Divorce by Mutual Consent

Although it is believed that relationships are created in heaven, these heavenly ties do not always continue forever. Divorce is now seen casually, and individuals utilize it as a first choice, despite the fact that the law intended it to be a last resort. Many times, the partners in a marriage can no longer stand one other and cannot live peacefully together. In such situations, the couple may choose to divorce mutually. Mutual divorce occurs when both husband and wife mutually agree that they can no longer live together and decide to dissolve their marriage.

Essential Conditions of Mutual Divorce

  • Parties must be living separately – In order to dissolve a marriage by mutual divorce, the parties must have been living apart for at least one year prior to submitting the divorce petition. Living apart does not imply living in different locations. Living under the same roof as a couple but without sharing the bond of husband and wife qualifies the required requirement of living apart.
  • Parties are unable to live together – There are a variety of scenarios in which a couple is unable to live together despite mediation, reconciliation, and numerous efforts. In such a case, the couple can divorce by mutual consent. Following the filing of the petition, the parties are allowed a six-month cooling period, which can be extended to eighteen months. Both parties must ponder and examine their options during this period. If the parties are still unable to live together, the district judge should issue a divorce order.
  • Parties have mutually consented to end the marriage– In order to dissolve the marriage by a mutual divorce, both parties must have agreed to do so. The divorce petition is submitted jointly by both parties in the case of mutual divorce. The parties have the right to withdraw the petition at any moment. The petition appears to be withdrawable at the request of one of the parties within six months of the petition’s filing date. When a joint motion is adopted by the parties after the expiry of six months but before the expiration of eighteen months from the date of presentation of the petition for inquiry, the individual right of a party to withdraw the petition seems to be barred.
  • Parties must file for divorce jointly and without undue influence, fraud, or corruption– Both parties must have consented willingly and without pressure from the other parties to file for divorce. If neither partner is willing to file for amicable divorce, the party seeking divorce may do so using the grounds specified in Section 13 of the Hindu Marriage Act.

Advantages of Mutual Divorce

  • A divorce by mutual consent minimizes needless confrontations, saving both spouses time and money.
  • Maintenance and custody of the kid can be readily arranged by the parties amicably before the marriage is dissolved.
  • In this divorce, the court legalizes and agrees to all that the couple has talked and chosen.
  • Under this, the spouses need not explain the reason for divorce before the court of law.
  • It does not lead to any confusion or chaos between the parties regarding how the assets and liabilities will be divided between the couple.
  • If the divorce takes place amicably without any conflict the couple can continue to be friends rather than sworn enemies.

Procedure for Mutual Divorce

To get a divorce by mutual consent, one must follow several steps. In India, the process of mutual divorce usually begins with the filing of a petition under Section 13B of the Hindu Marriage Act. Two motions are also involved in this procedure. Following are the important steps:

  • Filing a Joint Petition– The first step is to file a joint petition in the relevant family court. This joint petition must be signed by both parties. Both parties sign a joint declaration in the divorce petition declaring that they can no longer live together due to fundamental disputes and should be granted a divorce. This declaration also includes a distribution agreement, parental rights, and other details.
  • The appearance of both the parties in Court– The second step involved is the appearance of both the parties before the competent court before which the petition is filed. The court fixes the date and on this date, parties are asked to present before the court with their counsels.
  • Court review of the petition– The court will review the petition as well as the papers filed by both parties. When the court is satisfied, it records both parties’ statements. In some situations, the court will attempt to mediate a resolution between the parties. When the parties are unable to reconcile, the divorce process begins.
  • Recording of the statement and adoption of the order on the First Motion– When both parties’ statements are recorded, the court issues the first motion order. Previously, the parties were allowed six months to reconcile. This six-month period can be extended to eighteen months, after which a second motion can be submitted. This is no longer a required requirement. In the case of Amardeep Singh v. Harveen Kaur, the Supreme Court waived the six-month cooling period if it was believed that both parties were committed to the divorce, there was no possibility of cohabitation between an estranged couple, and no alimony, child custody, or property issues were raised.
  • Appearing for Second motion– If neither party agrees to come together after six months from the first motion or by the conclusion of the reconciliation period, the parties may appear for the second move for the final hearing. This also entails the parties appearing in court and making remarks that are recorded. Both parties present their cases at the final hearing, and the court records their statements under oath in the family court.
  • The Court’s decision– The most essential condition for a divorce by mutual consent is the free consent of both parties. In other words, unless there is total agreement between the husband and wife for the dissolution of the marriage and the court is satisfied, the court cannot grant a decree of divorce by mutual consent. Based on the parties’ declarations as well as the facts and circumstances of the case, the court makes the proper judgments and dissolves the marriage. The divorce is then finalized when the court issues a divorce decree.

Conclusion

Divorce is a painful issue that should only be used as a last resort; nevertheless, many people nowadays do not hesitate to divorce. It causes family disintegration, and the kid of a divorced marriage suffers substantial stress as a result of growing up with split parents. The best way to divorce is by mutual consent since the parties do not have to publicly embarrass each other in court and may resolve any issues and dissolve their marriage willingly. From the time of filing until the finalization of the divorce judgement, the total mutual consent divorce procedure might take anywhere from 6 months to 1-1.5 years.

CHILD LABOUR

We live in an age where many of us are privileged enough to enjoy technology-driven amenities or to acquire education from a proper school, or satisfy our hunger thrice a day. But, there are still some children out in the world who have not even relished a fraction of such comforts. Every coin has two phases as with the innocence of childhood. One is enjoying his burgers in McDonald’s while the other is thinking whether he will get the bread tonight. One is playing with PS at his home while the other is toiling under the sun. One is driving to the school in a brand-new Mercedes while the other is still struggling with counting the marbles. Children are the blooming flowers in the garden of humanity. Childhood is the depiction of innocence, love, and pure bliss. This innocence and childhood must never be stolen from any child.

CAUSES OF CHILD LABOUR:

Lack of social security, hunger, and poverty are the fundamental drivers of child labor. The expanding gap between the rich and poor people, privatization of fundamental organizations, and the neo-liberal monetary strategies are causes of significant areas of the population remaining out of business and without essential needs. This antagonistically influences kids more than some other age groups. A significant concern is that the real number of child workers goes un-distinguished. Laws that are intended to shield youngsters from unsafe work are ineffectual and not executed accurately.

MEASURES TO STOP CHILD LABOUR:

Elimination of poverty, the abolition of child trafficking, and compulsory and free education and training can help diminish the issue of child labor. Strict implementation of work laws is additionally a basic requirement with the end goal to counteract abuse by organizations. Amendments in the present child labor laws are required to actually take control of the situation. The base of the age of fourteen years should be expanded to something like eighteen. Then only we can put an end to the continuous harassment faced by our kids and help them have a bright future not only for themselves for the nation as a whole.

Conclusion:

Child labor is one of the broad social issues that require getting resolved on an urgent basis. This step is incomplete without the support of parents as well as the government. Kids carry a flourishing prospect of any developing nation. Thus, they should be a considerable concern of all the citizens.

Children should get an appropriate chance to grow and develop inside the contented surroundings of school and family. People should not use them for their earnings or for-profit motive. Children have the full right to live their personal life with proper education.

7 common women’s health issues

While both men and women contract various conditions, some health issues affect women differently and more commonly.

The following seven illnesses pose considerable health risks.

Heart Disease

Heart disease causes one in every four deaths among women.Although the public considers heart disease a common issue among men, the condition affects males and females nearly equally.

Breast Cancer

Breast cancer, which typically originates in the lining of the milk ducts, can spread to other organs, and is the most aggressive cancer affecting the global female population. The condition presents more among female populations in developed nations due to their extended life spans.

Ovarian and Cervical Cancer

Many people are not aware of the differences between ovarian and cervical cancer.Cervical cancer originates in the lower uterus, while ovarian cancer starts in the fallopian tubes. While both conditions cause similar pain, cervical cancer also causes discharge and pain during intercourse.

Gynecological Health

Bleeding and discharge are a normal part of the menstrual cycle. However, added symptoms during menstruation may indicate health issues, and unusual symptoms, such as bleeding between menstruations and frequent urinating, can mimic other health conditions.

Pregnancy Issues

Pre-existing conditions can worsen during pregnancy, threatening the health of a mother and her child.Asthma, diabetes, and depression can harm the mother and child during pregnancy if not managed properly.

Depression and Anxiety

Natural hormonal fluctuations can lead to depression or anxiety.Premenstrual syndrome (PMS) occurs commonly among women, while premenstrual dysmorphic disorder (PMDD) presents similar, but greatly intensified, symptoms.

Health Technology for Women

Soon, new technologies will emerge to assist care providers in treating women’s health conditions.

When the well is dry, we will know the worth of water.

Water scarcity is the lack of sufficient available water resources to meet the demands of water usage within a region.

It already affects every continent and around 2.8 billion people around the world at least one month out of every year.

More than 1.2 billion people lack access to clean drinking water.

Water scarcity involves water stress, water shortage or deficits, and water crisis.

While the concept of water stress is relatively new, it is the difficulty of obtaining sources of fresh water for use during a period of time and may result in further depletion and deterioration of available water resources.

Water shortages may be caused by climate change, such as altered weather patterns including droughts or floods, increased pollution, and increased human demand and overuse of water.

A water crisis is a situation where the available potable, unpolluted water within a region is less than that region’s demand.

Water scarcity is being driven by two converging phenomena: growing freshwater use and depletion of usable freshwater resources.

Water scarcity can be a result of two mechanisms: physical (absolute) water scarcity and economic water scarcity, where physical water scarcity is a result of inadequate natural water resources to supply a region’s demand, and economic water scarcity is a result of poor management of the sufficient available water resources.

According to the United Nations Development Programme, the latter is found more often to be the cause of countries or regions experiencing water scarcity, as most countries or regions have enough water to meet household, industrial, agricultural, and environmental needs, but lack the means to provide it in an accessible manner.

The reduction of water scarcity is a goal of many countries and governments.

The UN recognizes the importance of reducing the number of people without sustainable access to clean water and sanitation.

The Millennium Development Goals within the United Nations Millennium Declaration state that by 2015 they resolve to “halve the proportion of people who are unable to reach or to afford safe drinking water.”

Water is the basic necessity of every human being. But, water scarcity is a major issue that is rising very rapidly in modern-day India.

The problem has become so severe that in many states the groundwater has almost dried up and people have to depend on water supply from other sources.

In addition, water is one of the most misused commodities that we still waste. It is the central point of our lives but not the central point of our focus.

In the past, people understand the value of water and plan their lives around it. Moreover, many civilizations bloom and lost on account of water. But, today we have knowledge but we still fail to understand the value of water.

Reason for Water Scarcity in India

Water scarcity is the cause of mismanagement and excess population growth of the water resources. Also, it is a man-made issue that continues to rise. Besides, some of the reasons for water scarcity are:

Wasteful use of water for Agriculture- India is one of the major food growers in the world. That produces tons of quantity of food to feed its population and export the surplus that is left.

In addition, producing this much food requires a lot of water too. The traditional method of irrigation wastes a lot of water due to evaporation, water conveyance, drainage, percolation, and the overuse of groundwater.

Besides, most of the areas in India use traditional irrigation techniques that stress the availability of water.

The SmartPhone Buying Guide

Smartphones have transformed over the past two decades and they have become an integral part of our lives. They have a wide spectrum of applications; some of them being making calls, clicking pictures, accessing the internet, playing games and the list goes on and on.

Nowadays, we can buy smartphones for as low as INR 5000 and as high as INR 1,00,000 +. India being the second-largest market for smartphones in the world offers a wide range of choices for smartphone users. But then with this sheer number of choices, it often becomes difficult for us to chose which smartphone to pick and almost becomes an exercise involving spending hours on the internet to figure out the features and decide one.

Here’s a list of some essential things you should consider before buying a new smartphone.

BUILD QUALITY

The very first thing which is taken into consideration while buying a smartphone is the build quality. The build quality of a material defines its durability. So better the build quality of the smartphone, the more durable it would be. There are mainly two categorizations in the smartphone industry based on the build quality – metal and plastic.

Nowadays, some phone manufacturers are using glass coverings, but these are very rare. The ones with the metal body are the sturdiest as they can survive a drop from 2-3 feet whereas the survival of the other two body types is limited.

DISPLAY

Display type and quality are yet another important factor when it comes to smartphones. The media experience depends solely on the display quality. Better the display quality, richer the media experience. There are mainly two types of display technology – LCD and AMOLED. The main difference between them being the projection of light. LCD screens are said to offer brighter and better display in direct sunlight whereas the AMOLED display provides sharper contrast and more saturated colors.

CAMERA

In this picture and video-loving world, camera quality is one of the most important aspects of any phone. But most people just focus on the number of megapixels which is not the right criteria to judge a camera. Just having a higher number of megapixels does not ensure a better camera quality. The overall camera quality depends on several other factors apart from megapixels like ISO, aperture, etc. The other features to look out for are the number of Cameras, Aperture Size, hybrid autofocus, optical stabilization, manual modes, special effects, unique selfie feature, and many more.

PROCESSOR

This is the hub of the device on which the overall performance of a phone like its clock speed, refresh-rate, etc depends. It acts as the brain of a device and is responsible for controlling every function and action call. The processing speed is mentioned in terms of GHz (Giga Hertz). The higher the GHz, the faster would be the processor and thus the overall performance of the phone would also be faster.

BATTERY

It is one of the most important features to consider when deciding on a new phone. We cannot keep our phones connected to the charger or power bank throughout the day. So, it becomes really important to keep the battery capacity in consideration. The battery capacity is denoted in milliampere-hour (mAh) which is the amount of electrical charge a particular battery will hold.

INTERNAL STORAGE

It is the amount of space that is available in your device by default i.e, without any external attachments. The ideal storage space for a smartphone varies depending on the user. Some people prefer to keep lots of data and applications while others don’t. Hence they should accordingly choose the device whose Internal Storage suits their need the best. Although one can always expand the device storage via MicroSD cards.

TECHONOLOGY

Young people spend 27 or more hours a week on the Internet (Anderson). As society moves on, technology will keep diffusing and changing drastically; opening more possibilities for newer and undiscovered innovations to take over. Technology can be found anywhere from phones to cars that people drive every day. As technology advances, scientists and doctors have started an altercation between those who believe new tech will teach communities and strengthen our knowledge and others who believe that inventing untested gadgets will only corrupt the nation and affect students at work. Although people view technology as an important tool of the future, technology can be more harmful to society as students become distracted, leading to health concerns, and influencing people to cyberbully. To begin, technology can be used as a productive tool, but sometimes at school, this tool can become a huge distraction.

Advancements in Technology:

From the invention of the wheel to the use of microchips in computers and mobiles, technology has come a long way. Man has reached the moon and explored outer space just because of the advancement in the aeronautics field. Even in primitive occupations such as agriculture, there have been so many technological advancements with modern tools such as traction engines and steam tractor technology which have helped us make progress.

Prominent Examples:

Although there have been countless examples where technology has changed our lives, there are some which are considered revolutions for mankind. The technology used in the field of robotics is one such fine example. Nowadays robots are being used by people and industries all over the world for various purposes. They are also used in places that are otherwise considered harmful for humans thereby protecting us. One such area is the cleaning and managing of radioactive waste.

Artificial Intelligence (AI) is another field that is a classic example of the technological advancements man has achieved. Who could have imagined that a machine would be capable of thinking like us? That is what AI has been successful in doing. It is an intelligent machine capable of behaving like us. It can do activities such as problem-solving, planning, learning, and even reasoning. Today AI is used in all major areas such as warfare, security, healthcare, and communication. On top of this, it is far more efficient than us and has a lower rate of error.

Importance of Technology:

Technology has its own importance in our lives. Without technological advancements, our lives would not have been simpler and faster. The modernization that the world is witnessing today has all been possible because of the technological developments in different fields. Moreover, it has helped in reducing the risks people had to undertake in many sectors such as mining. With new tools available, the tasks are less risky and are more efficient as well.

Conclusion:

Technology can be said to be very addictive as a result of its convenience and the easy comfort sources accompanied by the entertainment that it offers. It is however important that one tries to find a balance between nature and technology and not get too much of technology. If one can do this, it is sure that one’s life will change for the better and one would be able to live a life that is happy and free of stress and depression.

Have we ever wondered why the rich are always rich and the poor are always poor?

we always looks this, thinks why the rich are always rich and the poor are always poor. The biggest hand in this is money. But money is not the only difference between rich and poor. Along with money, the wealthy have the desire to be successful and earn more and more money. Also the mentality of the rich is different from others. You cannot become successful and rich just by taking a good salary. Success requires a right attitude and a rich mindset. That’s why we are giving you information about the thinking and mentality of rich and poor,

If you think that only hard work and dedication towards work can make you rich, then you are wrong. Because rich people never work for money, but they earn money from what they do. They invest their money wisely and get good returns.

On the contrary, a person with a weak and poor mentality works hard to earn money throughout his life, but is not able to become rich, because he works hard but does not invest his money. You cannot become rich without investing, because only by investing will you get returns. Along with this, after one age you retire. Your income also decreases and it becomes difficult for you to meet your expenses at this time and only parents give knowledge of money management to children, and teacher can simply teach what is written in the book and can show us the right path for life. teach us, but only parents learn the work of money management.

One of the best things you can do to get the most out of your money is to manage it more closely. When it comes to money management, setting a budget and getting sound financial advice and support are two of the most important steps you can take. There will be some people in our country who make the budget of their house and we should also do the same, we should make a budget in our house. We should note the cost of everything in our house, the money should be done in the right place. We should try that we should save the money as much as possible. So instead of keeping your money in the account, invest and try to earn as much money as possible.

A rich and wealthy-minded person always believes in learning new skills and enhancing their experiences. Due to this approach, he gains more and more knowledge and information. Make your life different from others. But for poor or poor minded people, learning ends after formal education is over. They stop reading and learning new skills after their studies and stay in one place for the rest of their lives. We have to understand that the world is constantly changing and with the changing times we also have to change ourselves and upgrade our skills while learning new things. Due to these reasons even today the rich and rich are getting poorer and poorer.

BASKETBALL

Basketball is a team sport in which two teams, most commonly of five players each, opposing one another on a rectangular court, compete with the primary objective of shooting a basketball (approximately 9.4 inches (24 cm in diameter) through the defender’s hoop a basket 18 inches (46 cm) in diameter mounted 10 feet (3.048 m) high to a backboard at each end of the court) while preventing the opposing team from shooting through their own hoop. A field goal is worth two points, unless made from behind the three-point line, when it is worth three. After a foul, timed play stops and the player fouled or designated to shoot a technical foul is given one, two or three one-point free throws. The team with the most points at the end of the game wins, but if regulation play expires with the score tied, an additional period of play (overtime) is mandated.

The five players on each side fall into five playing positions. The tallest player is usually the center, the second-tallest and strongest is the power forward, a slightly shorter but more agile player is the small forward, and the shortest players or the best ball handlers are the shooting guard and the point guard, who implements the coach’s game plan by managing the execution of offensive and defensive plays (player positioning). Informally, players may play three-on-three, two-on-two, and one-on-one.

In December 1891, James Naismith, a Canadian professor of physical education and instructor at the International Young Men’s Christian Association Training School (now Springfield College) in Springfield, Massachusetts, was trying to keep his gym class active on a rainy day. He sought a vigorous indoor game to keep his students occupied and at proper levels of fitness during the long New England winters. After rejecting other ideas as either too rough or poorly suited to walled-in gymnasiums, he invented a new game in which players would pass a ball to teammates and try to score points by tossing the ball into a basket mounted on a wall.

Basketball was originally played with a soccer ball. These round balls from “association football” were made, at the time, with a set of laces to close off the hole needed for inserting the inflatable bladder after the other sewn-together segments of the ball’s cover had been flipped outside-in. These laces could cause bounce passes and dribbling to be unpredictable. Eventually a lace-free ball construction method was invented, and this change to the game was endorsed by Naismith. The first balls made specifically for basketball were brown, and it was only in the late 1950s that Tony Hinkle, searching for a ball that would be more visible to players and spectators alike, introduced the orange ball that is now in common use.

Should Plastic be Banned

Plastics are a man-made disaster that will stay with us for thousands of years to come. Also, our life has never been plastic-free. Every aspect of our lives includes plastics in it, whether it’s entertainment, medical, travel, work, or just home. But it won’t be fair if we don’t acknowledge the fact that plastic has also been a boon for economic development in the world. It has been a wonder material for many industries.

A truly wonderful and magical material, plastic was invented in the year 1907 by Leo Hendrick Bakeman in New York, United States of America. This wondrous material was made from phenol and formaldehyde in a cheap and easy method. Ever since this revolutionary invention, the world as we knew it has changed. Plastic replaced many materials in industries. Plastic is so widely used around the world because of its following properties:

  • Plastic is a hard material
  • Plastics are a highly dense material
  • Its tensile strength is high
  • It is resistant to heat and high temperatures
  • It is a non-conductor of electricity and heat
  • It is light in weight
  • The production of plastic is cheap and simple

Reasons to Ban Plastic Bags

There are numerous reasons why the government of various countries has come up with strict measures to limit the use of plastic bags. Some of these include:

  • Waste plastic bags are polluting the land and water immensely.
  • Plastic bags have become a threat to the life of animals living on earth as well as in water.
  • Chemicals released by waste plastic bags enter the soil and make it infertile.
  • Plastic bags are having a negative impact on human health.
  • Plastic bags lead to the drainage problem.

Although plastic is becoming a big threat for all of us, still this problem has often been overlooked and underestimated. This is because people do not look at the long-term effect of these small, easy to carry bags they use in their everyday life. Besides all of these people keep using bags due to their convenience. But now everyone has to completely stop using the plastic bag to save our environment and earth.
