when her song got viral. This song was called the “Charlie’s song” by Katie Price. Charlie just like any other night had taken Katie, to realize another of her dream & made her sing at a studio to record. And it suddenly went viral after her demise, which throws a …. of joy to Charlie & Jack.

All the songs in the movie are exceptionally phenomenal imbibed with deep meanings. So if you are the one who likes these tear-jerker movies, it’s sure to send chills to down your spine. Also, don’t forget to bring your tissues along.

Space Opera: A Virtual World

Science fiction is for real, space opera is for fun – Brian W. Aldiss

SPACE OPERA is a subtype of science fiction which is colourful, dramatic, large-scale and full of scientific adventures, which usually focuses on unreal imagination that has a heroic central character and plot action. It is usually set in the relatively distant future, in space or on other planets. It often involves war, piracy, military virtues, and a very large scale action. In space opera, characters are displayed with powerful energy weapons and other advanced technology. There is a difference between Science Fiction and Space Opera. Science Fiction is generic literature which involves a generalization of scientific, engineering or social theories in futuristic ways in terms of settings, science and technology, space and time travel, parallel universe etc. whereas space opera is simply convectional drama in a futuristic or otherwise science-fiction-like setting. Some popular space opera includes THE MASSIVE FRANCHISE, STAR WARS and other films such as BATTLESTAR GALACTICA and BATTLEFIELD EARTH. Space Opera is a story in which science fiction elements are not critical to the plot and could be replaced by planetary equivalents. It usually emphasizes the effect of progress and inventions where the settings are carefully worked out to obey the laws of Physics, Cosmology, Mathematics, Astronomy and Biology. The thrilling experience of space opera with full of space adventures is stupendous for every sci-fi lover. The most famous representatives of space opera are:

E.E. “Doc” Smith

Brian Herbert and Kevin J. Anderson

Isaac Asimov

C.J. Cherryh

Orson Scott Card

Dan Simmons

Kevin J. Anderson

Michael F. Flynn

Ann Leckie etc.

Current conventions of space opera:

“there is no general agreement as to what [space opera] is, which writers are the best examples, or even which works are space opera”

what used to be science fantasy is now a space opera is entirely forgotten.”

-Hartwell and Kramer

The conventions of space opera have changed quite dramatically over time, and its audience has expanded enormously, peaking with video media like Star Trek and Star Wars.

Apart from the only imagination, we might be surprised that we are also living in a space opera World that does exist without realising it. The best example of it could be none other than the concept of ‘Aliens’, ‘UFOs’ and other supernatural powers that we are not aware of. It’s been for years since we’ve been hearing about UFOs entering our planet, about Aliens and moreover, scientists have also been talking much about the existence of Aliens as well! We have been talking about it all without realizing that all of this has become a part of our universe now. Variety of games about spaceships, aliens have been made until now, which in a way shows us how we are living in a space opera universe. Some news has been flashed out on TV screens about caught of Alien, bizarre creatures, unseen paranormal signs from different places of the World that are sufficient to explain our living in a real space opera World.

Significance & Evolution of Western music

https://in.pinterest.com/pin/584131014160455756/

The Mid & the late 2000s was the era of songs when you had the most beautiful songs. The lyrics, rhythm & music just made so much sense & blended so perfectly to fit in each other. I still remember swaying my head listening to these tracks, whilst sitting by the window seat of local trains. As the cool breeze hit my face & the music captivated my soul. Truly an underrated experience.

Be it pop, jazz, heavy metals, or blues every musical composition had some deep & pleasant meanings to lend.

Remember the days back when we used thomp our feet on Shakira’s ‘Waka-Waka’ & ‘Closer’ by Chainsmoker’s. And if you are a fan of laments, then you may also recall sinking your heart listening to ‘A Thousand Years’ by Christina Perri or ‘Let Her Go’ by Passenger

You bet I didn’t forget all-time fave & heartthrobs of millions right? The One Direction! Giving a series of popular hits back then . ‘Live while we are young’ & ‘What makes you beautiful’ being the liveliest tracks I’ve ever heard. I don’t know if you’ve ever heard to the songs of this American musical drama movie called ‘The Sound of Music.‘ It was made in the mid-1960s. But if you haven’t, you must give it a try.

To the present, where we are mindlessly mesmerized by the songs that hold no proper significance of lyrics. No wonder why the current generation songs aren’t sought for traces of culture & ethics. Well, this is a never-ending debate that can be conquered by none.

A good song helps not only to have a rest but it’s also helpful for learning new vocabulary. If you like listening to music, your hobby can prove to be quite beneficial to you. As many people including myself, believe in music therapy. This helps you deal with your physical, mental & emotional by establishing a therapeutic relationship with music.

“One good thing about music is when it hits you, you feel no pain”

                                                           ~Bob Marley

Listening to these Billboard chart artists like- Taylor Swift, Marshmello, Dua Lipa, Ed Sheeran, Selena Gomez, Billie Eilish, Cardi B, Beyonce, Ariana Grande, Harry Styles are treat to ears. Similarly, bands like The Beatles, Maroon 5, The Weeknd, Imagine Dragons. The list goes on & on. Also, pardon me if I missed out on some importants.

From the era where one used to feel at bliss listening to music through gramophone to attending live gigs. We have come a long way. Attending the live concerts where the audience sings in chorus with the singer over & over again. And then finally as it ends, a sudden silence falls for a fraction of seconds. Moments later the crowd breaks into a round of applause. Isn’t it intoxicating & magical all at the same time?

K-pop bands like BTS, Army, Blackpink are no behind in taking the music levels to new heights & breaking the internet. Despite the fact of being unable to understand their language, fans all over the world haven’t given up on them. As songs sometimes doesn’t need understanding all it needs is music & soul to connect with. But that doesn’t necessarily imply mindless lyrics are all the same.

https://www.pexels.com/

Have you ever heard of this newly emerging virtual artist called, Lil Miquela? She’s currently taking the music world by storm & has a booming fan base. A CGI character created by Trevor Mcfredries & Sara DeCou. Precisely a robot of 19-years who has released some crackling electro-pop singles. Thus taking the internet by storm.

So this is how time flew by, from using instruments to produce musical notes to just using certain software to produce EDMSs. The simple lyrical songs overtime replaced the hearts of the masses by rap songs.

Books are amazing!

In today’s world, problems like stress, anxiety etc. are a common issue. Studies have found out that at an average of 10 people, 6 usually suffer from these issues. The solution? Well , a distraction. A distraction for some hours, to be free from all the notifications, the social media posts, the pending work, the recent gossip, everything. Because we all have adapted ourselves to this ‘lifestyle’ so readily that we overlooked the consequences like the mental issues we are facing today. Not only adults, but even children and adolescents! But, can you imagine a book can help you with that? No? So here are some  ridiculously amazing things a book can do!

Research  has shown that reading gradually helps insomnia patients to sleep. Many people suffering with anxiety and depression, even by reading just for minimum 20 minutes everyday, helped. It may sound boring to read but when you do start, you explore so many things , imagine yourselves in God knows many world’s,

you just can’t stop!

•Makes your day peaceful

According to a research, reading may relax one’s body by lowering his heart rate and easing his muscles. It’s because reading may include you battling  a whole army but in your mind! The 2009 study found out that reading calms your mind and lowers aggression. Books help you to think, interact and imagine infinite thoughts.

•Improves your vocabulary and pronunciation .

As you read you find out meanings of words you’ve never heard of , often helping in improving your writing skills.By doing this, you get familiar to many words and their synonyms. English is a mixture of various ancient languages, which means you also learn the origin of the words. This makes one understand various cultures and spoken languages and dialects. When you understand  a particular word, you start trying to pronounce it. Eventually you are able to pronounce difficult words easily and helps for a  fluent pronunciation .

•Makes one curious!

While reading, you might find different terms, anthologies etc. You acquire knowledge through the books. And this does not require any research, it is an experiment you can do on yourself ! We humans  love to learn, even if we deny it. Everything you do, everything you act  was through observing, examining and learning. Be it now to play video games or to read. While video games are fun to play, it makes one hard to focus when given a topic to elaborate. It makes you experience different situations, through which one inculcates it in his life as well. Curiosity may have killed the cat but satisfaction had bought it back!

•Increases your confidence.

Confidence is not procured by fairness creams, but  through your acts and work. Now that your vocabulary is increased, your words are smooth as butter and this makes you feel confident. Children stutter while reading in front of a crowd. Reading , indirectly Maidstone read in a correct grammatical order because you’ve practiced. Not only for English language ,but every language, if one practice while reading them, he is sure to add that language. Sure enough you can’t just keep reading the whole day, while that would have been great, but unfortunately ,we all have other crucial works to complete as well. But we can make it a point to read at least a paragraph from a novel, or a small  article from the newspapers/magazines. Our first step is to start reading, not just making timetables about reading on this particular time. They ended up reading nothing and wasting all the time making timetables. It’s alright if you just can’t read due to excessive work assignments, one should read according to his own speed and his own convenient time but remember to read everyday.

•Introduces you to various concepts and develops your imagination

Books have their own hierarchy. Listed from self help to mystery, from rom-com to thriller, from action(yes they do!)

to sweet romance stories, fantasy etc. and so many authors , trying hard everyday to give you a variety of stories and so much more. Printed books are more preferred over digital reading for they provide a lesser strain on your eyes but it’s alright if you read e- books  in a limit. If you are not able to get your hands on a printed books , the e- version is always available with paid memberships. If you are looking for free books, apps like Wattpad, Radish fiction etc give you access to many interesting stories . Wattpad is also a field where you, yourself can write your own stories. Infact, many Wattpad stories are published and famous , for example The Storm and silence series by Rob Thier (comedy) , Chasing Red by Issabelle Ronin (romance) and the After series by Anna Todd (the book was  produced into a movie as well!)

SC Orders CBI Probe In Sushant Singh Rajput Case

In a big setback to Maharashtra government which never wanted CBI probe in Sushant Singh Rajput case, the Supreme Court in this high profile case titled Rhea Chakraborty Vs. State of Bihar & Ors. in Transfer Petition (Crl.) No. 225 of 2020 delivered on August 19, 2020 has in no uncertain terms clearly, categorically and convincingly upheld the Bihar Government’s order to transfer the probe in the case related to the death of the Bollywood actor – Sushant Singh Rajput to CBI. Sushant was found dead in his house in suburban Bandra in Mumbai on June 14. Rhea’s lawyer Shyam Divan who is a senior and eminent lawyer of Apex Court argued that Rhea had no qualms with the case being transferred to the CBI but not at the behest of the executive orders of the Bihar Government. Another senior and eminent advocate – Vikas Singh who appeared for Sushant’s father urged the top court to hand over the case of the late actor’s mysterious death to CBI!

Most intriguingly, the Bombay Police had inexplicably and questionably failed to lodge an FIR even after the lapse of 65 days till now which undoubtedly has created bona fide and serious lingering doubts on its neutrality, credibility and commitment to resolve this case in fairness according to the rule of law! On the contrary, Bihar police had promptly lodged the FIR as soon as they received the complaint from the deceased actor’s father KK Singh at Rajiv Nagar police station in Patna against Rhea and six others including her family members for abetting the actor’s suicide which enhanced its credibility in the eyes of the people!

No doubt, a mandatory time limit of 24 or at the most 48 hours must be fixed within which the police must be made to register the FIR and strictest action must be taken against those police officials who refuse to lodge the FIR. Time and again we keep hearing many such cases where police either refuses to lodge an FIR or forwards some excuse or the other for not lodging an FIR which defeats the very purpose for which it is lodged! It is a long pending reform that is still in waiting queue and now it is high time that it be implemented at the earliest! This will help the litigants a lot especially the victims in their quest for justice and not further rub salt on their deep wounds further!

To be sure, a single Bench of Apex Court of Justice Hrishikesh Roy held that Bihar police had jurisdiction to register FIR with respect to the suicide of Sushant Singh Rajput at the complaint of the actor’s father and held that the transfer to CBI was valid. The Apex Court has directed the Maharashtra police to hand over the case files to CBI and to render necessary assistance. The Apex Court held clearly that, “It is court ordered CBI investigation. Maharashtra police must comply and assist.” Very rightly so!

To start with, the ball is set rolling in para 1 of this notable judgment wherein it is observed that, “This Transfer Petition is filed under section 406 of the Code of Criminal Procedure, 1973 (for short “CrPC”) read with Order XXXIX of the Supreme Court Rules, 2013 with prayer for transfer of the FIR No. 241 of 2020 (dated 25.7.2020) under Sections 341, 342, 380, 406, 420, 306, 506 and 120B of the Indian Penal Code, 1860 (for short “IPC”) registered at the Rajeev Nagar Police Station, Patna and all consequential proceedings from the jurisdiction of the Additional Chief Judicial Magistrate III, Patna Sadar, to the Additional Chief Magistrate, Bandra, Mumbai. The matter relates to the unnatural death of the actor Sushant Singh Rajput on 14.6.2020 at his Bandra residence at Mumbai. The deceased resided within Bandra Police Station jurisdiction and there itself, the unnatural death under section 174 of CrPC was reported.”

While elaborating on the petitioner’s version, it is then enunciated in para 2 that, “The petitioner is a friend of the deceased, and she too is in the acting field since last many years. As regards the allegations against the petitioner in the FIR, the petitioner claims that she has been falsely implicated in the Patna FIR, filed by Krishan Kishor Singh (respondent no. 2) – the father of the deceased actor. The petitioner and the deceased were in a live-in relationship but on 8.6.2020, a few days prior to the death of the actor, she had shifted to her own residence at Mumbai. According to the petitioner, the Mumbai Police is competent to undertake the investigation, even for the FIR lodged at Patna.”

To put things in perspective, it is then disclosed in para 5 that, “Representing the State of Bihar, Mr. Maninder Singh, the learned Senior Counsel submits that the Complaint disclosed a cognizable offence and therefore, it was incumbent for the Patna Police to register the FIR and proceed with the investigation. Since allegations of criminal breach of trust, Cheating and defalcation of money from the account of the deceased are alleged, the consequences of the offence are projected to be within the jurisdiction of the State of Bihar. The Senior Counsel highlights that the Mumbai Police was conducting the enquiry into the unnatural death of the actor u/s 174, 175 CrPC and such proceeding being limited to ascertaining the case of death, does not empower Mumbai Police to undertake any investigation, on the allegations in the Complaint of the Respondent No. 2, without registration of an FIR at Mumbai . Referring to the non-cooperation and obstruction of the Maharashtra authorities to the SIT of Bihar Police which reached Mumbai on 27.07.2020 and the quarantined detention of the Superintendent of Police, Patna who had reached Mumbai on 02.08.2020, senior counsel argues that the Mumbai Police was trying to suppress the real facts and were not conducting a fair and professional inquiry. Since no investigation relatable to the allegations in the complaint was being conducted and FIR was not registered by the Mumbai Police, the action of the Bihar Police in registering the Complaint, is contended to be legally justified. On that basis, the Bihar Government’s consent for entrustment of the investigation to the CBI is submitted to satisfy the requirement of Section 6 of the DSPE Act. Besides, as the petitioner herself has called for a CBI investigation and as the CBI has since registered a case and commenced their investigation, (on the request of the State of Bihar), the Senior Counsel submits that this transfer petition is infructuous.”

As it turned out, it is then held in para 20 that, “In the present case, the Mumbai Police has attempted to stretch the purview of Section 174 without drawing up any FIR and therefore, as it appears, no investigation pursuant to commission of a cognizable offence is being carried out by the Mumbai police. They are yet to register a FIR. Nor they have made a suitable determination, in terms of Section 175(2) CrPC. Therefore, it is pre-emptive and premature to hold that a parallel investigation is being carried out by the Mumbai Police. In case of a future possibility of cognizance being taken by two courts in different jurisdictions, the issue could be resolved under Section 186 CrPC and other applicable laws. No opinion is therefore expressed on a future contingency and the issue is left open to be decided, if needed, in accordance with law.”

As a corollary, para 21 then holds that, “Following the above, it is declared that the inquiry conducted under Section 174 CrPC by the Mumbai police is limited for a definite purpose but is not an investigation of a crime under Section 157 of the CrPC.”

To state the palpable, it is then rightly pointed out in para 30 that, “Having regard to the law enunciated by this Court as noted above, it must be held that the Patna police committed no illegality in registering the Complaint. Looking at the nature of the allegations in the Complaint which also relate to misappropriation and breach of trust, the exercise of jurisdiction by the Bihar Police appears to be in order. At the stage of investigation, they were not required to transfer the FIR to Mumbai police. For the same reason, the Bihar government was competent to give consent for entrustment of investigation to the CBI and as such the ongoing investigation by the CBI is held to be lawful.”

Be it noted, the Bench then observes in para 36 that, “The ongoing investigation by the CBI is held to be lawful. In the event a new case is registered at Mumbai on the same issue, in the fitness of things, it would be appropriate if the latter case too gets investigated by the same agency, on the strength of this Court’s order. Such enabling order will make it possible for the CBI to investigate the new case, avoiding the rigors of Section 6 of the DSPE Act, requiring consent from the State of Maharashtra.”

Most significantly, it is then held unequivocally in para 40 that, “The actor Sushant Singh Rajput was a talented actor in the Mumbai film world and died well before his full potential could be realised. His family, friends and admirers are keenly waiting the outcome of the investigation so that all the speculations floating around can be put to rest. Therefore a fair, competent and impartial investigation is the need of the hour. The expected outcome then would be, a measure of justice for the Complainant, who lost his only son. For the petitioner too, it will be the desired justice as she herself called for a CBI investigation. The dissemination of the real facts through unbiased investigation would certainly result in justice for the innocents, who might be the target of vilification campaign. Equally importantly, when integrity and credibility of the investigation is discernible, the trust, faith and confidence of the common man in the judicial process will resonate. When truth meets sunshine, justice will not prevail on the living alone but after Life’s fitful fever, now the departed will also sleep well. Satyameva Jayate.”

Truth be told, it is then stated in para 41 that, “In such backdrop, to ensure public confidence in the investigation and to do complete justice in the matter, this Court considers it appropriate to invoke the powers conferred by Article 142 of the Constitution. As a Court exercising lawful jurisdiction for the assigned roster, no impediment is seen for exercise of plenary power in the present matter. Therefore while according approval for the ongoing CBI investigation, if any other case is registered on the death of the actor Sushant Singh Rajput and the surrounding circumstances of his unnatural death, the CBI is directed to investigate the new case as well. It is ordered accordingly.” About this inherent powers under Article 142 of the Constitution, we see that the same has been discussed in detail in para 37 also while dwelling on the case of Monica Kumar (Dr.) and Anr. Vs. State of Uttar Pradesh and Others (2008) 8 SCC 781 pointing out when it can be invoked to render justice.

It is a no-brainer that if the Bombay Police had lodged FIR in time and had followed the proper procedure, the Supreme Court would never have ordered CBI to investigate this sensational Sushant death case! While it conceded that there was nothing to show any wrongdoing by the Mumbai police but as it had not yet initiated an FIR even after 65 days and was carrying out a limited inquiry under Section 174 of CrPC pertaining to inquiry into unnatural death, it lost the plot and ultimately the case was handed out to CBI! All the police of all the States in India must always be very careful of lodging the FIR in time as if they don’t do then they will have to face the consequences as we see in this case also!

No doubt, all those who are in police must read the relevant part of para 23 of this landmark judgment which clearly, categorically and convincingly states that, “Registration of FIR is mandated when information on cognizable offence is received by the police. Precedents suggest that at the stage of investigation, it cannot be said that the concerned police station does not have territorial jurisdiction to investigate the case. On this aspect the ratio in Lalita Kumari Vs. Govt. of UP (2014) 2 SCC 1 is relevant where on behalf of the Constitution Bench, Chief Justice P Sathasivam, pronounced as under:-

“120.1. The registration of FIR is mandatory under Section 154 of the Code, if the information discloses commission of a cognizable offence and no preliminary inquiry is permissible in such a situation.

120.2. If the information received does not disclose a cognizable offence but indicates the necessity for an inquiry, a preliminary inquiry may be conducted only to ascertain whether cognizable offence is disclosed or not.””

It is high time and now Centre must also take the requisite steps to make it mandatory for the police to lodge an FIR within a stipulated time frame so that the litigants especially the victims are not traumatized further after the crime has occurred! Also, what is most important is that strictest action must be stipulated against all those policemen who refuse to lodge FIR! It brooks no more delay now!

It goes without saying that people must also be given an alternative to lodge an FIR if police refuses with some other duly constituted body like the State Human Rights Commission or some other body so that people don’t have to suffer interminably as we repeatedly hear cases of police refusing to lodge FIR and instead building pressure on the victim to keep quiet! How can this huge injustice be tolerated any longer? Why should it be allowed any longer?

Bluntly put: Why can’t men in uniform in police be straightaway dismissed from service for refusing to lodge FIR? Why can’t they also be sent to jail for ten to fourteen years for refusing to lodge FIR? Only strong will power is needed which is there in abundance in this present dispensation as we saw when they amended Article 370 of the Constitution! But the moot question is: Will this Government show equal interest on this also?

ONLINE CLASSES : ONLY CONS

Those were the days when we all used to go to the college or schools through metro and bus , tasting every corner of the life . That happiness of chasing the bus just because we are getting late for the classes , still get late in the class . The adventure of travelling with sudden jolts in the bus has another important role in our journey . we used to go to college , meet and greet with our friends , enjoy and work on ourselves by participating in diffrent societies , physically . A wonderfull journey , it is . But , this covid -19 has ruined all the plans and everything has transformed from offline mode to online mode . At first , we all were excited to study through online classes as we are relieved from our hectic schedule and can do work just by sitting at home . But , it is not like that , rather it has increased more stress and anxiety in us , which is not good for our health.

The online mode is making us sit in front of our phone and laptop early in the morning as everything is work from home. Anxiety has increased among the people of every age and we have become lazy , a bad news it is . It is impacting on our eyes and causing us headache . We have to bow down in front of this situation as its about our life . It is giving us back aches . In my opinion , yes it is a smart move in this time but a reliable move .

The work is easy for teachers as they teach us using PPT’s and our doubts remained uncleared . Earlier , teachers were not used to put efforts and take the classes regularly , but , now classes are also happening regularly as it is really easy for them , not much efforts required for them to put in . The classes are not fruitful for us , as it is creating blur in our minds for most of the topics . On the other hand , the situation demands this kind of studying , at least we are studying.

I pray for the situation to get normal as soon as possible so that we can study they way we used to , with much more clarity.
