What is Mansplaining?

Mansplaining is a portmanteau of the word ‘Man + Explain’. Mansplaining refers to the explanation of something by a man, typically to a woman, in a manner regarded as condescending or patronizing. It stems from an authoritative and privileged belief that men know better, and that women are always ready to be helped and taught. The phenomenon has happened since long but the origin of the word was inspired from an essay by Rebecca Solnit titled Men Explain Things to Me. (Published in 2008)

In her essay, Solnit describes an incident which took place while at a party. During a conversation, an older gentleman cuts her off in between and starts explaining on a topic, claiming to know more about it than her. He insists that she read a particular book which supports his evidence. What he did not know was that she was in fact the author of the very book that he was talking about. Ironically, he hadn’t even read the book and had simply read an excerpt from it.

Although it might seem trivial from the surface, on a deeper level, mansplaining is linked to a larger abuse of patriarchal power. Since knowledge is power, men having held that powerful position for so long assume that they know better and that women are incapable of handling that knowledge of power. It is an offshoot of the societal idea of gender hierarchy where women are expected to be the pleasant audience. Having an opinion for themselves is considered to be an act of ‘questioning the authority’.

A Harvard study conducted in 2004 shows that men are 50% more likely to offer an answer in class and nearly 150% more likely to speak three times or more. This gets carried on and continues from schools to colleges, to workplaces, to politics and basically to any place where expression of ideas is concerned. “….it crushes young women into silence by indicating…that this is not their world. It trains us in self-doubt and self-limitation just as it exercises men’s unsupported overconfidence.”

This happens so much so that women are denied of expressing their own lived experiences. More extreme versions of mansplaining can be found in the Middle Eastern countries where women’s testimony has no legal validity. So, if a woman is raped, she cannot testify in court unless there is a male witness to testify for her. As Solnit says, “Credibility is a basic survival tool…Violence is one way to silence people, to deny their voice and their credibility, to assert your right to control over their right to exist.” Thus, on a larger context, it becomes a crime as grave as harassment or an assault.

As with every point raised, some would oppose this by pointing out things like “not all men do it” or “Women do this too”, and it’s true. Anyone, regardless of their gender, talking in a patronizing or condescending manner to someone else is wrong. “… a certain amount of self-doubt is a good tool for correcting, understanding, listening, and progressing — though too much is paralyzing and total self-confidence produces arrogant idiots… There’s a happy medium between these poles to which the genders have been pushed, a warm equatorial belt of give and take where we should all meet.”

This need not even be restricted to Gender. It ties into other identities like race, sexuality, class, disability and age; as terms like whitesplaining also exist. Any enlightening discussion involving mutual participation and exchange of information is good as long as it is done with respect for each other in a non-condescending and non-patronizing manner.

I really do talk about COVID in this editorial rather than I used in my daily life .

Yes you got it right. We are often told  don’t judge people on the basis of any parameter.

And yet here I am suggesting to judge not just people but situations efficiently.

What kind of judgment are we talking about here? You should learn to do selective judgment. Judgment Done by you should be on an individual level and it should not affect adversely the second party in anyway.Like I said there is good in the world along with the bad so your judgment should be limited to warding off the bad people around you.

Your call should not become any sort of discrimination towards the people.Your hatred or your indifference should not become social or societal indifference.

Judgement of a person is only for cautious purposes.

Like it benefits girls the most.Seeing the number of rapes and hate crimes committed against women,a key of caution towards judgement of intention can be handy.

Similarly,mothers and sisters of culprits can judge their son’s behavior as to what tendencies he has.This can help in avoiding at least a few incidents of female cruelty.

I agree,In india parenting is different.But that’s what we need to learn as a country.Adopt the positive things from other countries.

It can help you be safe.Prevent accident,incidence of injury to both mind and body.

Another angle to judgement is we learn to analyse situations and can foresee our reaction to it.We constantly react to external stimuli in many ways.

Learn to Apologize

Apologize when u do a mistake.Sounds cliche right?

But it has a deep meaning and significance.

There are two possibilities either you have done something for which you should genuinely apologize and second is you have not done anything wrong but still being accused.

Let’s discuss the former ,

If and when a mistake is committed by you be it intentionally or unintentionally,apologize for it.

It may so happen that your actions/words didn’t directly culminate to a mistake but have adverse indirect effects.So ,by keeping your heart out of ego ,empathizing with the victim , just apologize.

Your mistake might not feel big to you but could be grave or fatal for the other party.

You might have caused deep cuts by your words,causing injury to their soul.

Irrespective of your awareness of the grief,apologize.

It will not just Help them move on but also help yourself from avoiding any further regret. A man Can live poorly But living with guilt It’s some thing no one can afford.

So for the sake of your own selfishness at least,learn to apologize.

It is not easy to become brave and accept your mistakes.But it is wise and appropriated.Bowing down doesn’t make you weaker,it only helps you grow as a person.Self introspection grows stronger and your quest to success begins.Identifying and realising your mistake is an indication of self awareness and diluted self ego.

So next time you cause hurt,mental or physical intention or unintentional 

Apologize.

Now the question is when you know you have not done wrong and the other party is falsely accusing you.After self introspection you come to know that you aren’t at fault,no facts support you are wrong and the other party is falsely framing you for selfish purposes.

Do this,

First of all realise that this person is not your friend if s-he does something like this.Cut off this toxic person.

Do not apologize when you aren’t wrong.Take your stand. You aren’t nothing to bow down when you are right.Stand up for what you believe.

Provide facts or statements of your right.Convince those who care about your arguments.Those who do not care won’t care even if you are right.

Give counterarguments .Do not sit down helplessly.If the person is important to you then try to explain yourself if not once then thrice.If s-he doesn’t trust you regardless,leave.

Trust is an important tenet of any relationship-friendship.If you cannot trust you ,you should not keep them.

You need to achieve a balance between right and wrong.

A wrong means for a right future is not always justified.

So today’s mantra-

Organize yourself,your thoughts and never bow down your ideals to someone who doesn’t value you or your thoughts.

Care for yourself just like you would care for others.

When wrong,do not shy away from apologizing.

MANAGE REFUGEE INFLUX

ISSUES

According to data collected by the United Nations High Commission for Refugees (UNHCR), India has close
to 2 lakh refugees living within its territory with the number constantly rising. However, unofficial reports
place the figure at above 4.5 lakh.Currently, the only law specifically governing refugees in India is through
judicial decisions regulating specific situations. There are also ad hoc administrative advisories by the
Ministry of Home Affairs, regulating specific situations concerning refugees, such as the Advisory on preventing and combating human
trafficking in India, dated 1 May 2012

In the absence of specific legislation pertaining to refugees, the general law applicable to foreigners, the
Foreigners Act, 1946, applies to refugees as well. The status of refugees is determined by UNHCR,
but it has limited reach and resources.These ad hoc, case-specific measures lead to a two-fold problem.

First, India’s national security interest
are hamere by the absence of a content legal structure to ensure that all non-citizens resident in India are properly documented and have a legitimate reason for their presence in India. Second, the lack of a law
providing certain basic rights to refugees violates India’s obligations under customary international law,which it is subject to, notwithstanding
its non-ratification of the 1951 Refugee Convention.

SOLUTION

The foremost requirement in the Indian legal framework is a definition of the term ‘refugee’. This is essential for
any legislation making any provision for refugees, since the term is not easily defined. Second, the single most important principle relating to refugees in international law needs to be recognised in Indian law – that of non-refoulement, or non-return to country of origin. The Foreigners Act penalises those who enter the country
without valid identity documents, or may prohibit entry of such persons
into India. This implies that refugee-seekers are liable to be returned to the country they are fleeing from. A legal
solution needs to be worked out to prevent this.

As a consequence of accepting refugee-seekers at the border, a structured system must be put in
place for refugee status-determination.Moreover, a procedure with such
critical security implications should be controlled and carried out entirely by the government. As a result of this procedure, once a person is admitted into the country as a refugee, he needs to be issued a permit, either in
form of a long-term visa or a refugee permit. This will serve as an identity document, and assist the government in maintaining records.

IMPLEMENTATION AND IMPACT

The following amendments are required in the Foreigners Act, 1946,to implement the above:
1.The term ‘refugee’ needs to be defined as a person who, owing to well-founded fear of persecution based on race, religion, nationality,
membership of a particular social group or political opinion, is outside his country of nationality, or if having no nationality, is outside his country of habitual residence and i unable or, owing to such fear, unwilling to avail
himself of that country’s protection.
2. Exceptions must be carved out for refugees, codifying the principle of non-refoulement, wherever the Act prohibits or imposes penalties for being present in India without valid
documents.
3. A new section should be inserted in the Act, requiring status determination of refugees at the border, along with providing an identification document;
provision for rules outlining criteria for status determination as well as
officials responsible for the same.

CONCLUSION

These changes in the Foreigners Act will be the first key steps towards legal
recognition of refugees in India.

Definitions:-

According to the definition of Sir Ivon Jennings” Administrative Law can be defined as a law relating to administration. It determines the organization, powers and duties of administrative authorities.” According to Britanica,

Administrative law, the legal framework within which public administration is carried out. It derives from the need to create and develop a system of public administration under law, a concept that may be compared with the much older notion of justice under law. Since administration involves the exercise of power by the executive arm of government , administrative law is of constitutional and political, as well as juridical in nature.

Austin has defined administrative law as one which determines the ends and modes to which the sovereign power shall be exercised. According to him sovereign power should be either exercised directly by the monarch or entrusted to subordinate political agents holding a position of trust.

Holland regards Administrative law as “one of the six divisions of public law”.

Bernard Schawartz has defined it to be the law applicable to those administrative agencies which possess adjudicatory authority of a delegated legislation.

The three main stages led to the expansion of the meaning of the term Administrative law-

The moving of a state from the laissez faire to welfare state.

Administration has been in the forefront in indian history.Akbar and Ashoka’s court provide classic examples of the same.Later on the British administration was adapted and embibed in India.After independence, After independence, India adopted to become a welfare state, which henceforth increased the state activities. As the activities and powers of the Government and administrative authorities increased so did the need for ‘Rule of Law’ and ‘Judicial Review of State actions’.

Henceforth, if rules, regulations and orders passed by the administrative authorities were found to be beyond the authorities legislative powers then such orders, rules and regulations.

Milkha Singh – The Flying Sikh


‘The Flying Sikh’- yes, we all know him by this name and he is the great Indian track and field sprinter MILKHA SINGH. He was born in a Sikh family of Rathore Rajput origin, on 20th November ,1929 at Govind Pura in Panjab, British India. Govind Pura is 10 km from Muzaffargarh city in Panjab Province which is now belongs to Muzaffargarh District in Pakistan.
He was one of 15 siblings, 8 of whom dies before the Partition of India. There was an irony in his life, during the Partition of India his parents, a brother and 2 sisters were killed in the violence that ensued. After that he moved to Delhi, India, in 1947. He lived with his married sister’s family for few days.In that time, he was briefly imprisoned at Tihar Jail for travelling train without ticket. Then his sister sold some jewelries for releasing him. After that he spent sometimes at a refugee camp in Purana Qila and a resettlement colony in Shahdara, both in Delhi.
Singh’s life was totally different then, he was becoming a dacoit but his brother persuaded him to attempt recruitment to the Indian Army and this changed his life. He successfully gained entrance on his 4rth attempt, in 1951, and while stationed at the Electrical Mechanical Engineering Centre in Secunderabad he was introduced to athletics.
As a child Singh had run 10km distance to and from school and selected by the Army for special training in athletics after finishing sixth in a compulsory cross-country run for new recruits and it was the beginning of his “run of the better life”. He said “I came from a remote village, I didn’t know what running was, or the Olympics”.
When shing was in the Army he realized his abilities as a sprinter. After winning the national trials in 200-metre and 400-metre sprints he was eliminated in the preliminary heats at the 1956 Olympic Games in Melbourne. In 1958, he won both the 200-metre and 400-metre races in Asian Games. After that in this year he created a record in history of game, he captured the 400-metre gold at the Commonwealth Games, it was India’s 1st athletics gold. In 1960 Olympic Games in Rome, he narrowly lost the bronze medal in the 400-metre. In 1962, in Asian Games he retained his 400-metre gold and also took another gold as part of India’s 4×400-metre relay team. In 1964, in Tokyo Games as part of the national 4×400 team that failed to advance past preliminary heats. In 1964 he won silver in Calcutta National Games (400-metre). In 1959 he was awarded by Padma Shri which is the 4rth highest civilian honor.
Milkha Singh was persuaded by Jawaharlal Nehru to sit aside his memories of the Partition era to race successfully in 1960 against Abdul Khaliq in Pakistan.
During the felicitation ceremony, Pakistan’s president Gen Ayub Khan said to Milkha Singh, ‘Milkha, you came to Pakistan and did not run. you actually flew in Pakistan. Pakistan bestows upon you the title of the ‘Flying Sikh ‘.
In 1955 Singh met Nirmal Saini who was a former captain of the Indian Women’s volleyball team in Ceylon and in 1962 the get married and had three daughters and a son. In 1999, they adopted the Havildar Bikram Singh’s seven years old son after his death in Battle of Tiger Hill.
Singh and his daughter, Sonia Sanwalka, co-wrote Singh’s autobiography, “THE RACE OF MY LIFE”. It was published in 2013. In 2013 Bhaag Milkha Bhaag film was made inspired by his autobiography. This film won National Film Award and 5 awards at the International Indian Film Academy Awards in 2014.
In 2017, Singh’s wax statue created by sculptors of Madame Tussauds in London which was unveiled at Chandigarh.
But all good chapters have an end. here has also a pathetic end. In this COVID situation he was attacked by COVID-19 virus and passed away on 18th June of 2021. It’s true that he is no more among us physically but he will be live among us mentally.
