The Rule of Harmonious Construction

Law has an important place as a representative for social evolution. In this democratic system of governance, there are many intersections between legal order and social evolution. The source of the law in legislation is called statute law. It is made very fast, definite and does not have to wait for identification by the courts. The courts acknowledge a statute because it is law; it is merely not law because the courts recognize it. The cause for uncertainty of legislation is the basic nature of language. It is not always likely to perfectly turn the real intend of the legislation into written words. The ability to adopt the language inevitably means that there will be equally good or unconvincing arguments for both competing interpretation. Many of times the provisions are having more than one meaning or the uncertainty in the language. The legislature becomes functus officio when after enacting the statues. The interpreters cannot revert back to the legislature and ask the exact meaning of the statute because the legislators would not have take up such a wide variety of conditions while making any particular statute. Thus it is totally depend on the Judges to interpret such provisions to make both effective. To avoid further uncertainty, the legislation has provided us with some of the primary rules of interpretations. Harmonious Construction is one of the most significant rules where it is said that if the two or more or more than two provisions of the same act are conflicting with each other then it must be interpreted in such a manner that effect should be given to both, and the provision which has a wider concept will always prevail.

When there is a conflict or inconsistent between two or more provisions or two or more parts of a statute then the rule of harmonious construction is implemented. This rule follows a very simple theory that each and every statute has a purpose and intent as per the law and should be read as a whole. The interpretation should be adopted when all of the provisions are consistent. In the case in which it is totally impossible to harmonize both the provisions, the court’s decision regarding the provision shall prevail. Harmonious rule brings harmony among the various lists referred to in Schedule 7 of Constitution of India. (The 3 Lists of Legislation – Union list, State list, and Concurrent List). This doctrine follows a settled rule that an interpretation that results in hardship, injustice, inconvenience and anomaly should be avoided. The interpretation with the nearest compliance to justice must be picked.

Harmonious Construction has helped Judges to interpret between two conflicting laws easily and has proved easily in providing the justice to society at large. This does not mean that judicial interpretations always thought to be the true and as per the intention of the legislation. More but not the less their interpretation power has given a space for their own ideas to flourish. Although they in most of the cases they gave their best to bring sense out of miserably worded statute. The legislative inability to anticipate all conceivable future scenarios is understandable, and hence it is the task of the judiciary to make existing laws practical by rational interpretations. Judges must control themselves from their own thoughts and philosophy which affects the judgment and many a times they end up in making of new laws. Filling up of such space will ensure that the interpretation by judiciary in the future will produce fruit bearing results for all.

Fearless Version of Your Own Will Be Rescued Tomorrow!

Your Constitution of Fearlessness:

Have you forgotten the definition of fearlessness, only for memorizing the phrasal verbs of English grammar, the scientific names of Biology, The periodic table of Chemistry or the pages after pages of memorable dates of History?

Yes, if it so, then keep it in mind that your next stop is in your death!!

Be brave. Be strong. Be fearless. - Quotes You Need
Be brave, Be strong in your personal life (Pic Source: Google)

14 billion years ago some accident made the universe  bang into existence. Another mysterious accident sprang to life on Earth . Even when the 1st cell is divided into two, Life has always struggled to survive. Even though death gives life its meaning, death is meaningless without a proper life. So will you be sure that you bravely utilized your life before you become the sustenance for insects?

Well, when India is celebrating her independence with a lot of propaganda, parades , songs & anthem, One question arises: Are you really free as an individual, neither as a resident of any state/ Metropolitan city nor as a proud citizen of an almost self-sufficient India?

So let’s not just sing songs and watch parades, rather ratify your own constitution for your own individuality ( so that the nuisance of hundreds of fears inside your heart temple cannot throw you out).

  1. Stop planning:  Too much planning makes us fearful – if the planning doesn’t come implemented, how will I manage? – This fear Kills the cells of our courage.
  2. Go back to Basics: While life intends to be happy in every step, the suggestion here goes like – Simplicity is the key to Happiness & fearlessness. Whenever & wherever you do something simple things, that comprises your creativity and that originality provides smile to your lips every time and you feel yourself out of fear in your own world.
  3. Release Control & Allow Yourself to make mistakes: Most of us fear not the ghosts or the scorpions; rather we fear to make mistakes — So allow yourself to make mistakes after all, that’s where learning and growth really happens. Learning comes from failures and that needs to release control. Your mistakes won’t make your head down, so make mistakes as much as you want & as long as you can.
  4. Learn to Love: Yes, you don’t know the definition of love at all. You think, love means love to any one sweetheart — No, not like that; as Nachiketa rightly pointed out —

“ভালবাসা কোন পেসমেকার নয়,

কোন এক বুকে নেবেই যা আশ্রয়;

ভালোবাসা তো মুক্ত হাওয়া;

বহু মনে খুজে পাওয়া;

নানা রাগে কোমল আর গান্ধার”

from “Ki Hobe” album of Nachiketa

The unconditional love will destroy the handcuffs of giant fear.

5. Jerk out your ego: Once I heard one conversation of two friends : 1st one is asking the 2nd one, “why haven’t you wished Moonal (their mutual friend ) Happy Birthday?” Then the 2nd friend replied, “why would I ? She haven’t wished me on my birthday.”

This is ego he hasn’t done. So I won’t do it. This Type of little little egoistic behavior will make us more unfree from the core of our hearts & that will carefully construct your fearful entity !So Get your ego out through your very breathing.

6. Stare at fearless people: Feel your brain with images of what you want it your tomorrow self to look like. Pick up your role models and contact them as you can weather in person through a book or online. That will serve the source to combat your fear.

7. Be aware of fear in your life: Before you begin overcoming fear you have to admit that you have it and besides you have to keep it in mind that fear is your normal site of being.

So take 10 minutes and write down some aspects of your life, where you feel fear. Get them down on paper and throw the script wherever you want that will plant a seed of fearlessness in your tender Heart.

8. Visualize your future situation without fear: Imagine yourself in a scary situation without fear. Think about the worst situation your life may pass through. What people do things fearlessly that will normally freak you out. Visualize yourself as that person and think what you would have done if it happened to you.

9. Be stupid, out of stereotypes: Remember once you are willing to risk the emotional pain of making mistakes, you will successfully Shed more fear than you ever imagined. The works that are stupid to others will help you obtain information by which you will invent your creativity.

Keep in mind that if you copy something/ some Attitude from anywhere, there fear that will kill you every moment to lose the same; but what your creation it’s extremely yours and has no fear to be lost, rather your creativity will gradually possess the area that previously your fear possessed.

10. Read books: A lot of intellectuals will recommend you to read the books on how to succeed in life, but please refrain from obeying this advice as well as them! Read whatever you want with fearlessness. Read the books of failure. As followed by APJ Abdul Kalam,

APJ Abdul Kalam’s Fearless Quote

The causes of being feared is rightly scripted in the song sung by Srikanto Acharya

“না রে, সাহস করে স্বপ্ন তো কেউ দেখছে না,

না রে, সত্যি কথা মুখ ফুটে কেউ বলছে না”

from “Bristi Tomake Dilam” album of Sikanto Acharya

So don’t delay, don’t cheat your life, do try in new adventurous activity, dare to experience the world in a different way. You are not sure if the alarm clock will be able to wake you up tomorrow, so wherever you face hindrance today, just pat your chest and say,

“Oo Chachchu, All Is Well”

How Archives transformed in the Digital era

The Word archive is derived from the Greek word ‘Arkheion’. The word was further referred from ‘Archon’, which meant a magistrate who oversaw the town hall where all the official public documents were stored. The Word Archive came to use for the first time in the 17th century.

Archives are also known as ‘memory institutions’ because they record and preserve memories and form a significant part of culture, community, official and unofficial history of any place or region or state, or any institution. Their function is to collect, store and preserve artefacts and documents of historical, cultural, and legal importance from the yesteryears and the present so that they remain accessible, informative, and useful to future generations. In general, any organization, government institution or individual can build archives. The National Archives, UK has described archives as “collections of records or documents, selected for lasting preservation due to their historical value, significance as evidence, or as a source for research studies”. International Council on Archives (ICA) has defined archives as “documentary result of various human activities conserved for its long-term value”. They further described archives as contemporary accounts created to can provide a true and verified version of past events.

The significance of the archives lies in the orderly collection of crucial source documents accumulated over an individual’s or organizations’ lifespan and preserved, which can serve as evidence or reference for future work. As archives are the repositories housing various historical documents and records of value, archival research is facilitative for scholars and researchers looking for data to assess and facts to study from the original documents. However, owing to the vastness and diversity of ample archival documents and records, archival analysis is a hectic and tedious job. Access to the artefacts and documents stored in an archive is not an easy task and requires permission from the respected authority. In addition, most of the information stored in traditional achieves is paper-based and thus, is susceptible to decay with time. The aforementioned limitation of traditional archives can be overcome by archiving documents and artefacts in various digital formats, which can ensure that the information is preserved for a substantially longer period.

With the advent of newer digital technologies, it became easier and more convenient to store and preserve the information in the digital space. With the assistance of new digital tools and methods, the process of transcending information from the physical world to the digital world became much efficient and easier.

Digital archiving is an area where the relationship between digital tools/methods and information preservation can be witnessed. It is a blend of the former and current storage of information. Their function is similar to traditional archives, as repositories of elaborated collection of information in various digital formats at a virtual location. This also makes digital archives more accessible and democratic as the physical constraints are eliminated.

Advantages of Digital Archives:

  • The the digital archive allows “anywhere-anytime” accessibility to users ensuring a reduction of time, cost, and money.
  • The redundancy of information stored in digital archives can be reduced, which can promote ease of access.
  • No geographical site is required to build a digital archive, which is cost-effective.
  • The simultaneous requests of access from multiple users can be addressed by creating multiple copies of information stored, which can overcome the issue of bottlenecks encountered in traditional archives.
  • Managing and navigating objects or records stored digitally are easier in digital archives, which allow developing capacity to preserves terabytes of information.
  • Digital archives are less subjected to bureaucracy like traditional archives, which can ensure data accessibility to the general public.

Digital archives are not perfect. Many times due to the digital divide and other constraints, researchers are not able to access the information. Sometimes the information challenges the authority and due to this, the information can be unavailable in the digital archives because of censorship. But there is no denying that digital archives have transformed the way information is stored and processed.

What if it rains diamond instead of water?

Rain of diamonds

We people live in Earth experience rain more often. It brings out joy to some and sorrow to some. Climates changes and all other factors are becoming reasons for acid rains in urban areas and many rural areas are turning into desert without rain.

In those areas, raining of water itself considered as precious thing like diamond whereas in Saturn the rain is not made of water instead they rain diamonds.

[Courtesy: Discovery news]

Saturn and it’s diamonds

Scientists believe that there are about 10 million stones like this in the atmosphere of Saturn. Every year about 1,000 covered rocks rain down in Saturn as stated by NASA. So, Why it rains diamond in Saturn? Are they the real diamonds?
Saturn, the planet with rings has these diamonds rocks in its atmosphere. These rocks are formed because of the gaseous mass present in the atmosphere, they are very intense. When the lightning storm occuring in the planet strikes the Methane(CH4) gas, it converts it into soot like compound which contains mostly of Carbon molecules.
When the Saturn rays which are extremely high in temperature hits the Soot, they break the molecules separating the Carbon and Hydrogen. The newly formed compound will be heavy and is attracted by the gravity.
The falling compound is subjected to high pressure and increase in temperature transferring Carbon to Graphite and then into Diamonds while falling to the surface. This is how it rains Diamond in the six planet of the Solar System.
The large diamonds are in centimetres which are suitable for a diamond ring. These diamonds fall on the surface of the planet.
Who knows may be in the future diamonds would be harvested in Saturn.
Studies state that as like Saturn,  planets like Jupiter, Uranus and Neptune also rain diamonds.

WHY DO WE NEED TO BE PUNCTUAL?

Know the true value of time; snatch, seize, and enjoy every moment of it——-Lord Chesterfield

ITS MEANING

Punctuality means doing a work at the proper time. To account an engagement at 10 o’ clock in the morning and to arrive at the place to keep it at 10-30 does not become a gentleman. It annoys the other party and it harms the future of the caller. No one who is unpunctual in attendance to work can be depended on or trusted in. On the other hand, a punctual man is one who knows the value of time. Such a man is a perfect gentleman and everybody has faith in his efficiency and character.

IT GIVES A MEANING TO YOUR LIFE

Punctuality is important in every sphere of life. it is rightly said that punctuality is the crown of a king. It is the most precious jewel to the character of a man. A student has to be punctual at school or college. The manager of a big firm or its common clerk has to be punctual in his office. Equally it is necessary for a factory worker, a politician, or a statesman. The greatest value of punctuality is that it is a great time-saver. An unpunctual man is always worried about time. A student who is unpunctual in his class lags behind others in his studies, he creates confusion both for himself and for others in the class. He is considered a disturbing element and is looked down upon by his teachers as well as his classmates.

MISS IT AND WELCOME YOUR HARM

Many battles have been lost on account of unpunctuality. Many Cases in Courts of Law have been lost, because one of the parties did not come in time; many a train has been missed and business lost to unpunctuality. So, unpunctuality leads to dangerous consequences. Relation of free people knows the value of punctuality. Indians are now a free people and they should cultivate punctuality in everywhere. Unpunctuality is a vice and out of it are born other vices like dishonesty, falsehood, idleness and shirking of one’s duty.

So, we observe how punctuality plays a foremost role in anyone’s life. being unpunctual is a curse, we cannot be as winner as others. Besides, this rhythmic world demands punctuality so that all of us can be successful in life.

Canada on fire!

“195 percent rise in sudden deaths within 5 days”, “toll tops 800”, “On Tuesday, June 29, 2021 Lytton recorded a blistering temperature of 121.1 degrees” “the hottest moment ever seen anywhere in Canada since record-keeping began”. … Well, these headings are spread across the news channels currently; akin to the heat wave that has spread it’s wings over Canada. Let’s spread more light about the basics of the Heat wave.

The town of Lytton has just a few hundred residents and is known for being one of the hottest locales in Canada because of its dry climate and low elevation. But during the epic heatwave that has swept western North America this month, Lytton’s previous high temperature records have been absolutely shattered by nearly ten degrees Fahrenheit.

Lytton and nearby Lillooet share the second highest temperature ever recorded in Canada. In July 1941, temperature reached a record of 44.4°C. On August 14, 2004, tempaerature again reached around 41°C. The minimum temperature the mercury touched was 31°C.

Causes of Temperature inflation

Climate change is being said the root cause. In technical terms, the condition is called Heat Dome. The warm air generally rises up but the high pressure in atmosphere from above, pushes down towards land. The pushed down air becomes even hotter. Extreme weather conditions are escalated with climate change.

West Pacific area has seen significant rise in heat as compare to the East Pacific. The strong change in ocean temperature from west to east is believed to be the core reason of heat dome. Hot air is trapped by the high pressure fronts and as it is pushed to the ground it heats up even more. The condition also prevents formation of clouds thereby giving sun more space to radiate heat on the ground.

The condition of heat dome produces heat wave. Heat wave is a period of abnormally high temperatures which lasts more than 2 days.

Effects of heat dome

Temperature becomes unbelievably high leading to catastrophic deaths, crop damage, droughts. The rising temperature will demand high energy which will in turn increase the rate of electricity. Forest fires are no exceptions. In fact, the current situation is that half of the Lytton village is charred.

Fact

The temperature of Earth has already risen by 1° (totally a bad omen). The rise resultantly increases the chances of natural disasters exponentially. The studies show climate change can affect high-altitude regions at a faster rate. In the past 20 years, temperatures above 13,000 feet have warmed 75% faster than at altitudes below 2,000 metres (credits: Rutgers Today).

Possible Solutions

On an individual level, climate change cannot be solved anymore. Only government policy changes can prove most effective. Subsidies on fossil fuels should be removed, electric cars must be promoted, carbon tax to be imposed, more and more awareness to be raised on individual level.

CBSE’s decision to conduct 2022 Board exams in two terms, beneficial or not

Covid-19 has affected lives of everyone with people compromising on the most important events of their lives. Uncertainty is very common during these times especially for ones who have their most important exams of their lives hanging on a thread. When the first wave of Covid-19 hit in 2020 , few remaining board papers were cancelled by both- the ICSE and the CBSE. With the second wave of covid-19 hitting the subcontinent in its most horrible form, the students who were supposed to give their boards were highly stressed and confused about the position of their board exams. However, long after the general date of the commencement of the exam, the Board exams were declared CANCEL among much speculation.

With an aim to not arose confusion among students regarding the position of their Board exams if the worst case scenario happens, CBSE declared its 2022 Board Exam’s scheme today keeping in mind the worst happening possibilities of covid-19 which may or may not happen during the scheduled time.

CBSE’s decision

The CBSE has decided to hold 2022 boards in two terms- Term I and Term II respectively. As per the new criteria, the syllabus for the academic session 2021-22 will be divided into two terms with each term containing 50% of the original syllabus . The term end exams will be of 90 minutes duration each, while the the term-1 will be conducted in November-December, the term-2 exams will be conducted in March-April and the final rsult will include the average of both the terms. The pattern of the exams have also changed ensuring not to put much pressure on the students while the difficult times are going on. The term-1 exams will have MCQs including case based MCQ and assertion-reasoning type MCQs instead of the general descriptive paper which students are writing for their boards since ages. However , term-2 will have questions on different formats and in the case the condition is not conducive in March, the duration for the term-2 exams will be extended to two hours.

CBSE has asked the schools to continue the online classes unless further notice from the authorities and have especially asked them to create a student profile for each student which will record their assessments undertaken over the year. This year more focused will be paid to the Internal Assessments so that if the condition arose where the students are not able to give the exams in the formats that have been planned, the Internal Assessment marks can be relied upon. While for classes 9th and 10th, the internal assessment will include periodic tests, practical works, speaking and listening activities which have to be conducted in the entire academic session, classes 11th and 12th will have Unit Tests at the end of every topic, exploratory activities, practicals and projects. CBSE will facilitate schools to upload the internal assessment marks on the CBSE IT platform which is used by the schools this year to upload the home exams marks for classes 11th and 12th.

Is the decision beneficial for students?

Keeping in mind the situation which had occurred in the second wave with almost every family facing death of one or more members due to the deadly disease and hospitalizations due to severe health issues, this decision is extremely beneficial for the students. The second wave brought with it the terror of death, with everyone in stress about the deadly situation going around which brought extreme pressure for the students who didn’t know whether or not they will be able to write their boards. The studies show that it is not possible for the brain to work normally in the situations of extreme stress and if the board exams are to be held somehow even by the online means, it won’t be an unbiased exam and will be highly unfair for the students who had the ability but couldn’t perform.

With the division of syllabus in two parts with each term conducting exams only with the one part of the syllabus, has reduced the stress which the board students would be facing. Further, the decision of the board to keep internal assessment as a priority which generally is not for the board students ,ensures that the students get fair opportunity to perform throughout the year and maintain a good score at the end if the evaluation is to be based on internals .

How crocodiles survived mass extinction ?

Crocodiles,by reading the name you would have picturised a massive creature with pointed teeth and a thick skin. The very appearance of them would terrify anyone. We can also call them as living relatives of dinosaurs but still it has always been a mystery on how crocodiles survived the extinction which wept out the entire dinosaurs. Crocodiles shares many common features with dinosaurs but they are different from one another and they have a distinct feature which allowed them to survive the mass extinction of dinosaurs.Though we can’t come up with a perfect conclusion still there are few amazing theories which leaves us wondering.

Crocodile show a slow metabolism which allows them to survive for months without food. They being cold blooded cannot generate own heat due to which they hibernate during colder periods. While hibernating they dig burrows in the side of river banks and go for a long sleep. This particular habit of them would have enabled them to withstand the climatic condition prevailed during the mass extinction. The period that followed the event of mass extinction brought a radical weather change which would have wiped of the remaining dinosaurs whereas crocodiles on the other hand had the ability to hibernate or go dormant adopted to the changes and survived the condition.

Another important characteristics of survival is in the process of reproduction. In this case the crocodiles gave rise to a large number of offsprings at a time whose young one takes quicker time to grow mature thus increases the possibility of survival.

They also have a strong immune system which enable them to fight against deadly diseases thus providing more anchorage to the survival process. They grow slowly and steadily in size adapting to the surrounding and availability of food which was not characteristic of the other creatures that lived during that age. Apart from all others features, crocodiles are smarter creatures which can be seen through the fact on how easily they can be tamed and trained. They understand the changing around them clearly and tend to adapt to it. All these factors together has assisted crocodiles to escape and thrive through the mass extinction.

FAILURES

Do Our Failures Define Us?

In today’s fast moving and overly competitive world, all people care about is being successful. And for the ones who are already there, it is hard to believe that they faced no failure on their way to the top. Failure is a part of success, it is the part of our lives. That one failed moment is enough to make you think about what you can do if you give it one more try. People want success but what they don’t desire is failure.

You must have heard life stories of many great people but I bet everyone had their challenges. If you try to do everything perfectly, made sure that everything goes according to your “plan” and leave no scope for failure, do you really think life would be easy to live? Is it that easy to control every aspect of your life? I think not. I am not saying you must leave scope for failure but you must consider it as a possibility because sometimes things are just not under your control. You need to know that failure is one of the key ingredients in the recipe for success. Failure is what pushes you to keep going. Failure is what keep you humble. Failure encourages you to take that risk again and we all know that ‘greater the risk, higher the reward’. Yes, failing at something you worked this hard for can take a toll on our emotional and mental health. But you have to think about the fact that now you are aware of your mistakes. You finally know what you have been doing wrong and if that isn’t a good thing then what is.

DO OUR FAILURES DEFINE US?

Your failure is not what defines you but your capability to pick yourself up, defines who you are. As it is rightly said that if you fall, the person to pick you up should be ‘YOU’. It is understandable that after a point of time failure takes you down mentally but you still have to believe in yourself because as Marilyn Monroe once said “Keep trying, hold on, and always, always, always believe in yourself, because if you don’t, then who will, sweetie?” . All you have got is you. Life is full of challenges and it is for sure that a life full of challenges will teach you more about the world then a smooth sailing one.

Another thing you have to realize is that you are not alone in this. Everyone falls. Some more often than others but the people who refuse to stand up and begin again are the real failures. You cannot just give up. If you do, you will live with the regret of what you could have been if you got up, dusted yourself and gave it one more shot. The feeling of regret is worse than failure because if you never try you shall never know what you were capable of all along. Let me ask you a question, during your final days what are you more likely to think about- your current status or the time you didn’t recover from that one failure which could have been your shot? Well, if the latter is your answer then you have to get up, make a new plan, go out there and show everyone who ever doubted you that your failure is not what defines you but your success will.

I’ll leave you with this quote by Nelson Mandela,
“Do not judge me by my successes, judge me by how many times I fell down and got back up again.”

False Confessions

Would you confess to a crime you didn’t commit if you were being interrogated?

While common belief holds that innocent persons do not confess to crimes, the truth is that false confessions do occur and it happens more frequently than you might expect.

A false confession consists of an admission followed by a post admission narration (a comprehensive description of how and why the crime occurred) of a crime that the confessor did not commit. False confessions pose major concerns among social scientists, mental health experts, policymakers, and the general public. They are continuously one of the most prevalent, yet misunderstood, sources of error in the legal system, and hence one of the most prejudiced sources of false evidence that leads to wrongful convictions. False confessions are classified into three types: voluntary confessions, influenced confessions, and compliant confessions.

Voluntary false confessions are addressed by the confessor’s own psychological conditions or by external pressure applied to the confessor by someone other than the cops or someone else in authority. False confessions made voluntarily are typically attributed to inherent psychological or mental issues. While Influenced false confessions arise when questioning tactics compel an innocent person to doubt his memory and he really becomes convinced, whether temporarily or permanently, that he committed the crime despite having no recall of doing so. And Compliant false confessions on other hand are made in order to escape a difficult situation, evade punishment, or obtain a promised or implied reward. The most noticeable feature of a compliant false confession is that it is done intentionally: the suspect acknowledges guilt while knowing he is innocent and that what he says is untrue.

Even in the lack of coercive threats and offers, stress and a desire to avoid interrogation may result in false confessions. Custodial interrogations are naturally stressful and unpleasant encounters, and an accused may hit a level where he is eager to make a false confession merely to end the confrontation. Confessions are the most compelling and convincing evidence of guilt that the state can present against a defendant. False confessions are thus the most compelling and convincing false proof of guilt that the state can use against an innocent individual. Confessions have a significant inherently biased influence on the views and decision-making of both criminal justice officials and judges because most individuals assume that a confession, particularly a thorough confession, is accurate by definition. As a result, confession evidence tends to characterize a defendant’s case, frequently overwhelming any contradicting information or evidence of innocence.

This article reminds us that not only should we discard the notion that no innocent person in their right mind would confess to a crime, but that in some cases, false confession is rational or at the very least exceedingly reasonable.

Any marketing that uses electronic devices to convey promotional messaging and measure its impact. In practice, digital marketing typically refers to marketing campaigns that appear on a computer, phone, tablet, or other device. It can take many forms, including online video, display ads, and social media posts. Digital marketing is often compared to “traditional marketing” such as magazine ads, billboards, and direct mail. Oddly, television is usually lumped in with traditional marketing.
Did you know that more than 3 quarters of Americans go online on a daily basis? Not only that, but 43% go on more than once a day and 26% are online “almost constantly.” These figures are even higher among mobile internet users. 89% of Americans go online at least daily, and 31% are online almost constantly. As a marketer, it’s important to take advantage of the digital world with an online advertising presence, by building a brand, providing a great customer experience that also brings more potential customers and more, with a digital strategy

What is digital marketing?

Digital marketing, also called online marketing, is the promotion of brands to connect with potential customers using the internet and other forms of digital communication. This includes not only email, social media, and web-based advertising, but also text and multimedia messages as a marketing channel.
Essentially, if a marketing campaign involves digital communication, it’s digital marketing.

Inbound marketing versus digital marketing:-

Digital marketing and inbound marketing are easily confused, and for good reason. Digital marketing uses many of the same tools as inbound marketing—email and online content, to name a few. Both exist to capture the attention of prospects through the buyer’s journey and turn them into customers. But the 2 approaches take different views of the relationship between the tool and the goal.
Digital marketing considers how each individual tool can convert prospects. A brand’s digital marketing strategy may use multiple platforms or focus all of its efforts on 1 platform.
Inbound marketing is a holistic concept. It considers the goal first, then looks at the available tools to determine which will effectively reach target customers, and then at which stage of the sales funnel that should happen.
The most important thing to remember about digital marketing and inbound marketing is that as a marketing professional, you don’t have to choose between the 2. In fact, they work best together. Inbound marketing provides structure and purpose for effective digital marketing to digital marketing efforts, making sure that each digital marketing channel works toward a goal.

B2B versus B2C digital marketing:-

Digital marketing works for B2B as well as B2C companies, but best practices differ significantly between the 2.

  • B2B clients tend to have longer decision-making processes, and thus longer sales funnels. Relationship-building strategies work better for these clients, whereas B2C customers tend to respond better to short-term offers and messages.
  • B2B transactions are usually based on logic and evidence, which is what skilled B2B digital marketers present. B2C content is more likely to be emotionally-based, focusing on making the customer feel good about a purchase.
  • B2B decisions tend to need more than 1 person’s input. The marketing materials that best drive these decisions tend to be shareable and downloadable. B2C customers, on the other hand, favor one-on-one connections with a brand.
Of course, there are exceptions to every rule. A B2C company with a high-ticket product, such as a car or computer, might offer more informative and serious content. Your strategy always needs to be geared toward your own customer base, whether you’re B2B or B2C.

The 7 Types of Digital Marketing:-

INTRODUCTION:-

A group of men and women sitting around a conference room table working in their role as digital marketers.
Digital marketing can be broadly broken into 7 main categories including: Search Engine Optimization, Pay-per-Click, Social Media Marketing, Content Marketing, Email Marketing, Mobile Marketing, Marketing Analytics.
In the past decade, digital marketing has become a vital component in organizations’ overall marketing strategy. It allows companies to tailor messages to reach a specific audience, making it possible to market directly to people who are likely to be interested in their product. Digital marketing encompasses a wide variety of marketing tactics and technologies used to reach consumers online. Two academic team members from Southern New Hampshire University (SNHU) spoke about how digital marketing aligns with traditional tactics and shared information on some of the types of digital marketing in practice now.
A senior associate dean of business programs, Dr. Mark Hobson, said although digital marketing seems like a new world, in fact it is based in many of the principles familiar to traditional marketers and requires both foundational marketing knowledge and technical know-how.
Dr. Jessica Rogers, associate dean of marketing programs, said the two disciplines serve to connect with distinct groups of consumers. “… Traditional media is a great way to reach a broad consumer base, whereas digital media has the ability to reach very specific audiences,” she said “A key point is that depending on the target audience, some channels are more effective than others.”

Types of Digital Marketing:-

Rogers talked about some of the most popular types of digital marketing, providing a brief overview of each

1. Search Engine Optimization (SEO):-

The goal of SEO is to get a business to rank higher in Google search results, ultimately increasing search engine traffic to the business’s website. To accomplish this, SEO marketers research words and phrases consumers are using to search for information online, and use those terms in their own content. According to leading SEO software company Moz’s “Beginners Guide to SEO,” SEO encompasses many elements, from the words on your web pages to the way other sites link to you on the web to how your website is structured. An SEO specialist can make around $59,000, according to Salary.com.
So, what are some things that can improve a site’s SEO? It’s important to understand that one of the things that makes SEO challenging is that the answer to this question always depends on Google and its most current algorithm. Keeping that in mind, here are a few of the most important things for SEO strategists and marketers in general to understand about how SEO works today, from Moz’s Beginners Guide to SEO:
  • Content indexing – It is important to allow search engines to clearly “read” what your site content is, by doing things like adding alt text for images and text transcripts for video and audio content.
  • Good link structure – It is important that search engines can “crawl” your site structure to easily find all the content on your site. There are many things that an SEO specialist can do to properly format links, URLs, and sitemaps to make them most accessible to site crawlers.
  • Keywords and keyword targeting – Properly deploying your keywords – i.e. the search terms you want your site to be found for—in your content and headers is one of the fundamental building blocks of SEO. It is no longer good practice to “stuff” your content with as many keywords and keyword variations as possible. Writing high-quality content that uses keywords in the headers and a few times in the crawl-able page content is now considered better practice, and will make pages rank better in search results.

2. Pay-per-Click (PPC):-

A laptop screen showing the analytics behind a pay-per-click digital marketing campaign.

Pay-per-click refers to paid advertisements and promoted search engine results. This is a short-term form of digital marketing, meaning that once you are no longer paying, the ad no longer exists. Like SEO, PPC is a way to increase search traffic to a business online.
Pay-per-click can refer to the advertisements you see at the top and sides of a page of search results, the ads you see while browsing the web, ads before YouTube videos and in ads in mobile apps.
One of the other things that differentiates pay-per-click from SEO is that you only pay for the results. In a typical PPC model like a Google AdWords campaign, you will pay only when someone clicks on your ad and lands on your website. You can spend just about any amount of money on pay-per-click advertising. Some companies may see results from investing just a few hundred dollars, but plenty of large companies spend tens of thousands a month on pay-per-click.
How much it costs to run an ad or promote your search results will depend primarily on how much competition there is for your keywords. High competition keywords (i.e. keywords that many people are searching for and that many sites are trying to be found for) will be more expensive and lower competition terms will likely cost less.
When you set up a pay-per-click campaign, you will also be able to choose whether you want your ad or promoted results to be shown to users all over the world, or only within a specific geographic area. If you are marketing a brick-and-mortar business, this ability to tailor by location helps you not waste ad dollars serving ads to users who don’t live anywhere near your business, according to Google.

3. Social Media Marketing:-

A woman using her cell phone to track the results of a social media marketing campaign.

This includes everything a business does via social media channels. Just about everyone is familiar with social media, but marketers must approach social with an integrated and strategic approach. Social media marketing goes far beyond simply creating posts for social channels and responding to comments.
To be effective, efforts must be coordinated and consistent rather than an afterthought. To help keep posts consistent, there are many online tools available to automate and schedule social media posts, although marketers only should use automation as a tool, not a “set it and forget it” solution. Users will figure it out quickly if there is no real person behind the posts.
Social media marketers should not be in a silo separate from other marketing functions. Social marketers need to work with the company’s wider marketing team to coordinate their message across all platforms, online and off, so that every part of the brand is telling the same story.
A crucial part of social media marketing is analytics: Social media marketers must also be savvy at analyzing the performance of their posts, and creating strategies based on that data. Another reason for marketers to be consistently measuring and tracking their campaigns is that this data allows marketers to demonstrate to business leadership that their efforts are driving users to engage with the brand and eventually converting users into customers, therefore providing value to the company, according to Forbes contributor Jayson DeMers.
In other words, social media marketing is a lot more complicated than managing your personal Facebook or Twitter profile. It requires a blend of creative thinking and objective, data-driven strategy, and may be a great fit for professionals who enjoy blending these two disciplines. A social media analyst with a bachelor’s degree can earn about $63,841, according to Salary.com.

4. Content Marketing:-

A digital marketer working on a content marketing article on his laptop.

Content marketing uses storytelling and information sharing to increase brand awareness. Ultimately, the goal is to have the reader take an action towards becoming a customer, such as requesting more information, signing up for an email list, or making a purchase. “Content” can mean blog posts, resources like white papers and e-books, digital video, podcasts, and much more. In general, it should first and foremost provide value to the consumer, not just advertise the brand or try to make a sale. Content marketing is about building a sustainable, trusting relationship with your customers that can potentially lead to many sales over time, not just making a single transaction.
Content marketing works in symbiosis with other types of digital marketing: It is a way to incorporate SEO search terms into fresh website content, and the content created can be shared as social media posts and in email marketing publications. Looking at the analytics for your content marketing can tell you a lot about your customers: what are they looking for when they land on your site? What kinds of content make them stay on the site longer and keep looking around? What kinds make them lose interest and navigate away?
Unlike a method such as PPC, content marketing is a long-term strategy. Over time, marketers build up a library of content (text, video, podcasts etc.) that will continue to bring users to the site via search engines, according to Marketo, a marketing automation company. This content library also helps promote knowledge of your brand and increases your profile as a resource for information. And, if users are visiting your site for information, ideally they will remember you as an authority when it’s time to make a purchase.
Content marketing is a great avenue for people who enjoy writing and/or video and audio production. But as with digital marketing in general, it also calls for strong strategic and analytic skills.

5. Email Marketing:-

Even with the emergence of social media, mobile applications and other channels, email is still one of the most effective marketing techniques, Rogers said. It can be part of a content marketing strategy, providing value to consumers and over time convert an audience into customers. Email marketing pros not only know how to create compelling campaigns, they also understand optimal audience outreach and are skilled at analyzing customer interactions and data, and making strategic decisions based on that data, according to the American Marketing Association.
Email marketing software can offer many different analytical measures, but two that marketers are always striving to improve are the open rate –the percentage of recipients who opened the email – and the click through rate – the number of recipients who opened the email and clicked on a link in the email. According to leading email marketing software company Constant Contact, there are many things marketers can do to make their emails more appealing to users and more likely to be opened. These include:
  • Create a Sense of Urgency – Writing email copy that lets your recipients know that time is running out to get a special deal or that there are only a limited number of the offer available, can increase the number of people clicking through to your website.
  • Personalize Your Email – Setting your emails and subject lines up to incorporate the recipient’s name is a proven way to increase open and click through rates. (A sample subject line: “Katie, a special offer just for you.”)
  • Let Recipients Set Their Preferences – Allowing users to specify how often they want to hear from you can help keep some of your email subscribers subscribed to your list and clicking on your emails.

6. Mobile Marketing:-

This digital marketing type is this focused on reaching your target audience on their smart phone or tablet. Mobile marketing reaches people through text messages, social media, websites, email and mobile applications. Marketers can tailor offers or special content to a geographic location or time, such as when a customer walks into a store or enters an event.
ccording to a recent TechCrunch article, consumers in the United States now spend five hours a day on their phones. This represents a 20% increase from the fourth quarter of 2015. Users are also spending much more of their time in apps rather than on mobile browsers. In 2017, users are spending much more time with apps than watching television. 15% of that app time is spent with entertainment apps like Netflix and Hulu, 19% of it is spent on Facebook’s mobile app, 12% on other social and messaging apps, and 11% in gaming apps, according to the TechCrunch article.
Retail Dive reports that 45% of all shopping always or frequently involves a mobile device in some way, whether it’s used to do research, compare prices or make a purchase. For a majority of Millennials (defined the Pew Research Center as people born between 1981 and 1997), that number is 57%.
Marketers know that you need to take your message to where you customers are, and in 2019 it is very clear: your potential customers are on their phones.

7. Digital Marketing Skills:-

A laptop screen showing the analytics behind a digital marketing campaign.

Digital marketers support the wider marketing team and the strategic goals of the whole company by rolling out marketing strategies in the online environment, Hobson said. Digital marketers strive to be a voice for the customer and how they want to interact with a brand digitally, Rogers said. “(Marketers) strategically approach the brand’s channels to maximize investments, drive traffic and conversions, as well as manage integrated digital content,” she said.
The need to be where the customers are at all times means that digital marketers have a significant responsibility to be attuned to changes in technology, social media and software.
Technology changes quickly; the hot social media app of today may be all but abandoned by next year, but many of the foundational principles of marketing remain the same.
Today, many employers are requiring experience in Google Analytics, Google and Facebook Ads, HubSpot and Hootsuite, according to Rogers. In a master’s in digital marketing program, you’ll learn the foundations of tools such as these, exploring and applying them through coursework. They are also looking for candidates who are proficient in Adobe Creative Suites and have a working knowledge of SEO and keyword research.
However, some important pieces of the marketing puzzle have not changed since the days when companies primarily advertised in print, radio and TV. All marketers need strong communication skills and a strong basis in marketing principles.
Employers include these soft skills with the technology-related proficiencies in job posting requirements, according to Rogers.
“A basic tenant of marketing is communicating a marketing message to a target audience,” she said. “… Not only must we communicate with our teammates, but we must be able to communicate to customers, executives and more. These folks are our target audience and without strong communication skills, messages will not be received in the way in which we intended.”
Since digital marketing is a rapidly changing space and it is imperative for companies to stay up to date on new and emerging strategies, Hobson said. There are many ways that companies do this, some of which are the responsibility of digital marketers and some of which is done by other departments.
“Staying ahead of the competition has never been more important,” Rogers said. “The landscape for businesses is changing so rapidly, that is has become a key strategy to include looking to the competition to help inform your own digital strategy.”

Body Positivity

Body positivity refers to the assertion that all people deserve to have a positive body image, regardless of how society and popular culture view ideal shape, size, and appearance.

Being body-positive encourages affirming attitudes towards your own body. Loving yourself is the greatest revolution! Many of us struggle with becoming body-positive.

Below are 10 tips for body positivity you should keep in mind when practicing self-care.

1. Post positive affirmations on your mirror:

In front of the mirror is where we experience the most body-hate. Try posting positive notes on your mirrors, such as, “I am enough”, “Love your body”, and “You’re beautiful”.

2. Get rid of your scale:

Weighing yourself can become an obsession. The scale can have power over your happiness and self-worth. The number on the scale does not define your worth, it simply tells you your relationship with the gravity of the earth.

3. If you wouldn’t say it to your friends, don’t say it to yourself:

When you find yourself being critical of your body, ask yourself, “Would I say this to a friend?”, the answer will most likely be “No”. Treat your body like your best friend!

4. Learn to accept a compliment:

By not being able to accept a compliment, you are putting yourself down. Avoid responding to a compliment with “Thank you, but…”. Simply showing your gratitude by responding with just a “Thank you” is enough. You may also respond with returning a compliment, however, be careful not to undervalue yourself while doing this.

5. Donate your clothing that doesn’t fit instead of torturing yourself, and buy clothing you feel great in:

Experts found that we spend approximately 16 mins on a weekday deciding what to wear. Imagine how much longer this time could be trying to pick out clothing that no longer fits. Instead of torturing ourselves with thoughts that we no longer fit into our favorite pair of jeans, donate them! Buy clothes that make you feel great in.

6. Question whether body-hate is helping:

Does shaming your body actually do anything for you? Does it make you feel better? Does it make anything change? No, it doesn’t. Why cause unnecessary stress on yourself? Ask yourself these questions out loud, you will realize body-shaming is just a waste of energy.

7. Don’t compare yourself to others, or your younger self:

“Comparison is the thief of joy” – Theodore Roosevelt

Everybody is different, and our bodies change significantly as we grow older. It is normal and healthy to not look like what we looked like 5 years ago. It is important to be happy and healthy in the bodies we have now. Comparing yourself to others, or even yourself, does nothing for you, so just be(you)tiful!

8. Don’t tell that friend to un-tag you in that picture:

Don’t do it! Learn to accept what you look like in every situation. You do not need to look “perfect” in pictures. Even if you think you don’t look “good” in a certain picture a friend has posted of you, the people who are going to see this picture know you and know what you look like. So what’s the harm in posting a silly picture or a picture you may not completely love except destroying your self-love?

9. Challenge the idea that thin people are happier:

Do you know any thin people who are unhappy? Do you know any larger people who are happy? People can be happy or unhappy at any size. Challenge yourself to think of one thing you are happy about in your life right now, and the next time you compare yourself to others who are thinner, remember that you don’t know what they have been through or are going through.

10. Find a supportive squad to keep you positive:

Surround yourself with people who are supportive and uplifting. If your friends or family body-shame themselves or others, this is your chance to educate them on being body-positive, and maybe not asking, “Does this make me look fat”, when they try on an outfit. Being around supportive people can help you feel more confident.
