Government concerned over return of large number of Indian students from US due F1 visa issues.

The US order of July 7 stating that F1 visas will not be renewed for students if they are attending only online- lectures in the US is a concerning mater for India since the highest number of foreign students in the US are from India. The US government has announced those F-1 and M-1 (non-academic and vocational students) visa holders attending only online classes will not be allowed to remain in the US.

US Noted India's Concerns Regarding F-1 Visa Issue: Centre

India on Thursday said it has reported its concerns to the US govt about the new rule on F1 visa and urged to keep in mind the role education have played in the developing relationship between the two countries.

The concerns were expressed during the virtual foreign office consultations between Foreign Secretary Harsh Vardhan Shringla and US political affairs secretary David Hale on Tuesday. Ministry of External Affairs’ spokesperson Anurag Srivastava said that the US government has looked into the concern regarding the new rule.

During virtual meeting, Srivastava said that India is concerned about the possibility of the return of a large number of Indian students studying in the US due to new rules in visa.

The Immigration and Customs Enforcement (ICE), an agency of the US Department of Homeland Security (DHS) on Monday said that the foreign students pursuing courses in the US must return to their country if their institutes are conducting only online course due to covid-19 pandemic.

It’s not your weakness, it’s their strength

Are you motivated to do something? It’s what we call it but people will call it as influencing. They didn’t betray you, you trusted them. You are easy target for them. It’s you whom you should change. People are easy target for them. It’s us who should make us strong. Beleiving is good, but trusting is not better. They create a impression on your brain that you get attracted to them. It’s not your weakness, it’s their strength. Try to make yourself from such incidents.

Trusting blindly will not happen all of sudden. It’s a slower process where they crate a impact of them on you. People with clarity will definitely fake the people who actually wanted to fake us. So be careful while choosing friends. It’s easy to get influenced because it’s difficult to influence. Believing and betraying is a cycle. People who got betrayed will become the people will betray. it’s a never ending cycle. It ends when people start betraying. It only happens when people stop betraying. Have clarity over such things. There are too smart to catch. They influence you with their magical words which create a direct impact on your brain. Escape from such things.

Have a true life rather than making people suffer. Be kind and gentle atleast to yourself. Anyone no one gonna live permanent. People will betray someone untill people stop betraying. Have guts to earn something by working hard. Believe in your work and have confidence in you. Be happy with what you have rather than wasting your time on something that you never get. Go in a truthful manner and definitely right yhing will happen.

You definitely do what your friend had done because you too wanted to do what he did. It’s good it it’s good but if you do something wrong them that’s completely wrong. You will definitely get influenced by your friends unknowingly. You should have a control over your thoughts on this issue. It becomes serious if you do something that shouldn’t be done.

CORONA VIRUS Myths

It’s been almost close to 5 months with already half the year gone by. We are still on the road to recovery with hike in corona positive cases almost on a daily basis. With some states of the country extending the lockdowns and others taking drastic measures to control the spread of the virus. Still somehow we are falling back and missing out on something. With a scare that community transmission of the virus has started in India and the WHO confirming that the deadly virus can also be airborne and transit through air, it’s quite a terrible situation.

There is a lot of ‘what ifs’ and assumptions that people have conceived through various means which is not exactly true. I would like to burst some myths of this fatal virus in this article in order to educate people on the actual facts. This will benefit many by and large I hope.

So here are some facts about the corona virus that the World Health Organisation has stated.

FACT: People should NOT wear masks while exercising

People should NOT wear masks when exercising, as masks may reduce the ability to breathe comfortably.

Sweat can make the mask become wet more quickly which makes it difficult to breathe and promotes the growth of microorganisms. The important preventive measure during exercise is to maintain physical distance of at least one meter from others.

FACT: The likelihood of shoes spreading COVID-19 is very low

The likelihood of COVID-19 being spread on shoes and infecting individuals is very low. As a precautionary measure, particularly in homes where infants and small children crawl or play on floors, consider leaving your shoes at the entrance of your home. This will help prevent contact with dirt or any waste that could be carried on the soles of shoes.

FACT: The coronavirus disease (COVID-19) is caused by a virus, NOT by bacteria

The virus that causes COVID-19 is in a family of viruses called Coronaviridae. Antibiotics do not work against viruses.

Some people who become ill with COVID-19 can also develop a bacterial infection as a complication. In this case, antibiotics may be recommended by a health care provider.

There is currently no licensed medication to cure COVID-19. If you have symptoms, call your health care provider or COVID-19 hotline for assistance.

FACT: The prolonged use of medical masks* when properly worn, DOES NOT cause CO2 intoxication nor oxygen deficiency

The prolonged use of medical masks can be uncomfortable. However, it does not lead to CO2 intoxication or oxygen deficiency. While wearing a medical mask, make sure it fits properly and that it is tight enough to allow you to breathe normally. Do not re-use a disposable mask and always change it as soon as it gets damp.

* Medical masks (also known as surgical masks) are flat or pleated; they are affixed to the head with straps or have ear loops.

FACT: Most people who get COVID-19 recover from it

Most people who get COVID-19 have mild or moderate symptoms and can recover thanks to supportive care. If you have a cough, fever and difficulty breathing seeks medical care early – call your health facility by telephone first. If you have fever and live in an area with malaria or dengue seek medical care immediately.

FACT: Drinking alcohol does not protect you against COVID-19 and can be dangerous

The harmful use of alcohol increases your risk of health problems.

FACT: Thermal scanners CANNOT detect COVID-19

Thermal scanners are effective in detecting people who have a fever (i.e. have a higher than normal body temperature). They cannot detect people who are infected with COVID-19. There are many causes of fever. Call your healthcare provider if you need assistance or seek immediate medical care if you have fever and live in an area with malaria or dengue.

FACT: There are currently no drugs licensed for the treatment or prevention of COVID-19

While several drug trials are ongoing, there is currently no proof that hydroxychloroquine or any other drug can cure or prevent COVID-19. The misuse of hydroxychloroquine can cause serious side effects and illness and even lead to death. WHO is coordinating efforts to develop and evaluate medicines to treat COVID-19.

FACT: Adding pepper to your soup or other meals DOES NOT prevent or cure COVID-19

Hot peppers in your food, though very tasty, cannot prevent or cure COVID-19. The best way to protect yourself against the new coronavirus is to keep at least 1 metre away from others and to wash your hands frequently and thoroughly. It is also beneficial for your general health to maintain a balanced diet, stay well hydrated, exercise regularly and sleep well.

FACT: COVID-19 is NOT transmitted through houseflies

To date, there is no evidence or information to suggest that the COVID-19 virus transmitted through houseflies. The virus that cause COVID-19 spreads primarily through droplets generated when an infected person coughs sneezes or speaks. You can also become infected by touching a contaminated surface and then touching your eyes, nose or mouth before washing your hands. To protect yourself, keep at least 1-metre distance from others and disinfect frequently-touched surfaces. Clean your hands thoroughly and often and avoid touching your eyes, mouth and nose.

FACT: Being able to hold your breath for 10 seconds or more without coughing or feeling discomfort DOES NOT mean you are free from COVID-19

The most common symptoms of COVID-19 are dry cough, tiredness and fever. Some people may develop more severe forms of the disease, such as pneumonia. The best way to confirm if you have the virus producing COVID-19 disease is with a laboratory test.  You cannot confirm it with this breathing exercise, which can even be dangerous.

These are a few important facts. Please check the validity of any news you come across on any platform. Make sure you follow only authoritative source. And please do not panic. Stay safe!

Anger management

Getting angry on someone is the most easiest thing because it almost happens all the time. Can we control anger? Can we stop before we get it? Anger is a sudden reaction of the pressure inside that occurred due to disagreement of your opinion. Anger has a great impact because we speak without control. Words that come out of our mouth were actually came from our heart. Usually people hide the true opinions and try to fake friendships. But due to this sudden process the opinion of us over others comes out in a sudden manner.

Things done can never be undone so think before you do. Thinking about done doesn’t erase done. Neither can we change the past not set the future. So think about present because it’s the only thing that’s in our control. May be I can modify the sentence as present is also not in our hands atleast we have a feel that it’s in our control. The feel of real is not real but we are atmost in real. It gives us confidence and hope of our chances to change our present. Going with the flow is a old phrase which makes our lives flow like a wave in a sea. Have focus because its something that stops us from making something. Our conscience reacts only when it’s emergency, so depending on it is not trustworthy.

Have a clarity over your doing. Anger can’t be stopped from getting started. But we can decrease the intensity. We don’t know the initial point of the anger when it’s about to start. But we can remember it only after the incident. So try to stop the origin isn’t in our hands because it happens all of sudden and we don’t have control over it. So try to save ourselves from becoming worse is the only option left with us. We get to know about ourself at the time of anger. We need to control ourselves by shifting our thought to some other thoughts.

Manage your anger by thinking of something else and let your brian think in different direction. Have a shift over your thoughts and manage your anger. Don’t try to stop anger because you can’t stop it. Try to control the intense when you have conscience over your doing. It decreases the intense of your anger and thereby letting you mange your anger.

IS ASTROLOGY A MYTH OR FACT?

Astrology and Free Horoscopes | Jessica Adams Astrologer

Astrology is the study of the movements of the planets, sun, moon, and stars in the belief that these movements can have an influence on people’s lives. Astrology originated in Babylon far back in antiquity, with the Babylonians developing their own form of horoscopes around 2,400 years ago. Then around 2,100 years ago, astrology spread to the eastern Mediterranean, becoming popular in Egypt, which at the time was under the control of a dynasty of Greek kings.

Astrology is a very vast science. It is practiced in almost all the religions of world and each religion have different principles and methods for predicting future and revealing destiny. Many cultures have attached importance to astronomical events, and the Indians, Chinese, and Maya developed elaborate systems for predicting terrestrial events from celestial observations. In the West, astrology most often consists of a system of horoscopes  purporting to explain aspects of a person’s personality and predict future events in their life based on the positions of the sun, moon, and other celestial objects at the time of their birth. The majority of professional astrologers rely on such systems.

They made the calendar, predicted the tides, estimated the harvest season, followed the stars in the sea, and so forth. It helped, so it became the science of the day.

Things moved in the sky, but they always came back. Always. And they came in patterns. Just like how humans are born and dead. The cycle – the cycle of life. Maybe, just maybe, the celestial alignment breathes the very same cycle of life? A few thought so anyways.

With a gripping delusion, they projected everything up high, to the sky; the joy, the suffering, the pain, the flood, the death, the birth, the entire human existence. And right there in the night, under the gazing stars and the moon, astrology was born. An ancient pattern matching scheme – a manual one. And, astrology thrived.

They started manually collecting the celestial alignment at birth data of all the kings, queens, royals, servants, saints, widows and witches. And, then they manually labelled it, and looked for patterns. They checked if all royals had some celestial alignment in common, and the same went for the poor and the misfortunate. Criss-cross. Cross-criss. Thus began the humongous scheme of pattern matching.Through years and years of data collection, pattern matching and model learning, they tuned their model and churned out the model that best fits their data.A chart was stuck to you upon birth. A lifeline that tells your destiny, your personality, your likes and your dislikes. The one that indicates everything; your everything, even your sex life.To be honest, it’s an ingenious idea, and great efforts too. Mind the time, this is thousands of years ago, when they didn’t even have a WiFi.

As years roll on, the scientific community rejects astrology as it has no explanatory power for describing the universe, and considers it a pseudoscience. Scientific testing of astrology has been conducted, and no evidence has been found to support any of the premises or purported effects outlined in astrological traditions. There is no proposed mechanism of action by which the positions and motions of stars and planets could affect people and events on Earth that does not contradict well understood, basic aspects of biology and physics. Those who continue to have faith in astrology have been characterised as doing so. In spite of the fact that there is no verified scientific basis for their beliefs, and indeed that there is strong evidence to the contrary.

Confirmation bias is a form of cognitive bias, a psychological factor that contributes to belief in astrology. Astrology believers tend to selectively remember predictions that turn out to be true, and do not remember those that turn out false. Another, separate, form of confirmation bias also plays a role, where believers often fail to distinguish between messages that demonstrate special ability and those that do not. Thus there are two distinct forms of confirmation bias that are under study with respect to astrological believe.

Across several centuries of testing, the predictions of astrology have never been more accurate than that expected by chance alone. One approach used in testing astrology quantitatively is through blind experiment.

To MARS, Or Not To MARS ?

Strap yourself in, we are going on a trip in our favorite rocket ship, steering through the clouds like little Einsteins. Climb aboard and get ready to explore, the Red Planet- Mars. From hostile deserts, to lonely islands and the highest mountains, wherever there is space to expand into, humans do so.

Hence it is hardly surprising that we are all ready to set foot into Mars and create the first permanent colony outside of Earth maybe even terraform another planet and turn it into a second blue home.

If you don’t know who is Elon Musk, then you better start googling his name and get to know him. Not only is he the billionaire founder of Tesla Motors, this a.k.a. Iron man superhero Tony Stark has ambitious plans to send humans to Mars by 2025.

If this is a trip then like any other, there is a need for a checklist with list of items to be taken to Mars and items we can conveniently leave back on Earth. Let’s get started fellow Martians.

A MARS COLONY CHECKLIST :

  • PORTABLE OXYGEN GENERATOR- You need to breathe. In case of emergency, a standby kit to generate oxygen is required. But considering humans, we might need a mask too because air is our favourite natural element to pollute.
  • PORTABLE SOLAR POWER KIT- Low battery and no charger sounds as scary as the trip itself. Whatever electronics you are bringing, as long as there is no electricity, forget about your entertainment. You don’t want to die of boredom.
  • PORTABLE WATER FILTER- We know there is frozen water on the planet. But we dont know if ita drinkable. All the ice deserves a drink, so bring a filter and soda-making machine if excess luggage permits (check with your airline)
  • PLANT SEEDS- Once you run out of your snacks you should look into farming. Be prepared, bring some seeds and check some tutorials on gardening (preferably in space).
  • LONELINESS- Self isolation might be needed to avoid radioactive exposure, well looks like the year 2020 is indeed a good practice for it. Also aren’t we all lonely from inside (No? just me? Okay…. *crawls back into my hole*)
  • NUCLEAR REACTORS- For creating a safe atmosphere and not the nuclear weapons that Nations own for “defense purposes” Let those weapons stay on Earth along with the people who threaten to use them because there isn’t much spice in their lives.
  • MULTIMILLION DOLLAR SPACESHIP – So large that it could fit the 150 Million homeless around the world, people who have been disappointed by the Politicians and their promises.
  • A HIGH TOLERENCE – A tolerance level higher than what we have to everything on social media and to the lifestyle of new generations.
  • MAA KE HAAT KA KHANA – A nice Tupperware tiffin box with food made by your Moms because, The M.O.M on Mars doesn’t cook or do ALL your work. (M.O.M –Mars Orbiter Mission also called Mangalyaan)

Lastly a desire to get away from it all. Elon Musk is not crazy, but a visionary, a modern adventurer who dares to dream. NASA is behind him by committing to send the first batch of astronauts on his mission. More than 200,000 people have signed up for the one-way ticket to Mars including Leonardo DiCaprio. Musk hopes to send 1 million people to the Red Planet and a ticket is estimated to cost around USD200,000 for each passenger (Hefty I know, but you get to travel with Leo as your travel buddy, hopefully this space- SHIP doesn’t sink).

Well as scary and uncertain as everything sounds it all comes down to one very important factor, Does Mars have Wi-Fi?

Living isn’t expensive but trying to live like other make it so

Everything doesn’t happen the same way again. Nothing repeats, but if it repeats, it’s unintentional. Don’t hope the same thing to happen for you the way it happened for your mate. Destiny is different for different people. May be you are meant for another job. Take the pain, feel the pain. You are not the duplicate of your friend. He might have talent in one aspect and you might have in some other. Don’t do what exactly he does, if so you are the only person who is trying to kill your unknown talent.

Being you isn’t doing things in different way which are already done. Doing the undone is becoming you. No one loves their own life and believing in themselves. Always thinking of someones life and feeling to have a life like them is worthless. Be you and make yourself from yourself. Dont try to be like others because it makes your life invisible. If you don’t want your life to be existed then try to live like others. Have your identity because it’s you. You are atleast important to yourself. Atlast you should accept yourself. Have faith in you and being you isn’t wrong. Don’t feel ashamed of yourself.

If not you, whom do you expect to have a respect on you. You should care about yourself. No one cares you because everyone are busy building their lives. Have respect on you because it’s you with whom you gonna spend your rest of the life. Accept yourself, try to remake you and try to change the way you want see you. You can still do whatever you feel you can’t. You can’t feel the impossible, if you felt something, then later on someday it will happen. People won’t thing something that won’t happen. May be it won’t happen now, may be its impossible now. The only thing that is stopping us from doing is the border now. Having a dream that is literally impossible will be possible in future. The impossible present will definitely be a possible future. Future is unpredictable.

Have a composed life rather than rushing towards a life you think better for you. Have a pleasant and calm life. Living isn’t expensive but trying to live like others make it so. Try to live like you and copying is expensive. Be happy and content with what you have.

Mortgage, Mortgagor, Mortgagee

Section 58 of transfer of property act defines the terms mortgage, mortgagor, mortgagee, mortgage money and mortgage deed.

Section 58 of transfer of property act. Mortgage is the transfer of an interest in specific immovable property for the purpose of securing the payment of money advanced or to be advanced by way of loan, existing or future debt, performance of an engagement which may give rise to a pecuniary liability.

What is a Mortgage ?

A mortgage or charge is granted by a borrower in favour of a lender to secure repayment of a loan. If the borrower fails to pay back the debt, the mortgage gives the lender the right to take possession or to sell the property. The mortgage must be registered against the property at the appropriate registry. Each province has its own mortgage and registration rules.

What is a mortgage discharge ?

A mortgage discharge (also known as a “release”) is the removal of a mortgage from the registry in which it was listed. Once the mortgage has been discharged, the lender loses any rights it had against
the property under the mortgage.
The borrower must pay the legal fees for preparing and registering the mortgage, as well as any administrative
fees charged by the lender.

Conclusion

Mortgage is a legal instrument which is used to create a security interest in real property held by a lender as a security for a debt it is the lenders security for a debt. In other words the mortgage is a security for the loan that the lender makes to the borrower.

The case of Kanti Ram vs Kutubuddin is perfect to answer this question.
Sale of mortgage property or suit for sale of mortgaged property without redeeming prior mortgage form of decree sections 48,58,60,86,88,96 and 97 of transfer of property act. The plaintiff is not entitled to bring to sale the mortgaged property without first redeeming the prior mortgages. The lower court have proceeded upon a mistaken view of the law on the subject, and that they are entitled to bring to sale the mortgaged property subject to the lien of the prior mortgages and that would be acquired by th purchaser under the sale is the equity or redemption which existed in the hands of the mortgagor at the time of the second mortgage. The right of the mortgagor to redeem the prior mortgages. And on the other hand it has been contended on behalf of the respondents relying mainly upon the case of mata din kasodhan vs Kazim Hussain.

Is this what we call a “Revolution”?

The world has been divided into groups, sub-groups in which the people are categorised by either caste or religion and now on the basis of colour also. All of this is a very abstract topic and we just can’t argue on this but can we at least not work like the society, can we just look everyone with the same mindset, treat them equally, respect them equally. Our society has been ruled and judged by the superiors and is still being judged by our so called politicians who have manipulated the minds of the people and have turned off the ‘Humanity’ mode in them.

Things have turned really outrageous where people still haven’t learnt the real meaning of helping each other and treating everyone as equal. A recent example of “A Dalit couple” in Madhya Pradesh who have committed suicide because their crops were thrashed and they were being beaten up from the cops. This was a very brutal act against the marginalised sections of our society where those two were crying out for help and were begging to the police to stop and spare them, but nothing happened because it was an order from the government. This cruel and shameful act took place after the couple were seen growing crops on the land which was being inherited by the government. They were quickly rushed to the hospital after both of them consumed pesticides, and now they are in a normal condition.

Al Jazeera

“When our standing crop has been destroyed, we don’t have the option but to kill ourselves” Devi quoted.

All of this took place because the Government wants to build a college at the same spot where the couple had their farms and the government wanted them to leave everything and clear the land, but they didn’t accept their order because they were in debt and farming was the only source of living for their family. But in this also again the Political parties have started their war where they are blaming each other for this incident. This issue has come up weeks after that brutal and senseless incident where a son and a father were beaten up to death in Tamil Nadu by the cops.

What are we doing? where is the world going? On one hand where the policemen/policewomen are given the authority to serve for the country and work for the civilians, protect them, prevent all the evil things which are taking place in the society and on the other hand the police is beating up their people. Please stop, we are already having multiple issues in our society, people are dealing with numerous problems and above all Farmers are the fruit givers to the society, they feed us, how can we take their land and built something in place of a farm. This issue is something very serious and we have to fight against this, we have to fight against the rights of the farmers because they work for the Primary sector of the society. I hope this article will ring a bell of humanity in each one of us and will force us to make an initiative and stop the evil doings of this society, if not this at least we can pray for the farmers, for their health and well-being.

Global Diplomacy: The United Nations.

  • The name “United Nations” appears true only in books but in reality it seems like a contest for nations to prove their dominance and power individually. The diplomacy comes off to be biased. The World today is owned by corporate and the UN follows through. The actual role of united nations should be to rise above the competition and work as ONE UNITED PLANET towards climate change, global pandemic, poverty and financial slavery.

Though it is non-arguable that UN has helped bring forward issues like Women Empowerment, Poverty, Health, Education, etc. on a global platform. The real question is, are these issues solved or they have been piled upon by newer issues day by day.

But on a positive note, the UN has made progress in its peace making strategies and providing financial and healthcare aids to the countries in need. If not for this organisation then there would have not been a diplomatic relationship between nations and war would be the ultimate solution to all inter-nation problems.

Just because a medicine has side-effects does not mean it cannot be used for treating the illness in hand. Similarly, it is easy for anybody to make war but only the united front can make peace and prosperity!

  • The UN came from the minds of some of the renowned politicians of the western countries. When the super power nations felt their security and peace was under threat they collaborated with like-minded ones against the equally powerful nations. Powerful only in military and vengeance and the greed to conquer. According to human psychology (basic), a man desires power more than water for thirst.

From all the glorifications I read about this organisation, UN rose from the ashes of the war like a phoenix bird. Very beautiful and powerful bird- a phoenix-their tears have healing powers. One can say that United Nations came into existence to act as the panacea to diseases like violence, death and fading humanity.

But is the origin really important to determine its worth in the present scenario is something to ponder upon. Today UN works for a cause which it was originally built upon; irrespective of its results, – promotion of peace with its symbol the white dove soaring high, its wings flapping, freeing itself from the shackles of slavery of power, money, greed and hate.

Born in times of desperate times it can be regarded as an invention by man in the time of dire need. As we all know – “NECESSITY IS THE MOTHER OF ALL INVENTIONS!”

  • The UN Security Council consists of 5 permanent members and 10 temporary members all with a right to vote however only the permanent five have the right to veto. The word itself suggests that the council was made to resolve the security concerns of nations and to make peace among them.

Today, the Council responds to three types of situations:

  • (1) chemical, biological, radiological and nuclear weapons proliferation; (2) international conflict; and (3) intra-state conflict. More recently, the Council has also developed a (4) cross-cutting and (5) quasi-legislative agenda.

The above decisions and powers in the hands of the council sounds safe however it is not the situation in reality. There has to be an expansion of the members instead of giving all the authority in the hands of the few. This will help in avoidance of partiality or constant disagreement that has been happening since the council has been formed. Though it has never successfully managed to make any notable reforms , it is one of our best option to resolve the security threats and war like situations in many countries and their estranged borders.

  • Human rights are the rights we are all entitled to irrespective of the place of birth or the time of birth. The core of United Nations is built upon the protection and service towards human rights and its associated freedoms. However due to international politics and superpower nations greed to stay on top of others and world domination has endangered the human rights of developing and under developed nations. Human rights have become a selective freedom provided to only those who can afford it without any restrictions. In my country citizens think that they are not worthy of having human rights as they think only the rich and developed nations are fortunate enough to have human rights that too the basic one’s. In recent events of racism ad discrimination on the basis of colour and financial status, what is the united nations enforcing laws to stop the fights  to avail basic human rights. People have to come on streets and protest later developing into riots in order to practise their rights and enjoy the freedom of being born as a human on this planet.
  • The united nations in the past has failed in crisis management because of the disagreement between it’s member nations and security councils. Due to the interference of the security council the  situation was aggravated rather than being put out or quite down. Rather than focusing on the crisis at hand it focuses on the political relations of that country with the members of the united nations and then it takes the necessary actions that too not quick or decisive but slow and of poor quality. However by putting the past back the united nations can improve on its crisis management skills by being in constant touch with the country and states local administration and education people on a personal and more localised manner rather than representing it as a political agenda or foreign policy which puts the civilians in a mind-set of confusion and feeling of unsafe and non trustable environment.
  • Today a question arises on the future of the United Nations and will it still prevail in the modern world where people are becoming rather too aware and will want a more secular council, one which works one which provides solutions, one which is actually true to its purpose of being formed.
  • During the 2020 Global Pandemic the true face of UN is being put to test and how it acts now to maintain peace among nations will say a lot about its existence in the future or will it be left to be just pages in history textbooks.

Just wishing for once if we had leaders who cared about the upliftment of the entire nation and not just the name of their political agenda and parties. The world needs educated and selfless leaders and hopefully in the future with my generation in the front we will represent a better council than these old ways and barbaric wars.

Marital Rape:Culture or Consent?

Patriarchy, often perceived as a “culture” by the Indian society, strives to be protected at all costs, even if that means to strip off the “vulnerable”, of their basic human rights. All concepts that threaten this so-called culture, are categorised as “western concepts”, and are further refused to be acknowledged. Living in denial and refusing to acknowledge the problems, does not mean that they don’t prevail in the Indian Society. In fact, this means that a significant chunk of the society is not ready for the particular problem, but, that does not in any way, give them the right to disregard other people’s safety and security, just because their’s is intact.
One such controversial concept is ‘Marital rape’, often perceived as an oxymoron. Although, ‘rape’ has been clearly defined by most of the criminal codes of almost every country recognised by the United Nations, yet the understanding is rather subjective varying on the culture and relationship of the accused and the victim.  As Estelle B. Freedman points out in Redefining Rape,”At its core, rape a legal term that encompasses a malleable and culturally determined perception of the act…The meaning of rape is thus fluid”. One such factor is ‘marriage’, which supposedly rules out the possibility of forceful sexual conduct upon a wife, since a wedlock provides  immunity to the husband, sociologically as well as on legal grounds in 10 nations of the world.
Well, one of the most difficult challenge faced by people opposing marital rape, is the lack of acknowledgment of this sin. The surprising fact is that this is probably the only crime , where the victim does not recognise her violation of the rights, because control of a woman’s body is foundational to patriarchy. As British jurist, Lord Mathew Hale, states that,”The husband cannot be guilty of rape committed by himself upon his lawful wife, for by their mutual consent and contract the wife hath given up herself in this kind unto her husband, which she cannot retract.” This orthodox thinking is deep rooted in our society and is a shame to our so-called judicial progress, because if we see the section 375 of the Indian Penal Code,1872, although it defines rape, yet there is an exception in the statute which states, that, ’Sexual intercourse by a man with his own wife, the wife not being under fifteen years of age, is not rape.’

Arguments generally used to justify the non existence of this crime in the IPC, are that there are other sections like domestic violence and cruelty that protect the wives from the oppression and dominance.“there are other provisions that safeguards the rights of a wife, like domestic violence which covers cruelty, so why do we need another law? So greedy, these ‘feminists’ have become!”. This shows us the biggest problem in not recognising marital rape as a form of rape ,that is, the society is ready to accept the husband as an offender of  domestic violence, since the ‘anger issues’ are just unstoppable and ‘he is a man’, but are not ready to accuse the husband of rape of his own wife.Such beliefs are imbedded in notions such as the idea that a woman’s sexuality is a commodity that can be owned by her father or husband, the belief that what happens between husband and wife in the bedroom is a private matter, that a man is entitled to sexual relations with his wife, and that a wife should consensually engage in sex with her husband, thus making rape “unnecessary.”

The ways in which marital rape is condoned varies cross-culturally. In India, Supreme court ruled in February 2015, that marital rape is not a crime.A government minister then told the parliament, that it could not be criminalised in India, since “marriages are sacrosanct”.(BBC News,2015). Like, in United States of America, although it is a criminal offence, yet a significant amount of attitudinal surveys show that Americans regard the rape of a wife far less than a similar assault by an acquaintance or a stranger. “Marital rape is a western concept, it is not possible in the Indian Society”, as stated by Maneka Gandhi, minister of women and child development, Ironical? It’s a crying shame, that people still have to be convinced, that there is ‘no difference’ between rape and marital rape. A wedlock, does not take away the bodily rights of a woman, she is still an individual and her rights must be protected. This mindset cannot be changed solely by judicial activism, but by educating men and women, and making them sensitive towards each others sentiments.

One of the ignored reason of the exclusion of this crime, is the anthropological aspect of research. As Gabriella Torres points out in her book, ’Marital Rape: Consent, Marriage, and Social Change in Global Context’, that first and foremost, this issue is not been given the level of public importance that it deserves. The  arguments for keeping the exemption have included, first,  keeping the marital relationship private,  second,  protecting husbands from vindictive wives, third, because it is nearly impossible to prove, and fourthly because a charge of rape would discourage reconciliation between husband and wife.

The reason for the less public attention given by the people to this inhuman and heinous act is that, the society is so blinded with culture and customs, that now the customs are not according to the behaviour of the people, but the behaviour is according to the culture and customs. This is where anthropologists come into power, since the society has nicely, adapted the crime to the custom, it’s important to understand what the culture or customary practice originally stated. There can be two possible scenarios, that is, one, culture does not state to violate any right, then society’s mindset can be changed with the right information regarding their culture  and second possible scenario is, if the culture succumbs to the violent and dominant ideology and even after reading the accounts of the victim, the dominance of the culture has a possibility, then it is high time we make a choice between ‘Culture or Consent’.

E-commerce

Information Technology has been playing a vital role in the future development of financial sectors and the way of doing business in an emerging economy like India, Bangladesh etc. Increased use of smart mobile services and internet as a new distribution channel for business transactions and international trading requires more attention towards e-commerce security for reducing the fraudulent activities. The advancement of Information and Communication technology has brought a lot of changes in all spheres of daily life of human being. E-commerce has a lot of benefits and many acts which hurts the small businesses or business aspects. This study predicts some challenges in an emerging economy.

What is E-Commerce ?

E-commerce means buying and selling of goods over electronic and digital platforms. Thete have been many allegations that big e-commerce are responsible to harm healthy competition in the market. Economies of scale and advancement of logistical companies has helped e-commerce companies to ship goods to anywhere.

Why E-commerce?

With the increasing diffusion of ICTs, more specifically the Internet, the global business community is rapidly moving towards Business-to Business (B2B) e-Commerce. The buyers gain a clear advantage when the Internet gives them access to the global market, by which they can compare prices across regions, find out whether prices vary by order fragmentation and get awareness about substitute products. Due to transparency of the market, customer can compare the services of various e-commerce sites easily. For instant, in case of e-commerce the competitors are one click away from customer. If clients are not happy with the products, prices or services offered by a particular e-commerce site, they are able to change much more easily than in the physical. From the Sellers’ point of view, they don’t need to have physical existence of shop.

E-commerce Hegemony ?

Recently The competition commission of India ordered a probe into alleged competition law violations by Flipkart Amazon over allegations that the e-commerce major promoted and gave discounts to preferred sellers, entered into exclusive partnerships with smartphone brands and abused their dominant position.

Flipkart Amazon is good provider by online marketplace for selling goods in India. Flipkart and Amazon is a wholesaler which is in the business of seeking the good to reseller.

Section 4 of the competition act 2002 is very important as we know completion act is not against possessing dominant position in the market but is objects abusing such dominant position. Section 4 of this act deals with abuse of dominant position.

Dominant position in a market means positions of strength enjoyed by any enterprise in relevant market. Like any enterprise operate independently of competitive forces prevailing in the relevant market Affects it’s competitors or consumers or relevant market in its favor. Recent example of abuse of power should be Amazon Flipkart how they give heavy discounts to customer directly pick-up the good from company that hits the shopkeeper or small enterprises.

Conclusion

As e-commerce industry is emerging sector with high potential of growth govt has to introduce some policies to promote healthy competition in this industry. Govt has to anticipate current loophole in regulations and amend it is such a way that instead of harming msme sector. The e-commerce industry will be a leader with popularity in electronic business world in the upcoming years. The e-commerce revolution has fundamentally changed the business of transaction by giving new opportunities and breaking borders easily. In India, it has strongly impacted the traditional business system and changing the life of people by making it easier. While it gives benefits to customer and seller, e-commerce gives challenges to traditional business for competitive position. Developing countries face many obstacles that affect the successful implementation of e-commerce with the help of comparing with developed country. When the internet cost will be low then the e-commerce will flourish easily and will make many of traditional business to run out of their business. Convenience is one of the benefits that customer gets from the e-commerce and thus increasing customer satisfaction. This is due to customer can place a purchase an order from anywhere with internet connection. E-commerce business provider should give importance on every customer by giving smooth service and many options for payment and have more functions available online. Other benefits are expanded product offerings and expanded geographic reach. But e-commerce business faces a lot of challenges in flourishing their business.

WORLD’S FIRST COVID-19 VACCINE TESTED SUCCESSFULLY

A university in Russia tested the world’s first COVID 19 vaccine successfully. Russia’s university named Gamaliel institute of epidemiology and microbiology began the clinical trials for testing the vaccine on 18th June. It was tested on volunteers at the Sechenov First Moscow State Medical University. This information was confirmed by the director of the Institute for translational medicine and biotechnology, Mr Vadim Tarasov. He further went on to say that the first group of volunteers would be discharged on the Wednesday of the second of July.

The director of the institute of medical parasitology, tropical and vector-borne diseases at Sechenov University, Mr Alexander Lukashev, stated that the objective of the study conducted was to the vaccines is safe for human health. He further said that the objective was successfully achieved.

“The safety of the vaccine is confirmed. It corresponds to the safety of those vaccines that are currently on the market,” Lukashev told Sputnik.

The further vaccine development plan is already being determined by the developer’s strategy, including the complexity of the epidemiological situation with the virus and the possibility of scaling up production, Lukashev added.

“Sechenov University in a pandemic situation acted not only as an educational institution but also as a scientific and technological research centre that is able to participate in the creation of such important and complex products as drugs … We worked with this vaccine, starting with preclinical studies and protocol development, and clinical trials are currently underway,” Tarasov noted.

After over six months of novel coronavirus outbreak, which has infected more than 12 million people and killed over 500,000 all over the world, the clinical trials of the purported world’s first coronavirus vaccine have been successfully completed.

While over 7 million virus-infected people have recovered so far, scientists and other healthcare systems worldwide are trying to upgrade the production and development of a potential Covid-19 vaccine as soon as possible.

Gilead Sciences, Oxford University’s researchers and American biotech company Moderna are at the forefront of developing a Covid-19 vaccine. However, Gilead Sciences Inc. said earlier that an analysis showed its antiviral remdesivir helped reduce the risk of death in severely ill COVID-19 patients, but cautioned that rigorous clinical trials were needed to confirm the benefit.

Moreover, BioNTech SE and Pfizer Inc.’s Covid-19 vaccine candidate is expected to be ready to seek regulatory approval by the end of 2020, the Wall Street Journal reported on Friday, citing the German biotech firm’s chief executive officer. The experimental vaccine, which showed promise against the fast-spreading respiratory illness in early-stage human testing, is expected to move into a large trial involving 30,000 healthy participants later this month, pending regulatory nod.

Russia is the first nation to successfully complete the human trials of the corona virus vaccine. It has been many months since the deadly virus shook the world with its intensity. Other countries are also trying their best to find a beneficial solution and put an end to this pandemic. I really hope we can all overcome these testing times and hope for a brighter future.
