Oobleck? Yes you read it right. Thinking you have never come across this term in all your life? Well, Oobleck is nothing but a mixture of cornstarch and water. What does corn starch and water have anything to do with speedbumps? The answer can make you marvel at the human mind with its simple, yet smart thinking capabilities.

Why traditional speedbumps are a problem?

Speed bumps have been a part of the road culture for more than 5 decades now. The were introduced in the 1970s and have managed to exist till now. They are raised ‘bumps’ with 3-4 inches of thickness, used as speed reducing mechanisms for vehicles on road, specially in speed sensitive regions. While they do their purpose, there are some unwanted problems related with the usage of speed breaks, ranging from economical to health concerning issues.

Some of the problems are:

  • Inconsistent speed and abrupt slowing of vehicle due to speed bump and then picking up the speed leads to higher emission, leading to air pollution.

  • May cause spinal damage to some people

As I already mentioned, Oobleck is a corn starch slurry. This mixture is filled in long cylindrical shaped rubber reinforced tubes resembling a speed bump which is secured to the road. When vehicles pass this speed bump with a slow speed, the liquid parts and allows the vehicle to pass thorugh as if there was nothing present. But, when a vehicle with high speed tries to pass through, the liquid hardens, thus limiting the speed of the vehicle. How does that happen?

Non-Newtonian fluids and the science behind

Oobleck is a non-Newtonian fluid. A non-Newtonian fluid is one whose viscosity changes under stress. That is, when you apply force to such liquids, it hardens (viscosity increases) and on the release of the force, it gets back to its normal form. But other ‘normal’ Newtonian liquids do not exhibit such characteristics. On application of stress, they do not resist that stress and thus does not cause a strain. Stress is when you hit a metal with hammer and strain is the resulting dent occurred due to the stress.

Non-Newtonian fluids are not rare. We come across them in our daily life without even knowing them. For instance take tomato ketchup. Many times, you may struggle getting the ketchup out from the bottle, and you unconsciously tap the back of the bottle. And you will see that ketchup now falls into your plate. Ketchup is a non-Newtonian fluid whose viscosity decreases when stress is applied. By tapping the back of the bottle, a stress is applied and the ketchup becomes runnier, thus easily pouring out.

You can easily try this at home by adding 1/2 cup of water gradually to 1 cup of corn starch. After the powder is fully wet and feel like liquid, its time to get your hands messy. Dip you hands into the mixture and try making a ball. It will start to shape due to the stress you are applying with your hand. As the speed bump works as per the speed of the vehicle, there is no need for vehicles to slow down hence increasing fuel efficiency and decreasing emissions. The cost of installing and maintenance is low compared to traditional speed bumps. It does not do damage to the vehicle as the work of shock absorbers is reduced. Hence it is high time that countries start adopting this technology and try to reduce the damages we do to the environment one speed bump at a time!

If non-transferable property is transferred by a sale-deed, it is void and liable to be cancelled.

Transfer of property means an act by which a living person conveys property in present or in future, to one or more other living persons (or to himself) and to transfer property is to perform such act.

ESSENTIALS OF A VALID TRANSFER :

In order to constitute a valid transfer of property, whether movable or immovable, under the Transfer Of Property Act :

  1. the property must be transferable
  2. the transfer must be competent to transfer
  3. the transferee must be competent to take the transfer
  4. the consideration or object of the transfer must be lawful
  5. the transfer must not be opposed to the nature of the interest affected thereby
  6. it must be in the manner and in the form required by the act if any.

WHAT PROPERTIES MAY NOT BE TRANSFERRED :

The general rule is that property of any kind may be transferred  but here are properties which cannot be transferred :-

  1. Spes Successionis
  2. Right of re-entry

PERSONS COMPETENT TO TRANSFER :

Every person competent to contract and entitled to transferable property or authorised to dispose of transferable property not his own, is competent to transfer such property either wholly or in part and either absolutely or conditionally, in the circumstances, to the extent and in the manner, allowed and prescribed by any law for the time being in force.

SECTION 11 OF THE CONTRACT ACT provides what persons are, and what persons are not competent to contract. Every person is competent to contract who is of the sound mind and is not disqualified from contracting by any law to which he is subject.

That means evidence can be in given in any form oral, documentary as well as electronic.

A document means anything which is a permanent record of the happening of a fact. Oral statements of a witnesses become evidence only when the right and opportunity is given to the opposite party to cross-examine, failing which they remain only bare statements.

The word ‘evidence’ in its relation to law includes all the legal means exclusive of mere arguments which tend to prove or disprove any fact the truth of which is submitted to judicial investigation.

Every case that comes before a court of law has a fact story behind it. Facts out of which cases arise keep happening in the ordinary course of life. The means by which facts are proved governed by the law of evidence. The function of the law of evidence is to lay down rules according to which the facts of a case can be proved or disproved before a court of law. The means which can be used to prove a fact are all controlled by the rules and principles laid down by the law of evidence.

The facts of the case will be proved by way of evidence act whether it is civil cases or criminal cases. It is the burden of proof which is different in both the cases like in Civil Cases burden of proof will be the balance of probability and in case of criminal cases the facts must be proved beyond all the reasonable doubts.

For those of you who haven’t heard of it, surface duo is a foldable smartphone with two screens. The scope of foldable screens is not just limited to the smartphone industry. Is it worth the hype?

To be honest, the answer is disappointingly no, considering common users. Due to the dual screen, an extra layer of hand gestures are added the name of enhancements which only make it more complex. For one screen you have to remember to double tap to wake the screen, remember gestures for opening certain features, to switch apps between the two screens. All of it makes the user interface difficult.

All basic features that other phones have, like camera, speakers, battery performance are all second generation here. Some drawbacks observed are:

  • Confusing Software
  • Basic features- Second generation
  • No 5G
  • No headphone jack
  • No wireless charging
  • Camera and Speakers- Not so good for a high end phone

What to expect in the future?

Even though it suffers from major functionality issues, Microsoft took the big leap. It has set foot in a new field which requires more exploration. But it is sure that in the future all giant brands will release a range of foldable phones. And one more exciting news is that the Surface Duo 2 is said to be released this year. Hopefully the major drags of the previous version are rectified in Duo 2 and meanwhile all we can do is wait for the future of foldable phones unveil before us.

Government plans to deliver one crore vaccine doses per day from July

The increase of vaccinations against covid 19 on a mission mode is planned by the centre. An average of around one crore vaccines per day is going to be the target implementation around mid of July and August. The local production and supplies of Sputnik v are likely to start along with the improvement of vaccine supplies in Bharat Biotech and Serum Institute of India. The chairperson of the National Task Force, N K Arora stated that they are aiming to give one crore vaccinations every single day and will have 20 to 25 crore of vaccine doses by the end of August. To have more number of covid 19 vaccinations sites with the usage of entire network of one lakh child immunisation centres especially in the remote areas has planned by the government. Unborn person means a person who has not come into existence.

As a general rule, a property can be transferred between the two living persons that means persons should be in existence at the time of the transfer of the property.

Section 5 of the Transfer of Property Act,1882 defines the Transfer of property as :

Transfer of Property” means an act by which a living person conveys property, in present or in future, to one or more other living persons, or to himself, 1[or to himself] and one or more other living persons; and “to transfer property” is to perform such act.

But, Section 13 of the TRANSFER OF PROPERTY ACT provides for remedy by which a property can be transferred or an interest can be created in the property in favor of an unborn person. This is not an exception for the general rule, in fact it is an extension of the general rule which widens the scope to make the transfer of the property.

Where on a transfer of property, an interest therein is created for the benefit of a person not in existence at the date of the transfer, subject to a prior interest created by the same transfer, the interest created for the benefit of such person shall not take effect unless it extends to the remaining interest of the transferor in the property.

EXAMPLE : A transfers property of which is the owner to B, in trust for A and his intended wife successively for their lives and after the death tog the survivor, for the eldest son of the intended marriage for life, and after his death for A’s second son. The interest so created for the benefit of the eldest son does not take effect, because it does not extend to the whole of A’s remaining interest in the property.

LEGAL CONSEQUENCES 

The transfer in favor of unborn person must be preceded by a life interest and that only absolute may be given to the unborn has following legal consequences :

  1. The intermediary person living at the date of the transfer is to be given only life interest. It means giving him only the right to enjoyment and possession. He has to preserve the property like a trustee during his life-time on behalf of the unborn.
  2. The unborn must come into existence before the death of the person holding property for life. If the unborn comes into existence say, after month after the death of the last living person, the property shall revert back to the transferor or his heirs.

POSTPONEMENT OF ENJOYMENT

The enjoyment of the property transferred for an unborn person can be postponed for some future date. Section 14 of the Transfer Of Property act,1882 makes rule against perpetuity which means the postponement cannot be for unlimited period.

INTEREST AT THE TIME OF BIRTH

Section 20 of the Transfer of Property Act, where on a transfer of property, an interest therein is created for the benefit of unborn person not then living, he acquires upon his birth, unless a contrary intention appears from the terms of the transfer, a vested interest, although he may not be entitled to the enjoyment thereof immediately on his birth.

 

CONCLUSION

A property can not be directly transferred to an unborn person but if prior life interest has been created and the absolute interest has been made that is the whole of the remainder to unborn, then a property can be transferred in favor of an unborn person.

Japan to extend virus emergency with safe Olympics at stake

Japan is set to extend a corona virus state of emergency in Tokyo and other areas with infections not yet slowing to levels it can safely host the Olympics opening in the next 50 days. The extension is needed as people are increasingly roaming in public, especially in Tokyo and Osaka, when they should be doing the opposite, and it’s feared that lifting the emergency would cause an instant rebound in infection. The Olympics are scheduled to start on July 23 after a one year postponement due to the pandemic, and worries about the new variants and Japan’s slow vaccination rollouts have triggered calls from the public and medical experts to cancel the games. Olympic organizers have to decide around that date whether to allow any fans at all, after overseas spectators were banned months ago. The international Olympic committee has also said the Olympics would go ahead even if the host city Tokyo is under emergency measures. Japan has reported about 7,30,000 cases of infection and more than 12,700 deaths.

Life is an emotional experience, the quality of emotion that we experience every day determines the quality of our life. We all should know how to control our emotion or otherwise, our emotion controls us. The major problem with most people is, they are not able to understand what they feel or they find it harder to name their emotions. This is the place where we should become emotionally intelligent. Emotional intelligence plays an important role in our life because every human in the world has his or her own emotion. It allows you to understand and manage your emotion in order to self-motivate and create a positive social interaction. Understanding our emotions helps us to know more about ourselves. Our emotion not only affects us it also affects the other people around us. “There are hidden messages in every emotion”. Emotions are action signals very often their meanings are hidden but we ignore the hidden messages. All emotion is a call for action. Emotion is the inner game of success or failure. There are more than 3000 various emotions. We have only 1051 pleasant emotions and other are unpleasant emotion. This shows that we people are more focused on unpleasant sides than the bright side. We humans cannot forget the unpleasant emotion or feeling unless we let it go. Compressing our emotions and feelings leads us to mental depression. It is always good to express our emotions. When we are in control with our emotions that means we are emotionally intelligent. When emotion controls you, then it means you are emotionally slaved. Once when you are familiar with your emotion, then hidden messages, action signals even unpleasant emotion becomes your ally. Mostly we are aware of messages hidden behind pleasant emotion, but we are not aware of the hidden message behind unpleasant emotion. All the negative emotion contains positive message and instructions that help us to grow into a better human being.
Some of the unpleasant emotions that most of them face regularly are hurt, pain, anger, fear, guilt, unworthiness, and loneliness.
HURT
Hurt is a painful emotion that comes when we experience loss. It may be a loss of trust or expectation from the person we love. When we face betrayal or ignored by the person we care about, that feeling leads us to this unpleasant emotion hurt. There is always a way to get hold of ourselves from the unpleasant emotion. Always we expect something from our loved one, but we all know that expectation kills. So communicate with your loved ones explain yourself to them, explain your need and expectation to them. Certain things may be valuable to you but not them, so it is always better when you are open to your loved ones so that they can understand you.
ANGER
Anger is another unpleasant emotion every one of us faces in this fast-growing world. Anger is a physiological sensation due to a biochemical reaction in your body. Anger is a secondary emotion where frustration is the primary emotion. We feel frustrated when we don’t get what we want. We all have some important rules and standards in our life that we hold, when those rules have been violated by someone or maybe even by ourselves, it leads us to this unpleasant emotion anger. The hidden message in frustration is that we can do better and we need to change our approach to get better.
DEPRESSION
When we feel helpless and unworthy it leads us to the unpleasant emotion which is depression. When someone focuses on the minor things in life than the major one it is the primary reason for depression. The hidden message in depression is to find the purpose of life. When we are depressed we feel unworthy and we don’t feel the meaning of our life. Which may lead us to suicide.
FEAR
Fear is one of the terrible unpleasant emotions. The best way to overcome your fear is to face them, face the fear that you are afraid of and then they will leave you. Grief is one of the unpleasant emotions similar to fear. Acceptance is the answer for grief, just let it go then you feel relieved. The hidden message in fear is it is simply anticipation that something is going to happen soon, so be prepared for it.
LONELINESS
Loneliness is the unpleasant emotion which leads us to many unpleasant emotion like depression, unworthiness, anxiety, hurt and so on. Loneliness is about not only being alone it’s about being avoided by the person we love and also by society. It makes us to feel empty, alone, and unwanted. When your not a sociable person then you feel lonely from time to time. The hidden message in loneliness is that your need to become more sociable and more expressive.

We should know about what emotion that we are going through and we should know how to handle those emotions. Our unpleasant emotion is our greatest enemy which makes us feel low and sometimes leads us to the wrong path. Some unpleasant emotion like hurt, pain, anger, guilt, unworthiness, and loneliness that we face says us to have some change in ourselves. We have to take everything positively and try to decode the message so that we can easily get over the emotion that we are stuck in.
