Tamil Nadu celebrity YouTuber Madan Gowri has asked when the American company Tesla will introduce electric cars in India. Elon Musk responded by saying that Tesla was looking forward to the day, but that it was unlikely because India had the highest import duty in the world. He said India should not treat electric cars like petrol and diesel and that it would not be conducive to climate change in India. At the same time, he said that he expects the Indian government to provide a temporary tax exemption for electric cars, and if so, a Tesla car plant would be set up in India.

Meanwhile, government sources say that Tesla has written a letter to the Union Government of India to reduce the import duty on electric cars. It is noteworthy that a few days ago, Union Transport Minister Nitin Gadkari called for “Tesla to open a car manufacturing plant in India”.

The Union government has said it will impose higher taxes on foreign cars to encourage domestic carmakers. But economists blame rising Union Government taxes on rising petrol and diesel prices. Ban On Inter State Bus Transportation

Without leaving even a scintilla of doubt, the Madhya Pradesh High Court Bench at Indore has in a latest, landmark, laudable and learned judgment titled MP Bus Operator Association vs State of MP & others in Writ Petition No. 8597 of 2021 that was delivered on June 29, 2021 has maintained without mincing any words that in the extraordinary situation of a pandemic or disaster involving loss of life and human suffering, the Central Government as well as the State Government are empowered to put any restriction in the larger public interest under the Disaster Management Act, including restriction of movement of public by inter-state bus transportation. It must be apprised here that a Single Judge Bench of Indore Bench of Madhya Pradesh High Court comprising of Justice Vivek Rusia who authored this notable judgment was dealing with a petition filed by MP Bus Operator Association challenging various Government orders restricting inter State bus transportation between State of Madhya Pradesh and Maharashtra owing to the rising number of Covid 19 cases. It was the case of the petitioner association that despite having valid permit to ply inter state buses, the government had restricted them in wake of the second Covid wave. 

To start with, the Single Judge Bench of Justice Vivek Rusia first and foremost puts forth in para 1 that, “Petitioner / M.P Bus Operator Association has filed the present petition being aggrieved by the orders dated 21.03.2021, 31.3.2021 and 22.06.2021 issued by respondent No.3 whereby the inter-State bus transportation between State of Madhya Pradesh and Maharashtra has been restricted from 21.03.2021 to 31.03.2021 and thereafter up to 15.04.2021 and again extended up to 30.06.2021 due to Covid -19 pandemic.” 
While elaborating on the facts of the case, the Bench then lays bare in para 2 that, “The petitioner is an association registered under the Madhya Pradesh Society Registrikaran Adhiniyam, 1973 having its registered office at C-14, Vikas Tower, Navlakha, Indore. The society has authorized its President Mr. Arun Gupta to file the present petition by way of resolution dated 05.04.2021. The members of the petitioner/association are having permit to ply inter-State transport passengers buses. In the second phase of Covid-19 the government has restricted various commercial activities in order to control the spread of Covid virus. Since large number of Covid cases were reported in the State of Maharashtra, therefore, the State Transport Department of M.P. has decided to stop operating buses from the territory of Madhya Pradesh to the territory of Maharashtra and vice versa. According to the petitioner, the Central Government, Ministry of Home Affairs vide order dated 23.03.2021 has issued guidelines to the States and UTs for issuing necessary norms for regulating travel in other modes of public transport like buses etc. and to ensure that same are strictly complied with. All the activities are permitted outside the containment zones and SOPs have been prescribed for various activities including movement of passengers, rail, air travel, metro train, schools etc. It is further submitted that there is no restriction on the movement of passengers by way of air service and trains between these two States, therefore, the Government of M.P. cannot discriminate with the petitioner by way banning the inter-State bus service facility between these two States which is in gross violation of Article 19(1)(g) of the Constitution of India. The members of the association are having fundamental right to practice any profession or to carry on any occupation, trade or business which cannot be restricted by the State Govt. It is further submitted that the State has a right under Article 19(6) of the Constitution to put a reasonable restriction on the fundamental right but that should not be arbitrary or excessive in nature. The movement of public between Madhya Pradesh and Maharashtra is permissible through air, train, cab, taxi and through private vehicles but movement only through buses are restricted without any valid justification. The members of the petitioner are ready to follow any conditions to be put by the State Govt. for operating the buses in order to prevent spread of corona virus. They will not permit any passenger to travel in the buses without negative RT-PCR report, therefore, with certain restrictions the petitioner be permitted to ply buses between these two States.”
In addition, the Bench then also points out in para 3 that, “In support of the above contentions Mr. Manu Maheshwari, learned counsel for the petitioner has placed reliance over the judgments passed by the Apex Court in the case of Chintaman Rao vs. State of M.P- AIR 1951 SC 118; Saghir Ahmad vs. State of U.P & others- AIR 1954 SC 728; Subramanian Swamy vs. Director, Central Bureau of Investigation and another- (2014) 8 SCC 682 & Narinder S.Chadha and others vs. Municipal Corporation of Greater Mumbai and others – (2014) 15 SCC 689.”
As a corollary, the Bench then brings out in para 4 that, “The respondents have filed the reply by submitting that in the second wave of the Covid-19 most of the cases came in the State of Maharashtra and being a neighboring State of M.P, in order to protect the inhabitants of M.P, the State Govt. has restricted the transportation of public by way of buses. The State Govt. has passed the order looking to the public health in exercise of the powers conferred u/s 24 of the Disaster Management Act, 2005 (for short ‘the Act of 2005’). The transportation of the buses cannot be compared with the transportation by trains and airways because trains and airways are under the jurisdiction and control of the Central Govt. and the State Transport is within the jurisdiction of M.P State.”
Furthermore, the Bench then also brings out in para 5 that, “Shri Garg, learned GA appearing for the State has submitted that impugned restriction is temporary in nature and after the things are normalized the government is bound to lift the ban, but as on today there is a forecast of third wave of Covid delta plus coming up in the State of Maharashtra, therefore, the government may extend the period of ban which is going to expire tomorrow i.e. on 30.06.2021. It is further submitted that any tough decision taken in the public interest the interest of individuals are bound to be overlooked . The members of the petitioner society are not only restricted to do their business but other trade and business are being totally shut down like theaters, gym, restaurant, tourism etc. In order to provide essential items, the government is relaxing the restrictions . The petitioner’s members are restricted to operate the buses only to Maharashtra State where the large number of cases of Covid are reported but they are free to operate the buses in other States, hence there is no complete restriction on the right of trade and business, hence the petition kindly be dismissed.”
What’s more, the Bench then observes in para 6 that, “In rejoinder Shri Manu Maheshwari, learned counsel submits that the impugned order has not been issued u/s 24 of the Act of 2005, and only after filing of this petition the respondents came up with the plea that the impugned order has been issued under section 24 of the Act of 2005. The petitioner has filed the list of the trains and flights operating between Madhya Pradesh and Maharashtra in which there is no such restriction by the Central Govt. and submit that the petitioner be also permitted to ply the buses between Maharashtra and Madhya Pradesh and vice versa. It is further submitted that Government of Maharashtra has not imposed such restriction on transportation of passenger buses. Even the railways and airways are not demanding Covid report from the passengers and only on the basis of self-declaration they are permitting public to travel to any part of the country. The petitioner’s members are also ready to abide by all the conditions which are being followed by the rail and airways operators. I have heard the learned counsel for the parties and perused the record.”
Of course, the Bench then states in para 7 that, “It is not in dispute that the second wave of Covid -19 started from the State of Maharashtra and being a neighboring State there is a frequent movement of public between M.P and Maharashtra by all means of transport. Accordingly to the petitioner there is no restriction on transportation by railways and airways. The railways and airways are under the domain of the Central Government and on which the State Government cannot put any restriction. The transportation by stage carriages is under the control of the State Government, therefore, the State Govt. is competent to put restriction or conditions in which there is no discrimination by the State Government.”
Quite significantly, the Bench then holds in para 8 that, “Even otherwise, in transportation through airways and railways the entry and exit points of passengers are fixed and known from where the passengers can be checked about their health conditions but it is not possible in the transportation by buses. The buses can be stopped anywhere and collect the passengers which is not possible in the railways and airways, therefore, both are different classes of transportation. The State Government has put restriction only for the limited period subject to the reduction of cases of Covid. There is no permanent restriction for transportation through buses from Madhya Pradesh to Maharashtra and vice versa. The Government is reviewing the situation after the interval of 10-15 days and extending the restriction for limited period. Except Maharashtra the petitioners are permitted to ply the buses in other part of the country, therefore, there is no 100% restriction on the right of trade and business. In the larger public interest, the individual interest is bound to suffer.”
Most remarkably, the Bench then minces no words to hold in para 9 that, “So far as the applicability of section 24 of the Act of 2005 is concerned, the government has decided to enact a law on disaster management to provide for requisite institutional mechanisms for drawing up and monitoring the implementation of the disaster management plans, ensuring measures by various wings of Government for prevention and mitigating effects of disasters and for undertaking a holistic, coordinated and prompt response to any disaster situation. Section 2(d) defines the word ‘disaster’ and 2(e) defines ‘disaster management’ which means a continuous and integrated process of planning, organizing, coordinating and implementing measures which are necessary or expedient for prevention of danger or threat of any disaster or mitigation or reduction of risk of any disaster. Section 14 authorizes the State Govt. to establish State Disaster Management Authority for the State by way of notification. Section 24(l) gives power to the Central Govt. or the State Govt. to take such steps as are required or warranted by the form of any threatening disaster situation or disaster, therefore, in exercise of the aforesaid powers the State Govt. has decided to restrict or minimize the movement from Maharashtra to Madhya Pradesh. In normal situation the action of the State Government can be examined in respect of putting restriction on any trade and business but in the case of disaster or pandemic where the loss of life or human suffering or damages are in large scale then the Central Government or the State Government is empowered to put any restriction in the larger public interest in exercise of power under section 24 of the Act of 2005. Section 72 gives overriding effect to the provisions of the Act of 2005 over the other Act. The High Court in exercise of powers under Article 226 of the Constitution of India should not interfere in the policy decisions taken by the State Government looking to the interest of public at large.”
Quite rationally, the Bench then holds in para 10 that, “It is expected from the State Government that further extension or restriction of movement of public by inter-State transportation by buses shall not be in mechanical manner but after assessing the facts and figures of Covid -19 cases in the State of Maharashtra.” 
Finally, the last para 11 concludes this brief, brilliant and balanced judgment by holding that, “In view of the foregoing discussion, the petition is disposed of.”
To sum up, this cogent, commendable and convincing judgment by a Single Judge Bench of Justice Vivek Rusia of Indore Bench of Madhya Pradesh High Court sets the record straight by holding that in the extraordinary situation of a pandemic or disaster involving loss of life and human suffering, the Central Government as well as the State Government are empowered to put any restriction in the larger public interest under the Disaster Management Act, including restriction of movement of public by inter-state bus transportation. So such restrictions are valid and cannot be objected to by citizens at the drop of a hat. All citizens are bound to comply accordingly as has been clearly pointed out in this notable case also!

CRUDE OIL PRICES IN INDIA

 Today, the world is suffering from many unexpected problems. These problems includes corona virus pandemic, poverty, voilence in many subjects and rise in prices in almost every item. 

These problems got a boost after this corona virus pandemic. Providing essential items to everyone according to their needs have been one of the major problem. Almost every country is having such issues, that too due to the unexpected Covid-19 pandemic.

Presently, Farmer protests, violence, rise in prices, Covid19 vaccination for all on time, rape issues and political games are the topics which are trending in India.
In India too the prices are touching its brim. The rise in costs in food, commodities, jewellery, fuel, automobiles etc have become a greater problem. To provide everything for everyone with less issues is a need. 
The petrol and diesel prices have been increasing day by day. Retail price of automobile fuels have reached heights across the country. Petrol and diesel are taxed heavily in India and that’s why the consumer benefits have been decreased.
Low class families are getting benifits by the government, high class families already have enough salaries to spend freely and according to their needs.
For middle class families, the problems are like hell. No benifits, almost nothing for the middle class. Only low class are under the eyes of government but middle class are just ignored every time. Middle class are also like the low class but just a bit heigher than low class and so less than the upper class. This class is in the middle so no-one remember to provide special highlights to them. Pressure over the middle class to do everything on their own without any benifits or schemes from anyone, under huge loss. 
Diesel and petrol prices have hit high records across the country with petrol touching Rs 89 per litre in Delhi and diesel reaching a new high of Rs 86.30 per litre in Mumbai. Petrol prices are revised by the oil marketing companies like Indian Oil, Bharat Petroleum, Hindustan Petroleum etc. based on the international prices. So, when international crude oil prices gain, petrol prices in India increases and so on. If crude oil prices in the international markets drops, we see a down fall in daily petrol prices in India. 
Factors affecting Today’s Petrol Prices In India 
 The difference in the prices of crude oil in the international market directly influences the price of crude oil (raw form of oil) in the domestic market and this is one of the most important factor responsible for an increase in the petrol prices in Indian market. Increase in international demand as well as low production rate and any political no rest in the crude oil producing countries of the world severely affects petrol price.
 Increase in Demand – Economic growth in India and other developing countries has also led to the increase in demand for the petrol and other essential fuels in India. The number of people who own private vehicles has gone up in the recent past which has contributed to the increase in demand for petrol in India this has resulted in the rise in petrol prices in India. 
Logistics – Logistics is one of the significant factors in pricing retail fuel. Petrol and diesel transported to longer distances to cities or regions farther from depots will be priced higher than the places nearer to the oil companies storage area. The reason behind the change in the prices of petrol in different cities across India. This difference may be huge between cities that are far from each other. The fear linked to the rise of petrol prices in India might be never ending. 
Mismatch of Demand and Provided quantity – Oil refinery companies in India faces problem to meet the demands of the market due to the high cost of input price of crude oil thus resulting in low supply and high demand for petrol in the country. An increase in supply results in a decrease in the price of the petrol and vice versa. Oil refining and marketing companies maintains crude oil inventory up to six weeks, which also influences the price of the petrol and petroleum products.
 Rate of Taxes – The prices of petrol and other petroleum products varies according to the local government policies which impose taxes on fuels. As and when the government of India raises tax rates on fuels then oil companies in India also increase the price of the petrol to recover the loss and maintain marginal profits in the oil business in India. 
Rupee – Dollar Exchange Rates – The rupee-dollar exchange rate is also one of the major factors which influences the price of petrol in India. Indian oil companies pay to the oil imported from other countries in terms of dollars, but their costs are regarding rupee. So, when the price of the crude oil is in the fall but the rupee is also weaker against the dollar then it will reduce the profits to the oil refiners. So, when the rupee strengthens against the dollar and the price of the crude oil faces down fall, then most of the oil companies tend to gain alot.
Apart from this, the continued commitment of the producers to supply, amidst muted fuel demand has helped the fuel prices to scale up. The Organization of the Petroleum Exporting Countries (OPEC) and its member partner have their support for deeper oil supply cuts throughout 2021. The move was made to help bring down the swollen global crude stockpiles are increasing despite feeble oil demand. 
Meanwhile, the demand in china for crude oil is helping to support the oil markets as shown by the industrial track.

A Contentious call

Widespread chaos have been witnessed on the borders of the national capital since 26 November as a retaliation that came with the recently passed Farm Bills. The farmers of Punjab and Haryana are protesting against two Farm Bills passed by Rajya Sabha.

  • The Farmer’s Produce Trade and Commerce (Promotion and Facilitation) Bill 2020, and
  • The Farmer’s (Empowerment and Protection) Agreement on Price Assurance and Farm Services Bill, 2020.


The Trade and Commerce Bill allows the farmers to sell their produce outside the monopoly cartel of Agricultural Produce Market Committee (APMC) regulated markets providing the farmers with more choice regarding who to sell their produce.

The Empowerment and Protection Bill provides with a framework for contract farming enabling the farmers to strike a deal before the production happens. Inter-state or intra-state trade of farmers’ produce beyond physical premise of APMC Markets is also authorized.

The bills enables the farmers to bypass the Essential Commodities Act and vanquish the monopoly cartel of APMC Mandi and sell the produce irrespective of the boundaries and entering into contracts with businessman thus transferring the risk before the yield is produced. These Bills have made the farmer’s upset as they fear that the Minimum Support Price (MSP) that have been acting as a safety net since the Green Revolution might be snatched away.

Government procurements may also be affected due to the introduced reforms. If the government stops buying their produce only the big corporate will be available to sell and farmers show lack of faith in them. Many statements have been given by the government regarding the same but it did nothing assuage the unrest. Protests have taken form of dharnas, Raasta rook, demonstrations and even led to Bharat Band. Casualties are also reported during the protests but what is certain is that the farmers need a strong validation and reassuring statement from the government. Youth worldwide is also showcasing their support and many hashtags are used such as

#SpeakUpForFarmers, #tractor2twitter, #StandwithFarmersChallenge and many more.

A wave of uncertainty and fear is discerned among farmers. Many meetings are being held to bring in a solution. But a very important fact remains that the lack of communication, understanding and inclusion has led to the widespread protest and difficulties being faced by the farmers. A real or a misinformed fear, it is not small.

BAD DAY FOR POLITICAL PARTY:PRANAB MUKHERJEE DEATH(1935-2020)

Former President of India(13th) Pranab Mukherjee died on 31st August 2020 at the age of 84 after battling a long illness.In mid-August, he had undergone a brain surgery at the Army Research and Referral hospital in New Delhi. Hours before his death, hospital authorities said his condition had deteriorated and he was in a state of septic shock due to a lung infection.Prior to surgery, he tested COVID-19 positive on 10 August 2020.

His Personal Life :

Pranab Mukherjee was born on 11th December 1935 in the village of Mirati in Birbhum district in West Bengal. His father’s name is Kamada Kinkar Mukherjee, who was an activist in the Indian independence movement. His mother was Rajlakshmi Mukherjee. He married Suvra Mukherjee on 13 July 1957.

His Career :

Pranab Mukherjee took his education at Birbhum. He got MA degree in political science and history and also an LL.B degree from the department of law of the University of Calcutta. He began his career as a clerk in Post and Telegraph Department in Calcutta. He also worked as a journalist with the ‘Desher Dak’ before entering politics.

Pranab Mukherjee became a member of the Rajya Sabha in 1969. He was re-elected to the house in 1975, 1981, 1993 and 1999. He was appointed as Union Deputy Minister in 1973. He was appointed as Cabinet Ministers. He held many important posts in the government. He became the 13

th President of India on 25 July 2012.

New Cases of Covid-19 Break Out Again in New Zealand

On Tuesday, New Zealand announced that Auckland, its largest city, would be shutting down since 4 new cases has been found in the city.  It is the first case of domestic transmission for the nation after remaining covid free for 102 days.

New Zealand’s fight against Covid was recognised across the world. Prime Minister Jacinda Ardern was congratulated for her effective method and governance. A vigorous and decisive response to the pandemic had effectively curbed down the rates of infection. The Pacific island nation of 5 million citizens was considered to be the safest place as it remained Covid free for 100 days at a stretch. It had made a record of zero new cases of community transmission of Covid-19. From a first case on Feb 26 to the last one recorded on May 1st, the whole process of elimination took about 65 days. The nation was placed under lockdown for weeks when the virus first broke out and it had achieved a milestone of 100 days. The last case was recorded on May 1st. The government had warned from before as countries like Australia and Vietnam which were once free from the virus are now fighting a second battle.

The Director General of Health had said that the 4 new cases are from a single family in South Auckland. It is the first local case in 102 days. The patients had no international travel history and contact tracing has been started.

With the announcement of shutdown, media reports suggested that people have started panic buying. The Prime Minister has made a surprise news conference and announced that Auckland will have Level 3 restriction from Wednesday as a “precautionary approach”. According to it, people should be staying at home, away from work, school or any social gathering. Any gathering of more than 10 people will not be allowed. This restriction would be applicable for 3 days, until Friday. This was done to assess the situation and gain further information about contact tracing. In Kerala once again a animal harassment case found in which a stray dog found with a tight tape on his mouth. The tape on his mouth may be from two weeks. This case is found in Thrissur district of Kerala.

Rescue Team found the dog nearby a village in Thrissur. They told that tape was tied with his mouth from almost two weeks. This type of act really shows the cruelty and sick mindness of the people there. They not tried to kill the dog only, it’s like they tried to kill the humanity.

MCA notifies Insolvency and Bankruptcy (Insolvency and Liquidation Proceedings of Financial Service Providers and Application to Adjudicating Authority) Rules, 2019 (Rules)

The Ministry of Corporate Affairs (MCA) has notified the Insolvency and Bankruptcy (Insolvency and Liquidation Proceedings of Financial Service Providers and Application to Adjudicating Authority) Rules, 2019 (Rules) today to provide a generic framework for insolvency and liquidation proceedings of systemically important Financial Service Providers (FSPs) other than banks. The Rules shall apply to such FSPs or categories of FSPs, as will be notified by the Central Government under section 227 from time to time in consultation with appropriate regulators, for the purpose of their insolvency and liquidation proceedings.
The Insolvency and Bankruptcy Code, 2016 (Code) provides a consolidated framework for reorganisation, insolvency resolution and liquidation of corporate persons, limited liability partnerships, partnership firms and individuals in a time-bound manner. Section 227 of the Code enables the Central Government to notify, in consultation with the financial sector regulators, financial service providers (FSPs) or categories of FSPs for the purpose of insolvency and liquidation proceedings, in such manner as may be prescribed.
Shri Injeti Srinivas, Secretary, Corporate Affairs, stated that the special framework provided under Section 227 of the Code for financial service providers is essentially aimed at serving as an interim mechanism to deal with any exigency pending introduction of a full-fledged enactment to deal with financial resolution of Banks and other systemically important financial service providers.  The special framework under Section 227 of the Code shall not apply to Banks.  Separately, however, the government will notify specific categories of FSPs that do not fall under the systemically important category and shall be resolved under the normal provisions of the Code as ordinarily applicable to corporate debtors.

The Rules provide that the provisions of the Code relating to the Corporate Insolvency Resolution Process (CIRP), Liquidation Process and Voluntary Liquidation Process for a corporate debtor shall, mutatis mutandis, apply to a process for an FSP, subject to modifications, as under:
  1. The CIRP of an FSP shall be initiated only on an application by the appropriate regulator.
  2. On admission of the application, the Adjudicating Authority shall appoint the individual, who has been proposed by the appropriate regulator in the application for initiation of CIRP, as the Administrator.
  3. While conducting a proceeding of an FSP, the Administrator shall have the same duties, functions, obligations, responsibilities, rights, and powers of an insolvency professional, interim resolution professional, resolution professional or liquidator, as the case may be. He shall be appointed or replaced by the Adjudicating Authority on an application made by the appropriate regulator in this behalf.
  4. The appropriate regulator may constitute an Advisory Committee of three or more experts to advise the Administrator in the operations of the FSP during the CIRP.
  5. An interim moratorium shall commence on and from the date of filing of the application for initiation of CIRP by the appropriate regulator till its admission or rejection by the Adjudicating Authority.
  6. The provisions of interim-moratorium or moratorium shall not apply to any third-party assets or properties in custody or possession of the FSP, including any funds, securities and other assets required to be held in trust for the benefit of third parties.
  7. The Administrator shall take control and custody of third-party assets or properties in custody or possession of the FSP and deal with them in the manner, to be notified by the Central Government under section 227.
  8. The license or registration which authorises the FSP to engage in the business of providing financial services shall not be suspended or cancelled during the interim-moratorium and the CIRP.
  9. Upon approval of the resolution plan by the Committee of Creditors, the Administrator shall seek ‘no objection’ from the appropriate regulator to the effect that it has no objection to the persons, who would be in control or management of FSP after approval of the resolution plan. The appropriate regulator shall issue ‘no objection’ on the basis of the ‘fit and proper’ criteria applicable to the business of the FSP without prejudice to the provision of Section 29A of the Code.
  10. The FSP shall obtain prior permission of the appropriate regulator for initiating voluntary liquidation proceedings.
  11. The Adjudicating Authority shall provide the appropriate regulator an opportunity of being heard before passing an order for liquidation or dissolution of the FSP.
These Rules shall come into force on the date of their publication on the official gazette.

The Vice President, Shri M. Venkaiah Naidu today urged the media to not color news with views and stressed the need to maintain objectivity, fairness and accuracy. “The neutrality and sanctity of newsrooms should be upheld at all times”, he said.
Speaking at an event organized by Press Council of India on the occasion of National Press Day, in New Delhi today, he said that the cardinal principle of journalism is to present fair, objective, accurate and balanced information to the reader and viewer without journalists assuming the role of the gatekeepers.
The Vice President further said that this has become all the more critical in the present times after the advent of the ‘fake news’ phenomenon and the huge impact the social media is creating. “Sensationalism, biased coverage and paid news have become the modern-day afflictions of the media, he said adding that under no circumstances can slanted and opinionated reporting be termed as ‘interpretative reporting’.
Shri Naidu expressed concern over the fact that business groups and even political parties setting up newspapers and TV channels to further their interests.“With this the core values of journalism are getting eroded”, he said.
Maintaining that freedom and responsibility cannot be considered as inseparable, he opined that media must not only act as the watchdog to protect democracy but must also act as the true champion of the underdog. It has to be in the vanguard of fighting the ills that are plaguing the society.
The Vice President said that media landscape has transformed dramatically over the years and so have the values of journalism. In the past, journalism was treated as a mission for the nation’s service. Talking about the present state of affairs, he asked journalists’ bodies like PCI to do a serious introspection.

Shri Naidu said that time has come for media bodies to come out with a code of conduct for journalists. “In view of the critical role journalism plays in protecting democracy and in serving the larger good of the society, we should strengthen this important fourth pillar by ensuring that ‘truth’ is never compromised”, he added.
Noting that mobile phones are revolutionizing the manner in which we share information, he said every smart phone user has become a potential journalist. “No doubt, the internet and mobile telephony have democratized the availability of information. However, the glut of information is also generating fake news and fake narratives”, he added cautioning that, “journalists must guard against such news and fake narratives as they can be used by vested interests to create dissensions and divisions in our pluralistic society”.
The Vice President also appealed to media to provide greater space to development news andimportant sectors such as agriculture.
Admitting that legislations alone can not bring desired change, he called upon the media to play a positive role in creating public opinion on the need to eradicate corruption and social evils like gender and caste discrimination. “We have seen the positive impact created by the media in promoting the campaign for a Clean India”, he said.
Talking about the abrogation of Article370, he said that it was only a temporary provision which was removed by the Parliament with huge majority. He appealed to Indian journalistic community to convey the right facts to the world about Kashmir.
During this occasion, the Vice President also gave away the awards to the winners of ‘National Awards for Excellence in Journalism 2019’ under various categories.Eminent journalist Shri Gulab Kothari was awarded the prestigious ‘Raja Ram Mohan Roy Award’ for his outstanding journalism.
Shri Naidu also released three publications namely – the Directory of Press Council of India since 1966, the updated Norms of Journalistic Conduct Edition -2019 and a souvenir, ‘Reporting-Interpretation–A journey’  on the occasion.
Union Minister, Shri Prakash Javadekar, PCI Chairperson, Justice Chandramauli Kumar Prasad, Convener, Jury Committee and Member, PCI, Shri Jai Shankar Gupta and Secretary, PCI, Smt. Anupama Bhatnagar were among the dignitaries who graced the occasion. Representatives from various foreign countries such as Bangladesh, Nepal, Bhutan and Myanmar also attended the event.

“I am indeed extremely delighted to be amidst you all and share my views on the occasion of the National Press Day, which symbolizes the important role played by a free and responsible press.
It was on this day in 1966, the Press Council of India, a quasi-judicial body, started functioning as a watchdog body.
I am happy that several journalists in different areas are being honored for excellence in journalism today. My congratulations to all the winners!
Dear sisters and brothers,
Ever Since the launch of the first newspaper in India-‘The  Bengal Gazette’ by James Augustus Hickey in 1780, the presshas been playing an outstanding role in empowering the people.
The press played a pioneering and stellar role in inspiring the masses to fight against the Britishduring the freedom struggle and in strengthening the democratic foundations in the country since Independence. The nationalist role played by the newspapers and journals contributed in no small measure to influencing and moulding the public opinion during the freedom struggle.  However, during the Emergency, barring few exceptions like ‘The Indian Express’, ‘The Statesman’ and ‘The Mainstream’, the response of the Indian press by and large was muted during the Emergency.
The blank editorial published by The Indian Express during Emergency, under the leadership of Ramnath ji, was perhaps one of the strongest protests ever published against censorship in India.
It spoke more loudly than any words could have.
When asked about his fight for the truth in the face of stiff resistance, Ramnath Goenka ji was reported to have said : “I had two options–to listen to the dictates of my heart or my purse. I chose to listen to my heart”.
The media landscape has transformed dramatically over the years and so have the values of journalism. In the past, journalism was treated as a mission and those who wielded the pen were committed to ethics and highest standards of journalism. They used to work with undiminished enthusiasm and were overzealous in protecting its values.
The topic chosen for discussion on National Press Day this year–“Reporting-Interpretation–A journey” is quite appropriate. News used to be news in the past and it was neither interpreted nor misinterpreted.News and views were easily distinguishable.
The times have changed and so have the trends. These days, there appears to be a very thin dividing line between news and views. The news story is not only interpreted in tune with the management’s line of thinking, but the treatment it gets conveys a lot.
Occasionally, we do find that even important and newsworthy developments do not merit place on the front page and are rather buried in the inside pages.
The cardinal principle of journalism is to present fair, objective, accurate and balanced information to the reader and viewer without journalists assuming the role of the gatekeepers.
Fortunately for us there are a number of journalists who follow these principles. And that is what makes the Indian media so credible and unshackled by constraints.
However, there are aberrations like in any system. It is one thing to provide an insightful analysis of a news development by substantiating it with facts and figures and another thing to build a story on conjecture. The essential challenge is when this trend tends to become a new normal. Under no circumstances can slanted and opinionated reporting be termed as “interpretative reporting”.
Perhaps, it would be appropriate here to recall the views of Mahatma Gandhi on newspapers. He had said:“One of the objects of a newspaper is to understand popular feeling and to give expression to it; another is to arouse among the people certain desirable sentiments; and the third is fearlessly to expose popular defects.”
Instead of giving expression to popular feeling, some newspapers these days are giving expression to coloured and partisan views.For instance, reading any one major newspaper in the past used to give a fairly good understanding of what was happening around the country and the world. But it is not the case now. One will have to read a minimum of four to five major newspapers to get a complete sense of the current developments. Same is the case with the news channels.
Time and again, I have urged the media to not color news with views and stressed the need to maintain objectivity, fairness and accuracy. The neutrality and sanctity of newsrooms should be upheld at all times.
This has become all the more critical in the present times after the advent of the ‘fake news’ phenomenon and the huge impact the social media is creating.
With the electronic and social media providing news by the minute with alerts and flashes on smart phones, journalists will have to exercise greater caution and guard against ‘fake news’, disinformation and misinformation.
Sensationalism, biased coverage and ‘’paid news’’ have become the modern-day afflictions of the media.
With business groups and even political parties setting up newspapers and TV channels to further their interests, the core values of journalism are getting eroded.
Without delving further into the reasons for the present state of affairs, I would like journalists’ bodies like yours to do a serious introspection.
In such a context, freedom and responsibility of the media acquire far greater significance than ever before. Freedom and responsibility cannot be considered as inseparable and are inter-dependent on each other. The media has the onerous responsibility to not only provide unadulterated and correct information, but also educate the people on their rights as well.
It should also be remembered that freedom of media is not absolute and is circumscribed by certain reasonable restrictions relating to security of State, public order, decency or morality, defamation and contempt of court and sovereignty and integrity of India.
It should also be noted that during sensitive developments, vested interests use the social media to spread fake news and disinformation.
Finally, media must not only act as the watchdog to protect democracy but must also act as the true champion of the underdog. It has to be in the vanguard of fighting the ills that are plaguing the society. 
The media must also provide greater space to development news andimportant sectors such as agriculture.
Since the press has the power to influence public opinion, the credibility of newspapers in particular and the media in general is extremely crucial. A newspaper with credibility will gain the trust of the readers and has the chance to establish long-standing relationship with them.
In view of the huge influence in shaping the public opinion, the role of mass media assumes greater significance in the present era. It can play a positive role in creating public opinion on the need to eradicate corruption and social evils like gender and caste discrimination. The investigative journalism that uncovered the Watergate scandal and the subsequent downfall of an American President is still fresh in memory. There are many instances in which the media and of late the social media played a critical role—take the example of Egyptian uprising some years ago.
We have seen the positive impact created by the media in promoting the campaign for a ‘Clean India’. Thus, I feel that the press, TV and even the social media must educate the people on important health issues such as lifestyle changes and growing incidence of Non Communicable Diseases.
Of course, mobile phones are revolutionizing the manner in which we share data, information and visuals. With the number of smart phone users crossing 450 million in the country, every smart phone user has become a potential journalist. In fact, there are many instances where smart phone users have become “citizen journalists and virtually provided breaking news alerts to TV news channels. No doubt, the internet and mobile telephony have democratized the availability of information. However, the glut of information is also generating fake news and fake narratives. Journalists must guard against such news and fake narratives as they can be used by vested interests to create dissensions and divisions in our pluralistic society.
Apart from enforcing self-regulation, the media must ensure that the core values of accuracy, fairness, objectivity, news worthiness and independence are never compromised.Instead of focusing on negativity, it is important for newspapers in a country like India to accord importance to development journalism.
May be the time has come for media bodies to come out with a code of conduct for journalists. In view of the critical role journalism plays in protecting democracy and in serving the larger good of the society, we should strengthen this important fourth pillar by ensuring that “truth” is never compromised.
I compliment the Press Council of India for its role in promoting responsible journalism in the country.
