The Violence of Development: Lakshadweep Development Authority Regulation, 2021

ABOUT LAKSHADWEEP

Lakshadweep is the smallest Union Territory of India and covers an area of 32 sq. km. It has 36 islands out of which 10 are inhabited. The island is directly under the control of Central Government through an administrator. It has 3 main group of islands:

  • Amindivi Islands (Northernmost Island)
  • Laccadive Islands
  • Minicoy Islands (Southernmost Island)

It has tiny islands of coral origin and are surrounded by fringing reefs (hence called as Atoll). The capital is Kavaratti, which is the principal town of the UT and the Pitti Island (uninhabited) has a Bird Sanctuary.

The island has a population of 64,429 (according to Census of India, 2011). More than 93% of the population is indigenous and are Muslims. Because of the populations economic and social backwardness, the entire population is classified as Scheduled Tribes and there are no Scheduled Castes in the UT. The main occupation of the people is fishing, coconut cultivation and coir twisting. And tourism is an emerging industry. Under Participatory Guarantee System (PGS) of India, the entire island was declared as an Organic Agricultural Area.

WHAT IS LDAR 2021 ?

The latest Draft Lakshadweep Development Authority Regulation, 2021, for the creation of a Lakshadweep Development Authority (LDA) which will be the administrative body for the island and will pan the development of the island.

PROVISIONS

  1. CONSTITUION OF LAKSHADWEEP DEVELOPMENT AUTHORITY : The LDAR empowers the government to be identified as the administrator of the island and has the power to constitute Lakshadweep Development Authority. The authority will plan the development of any area in the island, which could be identified in a bad layout or in obsolete condition. This authority has power to prepare land use pans, zonation’s of land uses, indicate areas for different types of development etc. And only Cantonment areas are exempted from this.
  2. Definition of ‘Development: Development is defined as the process of carrying out of building, engineering, mining, quarrying or other operations, in, on, over or under land, cutting of a hill or any portion thereof or the making of any material change in any building or land or in the use of any building or land.
  3. LEGAL PENANLTIES: As per the DDAR, the development plan will not be questioned by anyone, either before or after being approved. It empowers the administering body to forcibly relocate or remove residents or citizens from their own property for carrying out any developmental activity. It establishes penalties for those who will violate the laws. Such as imprisonment for obstructing the development plan’s work or workers.
  4. FEES FOR CHANGING ZONES: It stipulates that islanders and citizens must pay a processing fee for changing zones, which implies that localities will be paying fees to gain approval for altering or changing zones as per the development plan as well as for permission to develop their own land.

CRITICISMS

Following concerns were raised by the people of Lakshadweep:

  1. VIOLATION OF FUNDAMENTAL RIGHTS : The LDAR provides the Government and Development Authority constituted by Government, the supreme powers to acquire, alter and transfer the properties owned by the residents of the island which violates the fundamental rights of the residents of Lakshadweep as guaranteed in Article 14 and 21 of the Constitution.
  2. INTERESTS ON REAL ESTATE : Many residents have been suspecting and fearing that LDAR might seeking real estate interests to usurp the small landholdings and properties owned by the native islanders. There have been proposals of bringing “Transferable Development Rights” to the island which has raised another major concern and fear among islanders for being migrated forcefully.
  3. FORCIBLE RELOCATION AND EVICTION: The LDAR has given the power to relocate people for development plans has become one of the major concerns and issues. According to the regulations provided, the owner has to develop his holding as per the plan prepared by the authority or else they will be penalized in case of non-compliance with the regulation.
  4. ECOLOGICAL CONCERNS: Lakshadweep is a part of coral ecosystem and it has inherited this cultural and ecological uniqueness as well as fragility. This ecosystem can get destroyed easily if the development activities around them are not regulated. The regulations which provide the government supreme powers for acquiring and developing land can be disastrous for this ecosystem.
  5. THREATEN THE CULTURE AND LIFE: The island is very vulnerable to destruction and any further large-scale infrastructural development can have large ecological and social footprint which can negatively affect the potentiality and sustainability of the area as well as the life forms present in the island.
  6. IGNORES PEOPLE’S NEEDS AND GEOGRAPHICAL REALITIES: Lakshadweep has unique geography, ecology and culture and for protecting and preserving this uniqueness it is important to limit the development activities in the island. The LDAR tries to expand the road connectivity ignoring the geographic conditions of the island and the interests of the people. And the LDAR has also provided the regulation that no one can raise or question the strategies or actions provided by the development authority, before or after being approved. This shows that the needs, interests and concerns of the people are undermined.
  7. VIOLATES THE OBJECTIVES OF LAND ACQUISITION ACT, 2013: The Act promotes the consultation with institutions of self-government and Gram Sabha’s, local people and tries to have a transparent and informed process for land acquisition.

DISCOVERY OF ELECTRON

NATURE OF ELECTRON

The properties of electrons indicate that they have a dual nature. An electron behaves both as a particle and as a wave. An electron has mass and possesses kinetic energy. The plot in a farce usually appears nonsensical, characters in the indulge in deception impersonations, and irrationalities. Serious and respectable people are drawn into the most undignified positions, grave and priggish persons are debunked. Most farce is centered around love affairs which themselves are caricatures. In the end, everybody comes out without any harm.

The elements of the Farce:

The elements of the farce can be seen even in the early English plays. Shakespeare’s ‘A midsummer night’s dream’ and ‘Twelfth Night’ are examples to show how farcical elements could be interspersed with comedy with great effect. Event tragedies had farcical scenes as we see in Marlowe’s Dr. Faustus.

As a separate form of entertainment, the farce came into vogue towards the close of the seventeenth century. The first popular farce was ‘The Rehearsal’ by the Duke of Buckingham. But The anti-sentimental comedy almost destroyed farce. But the anti-sentimental comedies of Sheridan and Goldsmith brought back farcical humor into English drama. Some of the scenes in Sheridan’s ‘The Rivals’ and most of the scenes in his “School for scandal” are enchantingly Farcical. Similarly in the play “She Stoops Conquer” by Goldsmith. In the Victorian period, the farce attained a sort of respectability. Farces such as ‘ The Private Secretary’ and ‘Charley’s Aunt’ were several times.

In modern times, the farce is an accepted form of dramatic entertainment. Most of the plays of Oscar Wilde and Bernard Shaw have farcical situations and dialogue. The farce requires unusual inventiveness, a craftsman, and a sense of humor on the part of the writer.

Most modern comic one-act plays tend to be farces. The purpose of such plays is only to give brief entertainment without malice and laughter without vulgarity. Modern one-act plays like ‘The Dear Departed’ are essentially farce designed to produce laughter.

Today is International Tiger Day – 28th July 2021. It’s significance and theme this year.

 Theme this year: “Their survival is in our hands”.

The day is observed to spread awareness about dangers faced by tigers, the threat to their natural habitats due to natural or man-made reasons, to protect them from poachers. Wild tiger numbers dropped by more than 95% since the beginning of the 20th century.

Over 18 States in India provide habitat for tigers. 70% of the total number of tigers in the world are in India. National Tiger Conservation Authority (NTCA) and the Wildlife Institute of India (WII) have mapped 32 major tiger corridors and several smaller ones. (By: ANI)

It has been reported that the number of India has increased over time due to active actions by local community. Reportedly approximately 3,900 tigers now. It is reportedly also known that many tigers live in cage rather than out in wild.

What are e-contracts?

Contracts that went overseas and returned with new electronics and a fancy name are referred to as e-contracts. Electronic contracts are contracts that exist in a digital format and are in high demand these days. E-contracts are quite similar to normal contracts; the only difference is that they take place through an online digital means of communication. E-contracts have eliminated the need for middlemen, and merchants may now reach out to buyers directly. The computer programmes that link the vendor with an electronic agent, i.e. the app, and the buyer with an electronic agent are now the middlemen. Essentially, it provides a venue for the buyer and vendor to meet.

Are e-contracts binding and valid?

In India, the Indian Contract Act, 1872, Section 10 states that “All agreements are contracts if they are made by the free consent of parties competent to contract, for a lawful consideration and with a lawful object, and are not hereby expressly declared to be void.” 

Also, Section 10(A) of The Information Technology Act 2000 states that “Where in a contract formation, the communication of proposals, the acceptance of proposals, the revocation of proposals and acceptances, as the case may be, are expressed in electronic form or by means of an electronic record, that such contract shall not be deemed to be unenforceable solely on the ground that such electronic form or means was used for that purpose.”

Electronic signatures are also considered as proof of signing under the Indian Evidence Act of 1882, and Digital Signature Certificates are created when a document is electronically signed, and this certificate is also legally valid and binding under the IT Act of 2000.

Contracts in India are governed by The Indian Contract Act, 1872, and electronic contracts must be legitimate within the law’s interpretation. The following are the fundamentals of electronic contracts:

  4. Lawful object,
  5. Competent parties to contract,
  6. Free consent,
  7. Certainty of terms.

The most intriguing aspect of this contract is that acceptance may be revoked by returning the merchandise. Furthermore, these days, licencing agreements are not supplied with the product, but rather shown before installing the software.

2. Click wrap contracts:-

Part IX of the Constitution craves a three-fold system of Panchayats namely (a) The village level; (b) The District Panchayats; (c) The intermediate Panchayats which stands between the village and district in the states where the population is above 20lakhs.

Composition:- All the seats in a panchayat shall be filled by a person chosen by direct election from territorial constituencies in the Panchayat area. The electorate has been named ‘gram sabha’ consisting of a person registered in the electoral rolls relating to a village comprised within the area of a Panchayat.

Duration of Panchayat:- Every Panchayat shall continue for five years from the date of its first meeting. But it can be dissolved earlier by the procedure prescribed by the State law. In case it is dissolved earlier, then the elections must be held within 6months of its dissolution.

Qualifications for Membership:- Article 243 F provides that all persons who are qualified to be chosen to the State Legislature shall be qualified to be chosen as a member of a Panchayat. The only difference is that a person who has attained the age of 21 years will be eligible to be a member.

Powers authority and responsibilities of Panchayats:- State Legislatures have the legislative powers to confer on the Panchayats such as powers and authority as may be necessary to enable them to function as institutions of self-government [Article 243G- 243H]. They are being authorized with the responsibility of (a) preparation of economic development and social justice plans and implementation of schemes for the same, (b) regarding matters listed in the 11th Schedule. The list contains 29 issues including land improvement, minor irrigation, animal husbandry, fisheries, education, women and child development, etc. The 11th Schedule distributes powers between the State Legislature and the Panchayat.

Powers to impose taxes and Financial resources:- Any State by law may authorize a Panchayat to impose, collect, and appropriate taxes, duties tolls, etc. The law may enact the procedure to be fulfilled as well as the limits of these exactions. It can also appoint to a panchayat various taxes and duties etc. collected by the State Government.

Panchayat Finance Commission:- The date on which the Constitution’s 73rd Amendment came into force and afterward every five years the State Government shall appoint a Finance Commission to review the financial position of the Panchayats and to make recommendations to —

(a) the distribution between the State and the Panchayat of the net proceeds of taxes, duties, tolls, and fees leviable by the State which may be divided between them and how the allocation would be made among various levels of Panchayats.

(b) what taxes, duties, tolls, and fees may be assigned to the Panchayats.

(c) grant-in-aid to the Panchayats.

The report of the Commission, together with a memorandum of action taken on it, shall be laid down before the State Legislature. These provisions are modeled on Article 280 which contains provisions regarding appointment of a Finance Commission for the distribution of finances between the Union and the States.

Bar to interference by Courts in Electoral matters:- As under Article 329, Courts shall have no jurisdiction to examine the validity of a law, relating to the delimitation of constituencies or the allotments of seats, made under Article 243K.

A horoscope (also known as a natal chart, astrological chart, astro-chart, celestial map, sky-map, star-chart, cosmogram, vitasphere, radical chart, radix, chart wheel, or simply chart) is an astrological chart or diagram that depicts the positions of the Sun, Moon, planets, astrological aspects, and sensitive angles at the time of an event, such as a birth.

Horoscope comes from the Greek words ra and scopos, which mean “time” and “observer” (horoskopos, pl. horoskopoi, or “hour marker(s)”). It is utilised as a means of divination for occurrences related to the time period it symbolises, and it is the foundation of astrology’s horoscopic traditions.

The horoscope depicts the skies as a stylised map over a certain area at a specific time. In most cases, the viewpoint is geocentric (heliocentric astrology being one exception).

The chart includes the positions of the actual planets (including the Sun and Moon), as well as entirely calculated features such the lunar nodes, house cusps (including the midheaven and ascendant), zodiac signs, fixed stars, and the lots.

Aspects are angular relationships between planets and other points that are commonly determined. 

The vernal point (the first day of spring in the northern hemisphere) is defined by the tropical zodiac as the first degree of Aries, although the sidereal zodiac permits it to process.

Many individuals are perplexed by the distinction between the sidereal and tropical zodiac signs.

t is worth pointing out that the sidereal signs and the tropical signs are both geometrical conventions of 30° each, whereas the zodiacal constellations are pictorial representations of mythological figures projected onto the celestial sphere based on patterns of visible star groupings, none of which occupy precisely 30° of the ecliptic.

So constellations and signs are not the same, although for historical reasons they might have the same names

An astrologer must first determine the exact time and location of the subject’s birth, or the start of an event, in order to generate a horoscope.

At the same time, the local standard time (adjusted for daylight saving time or wartime) is transformed into Greenwich Mean Time or Universal Time. To be able to calculate, the astrologer must translate this to the local sidereal time at birth.

The astrologer will then examine an ephemeris, a set of tables that displays the positions of the Sun, Moon, and planets for a given year, date, and sidereal time in relation to the northern hemisphere vernal equinox or fixed stars for a given year, date, and sidereal time (depending on which astrological system is being used).

The horoscope is divided into 12 sectors that circle the ecliptic, beginning with the ascendant or rising sign on the eastern horizon.

The houses are the 12 sectors, and there are several techniques for computing these divisions. Since the 19th century, tables of dwellings have been issued to make this otherwise difficult work easier.

Horoscopes and the zodiac sign have always been popular, and they continue to be so today. From celebrities to the ordinary population, there are a large number of devoted fans.

It can be tough to accept that astrology is not based on scientific facts and is a pseudoscience when there are so many believers and perhaps a personal connection to the horoscope or the zodiac.
