>Coronavirus update: Record 18,500 new cases in India in 24 hours, 2.9 lakh cured so far

Coronavirus cases in the country have breached the 5 lakh-mark after India registered 18,552 new cases in the last 24 hours. The new cases have crossed the previous record of 17,296 that was registered on Friday. The total number of people in India who tested positive for coronavirus has reached 5,08,953.

The current total includes 1,97,387 active cases. 2,95,881 Covid-19 cases have been cured or discharged from the hospital. The total recovery now stands at 58.13%. The death tally has also increased to 15,685.

Maharashtra continues to be the worst affected state in the country with 1,52,765 cases. Out of the total cases in the state, 79,815 have recovered from the coronavirus disease and 65,844 are still active. The state has reported a total of 7,106 deaths so far.

The national capital is second in terms of total cases. Delhi’s Covid-19 tally now stands at 77,240. The capital has registered 2,492 deaths, so far and 47,091 have recovered out of it. The tally of active cases stands at 27,657.

Delhi Chief Minister conducted a press conference on Friday claiming that the current situation in the capital is under control. He also claimed that the testing rate has been increased by three times.

Tamil Nadu has reported 74,622 total cases of coronavirus and the death tally in the state has grown to 957. Out of the total cases in the state, 32,308 are active and 41,357 have recovered.

Globally, the Covid-19 cases have increased to over 9.4 million and the death toll has reached over 4,80,000, as per the World Health Organisation on Friday. The total increase in cases was over 1,77,000 in 24 hours and the deaths over the same period were reported at 5,116. The United States continues to be the worst affected country with over 4.7 million cases. Brazil is the second-worst affected country with over 1.1 million positive cases. India is fourth in the list.

Electrified Fabric Could Zap the Coronavirus on Masks and Clothing

Wearing masks and other personal protective equipment (PPE) can slow the spread of COVID-19. The U.S. Centers for Disease Control and Prevention recommends everyone wear some kind of face covering in public places, especially where social distancing is difficult to maintain. And health workers are donning additional coverings, such as gowns. Yet all such protective gear shares one significant problem: people still risk becoming infected with the novel coronavirus if they accidentally touch areas of the fabric that are contaminated with viral particles. So researchers are working to develop cloth that could inactivate or repel coronaviruses—ideally including the one that causes COVID-19—and other pathogens.

People transfer infectious particles to their hands if they touch the front of a mask during use or when they remove gowns or other PPE, according to Chandan Sen, director of the Indiana Center for Regenerative Medicine and Engineering at Indiana University. He and his colleagues have been developing a way to render those particles and other infectious agents harmless. The team researches “electroceutical” materials that wirelessly “generate electric fields across the surface of the fabric,” Sen says. Those fields can disrupt the behavior of bacteria or viruses on the cloth.

“The beauty of this [technology] is the inherently simple design,” he says. The polyester material is printed with alternating spots of silver and zinc resembling polka dots. They are one to two millimeters wide and spaced one millimeter apart. When the electroceutical material is dry, it functions as an ordinary fabric. But if it gets dampened—say, with saliva, vapor from a coughed up droplet or other bodily fluids—ions in the liquid trigger an electrochemical reaction. The silver and zinc then generate a weak electric field that zaps pathogens on the surface.

The researchers co-developed the material with the biotechnology company Vomaris Innovations in 2012. Last year they showed that the technology could be used to treat bacterial biofilms in wounds. A clinical trial is underway to further evaluate the fabric’s effectiveness as a Food and Drug Administration–cleared dressing for wound care, Sen says.

In response to the COVID-19 pandemic, Sen’s team tested its existing material on a different coronavirus strain that causes a respiratory illness in pigs and on an unrelated type of pathogen called a lentivirus. “We wanted to know how broadly this principle could be applicable,” he says. In a study posted on the preprint server ChemRxiv in May, Sen’s team reported that its electroceutical fabric destabilized both viruses, leaving them unable to infect cells. The researchers plan to submit the results to a peer-reviewed journal as well.

To study the fabric’s action, they placed a liquid solution containing viral particles onto the electroceutical fabric and a polyester control fabric without the metal dots. After the droplets were fully absorbed, and the samples had rested for one to five minutes, the researchers recovered viral particles from both fabrics and tested whether they could still infect the types of cells they typically target.

“The data presented here show that, of the total virus that was recovered, a significant percentage was inactivated,” says Jeff Karp, a professor of medicine at Brigham and Women’s Hospital in Boston and co-leader of an N95 respirator working group at the Massachusetts General Brigham Center for COVID Innovation. Karp, who was not involved with the study, adds that the researchers did not test all of the virus that they had placed on the cloth. “In fact, the majority of virus was not recovered from the textiles examined in this study,” he says. Sen responds that his team focused on sampling only enough viral particles to show that the fabric had rendered them unable to infect cells. The researchers recovered roughly 44 percent of the particles from the electroceutical fabric samples that had rested for one minute. And they retrieved 24 percent of them from the samples that had rested for five minutes.

The material’s virus-fighting abilities have not been tested specifically on SARS-CoV-2, the coronavirus that causes COVID-19. The researchers’ findings with the two viruses they studied, however, gave them “hope that this could apply more widely,” Sen says. He adds that large-scale manufacturing of the electroceutical fabric is already possible and that the costs of producing it are relatively low. The metal dots could be printed directly onto the front surfaces of masks, he suggests. Or an electroceutical fabric could be inserted between the front of a mask and the wearer’s face.

If a virus-stopping PPE material were widely available, it could limit the novel coronavirus’s ability to spread. “There is a huge unmet need to better understand modes of viral transfer that lead to virus transmission,” Karp says. “As we develop a better understanding of this, there is a huge immediate need to develop and quickly apply solutions that can reduce transmission.”

Metal dots are not the only potential approach. Paul Leu, director of an advanced materials laboratory at the University of Pittsburgh, and his colleagues are developing a textile coating that repels bodily fluids, proteins and bacteria. It also repels one strain of adenovirus that causes respiratory illness and another that causes conjunctivitis, as reported in ACS Applied Materials & Interfaces in April. Leu’s team has also not tested the material with the novel coronavirus itself, however. “The main thing with testing [the coating on] SARS-CoV-2 is the biosafety level you need to test it, because it’s very hazardous,” he says. Still, his team plans to see how well textiles with this coating repel a different coronavirus.

Leu says the coating, which remains repellent even after ultrasonic washing and scraping with a razor blade, could make PPE safer for wearers to take off. It could also be used on hospital bed linens, drapes and waiting room chairs, the researchers note in the study. But Leu points out that the coating is intended for use with medical textiles that are already considered reusable. His team has not tested it on single-use masks or N95s, but he thinks it could potentially damage them. Still, he says, the coating could work well for cloth masks such as those now being worn by many among the general public.

By developing materials that kill or repel viruses, researchers hope to make masks and other protective gear safer to remove and more effective against all viruses. “If the common person were to have PPE that wouldn’t spread infection,” Sen says, “I think that’s a big, big deal.”

“Stop Worrying and Start Living” – Dale Carnegie – Book review

Dale Carnegie’s how to stop worrying and start living so the first big idea is ask yourself what’s the worst thing that can happen I remember the first year in college constantly worrying about my grades what was I getting to do if I got a B+ rather than an a well surely my life would be over and that i would never amount to anything in life like that was seriously the thought process browsing my 17 year old head now fast-forward five years.

How to Stop Worrying & Start Living
Carnegie tells a story of this guy in World War 2 who’s stuck in a submarine and basically knows that he’ll be dying in the next few hours and he sits there thinking about all the stuff he used to worry about at home and how absurd it was and makes a promise to never waste his life again like that if he survives now that might be hard to resonate with so let me give you a more contemporary example people are having their heads chopped off every single day every single day the only reason it’s not you is because you are born in a certain place. They weren’t that’s it now going back to my friend I told him look here’s what I want you to do every day you will start your morning by watching somebody’s head being chopped off and then you’ll go about the rest of the day.
He started freaking out about how he can’t do that and how he doesn’t like blood and whatever now here’s the thing. I know that’s really crass and morbid but I don’t care if you don’t worry about stuff great you don’t have to watch anything but if you’re worried about stupid all the time you have a disease so you either treat yourself or you never ask about how you can stop worrying again ever. Here’s what I will guarantee you if you start your day by watching someone else have their head chopped off nothing and I mean absolutely nothing could possibly happen to you for the rest of the day that you could get pissed off about and not feel like a complete retard yes when you’ve seen someone’s head chopped off you will have a weird feeling inside you as soon as you start to complain about how you deserve to be paid more at your job or what you’re going to do now since you bought a B+ rather than an A or how your washer is broken you’ll realize that.

If the guy had been given the chance to live and wear that same dirty shirt for the rest of his life without ever being able to wash it he would have been the happiest man alive realize the absurdity of it all the third big idea staying busy now I don’t mean the average busy person actually those are the people that worry the foremost the guy who works 12-hour days then comes home and watches Fox all night worrying about whether some guy can marry another guy or about all the foreigners who will come and take his job you know because he’s the only one entitled to that job I’m not talking about that kind of busy here’s how I like to stay busy read a book that I like go to the gym with my girlfriend play around on the piano and compose cook amazing food work on a project. I’m passionate about now here’s what happens when you do that your brain can’t think of two things at one time it just doesn’t have that capability you can try right now if you want you can’t think of your broken washing machine and at the same time think of how much you love playing soccer it’s not how your brain works so the best way to get rid of the negative thoughts in your head is to actually start putting positive thoughts in there get busy with what you love and your brain simply won’t even have the power to stress . Finally, a question that really resonated with me here’s what you’re going to do in your life you’re going to work and worry your entire life so you can gather a bunch of stuff like your house and all the stupid.

If you’re lucky after 50 years of all that worry and stress all of your stuff could be worth 1,000,000 dollars here’s the question would you sell your legs for a million dollars let me ask you this would you sell your legs for a billion dollars I wouldn’t and you probably wouldn’t either would you sell your arms for another billion dollars no there you go you have already got something that you simply value at two billion dollars actually hopefully more but you do not need to be all Zen you could be a greedy capitalist like me and understand this now here’s what you’re going to do you’re going to ignore and not utilize something worth two billion dollars because you’re too busy worrying and stressing about the things that might amount to 1 million dollars at the end of your life oh and you’ll be considered really lucky if that happens by the way all right.

So, I don’t know if you’re seeing how crazy that is but that’s kind of like having a huge mansion a personal jet every single car you ever wished for and not using and enjoying those things because you’re too worried about at some point having the ability to shop for a Corolla that’s crazy and sad you have already got everything that you value at billions and billions of dollars so stop ignoring wasting and treating it like for hours and days so you can worry and bitch about how your phone bill went up from a hundred dollars to a hundred and twenty.

The real ground reality of the corona treatment

Corona virus, every day its like we are tuned to the same channel spewing the same things like a factory mill on overwork. But be as it may every day, we learn more about this disease that was thrust suddenly to the world, after initially originating from china. There are many a theory afloat that China deliberately kept the onset of this disease a secret to gain from it, and knowing the level the Chinese usually stoop to it would not be farfetched to believe so. Nearly every country is trying to cope up to this disease with drastic level of differences. On one side we have countries like new Zealand who have virtually negligible cases and still effectively trying to combat the situation and on the other end we have countries like USA where the cases have arisen to such a point that their President has announced that he will be slowing down testing to make it seem like the number of cases have dwindled. So where on this spectrum does India lie?

Photo by Anna Shvets on Pexels.com

India is home to a vast population that counts in billions, to safely combat a virus which spreads so easily is a herculean task in itself. However, the front-line workers are continuously working to be the first line of defence, but is it enough. Very often we see on the news and media how heroically our government is fighting the virus, often depicting them as gallant saviours shielding us from the evil virus. The hospitals giving their best in order to help the patients that they get, treating them and sending them back to society so that they may function like before. However,  the ground reality is anything but so, with the influx of corona positive cases of nearly 15000 each day, adding the fact that hospitals are seeing the worst mismanagement that could be done during a pandemic, it is no surprise that to many people going to the hospital seems like a walk towards the gallows. The hospitals launched apps in order to increase their efficiency and help them control the crowd gathering in hospitals, however with the traditional Indian scene of mismanagement this has just poured fuel to the increasing fires. The apps show the hospitals having free beds when there are none, mistreating patients and whatnot. Many a hospital within Delhi, India’s capital city have started to look more like morgue, without enough beds to put the dead bodies in, entire floors have been converted into makeshift morgues with bodies simply piled up unhygienically. This is just the tip of the iceberg that is the inefficiency of the hospital scene in battling corona virus. With the amount that an average corona patient is charged, coupled with the gross mismanagement it can make life a living hell for anyone going to the hospital regarding this issue. During this pandemic bed charges have inflated very much, a general ward bed in super specialty hospitals costs around 11000 a day, due to the covid-19 expenses. The overall amount depends on the time period one I admitted. Adding the mismanagement of the hospital staff into the mix it can go for unnecessarily long periods. Counting in the per day costs of a ventilator in the ICU ward for serious cases it can add an additional 50,000 per day as well. Thus, even if one miraculously survives the ordeal of corona, monetarily they are thrust back way harder than before.

What actions we further take is for everyone to see.

How to attract people in first 90 seconds- Must read!!!

These are the secrets from an amazing book called “How to Make people like you in 90 seconds or less” by Nicholas Booth Man. Likable people are always open, welcoming and friendly in nature and you can notice their sincerity, trust, and self-confidence in their behavior as well, and you can develop all these qualities in yourself by meeting other people in a regular manner. If other people do not find you interesting in first 90 seconds after meeting you, then they would want to get rid of you as soon as possible.

How to Maintain Communication and Culture as a Growing Startup ...

If you want that people like you more, then you have to invest your efforts from the very beginning, and this starts even before you speak a single word from your mouth. Any new person notices three basic things just after meeting you, these three things are your

  1. Body language
  2. Your eyes
  3. Expression on your face

Thus, it is essential that when you meet anyone, these three elements give the feeling of openness to other people. For doing this, you will have to show your interest in them, along with your body, you will have to move your brain as well toward them. This effort will show your sincerity and commitment and openness in the conversation and in them as well after this, you need to see directly in the eyes of other people, this establishes the trust and as soon as you make an eye contact with other person make sure you give a genuine smile to them before they think or assume anything else about you. Let your positive attitude shine with a broad and genuine smile with this simple action, other people will consider you as a genuine, open and sincere person with this simple effort, you already made a warm and welcoming mood for the situation, and now you need to initiate by introducing yourself. You can do that with a standard greeting, like Hi or hello and you must need to do that in a very pleasant tone. Along with that make sure you share your first name to the other person and it will encourage the other person to introduce themselves for example, you can say,….”Hello, I am Akash”. When you say this, then the other person will also share his or her name with you, and as soon as they share their name, you must need to repeat their name like wise you said… “Hello, I am Sahil” you got response… “Hi, I am Sohil” now you have to say, “Sohil, Nice to meet your Sohil.” In his famous book, “How to win friends and influence people,” Dale Carnage shared the fact that the name of any individual is the sweetest sound in the entire world for that person that is why it is essential that you repeat other person’s name in the conversation as much as possible. This method will increase your acceptance and respect, it will also make it easier for your to memorize their name. And finally, you have to lean forward slightly. Just a little leaning would be enough, just like Mr. Obama is slightly leaning forward in this photo.

How To Give A Proper Handshake - Business Insider

With your slight inclination, other people will assume you are showing interested in them, and you are listening to them carefully, also, it will give you a pleasant appearance. Just look at photo and tell who is looking more generous in both of them. Of course, it is Mr. Obama, because he is using this principle.

Studies proved that people hire those people that are similar to them and even most of the time they date people with similar people because they make them feel safe and comfortable. If you try to pay attention, you will find, you enjoy the company of those people who think like you, who behave like you and those who make you feel comfortable. You can be comfortable for them just by synching your voice with their voice. The synching of voice is a very powerful tool in communication skills for this, you need to speak at the same pace as other people are speaking that means if they talk slow, then you should not run fast and second thing, you shall try to use the same tone similar to them. If they are calm and relaxed, and you will speak loudly or with excitement, then it won’t work well for you. You need to use same volume and you need to relax while talking. With this, other people will think you are like them and they will feel more comfortable while talking to you.

In 1979, Dr. Lisa Berkman did a study on 7000 people, and this study lasted for 9 years with this study, she found that people that do not have more social connections or those who do not meet other people, they get ill more often, and it increased their chances of earlier death as well and who meet other people more often, were likely to live longer. So, go and expand your social circle without having any fear, without any complications.

23 June – World Olympics Day – History…

On the 23rd of June 1894 the International Olympic Committee was founded at the Sorbonne in Paris. Prior to the IOC establishment by Pierre de Coubertin the British physician Dr. William penny Brookes had set up the Wenlock Olympian games in the English market town of Much Wenlock although he always maintained that he had the idea of reviving the ancient Olympic Games for amateur athletes himself, Coubertin entered correspondence with Brooks and benefited from his connections with the Greek government Coubertin was the Secretary General of the Union of French sports associations.

A Brief Look At The Olympics History

Coubertin first proposed establishing a modern Olympic Games at his meeting on the 25th of November 1892 although his enthusiasm was met with little more than general polite applause Coubertin wasn’t deterred and commenced to get the groundwork for what was to become the primary Olympic Congress at the Sorbonne in Paris in 1894. Initially invited participants to a gathering entitled reflections on and propagation of the principles of amateurism Coubertin later changed the name to a congress on the revival of the Olympic Games seventy-nine delegates from nine countries subsequently met at the Sorbonne though Coubertin himself recognized that there was still little enthusiasm for reviving the games. Despite this a vote was held at the last word meeting of the Congress on the 23rd of June that established the International Olympic Committee Coubertin was elected to the role of general secretary with the Greek businessman and writer Demetrius Vikelas because the first president it had been further agreed that the primary modern Olympic Games would happen in Athens in 1896. The second in Paris four years later the IOC has remained liable for the Olympic Games ever since.

Solar Eclipse- Everything you need to know!!!

Solar Eclipse a sight is rarely seen on earth. On this day the sun will look like a shining ring. This will be neither partial eclipse nor complete. The shadow of the Moon will cover  almost 99% of the Sun rays. Which will cause the side of the sun remain illuminated and the middle part of the sun will be completely covered by the shadow of the moon.

Solar eclipse will be addressed on 21st June 2020 from 10:20 AM  to  1:49 PM which will be visible in India and according to astrology this day will be impressive as many planets and constellations will be matching which did not match from past 500 years! Sutak period will start from 10:17 AM on 21 June it self. This solar eclipse will be in Mrigashira, Ardra, Nakshatra and Gemini. During this eclipse, 6 planets i.e. Jupiter, Saturn, Mars, Venus, Rahu and Ketu will be in retrograde state; Rahu and Ketu are always retrograde. Such position of planets will make solar eclipse impressive. According to astrology, eclipses can become a factor of natural disasters, which may cause disaster like earthquake, typhoon or storm.

Precautions should be taken during the solar eclipse every time like; Solar eclipse should not be viewed with naked eyes. During this time the rays emanating from the sun are vary harmful and hence can damage the eyes. Therefore, to see this, special types of equipment should be used like Welding glasses, X-ray sheet keep a not that your face and body should be covered fully as the rays may damage the skin. According to religious beliefs, do not do any auspicious work at the time of eclipse. At the time of the eclipse, neither should you eat or drink anything. It is believed that before eclipse, basil leaves should be put in food and drink to make it safer. In the eclipse period, remembering the Lord, do puja, chanting, charity etc. religious work which will be good for family and ourself too. As soon as the eclipse of the eclipse begins, cover the place of worship in the house during the eclipse. After the eclipse, take a bath and clean the place of worship and sprinkle Ganga water. Pregnant women should be very careful and stay away from the sun full day as it may affect the infant.

Dexamethasone- Corona Vaccine Update!!!

Finally some good news today dexamethasone is now being called a major breakthrough based on a recent randomized controlled trial in the UK. Dexamethasone also known as Decadron is an example of a glucocorticoid are sometimes referred to as corticosteroids other examples of glucocorticoids include hydrocortisone methyl prednisolone prednisolone, prednisone beta methazone and triamcinolone so glucocorticoids are a class of steroid hormones that bind to the glucocorticoid receptor in the body cortisol aka hydrocortisone is the glucocorticoid.

We naturally make in our body it’s essential for life it regulates or supports various cardiovascular metabolic and homeostatic functions it also plays a big role in our immune system especially when it comes to reducing certain aspects of inflammation this is why we use them all the time in medicine we sometimes give these steroids for asthma copd rheumatologic type diseases and countless more diseases. Sometimes it is also given for steroids for meningitis and also for some forms of cancer we also give them in the early course of severe ards acute respiratory distress syndrome whether that ards is due to infection such as pneumonia or vaping lung injury or whatever the cause for severe ards we typically give methylprednisolone or solumedral at a dose of one milligram per kilogram per day. So, for most people that ends up being around 80 milligrams per day so this is the equivalent of 15 milligrams of dexamethasone the idea here is to suppress the cytokine storm that has taken place meaning that the massive amount of inflammation that causes lung damage and can indirectly cause damage to other organs as well our body naturally makes cortisol in our adrenal glands specifically in the zona fasciculata of the adrenal cortex the adrenal gland then secretes cortisol into the bloodstream and the cortisol travels to different tissues of the body and then binds to the glucocorticoid receptor inside cells it then stimulates the cell to make more anti-inflammatory proteins and causes the cell to make less pro-inflammatory proteins but giving someone glucocorticoids meaning steroids to someone who has an infection is somewhat of a tricky thing because the fear is that if you suppress the body’s immune system it has the potential to make the infection worse. Sometimes the body’s immune system does more damage than the actual infection for example in cases of meningitis that is due to either streptococcus or tuberculosis we give steroids because the medical evidence shows that they have better outcomes when we do so and giving someone steroids for viral pneumonias like influenza is more controversial because doing so generally leads to worse infection with that said if the viral pneumonia is so bad to the point of causing severe ards most doctors will give steroids in that situation. So this is why, the general medical guidelines so far recommend against giving steroids for covert pneumonia unless the patient has severe ards and we’ve been waiting for randomized controlled trials to come out for steroids in covid and here we are now with this study so in march of 2020 the recovery trial which stands for randomized evaluation of covid-19 therapy was one of the randomized control trials that actually looked at several different potential treatments for covid which included low-dose dexamethasone this trial was done in the UK.

skynews-dexamethasone-covid-19_5014958

Over 11 500 patients in it so this trial has not been peer reviewed as of has not been published in the journal yet so everything I know so far is based on what’s been released to the general public in this trial over 2100 patients were randomized to receive dexamethasone specifically six milligrams once per day for 10 days and this group was compared with over 4 300 patients that were randomized to the standard care alone so 6 milligrams of dexamethasone is the equivalent of 32 milligrams of methylprednisolone so this is about half the dose we would typically use for someone with severe ards so among the patients who received standard care alone 20-day mortality was highest in those who required mechanical ventilation this was 41 and then intermediate in those patients who required supplemental oxygen only this was mortality rate of 25 percent and the mortality rate was lowest among those who did not require supplemental oxygen in which that mortality rate was 13 for patients who were on mechanical ventilators dexamethasone reduced mortality from 41 percent to 28 percent for patients who needed supplemental oxygen it reduced mortality from 25 percent to 20 percent and there was no benefit among those patients who do not require supplement oxygen in other words if someone only had mild disease there was no point in giving dexamethasone so based on these results one death would be prevented by the treatment of around eight ventilated patients. So that’s the number needed to treat for ventilated patients and then the number needed to treat for the ones who required supplemental oxygen that number needed to treat would be 25 so these preliminary results are significant but it doesn’t mean that dexamethasone is a miracle drug it’s certainly not a cure but it does seem to help based on these numbers index and methazone could be of huge benefit and not just rich countries but poorer countries as well because this drug is very cheap and is widely available so this is great news and very exciting but there are still a lot of questions that need to be answered like what is the ideal dose should we use higher doses in patients who are mechanically ventilated with ards and when will it be approved for use in the united states and we’ll get these answers pretty soon now another.

Interesting question is should we give decadron dexamethasone to people who have mild disease now even though this study didn’t show any benefit the reason why i bring this up is because some people start out with mild disease and then go on to have moderate or severe disease and we have no way of predicting who goes on to do that and also it happens very quickly lots of times someone could be doing just fine and then all of a sudden within hours they all of a sudden are deteriorating and they have severe disease so should we give those patients decadron regardless is there any harm doing so that’s another question that remains to be seen.

PIL Challenging Relaxations Prescribed Under MHA’s ‘Unlock 1.0’ With Cost

In a latest and fresh development, the Delhi High Court has just recently on June 12, 2020 in a latest, landmark and extremely laudable judgment titled Arjun Aggarwal Vs Union Of India And Anr in W.P. (C) 3449/2020 & C.M. No. 12224/2020 (stay) dismissed a PIL filed by a petitioner who is a law student. The PIL had challenged the June 30 order of the Ministry of Home Affairs wherein considerable relaxations from lockdown were operationalised under ‘Unlock 1.0’. The Delhi High Court has taken a very stern view of this PIL and termed it as “completely misconceived” and “has been filed only to gain publicity”.

To begin with, this noteworthy judgment authored by Justice Subramonium Prasad for himself and Justice Hima Kohli sets the ball rolling by first and foremost pointing in para 1 that, “The instant Public Interest Litigation (PIL) challenges the order dated 30.05.2020 bearing No. 40-3/2020-DM-1, issued by the Government of India, Ministry of Home Affairs. By the impugned order, in exercise of powers under Section 6 (2) (i) of the Disaster Management Act, 2005, the Government of India has extended the lockdown which had initially been issued by an order bearing the same number, dated 25.03.2020 for containment of COVID-19 in the country up to 30.06.2020, in containment zones and to reopen activities in a phased manner outside containment zones.”

To put things in perspective, it is then laid bare in para 8 that, “The writ petitioner has averred that he is a 5th year student of BA LLB (Hons.) course, studying in Guru Gobind Singh Indraprastha University and has the means to pay, if any cost is imposed by the Hon’ble Court. The instant writ petition challenges the guidelines on the ground that phased reopening will result in rampant spread of COVID-19 in the country. It is contended in the writ petition that the impugned Notification will deprive the citizens of their basic fundamental rights such as life and it ignores the health of its citizens by exposing them to the threat from COVID-19. It is stated in the writ petition that the reopening has been done only keeping in mind economic considerations while endangering its citizens to the extent of succumbing to a contagious disease in the absence of any proven medical cure for it. It is stated that there was no need or justification for reopening the prohibited activities.”

As it turned out, the Delhi High Court Bench after hearing Mr Apratim Animesh Thakur who is the learned counsel for the petitioner as pointed out in para 10, it then goes on to state in para 12 that, “A series of orders have been passed starting from the month of March, 2020 to tackle the situation and decisions have been taken by the Government to ensure minimum hardship to the people. Several economic packages have been announced to regenerate the economy. This Court can also take judicial notice of the fact that world over, the trend is now to reduce the restrictions which were imposed due to lockdown and to return to normal life. In order to ensure a proper balance between containing the spread of COVID-19 pandemic and at the same time make certain that people are not forced to starvation the Government has issued the impugned order. The re-opening has been directed in a phased manner and is not a decision that appears to have been taken in haste. The Government is expected to remain cognizant of the situation and evaluate it closely. If it is found that the rate of infection is going up, they can always review their decision and impose curbs, depending upon the situation.”

More crucially, while drawing a red line for itself, the Delhi High Court Bench then minces no words to make it clear in para 13 that, “The scope of judicial review of Government policies is well known. Courts do not and cannot act as an appellate authority examining the correctness, suitability and appropriateness of the policy; nor are court advisors to the executive in matters of policy which the executive is entitled to formulate. Courts cannot interfere with the policy either on the ground that it is erroneous or on the ground that a better or a wiser alternative is available. Illegality of the policy and not the wisdom and soundness of the policy is the subject matter of judicial review. (see: Union of India v. J.D. Suryavanshi, (2011) 13 SCC 167 and Directorate of Film Festivals & Anr. vs. Gaurav Ashwin Jain & Ors. (2007) 4 SCC 737.)”.

Most crucially, it is then made pretty clear by the Delhi High Court Bench in para 15 that, “The instant writ petition has been filed by the petitioner who is a law student without looking at the abovementioned position in law. Nothing has been shown as to how the impugned order is so arbitrary or is based on such irrelevant consideration that it deserves to be struck down as being violative of Article 14 of the Constitution of India. The writ petition is completely misconceived and has been filed only to gain publicity. It cannot be said that this instant petition has been filed bonafide. In State of Uttaranchal vs. Balwant Singh Chaufal and Ors., (2010) 3 SCC 402, Supreme Court has given guidelines in order to streamline the growing abuse of public interest litigation which read as under:

“180. In our considered view, now it has become imperative to streamline the P.I.L.

181. We have carefully considered the facts of the present case. We have also examined the law declared by this court and other courts in a number of judgments. In order to preserve the purity and sanctity of the PIL, it has become imperative to issue the following directions:-

(1) The courts must encourage genuine and bona fide PIL and effectively discourage and curb the PIL filed for extraneous considerations.

(2) Instead of every individual judge devising his own procedure for dealing with the public interest litigation, it would be appropriate for each High Court to properly formulate rules for encouraging the genuine PIL and discouraging the PIL filed with oblique motives. Consequently, we request that the High Courts who have not yet framed the rules, should frame the rules within three months. The Registrar General of each High Court is directed to ensure that a copy of the Rules prepared by the High Court is sent to the Secretary General of this court immediately thereafter.

(3) The courts should prima facie verify the credentials of the petitioner before entertaining a P.I.L.

(4) The court should be prima facie satisfied regarding the correctness of the contents of the petition before entertaining a PIL.

(5) The court should be fully satisfied that substantial public interest is involved before entertaining the petition.

(6) The court should ensure that the petition which involves larger public interest, gravity and urgency must be given priority over other petitions.

(7) The courts before entertaining the PIL should ensure that the PIL is aimed at redressal of genuine public harm or public injury. The court should also ensure that there is no personal gain, private motive or oblique motive behind filing the public interest litigation.

(8) The court should also ensure that the petitions filed by busybodies for extraneous and ulterior motives must be discouraged by imposing exemplary costs or by adopting similar novel methods to curb frivolous petitions and the petitions filed for extraneous considerations.”

The instant writ petition does not satisfy the dictum of the Guidelines laid by the Supreme Court and this Court.”

Equally significant if not more is what is then stated in para 17 while deprecating the petitioner’s careless conduct that, “During the counsel hearing, we had informed learned counsel for the petitioner that we are not inclined to entertain the petition as we find that it is an abuse of the process of the law. We had also warned the counsel that if he presses the petition, we would be constrained to dismiss it with costs. We cautioned learned counsel only because the petitioner is a law student. Despite that, counsel for the petitioner upon taking instructions from the petitioner, continued to addressing arguments, wasting valuable judicial time. We deprecate this conduct of the petitioner. He has not cared to read the judgments relating to public interest litigations and the limits on the Court while exercising its power of judicial review on policy matters.”

Finally, it is then held in the last para 18 that, “The writ petition is accordingly dismissed along with pending application with costs of Rs. 20,000/- imposed on the petitioner who is directed to deposit the same in the Delhi High Court Bar Association Lawyers’ Security and Welfare Fund within a period of two weeks from today, with proof of deposit to be filed with the Registry of this Court.”

To sum up, this latest, landmark and extremely laudable judgment by a two Judge Bench of the Delhi High Court is a very loud and strong wake up call to all the litigants that they should not waste the precious time of the court without any firm reason! If they dare to do still then they would have to be ready to pay the costs as we see in this leading case also! Centre took this daring decision after lots of deliberations, discussions and debate with the concerned experts which we all must admire, appreciate and applaud and not instead resort to gimmicks like filing PIL against it as we see in this case!

How to open a Franchise without money- US…

let’s talk about to open a franchise with no money so the first thing you can do, if you want to open a franchise with no money down is go to your friends and family look. I understand that that’s something that you may not want to do sometimes that’s a toughest conversation asking friends and family for money but I would assume if you’re willing to open a franchise and you have some skill sets you have a certain level of intelligence and a certain level of ambition so assuming that you have a good reputation and a good rapport with your friends and family then that’s the first place that you can go to get money to fund your franchise.

Now when you’re approaching them for the money it’s important to be tactical and strategic about it and you don’t just say hey! can I borrow ten thousand dollars can I borrow twenty thousand dollars can I have fifty thousand dollars you have to go into it strategically so go into it with a business plan this is the franchise that I want to buy this is the amount of money that I need to get started this is a lot the amount of money that I think I will make with the franchise this is the time period which I can pay the money back to you and get on that loan repayment plan, another way to approach getting money from feds and friends and family to fund your franchise is to ask them to be a partner with you so although they may not want to work in the franchise themselves maybe they’re more willing to give you money or lend you money for the franchise if they are an owner or an investor with you so maybe you’re the one that runs the franchise and you handle the day-to-day operations the sales managing the staff managing the overall business and they get a percentage of the profits as a way of paying them back.

The next way that you can fund a franchise is to get a loan and before you read about that real quick with the franchise so now in getting a loan to open a franchise business it’s important to note that one you’re going to need to have good credit and two you’re going to need to have an income that can support paying back. The loan and three the likelihood is you are still going to need money for the down payment on that loan if you get us an SBA loan which is Small Business Administration they require a minimum of 10% down from you in order to fund that business so what does that mean if you need $100,000 for your franchise business then that means you need to come up with $10,000 in order to here that loan so the question is how will you come up with that $10,000 and there’s a number of options that we’ll go over in a second of how you can do that one way you can do that is what we already talked about which is getting money from friends or family it’s so even with the Small Business Administration having a ten percent minimum requirement that you have to put towards the loan in order to open a business.

Most lenders that issue SBA loans are going to require anywhere from 20% to 30% in order for you to secure that loan so again in that example if you’re looking to open up a business that’s a total of $100,000 you’re going to have to figure out a way to come up with twenty to thirty thousand dollars in order to secure that loan and so in a second I’m going to tell you about a strategy of exactly how you can do that without having to ask your friends or family for money another way that you can fund a franchise without having any money so to say is seeing if you have any 401k or retirement plans now as someone who has managed over a hundred million dollars over the course of career as a financial advisor typically. I would not recommend for someone to take money out of their 401k and that’s not what I’m recommending to you. So, I want to make sure that you get that clear because there are severe penalties and tax consequences that you should consult the tax advisor about but there are ways that you can leverage your 401k so if you’re still working with your employer you can take out a loan against your 401k in order to fund a business and when you take out a loan there’s one thing that you have to be very careful about the thing that you have to be careful about is that if you leave that employer and you have an outstanding loan they are going to make you repay that loan within a certain period of time usually it’s 60 days if that is the case if you don’t come up with the money and repay the loan for the 401k they count it as an early distribution you’re going to have to pay taxes on that money depending upon if it’s a pre-tax 401k and you may have to pay some penalties. 2 guys opened up first location they were going to need 300 just over $300,000 in order to get first location open so they had a significant equity in their home at that time and want to went ahead and apply for a home equity loan they secured a three hundred and ten thousand dollar home equity loan use that home equity loan to fund the business and to pay for the business about a year or so later they actually wind up moving they sold their house the home equity loan was paid for paid off and now they own the franchise in the business completely outright don’t have any loans on the business and then the last way that you can potentially buy or open a franchise with absolutely no money is to talk to the franchiser again it’s not about the resources it’s about your resourcefulness so it never hurts to ask them and to make a pitch if you’re truly excited and confident about the opportunity.

Businesses that are majorly affected!!!

In the pandemic situation where the world seeks a miracle of vaccines, there are many business that came to halt or even they are going to be shut soon. Currently the major task of ours is to stop the spreading of corona virus. It is wisely said “If there is Health there is Wealth”. First we need to cope up with the pandemic situation and then business can be again built, if we stay alive.

CNBC Global CFO survey says that 40% of the business are facing the problem in transportation of the goods and it is expected that it would take more 5-6 months to start and run normally (25% of them said 6 months and other would take a long than that).

“Nobody knows. The economic issues are totally driven by public health issues. You tell me how long we will be at home and I will tell you how long it will take for the economy and supply chains to recover.”

-words of Yossi Sheffi, Professor at Massachusetts Institute of Technology and the director of the MIT Center for Transportation and Logistics. Yossi Sheffi further says, if we want to build our business again as soon as possible than there is only one way out to do this and that is to join the war again corona virus and defeat it as early as possible, this epic war is started by many of the companies with their different types of help they can provide, like wise:

  • Auto manufacturers like Tesla and GM motors are providing ventilators to the hospital.

The supply chain is completely disturb there is over manufacturing as there is no one to load and unload the trucks. Border shipping is still allowed but shipping through overseas it still a major concern. There will be also huge disturb in supply chain of for pre-planned Indian weddings, as now weddings are postponed or might be done in simple way, the business related to it like party plots, wedding photographers, ca tress, decorators, wedding materials, transportation, apparels and even small-small business related to it. A single event covers many business so all the business are affected largely.

The business of theater and restaurant are also at halt, which may cause a major set back as there are many of the workers working in restaurant it self. In film industry too many of the workers are engaged.

How’z That?: Playing Popular Games in Empty Stadiums

Cricket and football are two of the most passionate and fascinating sports in the world. We all love those beautiful games and the players connected with them. The ardent supporters would try their best to shirk work to attend matches and the crazier ones would not hesitate to sacrifice their sleep to express support to their teams. The emergence of COVID-19 had changed the whole scenario. There were no matches worth mentioning in any place in the world for more than three months. After a long pause things are limping back to some degree of normalcy.

Football is coming back to Spain with virtual crowds, regular matches and lots of testing being done for protection from coronavirus. The Spanish League was suspended for more than three months due to the pandemic. It will resume this weekend as the second top league to do so in Europe. The Bundesliga is the first league ever to start in the post-pandemic times. The other leagues, such as the Premier League and the Italian League, will start from next week. The league officials estimated the loss of $1.1 million if they do not resume the matches for the pandemic. The Spanish League is starting the match from Friday between Sevilla and Real Betis at 1.30 am IST as the El Garn Derby. The weekend will have a kickstart match by the table leader FC Barcelona versus RCD Mallorca. There will be another match played between the second placed Real Madrid and Eibar on Sunday next. The Sunday match will take place at Real Madrid’s training centre as the Santiago Bernabéu Stadium is under renovation throughout the season. The clubs are expected to have matches on a regular basis till its completion on 19 July, 2020. Supporters from all over the world are anticipating how the ‘new normal’ will affect the players on field.

La Liga is having high hopes to push the restart button as a celebration and it is also planning to pay respect to the victims of coronavirus. Spain has experienced more than 27,000 deaths and is one of the worst-hit countries in the world. The first match on Friday will show the world that the crisis is under control. The federation has decided to put down some rules which should be followed strictly. These will help to keep an eye on coronavirus and restrict it from spreading among the players and the staff.

The new norms are as follows:

  1. Corona test will be performed twenty four hours before the match at home for each player.
  2. Players must wear masks and gloves and have temperature checked before entering the stadium.
  3. Possibility to have a squad of twenty three players.
  4. Players and staff have to change their kits during the half-time break.
  5. Yellow card is to be shown if a player spits on the ground.
  6. Post-game press conference should be done through video conference call.
  7. Five substitutions instead of three in the eleven member-team.
  8. Handshakes are totally prohibited.
  9. Teams travelling by bus will use two buses.
  10.  The security personnel have to check on fans to ensure no large gathering in front of the stadium.
  11.  There will be no supporters in the stadium.
  12.  The players should sit on the alternate seats in the bench.

The VIVO Indian Premier League is one of the most popular and prestigious cricket tournaments in India. This year it was scheduled to start from 29 March to 24 May but it was postponed due to the outbreak of coronavirus. Sourav Ganguly, the President of the Board of Control for Cricket in India (BCCI), announced that the board is exploring all possible actions to restart the league. The matches will happen in empty stadium without any supporters. The board is discussing safety precautions for the players and staff where some of them have to take international flights to be with the teams. It is being speculated that the tournament might be played in the October-November slot if the International Cricket Council (ICC) decides to postpone the T20 World Cup. The board is in the process of developing a COVID-19 SOP (Standard Operation Procedure) for all State Cricket Associations with a few standard guidelines. It is also in the process of discussing domestic cricket tournaments with the state cricket associations. The economic structure of international cricket is likely to change and lower-ranked nations are already facing fund crunch.

The Indian Super League (ISL) final was held in an empty stadium in Goa on 14 March. I-League season was stopped on 15 March, with the Neroca vs Chennai City 2-2 draw becoming the last match of the season. The season was eventually called off with twenty three matches left and Mohun Bagan was crowned champions. India’s remaining World Cup qualifiers have been postponed. Matches against Qatar, Afghanistan and Bangladesh were scheduled for the March-April window and there’s little clarity on when they will be played. The postponement of the U-17 Women’s Football World Cup, 2020, which was to be hosted in India in November, has also caused some concern. Though FIFA has mentioned that new dates will be identified at a more suitable time.

It is obvious that fans and supporters of all kinds of games around the world have to wait patiently for the matches to start again. There is a huge impact on the world sports arena due to the coronavirus. The feel and shrill of collective expressions reverberating the stadiums are being missed by all.

India under Lockdown: Unlocking Domestic Violence

Home is the safest place for anyone to be with own family in this pandemic situation. Unfortunately it is the worst place for lot of women in the world. Domestic violence has witnessed a tremendous surge during the lockdown period. The modes vary from the physical, sexual, mental to financial abuse or assaults. The victims, most of whom are women, fall prey to chronic diseases, acute depression, trauma and so forth. The attacks are repeated on a regular basis, daily. The World Health Organisation (WHO) has warned that the risk of intimate partner violence will increase all around the world as people are encouraged to be in their homes during the lockdown. There are various domestic violence helplines from different organisations in different parts of the world to save the victims.

According to the reports of National Commission for Women (NCW) in India, issues an urgent alert on the increasing number of reported cases. The lockdown stress is intensifying mental frustration if the perpetrators of violence, who vent their anger on women and children. The anxiety of losing jobs, associated insecurities and financial problems are making the abusers more violent. To cope with this trend various hotlines are operating to enable victims to report their cases. The number of cases surprise all because no one realised before that the lockdown would lead to such unleashing of domestic violence.

Coronavirus has affected the Indian economy very badly. Alongside the economic uncertainty these cases are rising steadily. The NCW reports that this year it has received more than 250 cases of domestic violence from 23 March to 16 April which is almost 100% increase from 27 February to 22 March. The NCW apprehends that the reported cases are only a small percentage of the cases occurring. There must be more unreported cases where the victims are in constant vulnerability. The number of domestic violence cases rose from 3,287 to 3,993 during the lockdown.

West Bengal government helpline has received over seventy cases during the lockdown. A woman living in a high profile highrise in Kolkata had to file a FIR in the nearby police station alleging torture and abuse by the husband.  In another incident, the Association of Protection of Democratic Rights (APDR) reported that a twenty-six year old woman, Sona Mondol from Malda district, was strangled by her husband. In another case, a wife was killed by her husband for protesting against his extra-marital affair.

616 domestic violence cases have been reported across Tamil Nadu from 25 March to 14 May through helplines. The number is alarming considering the brief period. Telangana women are also facing the brunt of the hike in domestic violence cases. According to Sakhi One Stop Centres, around 89% cases registered in April are of domestic violence. A report from the National Legal Service Authority (NALSA) mentions a total of 144 registered cases in Uttarakhand. According to the Punjab State Commission for Women (PSCW), the helpline number is receiving minimum of thirty complaints regarding domestic violence each day since 22 March. There are some interstate cases as well. Thus, the Kerala State Women Commission received a call from Chennai. The caller reported that his sister and her daughter were hiding in the wild forest in Idukki district, Kerala, after being thrown out from home.

Police in Delhi states that over 2,500 women called their emergency helpline numbers. They have received 600 cases of abuse against women, 23 cases of rape assaults and 1612 cases of other kinds of domestic violence within second week of April. There is one case from Uttam Nagar, of a twenty-eight year old young mother, who had undergone mental and physical abuse in front of two toddlers by her spouse and his family. He beat her up severely and told her to leave the house immediately.

Coordinators of various private helpline numbers from across India report that their phones are constantly ringing with distress calls, some of which call for immediate help. Domestic violence is not going to vanish instantly. But what is important is to report these cases to the nearest police station and to make use of both the government and private helplines.

Easing out the lockdown

The World Health Organization (WHO) has declared that the rate of infection of coronavirus has increased in those countries that relaxed the lockdown at once. They have indicated that underestimating the challenges that may arise in the future needs to be taken into consideration by the stakeholders.

WHO Director-General Tedros Adhanom Ghebreyesus has said that China and Germany have reported an increase in cases after a lockdown was relaxed. Any lifting of restrictions imposed for safeguarding the people be done with proper planning and catering for the contingencies, which includes testing on priority and vigilance of the government on every development.

The country lifting the lockdown should possess enough medical potential to deal with the development of new clusters of the coronavirus. Easing out the pressure on medical fraternity is the need for time as they are under stress for the last couple of months. A gradual and firm approach in lifting the restrictions is required. Indian public health system has been doing well when we think of coping up with the coronavirus pandemic.

India needs to facilitate investment in the health system to cope with any development of the second wave. The limitations of testing can be addressed by the government on top priority to avoid any resurgence going unnoticed for a longer period. A steep rise in the infected coronavirus cases can be seen for the last three days, India is about to touch the figure of the daily rise of coronavirus infected cases to ten thousand which is a matter of concern.

Rolling out of effective plans to revive the economy amidst the spread of coronavirus after keeping a lockdown for a considerable period is understood. However, hurried opening or relaxing the restrictions may boomerang on society and can cause a huge spread of coronavirus. Social distancing measures can be converted to the law for a certain period and people breaking the same can be imposed a penalty to stay in quarantine etc. this will reduce the unnecessary burden of movement of people.

Health and survival of the people be given the topmost priority over giving impetus to economics. A steep rise in the coronavirus cases during the past week in India is a sign to the government to monitor the cases more closely. The government needs to plan an effective exit strategy for a smooth transition from a complete halt.

Workplaces that require less manpower and contribute more to the development of the economy can be opened by the government on priority rather than the opening of malls and educational institutes that may become a hub of the spread of the infection. India has succeeded in keeping the mortality rate low due to coronavirus at a bare minimum in comparison with the developed countries of the world who delayed the lockdown and suffered the loss of lives.

Migrant workers moved to their native place causing economic loss to the place from where they moved and adding to the burden of accommodating them to their native place. Unemployment is increasing in urban areas and the migration of people has carried the infection to rural areas too. Unambiguous guidelines of the government are required and center-state face-off must be avoided on political grounds by both, rather the states should support the central government in dealing with the entire scenario diligently.
